McClatchy reports that even though the Obama Administration has not publicly reiterated Pakistan’s commitment to the Afghan War, a necessary announcement to justify both military and non-military aid to Islamabad, it has nonetheless waived the requirement to released US$2 billion:

The Obama administration has refused for the first time to declare that Pakistan is making progress toward ending alleged military support for Islamic militant groups or preventing al Qaeda, the Afghan Taliban or other extremists from staging attacks in Afghanistan.

Even so, Secretary of State Hillary Rodham Clinton has quietly informed Congress that she’s waived the legal restrictions that would have blocked $2 billion in U.S. economic and military aid to Pakistan. Disbursing the funds, she said in an official notice, is “important to the national security interests of the United States.

The Congressional Research Service released a report last week outlining the timeline the Administration pursued to reauthorize the aid over the summer:

By mid-2012, however, conditions were such that a second certification under the EPPA [the 2009 Enhanced Partnership with Pakistan Act] appeared extremely difficult to justify. The November 2011 Salala border incident had spurred an angry Islamabad to close vital supply lines used by NATO forces in Afghanistan, and these remained closed for more than seven months until difficult negotiations finally resulted in their reopening in early July 2012 (in an apparent quid pro quo, Washington days later released nearly $1.2 billion in pending CSF payments). Despite this breakthrough, U.S.-Pakistan relations remained uneasy and, with the fiscal year in its final quarter, the Administration faced having to make a decision on if and how to free planned FY2012 aid to Pakistan, given congressional conditions.

In mid-August 2012, the State Department quietly notified Congress of its intent, “consistent with U.S. national security interests,” to waive the certification requirements of the EPPA. The stated justification was that proceeding with “cooperation and joint action in areas of mutual interest with Pakistan” requires the Administration to have available all foreign policy tools, including foreign assistance. One month later, on September 14, the relevant congressional committees received formal notification from Secretary Clinton that she found it important to the national security interests of the United States to waive the limitations on security aid to Pakistan found in Section 203 of P.L. 111-73. The Secretary’s accompanying justification for the waiver was delivered in classified form. Also on September 14, Secretary Clinton notified the House and Senate Appropriations Committees that she was waiving the Pakistan-related certification requirements in Section 7046(c) of P.L. 112-74. This waiver was similarly made under the law’s national security provision.

Iranian policymakers should understand that failing to limit the enrichment program will eventually trigger war”: The Security Times carries a commentary by Mark Fitzpatrick of the International Institute for Strategic Studies, an influential British think tank. Outlining the continuing difficulties in negotiating an agreement on Iran’s enrichment activities, Fitzpatrick notes that the lack of an agreement means that pressure will grow to take military action in the coming years:

…. Iran already is nuclear capable – now possessing all the materials and technology, requiring only a political decision – and, while unpalatable, this status has not triggered military action.

The problem is that the red line separating nuclear-capable from nuclear-armed will become less clear as Iran’s enrichment program makes further advances. At present, Iran is still months away from being able to make a successful dash to produce weapons-grade highly enriched uranium (HEU). Because IAEA inspections take place on average twice a month, any such ‘breakout’ at declared facilities would be detected in time.

If, however, the Iranians sought to produce HEU at clandestine plants, they could not be confident the work would remain hidden. Twice already, secret enrichment plants have been exposed. Iran might judge that it could get away with such exposure, claiming, as it does today, that it does not need to follow IAEA rules about early notification of new nuclear facilities.

If this is Iran’s calculation, it could well backfire. Iran does not know how close it could come to crossing the line to weapons production before its adversaries determined it was too close. If Iran’s enrichment program continues unabated, at some point Western intelligence agencies will judge that because the uranium stockpile is too large, the technology too advanced and the hiding places too many, a dash for the bomb cannot be detected in time. The red line of weapons production will have become too blurred to serve as an effective tripwire.

Iran’s Nuclear Program: Tehran’s Compliance with International Obligations”: The Congressional Research Service asks “Has Iran Violated the NPT?” in a new report and concludes that the matter is “unclear” though the IAEA believes Iran “has violated its safeguards agreement” and was, until at least 2003, pursuing military research as part of the program. It notes that investigations are still ongoing over claims that Iran violated the NPT’s Article II, “which state[s] that non-nuclear-weapon states-parties shall not ‘manufacture or otherwise acquire nuclear weapons or other nuclear  explosive devices’ or “’seek or receive any assistance in the manufacture of nuclear weapons or other nuclear explosive devices.’”

The 2007 US National Intelligence Estimate assessed in 2007 that Iran halted its nuclear weapons program in 2003.

In response to an IAEA Board of Governors ruling that Iran had not met its disclosure (and safeguards) obligations, the Iranian press reported that “Iranian Majlis Speaker Ali Larijani said that the most recent resolution issued against Iran by the International Atomic Energy Agency raises doubt about the benefit of being a signatory to the nuclear Non-Proliferation Treaty (NPT).”

Who’s Sabotaging Iran’s Nuclear Program?”: Building off an earlier New York Times report on allegations of sabotage against Iran’s nuclear facilities, the Daily Beast’s Eli Lake questions if this is an act of escalation by the perpetrators:

Fereydoun Abbasi, Iran’s vice president and the chief of its nuclear-energy agency, disclosed that power lines between the holy city of Qom and the underground Fordow nuclear centrifuge facility were blown up with explosives on Aug. 17. He also said the power lines leading to Iran’s Natanz facilities were blown up as well. On the day after the power was cut off at Fordow, an inspector from the International Atomic Energy Agency (IAEA) asked to visit the facility.

The disclosure is significant. To start, it is the first piece of evidence to suggest opponents of the Iranian program are targeting the country’s electrical grid and doing so on the ground.

