Although the Obama administration appears to be currently focused on resisting calls to increase sanctions on Iran while negotiations over its nuclear program are in session, the far more dangerous “military option” is alive and well in Washington despite its many pitfalls.

Senator-elect Tom Cotton (R-Ark) told a group of reporters on Dec. 3 that Congress should be considering the “credible use [of] force,” against Iran, according to the Free Beacon. Cotton, who described the ongoing negotiations with Iran as “a sham,” also said the US should consider arming Israel with bunker-buster bombs that could penetrate Iran’s underground nuclear facilities.

A day later, Dennis Ross, Ray Takeyh and Eric Edelman—all of whom have served in the US government—echoed their previous calls for a greater threat of force against Iran in the Washington Post. “The president would be wise to consult with Congress on the parameters of an acceptable deal and to secure a resolution authorizing him to use force in the event that Iran violates its obligations or seeks a breakout capacity,” they wrote Dec. 4.

While the White House has considerably lowered the volume on its insistence that “all options are on the table,” it has maintained the mantra. “We will not let Iran acquire a nuclear weapon—period,” said Vice President Joe Biden on Dec. 6, according to Reuters. “End of discussion. Not on our watch.”

Of course, President George W. Bush considered the so-called “military option” against Iran’s nuclear infrastructure in 2006, but rejected it. The notion of “surgical” air strikes is also absurd: Bush was told taking out Iran’s nuclear infrastructure would require a massive effort. And despite its repeated threats, Israel does not have the capability with which to launch such an effort (unless it resorted to nuclear weapons). Only the US has a sufficiently robust conventional capability to do so. However, the military challenge is greater now than it was back in 2006.

The Military Option Lives On

Iranian Supreme Leader Ali Khamenei declared in June 2014 that the Americans “have renounced the idea of any military actions.” Khamenei was likely reacting to President Obama’s West Point speech a week before. Referring to military action in general, the president said: “Just because we have the best hammer does not mean every problem is a nail.” However, asked for a reaction to Khamenei’s assertion, the White House highlighted another passage in the speech on Iran: “…we reserve all options in order to prevent Iran from obtaining a nuclear weapon.”

Possibly extending the threat into the future, leading Democratic presidential contender for 2016 Hillary Clinton repeated the mantra in March of this year. While arguing that the diplomatic process with Iran should be given enough time to work, she also said she was “Personally skeptical” of Iranian intentions. “[L]et’s be clear, every other option does remain on the table,” she added, according to Haaretz.

Various American pundits (be they hawks or those who are sensitive to Israeli views on the matter) have since labored to keep the military option alive. Harvard Law Professor Alan Dershowitz declared in TV interview on Nov. 24 that if diplomacy fails, the US “should use its military facilities and ability to prevent Iran from developing nuclear weapons.” Israel also keeps the heat on the US by threatening to strike Iran if Washington fails to do so. Dershowitz, however, noted correctly that an Israeli attack “could only ‘set back’ Iran’s nuclear program for a few years.”

Israeli vs. US Military Action

Aside from using nuclear weapons, Israel does not have an effective military option. The extreme range involved greatly reduces the power of Israel’s military reach. Additionally, finding routes to and from the target is dicey, with most countries certain to oppose use of their airspace.

Flying through Turkey is a leading option, but Ankara would not grant permission, and could try to interfere. Cooperation between Israel and some of the Arab Gulf states (sharing the same dim view of Iran) reportedly has increased. But if a southern corridor were available—even if GCC aerial tankers refueled Israeli aircraft en route—the Israelis could only severely damage a few key targets.

By contrast, with access to the Gulf and the Indian Ocean, plus its bases close to Iran, the US could mount a vastly more powerful effort. Carrier battle groups, other naval assets, and large numbers of US Air Force combat aircraft could be used.

Iranian Military Preparations

Despite its public scoffing, Iran is aware that it could face a robust military assault at some point and has thus been busy since 2006 upgrading its ability to deter or confront an attack.

Iran has upgraded its military radar and missile systems with assistance from sources such as China and Russia, as well as a variety of equipment and expertise secured through less official channels. Iran has also enhanced its large arsenal of MiG-29 fighter aircraft and several formerly Iraqi SU-24 fighter-bombers that were flown to Iran at the outset of the First Gulf War. Iran’s navy has also expanded its inventory of missile-equipped fast-attack vessels to confront a more modern navy with an asymmetric threat: “swarming” enemy vessels (overwhelming them with large number of smaller craft).

The most significant upgrade to Iran’s air defense was to have been the potent Russian S-300 anti-aircraft/ missile system. However, in response to a greatly tightened UN arms embargo in 2010, Moscow suspended the deal.

The Iranians claim to be developing their own version of the S-300 (the “Bavar-373”). They also claim to have produced their own models of a host of other foreign air, air defense and naval systems.

Many of these claims are dubious, but as with its own impressive Shahab series surface-to-surface ballistic missile program, Iran has developed quite impressive technical military-related capabilities. Some upgrades and even a few of these indigenous systems probably have been successfully fielded. I observed impressive Iranian improvisation while covering the Iraq-Iran War from inside the US Intelligence Community. For example, the Iranians kept advanced US F-14 fighters in the air far beyond all Pentagon estimates, even producing a large number of parts needed for basic maintenance and minor overhauls.

The Military Option Means War

Veteran investigative journalist Seymour Hersh consulted me regarding his April 2006 New Yorker article about Bush administration deliberations concerning the military option against Iran. My intelligence credentials told me that Hersh had assembled, effectively, a surprising amount of information on the military planning presented to President Bush.

Hersh revealed that one military option included the use of tactical nuclear weapons to destroy vast underground facilities such as the Natanz enrichment complex. Hersh felt, as I do, that as a part of such planning, extreme options are provided, but such an option was highly unlikely to be part of any realistic plan.

Nonetheless, even conventional US military action to destroy or cripple all known Iranian sites, would, as envisaged in 2006, involve a massive effort. The Pentagon anticipated as many as 2,000 military combat flights and a possible duration of a week. Why? In order to reach Iran’s array of nuclear sites, US combat planes would have to smash Iranian defenses leading to and around the targets.

Although unclear back then, it is also possible once the US had decided to go that far, it would also hit Iran’s ballistic missile inventory, manufacturing, and test sites. This would target what many US officials (and the Israelis) consider a potentially nuclear-related sector of Iran’s military-industrial complex: a formidable delivery capability.

Iran would hardly remain passive while all this unfolded. Therefore, the US would have to anticipate attempts by Iran’s large air force to intercept incoming US aircraft, as well as sea- and air-borne attacks against US naval vessels. Finally, dozens of Iranian anti-ship missile sites flanking the Strait of Hormuz would have to be taken out. Given Iran’s post-2006 military upgrades, US aerial combat missions and the length of the assault would have to be increased. Slugging it out with Iran’s anti-aircraft defenses, confronting its air force, fending off its navy, and striking nuclear targets would effectively add up to war.

