Mr. Brennan is the president’s chief counterterrorism adviser and the architect of this model. In a recent speech, he claimed that there was “little evidence that these actions are generating widespread anti-American sentiment or recruits for A.Q.A.P.,” referring to Al Qaeda in the Arabian Peninsula.

Mr. Brennan’s assertion was either shockingly naïve or deliberately misleading. Testimonies from Qaeda fighters and interviews I and local journalists have conducted across Yemen attest to the centrality of civilian casualties in explaining Al Qaeda’s rapid growth there. The United States is killing women, children and members of key tribes. “Each time they kill a tribesman, they create more fighters for Al Qaeda,” one Yemeni explained to me over tea in Sana, the capital, last month. Another told CNN, after a failed strike, “I would not be surprised if a hundred tribesmen joined Al Qaeda as a result of the latest drone mistake.”

Rather than promote the author of a failing strategy, we need a C.I.A. director who will halt the agency’s creeping militarization and restore it to what it does best: collecting human intelligence. It is an intelligence agency, not a lightweight version of Joint Special Operations Command. And until America wins the intelligence war, missiles will continue to hit the wrong targets, kill too many civilians and drive young men into the waiting arms of our enemies.

In what is sure to be one of the most glaringly obvious headlines written about the General Petraeus-Paula Broadwell affair, the Washington Post writes: “Petraeus hoped affair would stay secret and he could keep his job as CIA director.”

Clearly, things did not go according to plan. Right after the election, Petraeus submitted his resignation to President Obama after being under investigation by the FBI for months; he had already reportedly broken off his relationship with Broadwell, his biographer.

ABC reports that the FBI did not in fact inform the White House because their findings were “the result of a criminal investigation that never reached the threshold of an intelligence probe” — but even as the FBI was mulling over what to do next, one of the agents on the case was contacting Florida socialite Jill Kelley to inform her of their findings so far.

The investigation showed just how broad the Bureau’s powers are with respect to communications monitoring. Rather than observing what The Daily Beast calls “the spirit of minimization to lead the FBI to keep any personal revelations within the bureau and not say anything to anybody” in other cases involving personal threats, it seems that the since-dismissed agent violated this policy and not only told Kelley, but Members of Congress as well, before the Tampa office handling the email-reading contacted the Director of the FBI to warn of possible national security implications.

As a result of the FBI’s case with Kelley, the US/NATO commander in Afghanistan, General John R. Allen, is also now “involved” in the scandal due to his lengthy email correspondence with Kelley that has raised concerns over potential breaches of national security.

Though the details of the affair have captured headlines and a large number of officials and foreign policy commentators are bemoaning the damage done to Petraeus’s military-policy reputation, some discussion is occurring over the ex-DCIA’s record as top general in Iraq and Afghanistan, as well as Langley’s chief drone advocate.

Issandr El Amrani at the Arabist offers a succinct observation of how Petraeus’s star rose in the Beltway hierarchy as the US sought a way out of Iraq: “[h]e delivered results of sorts for the US, which gave Washington political cover for an exit.” While this certainly represented a success for a despairing Bush White House, it was not a step towards carrying out an extended occupation, or even reinvigorating the potpourri of war aims increasingly advanced after 2003 to re-spin the war’s WMD casus belli. Iraq’s ongoing political troubles offer few hints as to how counterinsurgency, or COIN, may have staved off total collapse. At least, from the military’s perspective, the “Surge” staved off a complete collapse and ensured the US could withdraw in the near future, not unlike Nixon’s 1973 “peace with honor” adage in Vietnam. With Iran maintaining its influence in Baghdad (handed to them by the US invasion), disparate militias eyeing each other warily in Kurdistan, and Iraq’s anti-Iranian & anti-American terror cells looking to Syria to revitalize their regional struggle, America’s 21st century “peace with honor” may sound just as hollow for some Iraqi officials today as it sounded for South Vietnamese negotiators back then.

COIN itself never came to reoccupy the spot formerly reserved for “nation-building” in the years Robert McNamara’s whiz kids rode high. As Andrew Sullivan and Michael Hastings note, the general himself did not exactly follow his own press in practice when he transfered over to Afghanistan, emphasizing air strikes and special operations missions over his much-lauded counterinsurgency practices of going door-to-door to win the population over. As Spencer Ackerman, who has issued an apology for not being more aware of how the general’s Army office was influencing his past reporting, Petraeus has done much to expand the CIA’s own drone program, calling for a significant expansion of the program just weeks before his resignation.