The US has publicly denied it is carrying out attacks on any facilities and military or civilian targets in Iran. An NBC investigative report from the summer reported that Israel, not the US, is actually orchestrating the bombings and assassinations. Rather than risk discovery of its own network in the Islamic Republic, the NBC said that the Mossad relies on members of the People’s Mujahedeen of Iran (PMO) to carry out these operations.

Poll: Majority of Palestinians, Israelis say attack on Iran would result in major war”: Haaretz reports on a new poll in Israel expressing growing concern among Israeli citizens and Palestinians in the Occupied Territories that a war with Iran would “would ignite a major regional war,” though the poll also noted that a significant number of respondents do not believe a war is likely this year anyway:

According to the study’s finding, 77 percent of Israeli respondents and 82 percent of Palestinian respondents said that an Israeli attack on Iran would result in a major regional confrontation.

Regarding the possibility of an Israeli strike without U.S. backing, 65 percent of Israelis were against such a course of action, an increase from 52 percent in June.

Also, the study found that 70 percent of Israelis did not believe Israel would strike Iran in the coming months, with only 20 percent of respondents saying they believe the Iranians’ goal is to destroy Israel.

The Israeli press also reported that US diplomats have warned their Israeli counterparts that should Israel attack Iran this year, it would jeopardize Israel’s peace treaties with Jordan and Egypt.

Although I believe war with Iran would be folly, one cannot rule it out. All countries commit blunders, and neither the United States nor Israel is immune to this sort of miscalculation (see under: Iraq, Lebanon, etc.). But I am remain skeptical that Israel will attack, for the simple reason that it does not have the military capability to inflict strategically significant damage on Iran’s nuclear facilities. As the Congressional Research Service reported earlier this year, “Israeli officials and analysts generally agree that a strike would not completely destroy the [Iranian nuclear] program.” The CRS report also suggested that an Israeli strike could not delay the program for long, and that long-term success would depend either on repeated follow-up strikes or on subsequent diplomatic activity (e.g., more sanctions).

All of which suggests that all this talk of Israeli “red lines” and some sort of imminent attack (including the possibility of an “October surprise”) is just talk. Indeed, those prophesying war are starting to sound like those wacky cult leaders who keep predicting the End of the World, and then keep moving the date when the world doesn’t end on schedule. At what point are we going to stop paying attention?

Like I said, I can’t be completely sure that reason will prevail and that a war won’t happen, although there do seem to be a lot of sensible voices inside the Israeli security establishment who are counseling against it. What worries me most is that the people who have been sounding all these alarmist warnings will start to worry that their credibility is evaporating, and they will feel compelled to go to war because they’ve talked about it for so long. That’s just about the dumbest reason I can think of, but sometimes even pretty smart people do dumb things.

Commentary editorial director and Weekly Standard co-founder John Podhoretz has an op-ed in today’s New York Post. Podhoretz, not wasting an opportunity to float a “linkage”-denying argument, says that the pro-democracy protests in Egypt show that the Israeli-Palestinian conflict is just a sideshow compared to the real issues facing Arabs.

He writes:

The anti-Mubarak revolution won’t only topple an authoritarian regime. It will also topple 40-plus years of wrong-headed thinking about the causes of Middle East instability among the world’s foreign-policy cognoscenti.

In that view, the horrible relationship between Israel and the Arabs is the dominant issue for the Near East’s 20-plus nations and its 250-million-plus people — and the root cause of the region’s tempestuousness.

And poses the question:

If there were a Palestinian embassy in Washington today, would Hosni Mubarak have been any more mindful of the eventual consequences of his iron-fisted fecklessness in refusing a transition to a more representative Egypt because there was an ambassador from Palestine in Washington?

While Podhoretz considers this to be a rhetorical question, a slightly nuanced reading of the situation would respond affirmatively to that question.

Perhaps Podhoretz should answer this question: Could Hosni Mubarak’s authoritarian rule in Egypt have lasted for thirty years had Egypt not enjoyed the benefits—largely in the form of U.S. aid and military assistance—of a peace deal with Israel?

Podhoretz writes:

Cure the Israeli-Palestinian problem, they tell us, and you cure regional instability. But the problem for the overwhelming majority of countries in the Middle East hasn’t been instability. The problem has, rather, been an excess of stability — the result of sclerotic regimes of preposterously long duration.

Mubarak has been in power since 1981, as part of a movement in charge of Egypt for nearly 60 years. The al-Saud family has run Saudi Arabia since 1903; the al-Sabahs have been Kuwait’s poohbahs since 1913. The Jordanian royal family has held sway for eight decades; the Assads, father and son, have bossed Syria since 1970.

Is it any coincidence that these governments all benefit from close relationships with the U.S.? Are we to believe that Washington’s support of these governments is totally independent from its concern over Israel’s security?

A June 15, 2010 Congressional Research Service report (PDF) spelled out the U.S.’s aid strategy in the Middle East (my emphasis):

The degree to which foreign assistance has contributed to the achievement of U.S. objectives in the Middle East is difficult to measure, but the consensus among most analysts seems to be that
U.S. economic and security aid has contributed significantly to Israel’s security, Egypt’s stability, and Jordan’s friendship with the United States. The promise of U.S. assistance to Israel and Egypt during peace negotiations in the late 1970s helped to enable both countries to take the risks needed for peace, and may have helped convince both countries that the United States was committed to supporting their peace efforts. Excluding Iraq, Israel and Egypt are the largest two recipients of U.S. aid respectively.

While Podhoretz would like to have his readers believe that Israel is a totally independent variable in the region’s stability, the reality is that U.S. aid and support for authoritarian regimes who maintain peace with Israel is a real side effect of the ongoing Israeli-Palestinian conflict.