Among the many adverse consequences, perhaps the greatest concern would be radioactive contamination stemming from attacking sites near large Iranian civilian populations. The Arak reactor complex and a number of other nuclear-associated sites are close to or practically within Isfahan. The Natanz enrichment facility is less than 30 miles from the smaller city of Kashan. And the Fordow nuclear enrichment complex is situated near over a million people who call the holy city of Qom their home. International outcry over radiation leaks, civilian casualties, and other collateral damage could exceed that resulting from the assault itself.

With so many aircraft missions involved, another is the possibility that a few would be damaged or experience in-flight failures, with aircrew falling into Iranian hands. US diplomatic efforts to secure the return of downed flyers would be inevitable (for which Iran would surely exact a high price).

A particularly ominous result could be the very real possibility of an Iranian break with the International Atomic Energy Agency (IAEA) in order to pursue—with lots of expertise and perhaps more residual nuclear capabilities than thought—a nuclear weapon, although probably defensive (precisely what such an attack would try to forestall).

Once hostilities are initiated, Iran might also not end them definitively. While Iran might do very little (or nothing) to sustain the military confrontation, the US could be saddled with the seemingly endless task of keeping large air and naval forces in the Gulf as a precaution against potential retaliation, particularly against frightened Arab Gulf states (several of which could have aided the US effort). Such an open-ended commitment and prolonged instability in the Gulf could become a nightmare for Washington—and plenty of other countries around the globe.

As a postscript to my previous post, I want to draw attention to two bits of news that I came across later that day, and to offer brief comments.

Iran’s Foreign Minister, Mohammad-Javad Zarif, addresses the Nuclear Diplomacy Seminar at Allameh University: “We have not had any roll-back, and the structure of the nuclear program has been preserved. The movement forward of the nuclear program towards industrialized [scale] is continuing, and Iran’s activities in Arak and Natanz will continue…We have gained respect for the state. They respect Iran’s behavior, and the calculations of the ill-wishers of the country are in disarray.” FDD Iran Press Review, 2 December 2014

Note the emphasis on avoiding roll-back, which suggests roll-back is an Iranian “red line,” and Zarif’s insistence that halving the number of operating centrifuges at Iran’s disposal would condemn the nuclear negotiation to failure. That may sound worrisome. But it need not be if, as is reportedly the case, Iran is ready to send its low enriched uranium stocks to Russia for use in making fuel for the Bushehr reactor. In those circumstances, avoiding roll-back can be reconciled with US break-out avoidance ambitions, provided these are moderated.

Note too the references to respect. This is a clue to why avoiding roll-back is a “red line.” The leaders of Iran see its nuclear achievements as a symbol of national dignity. For them, nuclear cut-backs would entail humiliation.

This talk of dignity and humiliation may strike some readers as over-sensitive. Britain and the US tend to take their dignity for granted. But remember General Charles de Gaulle, France’s president from 1944-46 and from 1958-69.

For him, the French defeat in 1940 was such a national humiliation that the restoration of French dignity was as much of an objective for him as helping Britain (and later the US) to win the war. Time and again, he tested the patience of his British war-time hosts and allies by making demands or refusing concessions in the interest of upholding French dignity and self-respect.

Now on to a Dec. 2 Reuters report, an excerpt of which I have provided below:

Iran said it has provided evidence to the United Nations atomic agency showing that documents on suspected nuclear bomb research by the country were forged and riddled with errors….

Iran has offered detailed explanations to the IAEA and there has never been “any authenticated documents for PMD claims”, said the Iranian note posted on the agency’s website…..

They “are full of mistakes and contain fake names with specific pronunciations, which only point toward a certain member of the IAEA as their forger”, it said.

Since Nov. 11, 2013, Iran and the International Atomic Energy Agency (IAEA) have been cooperating better on the so-called “possible military dimension” (PMD) of the Iranian case. Will this incline the IAEA secretariat to react more forensically than in the past to this latest Iranian dismissal of material allegedly found on a laptop a decade ago? Will they produce and circulate to members of the Board of Governors a reasoned critique of the Iranian “explanations” if, after studying Iran’s grounds for doubt, they continue to believe in the authenticity of the laptop material?

This material has been an obstacle to a peaceful resolution of the Iranian case ever since the IAEA elevated it to a primary concern in early 2008, when all other concerns had been resolved. From the outset people I respect, such as the former Director General of the IAEA, Mohamed ElBaradei, had doubts about its authenticity.

It would be as wrong to find Iran guilty of clandestine nuclear weapon research on the basis of dubious evidence as it would be to condemn a criminal suspect on the basis of dodgy state evidence submitted to secure a conviction.

The IAEA maintains that it has reasons other than the laptop material for suspecting a military dimension to the Iranian case. I am not suggesting that consigning the laptop material to the “too dubious to be useable” file would eliminate that dimension. But I am confident that putting it to one side would simplify the IAEA’s task of bringing this investigation to some kind of resolution.

With the November 24 deadline for a comprehensive deal between world powers and Iran on the country’s nuclear program now behind us, the negotiating teams have returned to their capitals to debate next steps. They will reconvene in Oman in early December to continue their efforts to strike a deal in seven months.

The extension represents both good and bad news. It shows once again that the parties truly want a final deal and that they are ready to take up the task. At the same time, the prolonged timeframe for a deal won’t be welcomed by various factions back home, who now have more time and room to derail the process altogether.

Indeed, as the negotiating teams were working around the clock to try to bridge the remaining gaps, various groups in Tehran and Washington, as well as in Tel Aviv and Riyadh, were working to get their own concerns onto the negotiating table.

In the United States, some influential members of Congress believe that Iran is in a comfortable position, not really seeking a solution but rather an indefinite extension of the talks to get sanctions relief. But as noted by Secretary of State John Kerry from Vienna on the day the extension was announced, Iran has been complying with the interim deal concluded in November 2013. In fact, the International Atomic Energy Agency (IAEA) released a report the same day showing that key elements of the Iranian nuclear program remain suspended. Tehran, then, is not just kicking the can down the road.

Powerful Iranian figures also have concerns about the extension. They believe that the interim Joint Plan of Action (JPOA), signed last year in Geneva, has effectively suspended important parts of the country’s nuclear program without giving Iran much back in return. However, they are also ignoring an important element of the process: The JPOA has granted Tehran access to some of its frozen assets, as it slowly prepares to reopen its market to international business, and leave its political isolation.

Over the next few months, critics on all sides will become louder, especially as Tehran and Washington continue to engage in cordial settings, raising concerns among some of their respective key constituencies.

The remaining key issues—the number of centrifuges Iran will be able to keep and operate, the timeframe of the deal, and sanctions relief—will likely be the main points of contention for these constituencies.

Other challenges could also arise in the process, including the interpretation of the JPOA over the next several months and the grey areas it includes. For instance, a couple of weeks prior to the deadline, Iran began to feed its IR-5 centrifuges (currently non-operational) with Uranium Hexafluoride, which caused a serious debate among nuclear experts. According to David Albright of the Institute for Science and International Security, this act was a violation of the interim deal. Others, however, including Jeffrey Lewis at the Monterey Institute, rejected the charge, stating that the JPOA does in fact allow Iran to pursue research and development, including this activity. Expectedly, Iran denied that it had failed to uphold its end of the bargain and the US State Department ultimately backed up the Iranian position.