COIN and its mythologizing aside, there are few reasons to expect that the general’s counterterrorism policies will suddenly fall out of favor with the White House, not least because Deputy NSA John O. Brennan has been one of the driving forces for institutionalizing drone warfare since his appointment in 2009. The influential former DCIA Michael Hayden, now coming off of his stint as an advisor to former GOP presidential nominee Mitt Romney, is urging the agency to move away from its targeted killing trajectory and back towards threat assessment and anticipation. He remarked that looking to the future of the Agency, “[t]he biggest challenge may be the sheer volume of problems that require intelligence input.”

There is little chance though that Petraeus’s downfall will see the downgrading of the Agency’s robot presence. With both the US and Pakistan unwilling to launch ground major operations into the Afghanistan-Pakistan border regions due to the casualties their armed forces would incur, the drone wars are regarded as the most effective military option available. Neither Washington nor Islamabad — or on the other side of the Indian Ocean, Sana’a and Mogadishu — have either the capacity or will for anything more. Or for anything less, in fact, since that would mean ceding the field to the targets, who despite their losses, can draw strength from these strikes. The CTC man told the Washington Post last year while the Agency may be “killing these sons of bitches faster than they can grow them now,” he himself does not think he’s implementing a truly sustainable policy for this Administration, or for those that will follow.

But as the Post reported this past month, Deputy NSA Brennan seems to think otherwise, along with those reportedly elevated in the CIA under Petraeus’s directorship.

While the relationship between reporter and officer — whether sexualized or not — is likely to remain a topic of debate and “soul-searching” for commentators in the coming months, and COIN may fade away from Army manuals trying to plan out the next “time-limited, scope-limited military action, in concert with our international partners,” the new face of counterterrorism that is the General Atomics MQ series is likely to be the general/DCIA’s most lasting legacy. And this will be the one that holds the fewest headlines of all in the weeks to come, given it’s broad acceptance across both major parties and the “punditocracy.”

The Washington Post‘s Greg Miller has begun a three-part series on the future of the Obama Administration’s counterterrorism drone strike program, which will include a “next-generation targeting list” (aka “kill list”) in the form of a “dipposition matrix”.

Though the White House, CIA, JSOC and ODNI declined comment requests, the article cites “dozens of current and former national security officials, intelligence analysts and others.”

Miller’s report somewhat contradicts the Obama Administration’s frequent assertions that al Qaeda is exhausted and on the run. The officials interviewed essentially offer a redux of the “War on Terror” methodology minus the renditions and speechifying. And, even while touting the success of the program, the Administration remains committed to “embedding” it in national security planning.

According to Miller, the program is meant to outlive the Obama Administration: “White House counterterrorism adviser John O. Brennan is seeking to codify the administration’s approach to generating capture/kill lists, part of a broader effort to guide future administrations through the counterterrorism processes that Obama has embraced.”

The expansion of the US’s drone fleet and African operations were also noted, as was the US’s overall growing reliance on unarmed drone surveillance, now over Libya, and according to the Post, Iran. Meanwhile, The Diplomat notes the US is looking to create a more autonomous drone force that is less dependent on operator-control to carry out missions.

Micah Zenko of the Council on Foreign Relations reflects on President Obama’s institutionalization of “extrajudicial killings” in comparison to his predecessor’s more careful approach:

Having spoken with dozens of officials across both administrations, I am convinced that those serving under President Bush were actually much more conscious and thoughtful about the long-term implications of targeted killings than those serving under Obama. In part, this is because more Bush administration officials were affected by the U.S. Senate Select Committee investigation, led by Senator Frank Church, that implicated the United States in assassination plots against foreign leaders—including at least eight separate plans to kill Cuban president Fidel Castro—and President Ford’s Executive Order 11905: “No employee of the United States Government shall engage in, or conspire to engage in, political assassination.”

President Abed Rabbo Mansour Hadi of Yemen told the Washington Post this week that his office and the Yemeni military fully cooperate with US counterterrorism efforts in his country, a frank admission that his predecessor was not willing to provide:

Hadi’s comments mark the first time he has publicly acknowledged his direct role in a campaign of strikes by U.S. drones and conventional aircraft targeting an al-Qaeda franchise that is seen as the most potent terrorist threat to the United States.