However, while key components of the Iranian program, including the installation of new centrifuges or further work on the Arak heavy water reactor, are suspended under the JPOA, Tehran continues its research and development. This means that a new generation of centrifuges could add fuel to the fire. Ideally, Iran would refrain from such activities while the talks are ongoing. But while such a step would be received positively on the international stage, thereby aiding the confidence-building process, domestically, it would backfire. It would provide conservatives and other hard-liners in Tehran with more ammunition to shoot at the negotiating team and the government generally.

Indeed, balancing international and domestic priorities and expectations is going to constitute a major challenge for Iranian President Hassan Rouhani as the talks continue. If his government is to make any concessions, it needs to show its domestic constituencies that it is not giving up and still making progress on the nuclear program.

The good news is that Supreme Leader Ayatollah Ali Khamenei, the highest authority in Iran, continues to back the negotiating process. He reiterated his support for the negotiators led by Foreign Minister Javad Zarif on Nov. 25, the day after the deadline was missed, saying that Zarif and his team remained standing even as the West tried to force them to kneel. This crucial statement, which reiterated his deep mistrust of the West, came amid increasing pressure from hard-liners in Tehran and will serve in quieting them down for a while.

But as they key countries of Iran and the United States continue to engage, the prospect of prolonged détente, and especially rapprochement between the two long-time adversaries will result in the unity of four unlikely stakeholders—hard-liners in Tehran and Washington, as well as Riyadh and Tel Aviv—in opposing improved US-Iran relations, for their own reasons.

Meanwhile, the stakes are higher than ever. President Obama, who will be dealing with a Republican-dominated Congress as of January, needs a major foreign policy achievement before his term is up in 2016. In the meantime, his ability to effectively “defeat and ultimately destroy” Islamic State forces in Iraq and Syria—another defining element of is presidential legacy—will inevitably be influenced by the outcome of the talks. On the Iranian side, by the new deadline of July 1, 2015, the Iranian president will have spent the better half of his first term almost entirely focused on the nuclear issue, essentially rendered unable to seriously advance other items on his agenda.

In other words, both presidents have been banking on a historic deal, but while the extension of the talks allows Tehran and the West to continue engaging, thereby building the trust necessary for a final accord, it also means more time and room for detractors to sabotage the process.

As Iran and six world powers scramble to reach a deal over Iran’s nuclear program by the deadline of Nov. 24 in Vienna, Washington is seeing a flurry of last-minute events focused on the pros and cons of pursuing diplomacy with Tehran.

While advocates from both sides made their arguments on Capitol Hill this week, two distinguished former US ambassadors told an audience here Wednesday that a deal between world powers and Iran over its nuclear program offers “huge advantages” and that the chances of a “complete breakdown” in the talks at this stage are low, even if the prospect of a comprehensive accord being signed before the looming deadline is also unlikely.

Stuart Eizenstat, who played a key role in promoting sanctions against Iran under both Jimmy Carter and Bill Clinton, endorsed the diplomatic process with Iran at a Nov. 19 panel discussion hosted here by the Atlantic Council.

“I am of the belief that an agreement is important, and that there are huge advantages—to the United States, to the West, and to Israel—in having an agreement along the lines of what we see emerging,” he said.

Last month the veteran diplomat, who was named special adviser to the secretary on Holocaust issues last year, offered a key endorsement of diplomacy with Iran in an interview with the Jerusalem Post.

Eizenstat, who currently chairs the Coucil’s Iran Task Force, also emphasized the consequences of failing to reach an accord with Iran:

Without an agreement, one always has to ask, “What’s the alternative?” No deal means an unrestrained [Iranian] use of centrifuges, it means a continuation of the Iranian plutonium plant in Arak, it means no intrusive inspections by the IAEA, it means no elimination of [Iran’s] 20% enriched uranium, it means less likelihood of eliminating weaponization, it means undercutting those who are relative moderates in Iran. So there are enormous implications.

Thomas Pickering, who served as Washington’s chief envoy in virtually every hot spot—from Moscow to San Salvador and from Lagos and Tel Aviv to Turtle Bay (in the run-up to and during the first Gulf War)—meanwhile explained why a negotiated settlement to Iran’s nuclear program is highly preferable to the “military option.”

“Nobody believes that the use of force is a guaranteed, one-shot settlement of the problem of Iran’s nuclear program,” said Pickering, who co-runs the Iran Project, which promotes diplomacy between Iran and the United States, along with several other top foreign policy experts.

Pickering also argued that a deal would open the door to “further possibilities” for US-Iranian cooperation on a host of regional issues, most immediately in serving the president’s plan of “degrading and destroying” Islamic State (ISIS or IS) forces in Iraq and Syria and in bringing stability to Afghanistan.

“I remain optimistic,” he said, “but only on the basis of the fact that reasonable people could agree.”

Pickering argued that domestic politics in both countries could be the ultimate impediment to a final deal.

“The real problem is that there is a lot of unreasoned opposition, in both countries, that is affecting the situation,” he said.

On the American side, the “unreasoned opposition” Pickering referred to is rooted in Congress, where key members of the House and Senate advocate the Israeli government’s position that any deal should completely or almost completely dismantle Iran’s nuclear infrastructure, which would be a non-starter for the Islamic Republic.

Yet whereas Pickering was critical of Israeli Prime Minister Bibi Netanyahu for having “overreached” last November in calling last year’s interim Joint Plan of Action (JPOA) a “historic mistake,” Eizenstat suggested that his hardline stance may actually have toughened the P5+1’s (US, UK, Russia, China, France plus Germany) resolve to minimize Iran’s enrichment program as much as possible.

But Uzi Eilam, the former director general of the Israeli Ministry of Defense Mission to Europe, argued that Netanyahu is “getting used” to the idea that Iran will retain some enrichment capacity under a comprehensive deal.

A deal that includes stringent monitoring by the International Atomic Energy Agency (IAEA) and a third party (Russian) commitment to process Iran’s enriched uranium into fuel and assume responsibility for spent reactor fuel would be enough to meet Israeli security concerns even with an active Iranian enrichment program, said Eilam.

Pickering also noted that sanctions relief remains a sticking point, with the Iranians wanting full relief immediately and the P5+1 insistent on maintaining some sanctions in order to ensure Iran’s continued compliance with the terms of the final accord. But he was joined by Eizenstat in arguing that it would be “almost impossible” (Eizenstat’s words) for both sides to just walk away from the talks at this point.

While both Iran and the P5+1 continue to insist that they are focused on reaching a comprehensive accord by the deadline, with just three days to go, it appears highly unlikely.

As to how long the talks would go on in the event of an extension, Pickering argued that “short-term would be better than long-term,” though he acknowledged that “short-term is harder to get because everybody’s tired, they want to go home and think.”

Eizenstat added that the impending political change in Washington, where Republicans will take control of the Senate in January and are expected to oppose any deal with Iran, would make a short extension more desirable than a long-term one.

To date, negotiators on both sides of the talks over Iran’s controversial nuclear program, which resume next week, have been remarkably discreet. Even at the political level, people have been unusually quiet. This is an excellent omen. In the past, too many opportunities have been nipped in the bud due to an excess of statements calibrated for domestic purposes (a special mention to Wendy Sherman, the chief US negotiator, for saying so little, amiably, in many background meetings with the press). The involvement of the International Atomic Energy Agency (IAEA) in the negotiations has also been of inestimable value. The Agency offers unique expertise and notarizes regularly the way in which Iran complies with its commitments. It contributes therefore decisively to the smooth progression of the discussions.

Quite unexpectedly, Iran’s negotiators have been the driving force in this process. They have seized President Hassan Rouhani’s initiative to solve the conflict over Iran’s nuclear program and have kept it ever since, setting the targets as well as the tempo. Iran’s foreign minister and lead negotiator, Mohammad Javad Zarif, said on April 7 that the drafting of the final agreement between Iran and the P5+1 (the U.S., Britain, France, China, and Russia plus Germany) should start in May, and that all efforts should be taken to complete the negotiations by the official deadline of July. The Iranians seem set to resolve the conflict over their nuclear program as fast as possible, once and for all.

The Rouhani administration’s determination serves in pleasant contrast to the rather stiff and slow Iranian behavior that was especially exhibited during the Ahmadinejad era, but also, at times, in the most favorable of circumstances, during the 2003-05 period, when Rouhani was himself Iran’s chief negotiator. At that time, the Iranian diplomats on the frontline were subjected to a heavy-handed system of control, which tended to stifle their movements. Having learned from this experience, President Rouhani, elected last June, has obtained a carte blanche from Iranian Supreme Leader Ali Khamenei. While the Leader did issue a set of red lines last month (English diagram), and has issued specific warnings every now and then, he has consistently supported Iran’s diplomats while keeping domestic criticism of Iran’s team at a manageable level.

Indeed, Rouhani may not own the horse, but he controls the reigns. One of his first acts as president was transferring Iran’s nuclear negotiating file from the Supreme National Security Council to the Ministry of Foreign affairs. That enabled him to build a “dream team” of seasoned negotiators, perfectly comfortable with the codes and practices of their Western counterparts. Iran’s new and refined team has stood out in stark contrast to the collective clumsiness of the P5+1 negotiators, as in the early November 2013 episode, when four Western Foreign Ministers rushed prematurely to Geneva, spurring the media to believe, mistakenly, that a deal would be signed (it was signed 10 days later). But, as Marshal Foch used to say: “After leading a coalition, I have much less admiration for Napoleon…”

Getting to the heart of the matter, many points seem close to being settled. Iran is ready to cap at 5% its production of enriched uranium and to limit its current stockpile from further enrichment. The controversial underground facility of Fordow will probably end up as a kind of research and development unit. The Arak reactor’s original configuration allowed the yearly production of about ten kilograms of plutonium, enough for one or two bombs. Ali Akbar Salehi, chairman of the Atomic Energy Organization of Iran (AEOI), has hinted that this configuration could be modified in order to accommodate low-enriched uranium fuel rather than natural uranium. This would reduce Arak’s plutonium production capacity by a factor of five to ten. And Iran has already confirmed that it has no intention of acquiring the fuel reprocessing capacity indispensable for isolating weapon-grade plutonium.

Depending on the pace of sanctions relief, Iran also seems ready to return to a kind of de facto implementation of the IAEA’s Additional Protocol, which would provide enhanced monitoring over all of Iran’s nuclear activities. Iran should be ready to initiate the Protocol’s ratification process as soon as the United Nations Security Council shows itself ready to remove the Iranian nuclear file from its agenda, thus erasing the burning humiliation of 2006, when it passed its first resolution on the subject.

The make or break issues

To date, five sticking points remain on the table.

The most difficult issue concerns the format of Iran’s enrichment capacity. The Joint Plan of Action (JPOA), adopted last November, speaks of “parameters consistent with practical needs, with agreed limits on scope and level of enrichment activities”. But the West has focused on “breakout time”, that is, the time needed to acquire enough highly enriched uranium for a first bomb if Iran decided to renege on its commitments. This delay has been estimated at about two months in the current state of Iran’s enrichment program. To extend it significantly, Iran would have to bring down the number of its centrifuges from the present 20,000 to 2-6,000.

A drastic reduction of the number of centrifuges, however, would be a deal-breaker for Iran. Following the conservative elements of the regime, the Supreme Leader has recently excluded any kind of bargaining on Iran’s nuclear achievements.

Fortunately, other solutions can alleviate the West’s concerns. First, having enough highly enriched uranium for one bomb does not mean having the bomb. Several more months would be necessary to make it ready. Second, one wonders why the international community would need more than one or two months to properly respond to an Iranian rush for a bomb. If it can’t make it in two months, why would it succeed in six? Third, this infamous breakout time could be extended without reducing the present number of centrifuges by using, as fast as possible, the low enriched uranium produced by Iran as fuel for nuclear reactors, rendering it unserviceable for further, weapon-grade, enrichment. Here, feeding the Arak reactor with domestic low-enriched uranium could solve a good part of the problem.

It is unfortunate, though, that the Iranians have made so little effort up to now to identify the “practical needs” mentioned, at their initiative, in the Geneva agreement. The spokesman of the AEOI has announced recently that a “comprehensive document” was being elaborated on the subject, and would be submitted for approval to the Iranian Parliament. But this process will probably extend beyond the time limit set for the negotiations.

In the meantime, we know that the Russians are bound to provide for eight more years the low enriched fuel necessary for the Bushehr nuclear plant. After this period, they will resist the introduction of Iranian fuel into the Bushehr reactor, as the selling of fuel is for the Russians the most profitable part of their contract with Iran. Their attitude will be the same when discussing the construction and operation of more reactors in Iran. By all means, new Russian reactors, or any reactors from other origins, will not be active before a decade. All of this is to say that if the current number of 20,000 centrifuges was accepted by the international community, the Iranians would have no “practical need” in the offing to justify a raise of this number in the years to come.

Another difficult point is the question of nuclear research and development. The West would like Iran to forsake such activities, especially in the field of centrifugation. Again, this is a red line for the Supreme Leader and the conservatives, as Iran’s engineers are working on models up to fifteen times more efficient than the present outdated model forming the bulk of its program. Here, a simple solution has been suggested by Salehi: instead of setting a cap on centrifuges, which could be circumvented by using more efficient models, the parties should define this cap in “separative work units”, the equivalent of horsepower in the field of enrichment. The introduction of more efficient centrifuges would thus reduce in due proportion the total number allowed.

A third difficult point is the ongoing exploration by the IAEA of the “possible military dimensions” of Iran’s nuclear program. This demand, reiterated by the IAEA Board of Governors and the UN Security Council, has been fiercely resisted by Iran. In fact, it was the head of the US national intelligence community who said, in 2007, that the Iranian weaponization program was stopped before completion by the end of 2003. Ten years have since passed, and the people involved in that program must have been granted some kind of protection in exchange for their compliance, hence the inherent difficulty for the Iranians of authorizing outsiders to probe too deep into this subject. In former similar occurrences, such as with Egypt, South Korea and Taiwan, the IAEA has accepted not to divulge details on the wrongdoings discovered by its inspectors, once assured of the cancelation of these programs. A similar way out should be explored with Iran.