“Every operation, before taking place, they take permission from the president,” Hadi said in an interview with reporters and editors from The Washington Post in his hotel suite in the District. Praising the accuracy of the remotely operated aircraft, he added, “The drone technologically is more advanced than the human brain.”

Hadi’s enthusiasm helps to explain how, since taking office in February after a popular revolt ended President Ali Abdullah Saleh’s 33-year rule, he has come to be regarded by Obama administration officials as one of the United States’ staunchest counterterrorism allies.

….U.S. Special Operations drones patrol Yemen from a base in Djibouti, on the Horn of Africa. The CIA aircraft are flown from a separate facility on the Arabian Peninsula whose location has not been publicly disclosed.

The admission illustrates a high level of confidence by the Yemeni leader that he will not suffer political fallout in Yemen from the program, as the Washington Post reported in May that the drone strikes were proving deeply unpopular among Yemenis outside of the capital, Sana’a. Foreign Policy notes that his predecessor, Ali Abdullah Saleh, was very reluctant to admit the scope of his military cooperation with the US and Saudi Arabia. Yemeni elites are still grappling for power in the vacuum created by the long-serving Saleh, whose slighted family retains influence in their country’s armed forces. According to Bloomberg News, USAID funds to Yemen “more than doubled” this past year while the US also recently waived military assistance restrictions.

Ahead of tonight’s first 2012 presidential debate, new questions are being raised about the Obama Administration’s policies on counterterrorism abroad — one of the Administration’s main foreign policy record talking points — in light of the attack on the US consulate in Benghazi Libya that killed four Americans.

Darrell Issa (R-CA) has called for Secretary of State Clinton to testify at a House Committee on Oversight and Government Reform on how the State Department weighed two bomb attacks on the consulate in the preceding months in light of increased security concerns over US assets in Libya. Republicans are also questioning whether the Administration maintained for several days that the attacks were the result of anti-American riots over a film in order to deflect blame for not seeing a pre-planned attack coming. But according to The Daily Beast/Newsweek, the CIA informed top officials in a briefing three days after the attacks that killed Ambassador Chris Stevens — when UN Ambassador Susan Rice was asserting that the attacks were the result of the riots — that “the events were spontaneous.”

That briefing, the report notes, has since been called into question. The Associated Press reports that “[w]ithin hours of last month’s attacks on U.S. diplomatic facilities in Benghazi, Libya, President Barack Obama’s administration received about a dozen intelligence reports suggesting militants connected to al Qaeda were involved,” yet the official messaging remained contradictory. According to the LA Times, the US reportedly began tracking suspected militants in Libya by drone and wire-intercepts in the aftermath of the attack, suggesting that there were concerns in advance over their intentions towards the consulate.

The Associated Press also reports that questions over the attacks — which became a flashpoint in this presidential campaign raised by Republicans are likely to become a venue for criticizing the Administration’s Mideast policies. Politico reports that within the Romney campaign, there is division among his advisors over whether or not to shift some focus from the economy over onto the Benghazi attacks, with campaign manager Stuart Stevens against making such a shift, likely due to the strong backlash against Romney’s earlier comments that were made without knowledge of the four Americans killed in Libya.

But given the internal rifts within the campaign over Stevens’s leadership style, it’s not certain that foreign policy pundits have lost the battle, as they continue to assail Obama on Libya alongside Congressional Republicans demanding an investigation into what intelligence warnings the State Department may have had ahead of September 11, 2012 but failed to act on. The Christian Science Monitor

 suggested that Republicans will be “Jimmy Carterizing Obama” in spite of such internal debate, as those close to the campaign — such as former UN Ambassador and Romney advisor John Bolton — have pulled no punches in their TV appearances.

Of all the prominent Republican critics, only Senator John McCain (R-AZ) — while still demanding the Administration clarify its contradictory remarks about the attacks — has offered a qualified defense of the US’s overall record of intervention Libya, criticizing his interviewers on Fox News last month for suggesting that Libyans generally supported the attackers. In fact, tens of thousands of Benghazi residents demonstrated against Islamist militias soon after the attacks and the government launched a crackdown on suspects and loose weapons in the city.

McCain has also charged the Administration is retreating from the region, but the US intelligence and military presence is set to increase in Libya in the coming weeks now that the intelligence community has fingered several pre-existing Islamist organizations in “chatter” over the attacks.

The personal and controversial nature of much of the criticism over what has been one of the Administration’s most concrete achievements in the Middle East since 2008 seems to be wearing patience thin in the White House.