The fourth sticking point evolves around Iran’s ballistic missiles. The West wants to include them in the negotiations, as a source of worry identified by the UN Security Council, but this has been outright rejected by Iran. Recall that Iran has accepted to negotiate over its nuclear program as a civilian program placed under the aegis of the Nuclear Non-Proliferation Treaty (NPT). Negotiations over missiles pertain to a different world, the world of defense and disarmament, in which negotiations are by definition collective, save for unilateral measures imposed upon a defeated country. If there is a solution here, it would require a separate, multilateral discussion on the level and distribution of ballistic missiles in the Middle East, with the aim of convincing concerned states to join the International Code of Conduct against Ballistic Missile Proliferation, adopted in 2002 in the Hague.

The last point, little talked about, but hardly the least difficult, concerns the duration of the future comprehensive agreement to be signed by Iran and the P5+1. Under the Geneva JPOA, this agreement, once fully implemented for the duration of all its provisions, will be replaced by the common regime applicable to all NPT members. Iran would then be freed of specific commitments such as the limitation of its enrichment activities, on which extensive IAEA controls, of course, would remain. Such a shift would mean that the International community would be fully reassured about the peaceful nature of the Iranian nuclear program.

However, to reach such an assessment, the general behavior of the Iranian regime and the quality of its relations with the outside world would be as important as the state of its nuclear program. How long should the assessment process last? These considerations cannot be put into writing. The Iranians will probably insist on no more than five years, while the West would be happy to see this regime of special constraints indefinitely extended. This point could be the last outstanding issue in the discussions. Hopefully, if solutions are found on all the previous questions, there will be a strong incentive to find a compromise here to ensure a final deal once and for all.

What does this mean for the continued negotiations over Iran’s nuclear program?

ArakWhat is Arak?

Arak, or araq, is an anise-flavored alcoholic beverage that is especially popular throughout the Levant. It is closely related to the Turkish beverage rakı and the Greek ouzo.

Arak is a city of over 500,000 people, located in the Markazi province in central Iran. It’s about 150 miles southwest of Tehran. Modern Arak was incorporated in 1795 by a Georgian lord who got on Catherine the Great’s bad side and offered himself and his army to the Qajar ruler of Iran, Mohammad Khan, in exchange for sanctuary. This makes Arak almost as old as the United States of America, but for an Iranian city that’s still pretty new.

What does Arak have to do with the nuclear talks?

Iran informed the IAEA (International Atomic Energy Agency) in 2003 that it would begin construction on a “pressurized heavy water” nuclear reactor (PHWR), named IR-40 (40 because it was designed to run at 40 megawatts), at Arak. PHWRs are generally seen as greater proliferation risks than the more common “light water” reactors (LWR), so the status of the planned Arak reactor has become one of the primary issues in talks over Iran’s nuclear program.

What is a PHWR and why do they raise proliferation concerns?

A sustained nuclear reaction uses the free neutrons produced when one atom of uranium is split (fission) to strike other uranium atoms and cause them to split, but those neutrons have to be “moderated,” or slowed down, so that they will interact with fissile U-235 (the more common uranium isotope, U-238, is not fissile). Where LWRs just use regular water (H20) as coolant and neutron moderator, PHWRs use deuterium oxide (D20). Deuterium is a hydrogen isotope that contains a neutron in the nucleus (the added weight of the neutron is the reason why it’s called “heavy” water); in nature it accounts for less than 0.02% of all hydrogen in water, but the solution used in a PHWR will be nearly 100% D20.

Heavy water absorbs far fewer free neutrons from nuclear reactions than regular/light water, making it a more efficient neutron moderator. This means that it’s possible to run a PHWR using natural uranium, because all those neutrons that aren’t being absorbed are available to strike enough U-235 to sustain a reaction even in natural uranium (which contains very little U-235). LWRs require enriched uranium, which has been altered in centrifuges to artificially increase the percentage of U-235. This is the first reason why PHWRs are a proliferation concern, because while enriched uranium is subject to monitoring safeguards in how it is bought, sold, and transported on the world market, natural uranium is not. But the far greater concern is that PHWRs can produce significant amounts of plutonium as waste product, which can then be reprocessed into weapons-grade material. For example, India’s first tested nuclear weapon, Pokhran-I, was fueled by plutonium reprocessed from its heavy water CIRUS reactor, whose design is similar to IR-40’s.

Why does Iran want a heavy water reactor?

Reactors that are intended to be used for research (for example, to produce medical isotopes) rather than for power generation, often need to use uranium enriched to 20% U-235 or more, which in addition to being costly to produce is also itself a proliferation concern. PHWRs, again because D20 is such an efficient moderator, are an alternative in such applications. Iran insists that IR-40 is intended only to replace its aging Tehran Research Reactor, which produces medical isotopes for cancer patients, but the P5+1 has expressed concern about its potential use in developing a weapon. The Joint Plan of Action that was signed in Geneva in November 2014 stipulated that Iran would take no steps toward bringing Arak online for its duration.

For all the P5+1’s supposed concern about Arak, it must be noted that, as Gareth Porter has pointed out, Iran has made no move to build the kind of reprocessing facility that would be needed to convert IR-40’s plutonium waste into weapons fuel. While it could build such a facility in the future, that would take considerable time and would not be easily concealed from IAEA inspectors, so Arak is not an imminent threat from a proliferation standpoint.

What is involved in this agreement that’s been reached, and what are its implications?

To be clear, so far there is no official confirmation that any deal has been reached. But while Iranian officials have ruled out converting IR-40 to a LWR, they have suggested a willingness to modify its designAl-Monitor’s Laura Rozen reports that the compromise is likely very similar to a proposal laid out by a group of Princeton University scientists in the journal Arms Control Today, whereby IR-40 would be modified to run on lightly enriched uranium, rather than natural uranium, and would run at a lower temperature, 10-30 megawatts rather than 40. Both of these modifications would substantially reduce the amount of plutonium waste produced by the reactor (to about the same amount as if it were converted to a LWR) without compromising its effectiveness as a research reactor.

Arak has been a prominent element in the negotiations, so if a deal over its status has been reached, then it’s likely that the negotiators are now on the last few major disputes that need to be ironed out for a comprehensive agreement. These undoubtedly revolve around the issues of uranium enrichment and IAEA monitoring, which arms control expert Robert Einhorn has argued are the biggest issues in the talks.

His recommendations must be seen as authoritative.

The paper addresses the issues that are at the center of the ongoing negotiations in Vienna between Iran and the P5+1 (the US, Britain, France, China, and Russia plus Germany). Einhorn recommends key requirements for an acceptable agreement with Iran — requirements designed to prevent Iran from having a rapid breakout capability and to deter a future Iranian decision to build nuclear weapons.

Preventing a rapid breakout capability

Iran’s development of a capability to enrich uranium has been at the core of Western concerns about Iran’s nuclear programme for over a decade. The two enrichment facilities that Iran has built, at Natanz and Fordow, are being used to produce low-enriched uranium for civil purposes but could be used to produce highly enriched uranium for military purposes.

The Nuclear Non-Proliferation Treaty (NPT) prohibits the manufacture of nuclear weapons by states such as Iran but does not prohibit the possession of enrichment facilities. The West’s negotiators therefore have a delicate task: they must contrive to persuade Iran to accept restrictions on its use of this technology — restrictions that would give the UN Security Council enough time, reacting to evidence, to prevent Iran from producing enough weapons-grade uranium for one device (i.e. from “breaking out”).

Einhorn explains that the breakout timeline depends on the numbers and types of centrifuges used and on the nature of the uranium feedstock available for a breakout attempt (for instance, if the feedstock is already low-enriched much less time is required than if it is un-enriched).

He goes on to describe the implications of limiting Iran to between 2000 and 6000 first-generation centrifuges. This creates the impression that these are the sorts of numbers that ought to be agreed to in Vienna. That is unfortunate, because Iran has already installed 19,000 first-generation centrifuges and is using 10,000 of them — and Iran’s President Hassan Rouhani has ruled out the dismantling of any existing capabilities (which his political opponents could portray as a humiliating surrender of Iranian rights).

Einhorn’s choice of what looks like an unrealistically low figure appears to stem from wanting to give the UN Security Council several months to react to evidence of a breakout attempt. However, as he himself implies, several months would be useful only if the Security Council were to want to impose sanctions before opting for force.  In reality, since sanctions have proved ineffective as a tool for coercing Iran, the council would be well-advised to opt for force within a matter of days, and could do so if the P5+1 had pre-agreed that this would be the most appropriate response (see below).

A related concern is possible Iranian development of more advanced centrifuges. With a few thousand third-generation machines, using a low-enriched feedstock, only a few weeks would be required to break out. This concern could be resolved by placing limits on the scope of Iran’s centrifuge R&D, as Einhorn recommends. But tight limits may not be negotiable.

Yet another concern relates to the plutonium-producing potential of a 40MW reactor under construction at Arak. Einhorn describes ways in which this potential could be reduced. Recent Iranian statements suggest that they, too, are working up some proposals. So this concern is likely to be largely allayed, although the risk of a plutonium-based breakout may not be totally eliminated.

Deterring an Iranian decision to build nuclear weapons

In the absence of watertight solutions to these breakout concerns (or to concern that Iran might break out using a small clandestine facility) the West’s negotiators will do well to devote at least as much effort to deterring breakout as to trying to make rapid breakout impossible.

Since 2007 US National Intelligence Estimates have drawn attention to the importance of influencing the cost/benefit calculations of Iran’s leaders, implying that this is likely to be the most effective way of ensuring that Iran does not become a nuclear-armed state.

The framers of the NPT perceived that the treaty’s impact would hang on the ability of parties to recognise a national security interest in supporting nuclear non-proliferation and disarmament. Consequently the only deterrents envisaged in the treaty are verification of nuclear material use by the International Atomic Energy Agency (IAEA), the risk that non-compliance will result in UN sanctions or authorisation of force, and the certainty that non-compliance will lead to a loss of prestige and exclusion from the society of the treaty’s adherents (currently 190 states).

Since 2003 President Rouhani has shown that he understands all this very well. He knows that Iran would pay a high price for breaching its non-proliferation obligations and that acquiring nuclear weapons would bring no benefit, since Iran is not in need of a nuclear deterrent. The signs are that his political opponents, too, have figured that out.

All this needs to be borne in mind when determining whether any additional (going beyond the NPT) deterrents are necessary in the current context.

Einhorn believes that they are.  The most questionable of his recommendations are that: 

  • The Security Council should agree in advance on how to react to any evidence of an attempt to break out or other serious violation of the agreement under negotiation in Vienna;
  • The US Congress should pass a standing authorisation for the use of military force (AUMF) in the event of evidence that Iran has taken steps to abandon the agreement and move towards producing nuclear weapons;
  • The US administration should indicate publicly how it would react to such evidence. 

These recommendations betray a flawed understanding of Iranian psychology. Such public threats would be seen in Iran as humiliating, and would be resented. That resentment could be used to stir up opposition to the agreement and could even end up providing a motive for ditching it. The threats would serve no practical purpose since leading Iranians are already well aware of what they would risk were they to attempt breakout.

More in keeping with Iranian psychology and a more effective deterrent would be a private P5+1 intimation that they will be united in urging the Security Council to authorise force in the event of evidence of a breakout attempt. Nothing more is needed. Iranian diplomats are highly intelligent. 

Conclusion

This paper is heartening. It offers reason to think that the Vienna negotiators can succeed in producing a resolution of Western concerns that Iran will have an interest in respecting. However, as Iran’s Foreign Minister Mohammad Javad Zarif likes to remind us, a resolution will require flexibility from both sides. The West must try to avoid the over-bidding (in pursuit of over-insurance) that doomed the 2004-05 negotiations between Iran and the E3 (the UK, France and Germany).

Instead, parties will explore areas of possible convergence and make steady progress towards a potential final deal.

All negotiations are about what parties want and how much they can compromise. What has changed here is not what the P5+1 (the US, Britain, France, China, and Russia plus Germany) and Iran want, but how badly they want a solution. Both sides are painfully aware of the downsides of no agreement. In the words of a participant at a recent workshop hosted by the International Institute for Strategic Studies, the best alternative to a negotiated agreement is in this case “very bad” — likely, more sanctions and an Iran closer to a rapid breakout capability. This is why there is a strong incentive to explore areas of potential agreement.

What does each side want? The P5+1 want substantial reductions and the dismantlement of some of Iran’s nuclear program. The main issues of concern are Iran’s enrichment capacity, its Arak heavy water (HWR) reactor and the past possible military dimensions of its program. Iran however, aims to preserve as much of its program as possible, and perhaps even expand its capacity. It wants (preferably total) sanctions relief and a clear guideline on the duration of the final agreement. So far, this doesn’t bode well.

Former US official Bob Einhorn encourages negotiators to focus on Iran’s “practical needs”. The November 2013 Joint Plan of Action (JPA) called for a “mutually defined enrichment programme with mutually agreed parameters consistent with practical needs”. The P5+1 believe that Iran’s enrichment needs for a civilian nuclear program can largely be met through foreign supply and that Tehran does not need to enrich on its soil. But after years of political and economic investment into enrichment, Iran can’t just forgo it. The P5+1 demonstrated their understanding of this conundrum when they stopped asking for enrichment to be fully suspended and accepted it on Iranian soil. The trick now will be to find enough common ground over lengthening Iran’s breakout time by addressing the number and efficiency of centrifuges, while meeting Iran’s current and future needs. Iran repeatedly insists that dismantlement is not on the agenda. Whether that is accurate or part of pre-negotiation posturing, exploring P5+1 condoned research and development into advanced centrifuges as an additional sweetener could make Tehran more amenable to such roll-backs.

The Arak HWR also poses a proliferation concern because of its ability to open up the plutonium route to a bomb for Iran. Despite requiring a reprocessing plant, which Iran does not have and so far does not intend to build, the P5+1 have made it clear that maintaining it in its current form is unacceptable. Iran’s nuclear chief, Ali Akbar Salehi spoke of the country’s willingness to modify the reactor to produce less plutonium to allay Western fears. But the true test is whether the P5+1 can coax Iran to allow the modification of Arak into a light-water reactor. Once again, the P5+1 seem to be exploring positive incentives to address this.