The Administration’s growing anger over the criticism being aired against it was best exemplified in an expletive-filled exchange between one of Secretary of State Clinton’s top aides and journalist Max Hastings this week. Hastings defended CNN’s controversial use of the late ambassador’s recovered diary in its Libyan reporting last month. The Administration is upset with CNN’s handling of the diary partly because the network tried to keep its use of his diary quiet. But the diary is also embarrassing from a policy standpoint because in it, CNN says the late ambassador was concerned the consulate was being targeted by terrorists.

Unnamed officials now concede that the US had (general) concerns about targeting in the months prior to the attack, such that special forces teams were dispatched to Libya and other Muslim countries to set up rapid-response counterterrorism centers. According to the AP report that quoted these officials, the center in Libya was too new to have offered sufficient advance warning.

There may be further Beltway discussion of Obama’s Middle East record based on a report in the Wall Street Journal detailing how Egypt’s new Muslim Brotherhood President has been cutting deals with Islamist groups to release batches of their members imprisoned by Hosni Mubarak. The majority of these men — who were tortured by Mubarak’s security services for years — are thought to be political prisoners now too old and bruised to pose any security threats. But several of those freed, the Journal reports, are still active as militant organizers. One of those released was Muhammad Jamal Abu Ahmad, an Egyptian national who is believed to be the main point-man for an al Qaeda core leadership seeking to (re)assert it’s presence in the Maghreb.

Ahmad is reportedly seeking to step up operations in Libya under his own aegis against Libyan and American targets.

New intelligence on Iran nuke work”: The Associated Press reports that the International Atomic Energy Association (IAEA) has received intelligence from the United States, Israel and at least two other Western countries showing that Iran has “moved further toward the ability to build a nuclear weapon”.

Q: You say that after an attack, Iran would have strong motivation to rebuild its nuclear facilities, this time faster and deeper underground. But the Israeli attacks on nuclear reactors at Osirak, Iraq, in 1981 and Al-Kibar, Syria, in 2007 were quite successful in keeping those countries non-nuclear.

A: First, Iran’s multiple facilities, well fortified (especially the centrifuges buried deep in the rock at Fordow, near Qom) present a much tougher target than the reactors in Iraq and Syria. Second, and more important, the Osirak attack, far from stopping Iraq’s nuclear ambitions, hastened them. After Israel bombed the reactor, Saddam Hussein launched an accelerated, covert program to manufacture nuclear weapons. When the First Gulf War ended his ambitions in 1991, that program was well underway. Experts disagree how far Saddam was from having a weapon (estimates ranged from six months to three years) but the Israeli strike in Iraq accomplished what many fear a strike in Iran would accomplish: it gave the nuclear weapons program new life. Third, Israel’s attack on the (suspected) nuclear reactor in Syria was kept secret for a long time, so that Syria did not feel obliged to undertake reprisals against the superior Israeli military. It’s inconceivable that Iran and the world would not know whom to hold responsible for an attack on its facilities, and Iranian leaders would have to lash back, if only to save face. Fourth, what ended Iraq’s nuclear ambitions was a full-scale military invasion in 1991 – followed by an (unnecessary and botched) occupation in 2003. No doubt, occupying Iran would solve the problem of its nuclear program. Anybody up for that?

Former CIA Chief: Obama’s War on Terror Same as Bush’s, But With More Killing: Wired reports that Michael Hayden has offered words of praise for President Obama’s counterterrorism agenda after initially criticizing the POTUS’s early comments against programs Hayden helped formulate under George W. Bush, such as the use of “enhanced interrogation” techniques and domestic wiretapping:

“But let me repeat my hypothesis: Despite the frequent drama at the political level, America and Americans have found a comfortable center line in what it is they want their government to do and what it is they accept their government doing. It is that practical consensus that has fostered such powerful continuity between two vastly different presidents, George W. Bush and Barack Obama, when it comes, when it comes to this conflict,” Hayden said Friday while speaking at the University of Michigan.

But Hayden, in a nearly 80-minute lecture posted on C-Span, said Obama came to embrace Bush’s positions. Both Bush and Obama said the country was at war. The enemy was al-Qaida. The war was global in nature. And the United States would have to take the fight to the enemy, wherever it may be, he said.