One area of greater agreement is over transparency and verification. Iran insists it is prepared to accept intrusive verification measures to prove the “peacefulness” of its program. In fact, it already did so under the JPA. But the Additional Protocol (AP) is a difficult sell back home. Iranian negotiators are prepared to implement some of its safeguards as long as it’s not branded as such. Iran is also adamant that the scope and duration of these measures must be clearly defined.

This brings us to another important part of these talks: rhetoric. Today more than ever, there seems to be an understanding on both sides about what the other faces back home. Iran knows that US President Barack Obama walks a fine line on these negotiations when it comes to Congress, while the West is clearly more perceptive of the difficulties posed by the hardliners in Tehran and Iran’s need to save face. The P5+1’s willingness to accept suggestions such as implementing intrusive verification measures without naming the AP or framing talks in terms of modernising the Iranian program rather than dismantling it demonstrates this. Some officials recognise the need to ignore Iranian rhetoric, knowing full well that like in the West, the most uncompromising statements are often intended for a domestic audience.

The road to a final agreement is long and complicated. Anything from a small statement by an Iranian or American hardliner to Russian disengagement from the negotiations because of the crisis in Ukraine could derail the talks and take us back to square one. But we keep forgetting how far we’ve come in so little time. A year ago, no one would have thought that Supreme Leader Ali Khamenei would embrace a more moderate president or that he would agree to an interim deal constraining Iran’s nuclear program. Today, both sides are negotiating wholeheartedly. What they want has not changed. What has changed is how much they want a final solution.

Prominent neoconservative writers Bret Stephens and Reuel Marc Gerecht called for a much tougher approach to talks with Iran over its nuclear program in a debate hosted here by the McCain Institute on March 11, one week before talks aimed at a final deal between Iran and world powers resume in Vienna.

Stephens, the deputy editorial page editor of the Wall Street Journal, and Gerecht, a senior fellow at the Foundation for Defense of Democracies, were up against the Brookings Institute’s arms control expert Robert Einhorn who served as a top non-proliferation adviser at the State Department in Obama’s first term and the Carnegie Endowment’s Karim Sajadpour, both of whom argued that now is the right time to give diplomacy a chance to succeed.

The neoconservative writers hammered the Joint Plan of Action (JPA), negotiated between Iran and the P5+1 (the U.S., Britain, France, China, and Russia plus Germany) in Geneva on November 24, 2014 as a surrender of sanctions for few, if any, Iranian concessions. Gerecht, who wrote in 2002 that an invasion of Iraq and the installation of a democratic government there would “probably” cause regime change in Iran, characterized the difference between those who support the JPA and those who oppose it as all related to a single question: “are you prepared to pre-emptively strike Iran to prevent it from developing a nuclear weapon?” Supporters of the JPA, he contended, are not, implying that they’re not tough enough to extract a favorable deal from the Iranians either. Stephens, a supporter of the Iraq War who still insists that the war was based on sound intelligence, took an even harder line against the negotiating process, contending that “the whole strategy of Iran since negotiations began in 2002 has been to delay and delay and delay” in order to continue developing its nuclear program without risking a military response.

On the other side, Einhorn commended the JPA, calling it “a very promising first step that halts movement in Iran’s nuclear program for the first time in twelve years” that also greatly improved access for international monitors, in exchange for relatively light sanctions relief. Sajadpour added that instead of criticizing the JPA for not being “the ideal deal,” opponents “have to look at the reasonable alternatives,” which are not favorable. A harder American line on issues like uranium enrichment, according to Sadjadpour, would also risk splintering the international consensus that has supported the sanctions regime thus far and might embolden Iranian hardliners to stop talking and fully pursue a nuclear weapons program.

The question of reasonable alternatives to the JPA — whether there were any and whether those would have been preferable to the deal that was reached — permeated the discussion. Both Einhorn and Sajadpour stressed the degree to which America must be seen as allowing room for diplomacy to work in order to build international support for tougher actions (whether economic or military) down the road, if needed. Stephens and Gerecht, on the other hand, supported stronger sanctions even at the risk of Russia and China abandoning the P5+1 altogether. When Einhorn pointed out that China is the largest importer of Iranian crude and would undoubtedly increase its imports if they were to pull out of the sanctions coalition, Gerecht countered with the argument that neither Russia nor China’s departure from the coalition would have much impact on the most painful banking sanctions. This assertion, an interesting one given that the Bank of Moscow just agreed to pay a $10 million fine to the Treasury Department for violating sanctions against the Iranian banking industry, was left unchallenged.

The moderate Einhorn did, however, support a general “toughening” of the US negotiating position, proposing that Congress could pass a “prior authorization to use force” resolution to empower President Barack Obama to strike Iran if it violates its obligations. No one mentioned what happened the last time Congress gave a president prior authorization to use military force over a Middle Eastern nation’s supposed weapons of mass destruction program.

Another hotly contested point had to do with the efficacy of international monitoring. Einhorn praised the JPA for its verification provisions and for laying the groundwork for even tougher monitoring in a permanent agreement. He pointed to successes in identifying the facilities at Natanz, Arak, and Fordow as evidence that monitoring and intelligence gathering has worked, while Stephens pointed to America’s failure to predict India’s 1998 nuclear tests as evidence that verification can easily fail. Gerecht argued that Iran will resist more stringent monitoring in a permanent agreement, and warned that the US intelligence community likely has no sources in high positions either in the Iranian government or its nuclear program, and therefore lacks the ability to check what international monitors find.

The debate over monitoring highlighted what seems to be a fundamental flaw in the neoconservative position: by their logic there seems to be no circumstance under which negotiations can be allowed to work. After all, according to their argument the Iranians cannot be trusted, verification does not work, and toughening sanctions is always better than easing sanctions. If there is no way to trust that verification can work, and no way to trust the Iranians themselves, then how can there be a diplomatic solution to this situation? Gerecht’s question about pre-emptive military action could easily be reframed for opponents of the JPA: “are you prepared to ease sanctions on Iran, ever, in exchange for any Iranian concessions?” Are sanctions, and the implicit threat of military action they contain a means to the end of preventing Iran from achieving a nuclear weapon (or rapid breakout capacity), or are they the end in themselves?

The two sides did find common ground in supporting a policy of regime change in Iran, but had drastically different ideas as to implementation. Sajadpour suggested that, if the West pursues policies that cultivate goodwill among Iranians, and especially the Iranian youth, Iranian leader Ayatollah Ali Khamenei may have no choice but to acquiesce to internal pressure to improve relations. On the other hand Gerecht and Stephens argued that a military strike that drastically set back Iran’s nuclear program would severely damage the regime’s credibility at home, a questionable assumption that has been challenged by moderate Iranian leaders. Einhorn cautioned that there is no way to know how far back a strike could set Iran’s nuclear program, but that it would certainly end any chance of a negotiated nuclear settlement and put Iran inexorably on the path toward developing a nuclear weapon.

“We know they don’t need to have an underground, fortified facility like Fordow in order to have a peaceful nuclear program, they certainly don’t need a heavy-water reactor at Arak in order to have a peaceful nuclear program, they don’t need some of the advanced centrifuges that they currently possess in order to have a limited, peaceful nuclear program” stated President Obama on Dec. 7.

“…So the question ultimately is going to be, are they prepared to roll back some of the advancements that they’ve made that could not be justified by simply wanting some modest, peaceful nuclear power, but, frankly, hint at a desire to have breakout capacity.”

In the same vein, Laurent Fabius wrote about one week later: “It is unclear if the Iranians will accept to definitively abandon any capacity of getting a weapon or only agree to interrupt the nuclear program… What is at stake is to ensure that there is no breakout capacity”.

Addressing the two routes to the bomb

It is certainly a legitimate goal to try to erect around the Iranian nuclear program a tight barrier on the two ways that could lead to acquiring a bomb: the enrichment of uranium at the highest levels at Natanz and Fordow, and the production of weapons-grade plutonium by running a research reactor such as the one presently under construction at Arak. But the formulas put forward by President Obama and Foreign Minister Fabius have little chance of persuading the Iranian government. Significantly, they are not reflected in the Nov. 24 agreement that laid the groundwork for the negotiation to come. The final part of the agreement addresses these two points, but in a different way. Regarding enrichment, it asserts the necessity of defining an enrichment program “consistent with practical needs, with agreed limits on scope and level of enrichment activities, capacity… and stocks of enriched uranium.” Concerning the production of weapons-grade plutonium, it affirms the will to “fully resolve concerns related to the reactor at Arak”.

The route to the uranium bomb

What is really at stake? Starting with enrichment, it has been estimated by some that the Iranian enrichment program, with its 19,000 centrifuges, its stock of around seven tons of uranium enriched up to 5% plus a few hundred kilograms of uranium enriched up to 20%, would be able to produce the fissile material necessary for a bomb in just a few weeks; that is, 20 to 25 kilograms of 90% enriched uranium. That would be too short a time for inspectors of the International Atomic Energy Agency (IAEA) to detect such a breakout and for the international community to react effectively. To be on the safe side, according to these estimates, it would be necessary to roll back Tehran’s program. Iran should not possess more than a few thousand centrifuges of its current prevalent model, the IR1, and should not be permitted to produce more efficient models. And it should not retain more than a minimal stockpile of low-enriched uranium available for further enrichment.

But what is the practical value of such estimates? First, having the material for the bomb does not mean having the bomb. Several months, possibly a good year or more, would still be necessary to manufacture and test a first nuclear explosive device. Second, to maintain a minimal deterrent effect after an initial test, at least two or three bombs should be kept in stock. To obtain such a deterrent, however, would significantly add to the time needed for enrichment to 90%. Some argue that as soon as this highly enriched uranium would be produced, and subsequently diverted, it would escape the safeguards of the IAEA, making it much more difficult for the international community to react. But why? The whole country would still be there, both as a possible target for increased sanctions and more. And if a few weeks are theoretically enough for a successful breakout, a few days should be enough to deploy and deliver an adequate response.

Forbidding Iran to develop more efficient models of centrifuges than its first-generation, low-yield, IR1s does not seem realistic either. Such a ban on research can be imposed on a defeated nation. In 1945, Germany, for example, was required to abandon all of its R&D in the field of aircraft engines. But Iran is not in such a position. The limitation of Iran’s enrichment capacities should be addressed, not in terms of numbers and models of centrifuges, but rather in terms of total enrichment capacity (calculated in the nuclear jargon, in separative work units). Once such a ceiling is fixed by mutual consent between Tehran and the P5+1, Iranians scientists and engineers should be left free to make their own technological choices.

As for the small underground enrichment facility of Fordow, it will be hard to convince Iran to close it. Fordow is placed under the same IAEA safeguards as any other Iranian nuclear facility, and being buried 70 yards deep makes no difference. It would make a difference in case of air strikes, but Iran, which is party to the Non-proliferation Treaty (NPT), has no reason to facilitate the destruction of its nuclear facilities, especially by a non-signatory of the NPT, or by any of the five members of the NPT authorized to keep their nuclear arsenals.

On the other hand, it is Iran’s urgent duty to address the widespread suspicions raised by the vagueness of its ambitions when it comes to its nuclear power and research program. Professor Ali Akbar Salehi, head of the Iranian Atomic Energy Organization, recently announced that Iran should produce 150 tons of nuclear fuel to supply five nuclear power plants. Would it be possible to know how exactly, in what time-frame, through which procedures and on what budget such projects are to be implemented? When one knows that 150 tons of idle low-enriched uranium, through further enrichment, is theoretically capable of producing about 150 bombs, the international community is entitled to have access to and thoroughly assess Iran’s plans in this regard.

The route to the plutonium bomb

A word about the plutonium route. The Arak reactor has a design similar to various existing reactors used to produce weapons-grade plutonium, be it in Israel, India or Pakistan. Even if this reactor has little chance to be operational for another three or four years, the concerns about it are legitimate. Furthermore, to recoup the plutonium generated in the reactor’s core, the Iranians would have to build and operate a dedicated side facility. Until now, they have foregone such a possibility. All in all, even with the worst intentions, Iran could hardly produce the first six or seven kilograms of plutonium necessary to build one bomb before the end of the decade. And even so, because of the specific challenges presented by the plutonium route, the time span between the beginning of a possible breakout and the acquisition of a first batch of plutonium would be significantly greater than that of the uranium route.

True, the Arak reactor, once in operation, could not be destroyed without incurring unacceptable nuclear-related damage to the surrounding populations. But this cannot justify a legally indefensible preventive strike on a construction site that has been placed under IAEA safeguards. All in all, the proliferation risk raised by the Arak reactor looks much less pressing than the one generated through uranium enrichment. But it is also true that the best way to permanently alleviate this risk would be to modify, while there is still time, the design of the reactor in order to reduce its capacity to produce weapons-grade plutonium without affecting its other capacities. This is possible with international cooperation, and money.

Suspicion against suspicion

Let us go back to basics. In 1968, the newly signed NPT drew a clear line between licit and illicit nuclear activities for those countries willing to renounce the acquisition of a bomb. For better or worse, that line was drawn at the point before the actual manufacture of a nuclear explosive device. But this was not enough to dispel suspicions of possible breakouts by unruly countries. It has therefore been tried repeatedly — and now again with Iran – to prevent countries from developing the capacities that could theoretically lead to the construction of a bomb. But nations in the forefront of such endeavors have often been among the same ones authorized by the same NPT to retain their nuclear arsenals. It has thus been tempting to interpret their efforts to limit the development of nuclear programs of other nations as an attempt to consolidate their own strategic advantage, especially as they have shown limited enthusiasm for following through on their own NPT commitments to nuclear disarmament. Still another source of suspicion has arisen from the fact that the six members of the P5+1 together comprise the world’s major source of enriched uranium. Their efforts to limit the enrichment capacities of other nations may thus come across as an effort to preserve their own commercial interests.

Even putting aside sources of contention between Iran and the great powers and its regional rivals beyond the nuclear realm, one can see why mutual suspicion still looms so large, even after the breakthrough of the Nov. 24 agreement. To overcome it, vision, restraint, and steady diplomatic work will be critical on both sides in the months to come.