The Deafness Before the Storm”: Vanity Fair’s Kurt Eichenwald delivers a bombshell report in the New York Times on the 11th anniversary of the September 11th attacks arguing that the Bush Administration had received multiple warnings prior to August 2001 from the CIA about Osama bin Laden’s intent and capabilities to attack US targets. According to Eichenwald, the White House dismissed the agency’s sources as agents “in” on a maskirovka directed by both Saddam Hussein and Bin Laden:

But some in the administration considered the warning to be just bluster. An intelligence official and a member of the Bush administration both told me in interviews that the neoconservative leaders who had recently assumed power at the Pentagon were warning the White House that the C.I.A. had been fooled; according to this theory, Bin Laden was merely pretending to be planning an attack to distract the administration from Saddam Hussein, whom the neoconservatives saw as a greater threat. Intelligence officials, these sources said, protested that the idea of Bin Laden, an Islamic fundamentalist, conspiring with Mr. Hussein, an Iraqi secularist, was ridiculous, but the neoconservatives’ suspicions were nevertheless carrying the day.

“The U.S. is not the target of a disinformation campaign by Usama Bin Laden,” the daily brief of June 29 read, using the government’s transliteration of Bin Laden’s first name. Going on for more than a page, the document recited much of the evidence, including an interview that month with a Middle Eastern journalist in which Bin Laden aides warned of a coming attack, as well as competitive pressures that the terrorist leader was feeling, given the number of Islamists being recruited for the separatist Russian region of Chechnya.

Iraqi Spokesman: Al-Hashemi Is ‘Connected Directly’ To Terrorists”: Al-Monitor interviews Iraqi Government spokesman Ali Aldabbagh on the in absentia death sentence against the country’s Vice President Tareq al-Hashemi and the ongoing oil revenues dispute between Baghdad and the Kurdish north. The wide-ranging interview also touched on Iran-Iraq relations, including an oblique reference to reports that the US is pressuring Iraq to do more to undermine Iranian assistance to the Syrian regime:

Al-Monitor:  The US has asked Iraq to inspect Iranian planes flying to Syria to prevent arms and material from reaching the Syrian government. Is this a reasonable request? Will the government of Iraq consider doing so?

Aldabbagh:  The US never asked [us] to do so, but it is our commitment not to allow the flow of arms or fighters to both parties in Syria. We had informed the Iranians that Iraq will never [allow the] use [of] its airspace to do so. Iraq is ready to be part of international efforts to stop any arms to Syria. We protect our borders from [allowing the flow of] any equipment or fighters to or from Syria. Iraq is totally committed to these principles. The US had satisfied with Iraq measures toward Syria.

:  How do you assess Iraq-Iran relations? Does your relationship with Iran complicate your ties with the United States, as in the case of Syria?

Aldabbagh
:  Never, on the contrary. The US understands that Iraq should maintain good relations with Iran, as we [have] been mediating between them. Even with the Syrians, we differ on some issues with US, while we agree and have the same ideas on some Syrian aspects. Such differences never affect our relations — the US respects Iraq sovergnity [sic] in building relations with others.

Reports that FBI counterterrorism training programs relied heavily on Islamophobic material has sent shockwaves through the FBI and the Department of Justice. Wired’s Spencer Ackerman has closely followed the influence of FBI trainer William Gawthrop’s presentation, “The Sources and Patterns of Terrorism in Islamic Law,” and notes that the slides have been cited in Justice Department training material which portray an existential battle between Islam and the West.

Ackerman notes that in 2007, Gawthrop taught a class on “intelligence and homeland security” and the National Defense Intelligence College. A ThinkProgress investigation into Gawthrop’s background reveals he was part of a U.S. Army War College think tank, the Proteus Management Group (PMG), at which Islamophobic training material and papers were regularly produced and shared.

Pat Cohn, a contractor for the Army who works at the War College and is listed as a contact for the group, told ThinkProgress that, to the best of his knowledge, Proteus had been shut down when it lost its funding. He could not say when the funding had been cut. Portions of the project’s website have been erased but a combination of a cached version of the website and documents still hosted on U.S. military web-servers reveal a DOD operation which served as a breeding ground for the Islamophobic narratives present in Gawthrop’s presentations.

Proteus’ mission was to “consider differing values and perceptions,” and “frame complex issues holistically.” A banner on the now-erased Proteus website reflects the group’s “outside the box” mission.

Proteus, which was sponsored by the Office of the Director for National Intelligence and the U.S. Army War College’s Center for Strategic Leadership, hosted Gawthrop as a “PMG Fellow.” A March 2007 Proteus newsletter directs readers to one of Gawthrop’s articles in which he suggests the ideas of Islam should be “countered” through “critical vulnerabilities.” He writes:

Critical vulnerabilities of the Koran, for example, are that it was uttered by a mortal; portions were ghostwritten by others; portions were lost or redacted, and it was revised and re-issued by another mortal. Similar vulnerabilities may be found in Mohammad’s character as a political and military leader, the character of other Clerics in the Modern Era, as well as the topics addressed in the Haddiths.

But Gawthrop’s portrayal of Islam as inherently violent — indeed he glosses over the history of Christian wars of aggression by declaring “the Crusades were a delayed response to Jihad” — and at odds with Western civilization was hardly outside the norm in the “future” research conducted at Proteus.

Documents hosted on DOD webservers and associated with the Proteus program lay bare a culture of hostility toward Islam and closely resemble the messages in Gawthrop’s training materials.

A “Proteus Monograph Series” on “Truth, Perception, And Consequences,” authored by Christine A. R. MacNulty, reads:

[The Enlightenment] was the time of a major paradigm shift for the West, away from the authoritarian epistemology of medieval religious doctrine and towards an empirical epistemology based on the scientific method. The Islamic world has not been through a similar shift, which could explain its current predicament. [...]

While the [Islamic] radicals permit no creativity in general, they exhibit great creativity in terms of tactics and the development of IEDs, bombs, and other weaponry. They are innovative in their uses of technology such as cellphones. But behind them are still the concepts of revenge, honor, and “face” mixed with resentment and envy of the West.

In a presentation delivered by Cynthia E. Ayers at a Proteus workshop in August 2006, she warns that the Bush administration’s offer of incentives for Iran to cease nuclear enrichment could “be interpreted by Iranian leaders as an offer to pay ‘tribute’ in submission to Islam.” The presentation concludes with this slide.

While public attention has focused on Gawthrop’s presence at the FBI, documents from Proteus would suggest that the Islamophobic narratives in his presentations were common, if not actively encouraged, by the Department of Defense at the Army War College.

Senate Majority Leader Harry Reid (D-NV) blocked a vote on this year’s defense budget authorization act because of provisions in the bill that the Obama administration says will tie its hands when dealing with terrorism suspects. Reid explained his impending move on the Senate floor Monday before issuing a letter Tuesday to the Democratic chairman and ranking Republican on the Senate Armed Services Committee. On the floor Monday, Reid said:

But I also say, Mr. President, in its present form, I’m going to have some difficulty bringing this bill to the floor. It contains provisions relating to the detention of terrorism suspects that in the words of national security adviser John Brennan would be, and I quote, “disastrous. It would tie the hands of our counterterrorism professionals by eliminating tools and authorities that have been absolutely essential to their success.

To show you how extremely important it is that we do something about these provisions in this bill that are just wrong, both the Judiciary Committee in the Senate and the Intelligence Committee in the Senate have asked for hearings on this provision in this bill.

In a September speech, Brennan, a deputy national security adviser, decried any “rigid, inflexible approach” to terrorism that would stop the Obama administration from taking its “practical, flexible, results-driven approach that maximizes our intelligence collection and preserves our ability to prosecute dangerous individuals.”

A day after his floor comments, Reid sent a letter the Armed Services Chairman Carl Levin (D-MI) and Ranking Member John McCain (R-AZ) informing them that he didn’t intend to bring the National Defense Authorization Act to the floor until it was stripped of the detention provisions. In the letter, Reid objected to:

[T]he authorization of indefinite detention in section 1031, the requirement for mandatory military custody of terrorism suspects in Section 1032, and the stringent restrictions on transfer of detainees in Section 1033. [...]

I strongly believe that we must maintain the capability and flexibility to effectively apply the full range of tools at our disposal to combat terrorism. This includes the use of our criminal justice system, which has accumulated an impressive record of success in bringing terrorists to justice.

In his floor speech, Reid cited a compromise over last year’s National Defense Authorization Act, which originally included a repeal of the Don’t Ask, Don’t Tell policy on gays in the military. Republicans filibustered the authorization and Democrats relented, taking the DADT repeal out of the bill and agreeing to put it forward later as a separate vote. Reid asked that McCain take the same approach to the terrorism detention provisions in this year’s authorization.
