The Palestinian Authority (PA) has now moved a step closer to making good on its threat to go to the International Criminal Court (ICC) and bring charges against Israel. There is little doubt that this was a move Palestinian President Mahmoud Abbas tried desperately to avoid. In the end, he was forced to do it by a combination of U.S.-Israeli rejectionism, Palestinian desperation to do something to try to end Israel’s occupation, and his own many missteps.

Abbas signed on to 18 international agreements after the quixotic attempt to pass a resolution at the United Nations Security Council (UNSC) predictably failed. Among them was the 1998 Rome Statute, which established the ICC and took formal effect in 2002. This is the step that the U.S. and Israel have warned Abbas against most strongly. Among all the “unilateral steps” the Palestinians could take (which, one should note, is no more “unilateral” than any number of actions taken by Israel on a routine basis), this is the one Israel worries about most.

The reason, of course, is obvious. Israel knows it has committed war and other international crimes—some very serious—in the course of its occupation. While Israel generally scoffs and waxes indignant at critical world opinion, it is concerned that being hauled before the ICC could further negatively impact public and elite opinion in Europe, Israel’s main trading partner, where patience with Israeli policies has grown ever thinner.

Abbas knows only too well that he risks losing what little power he has in the West Bank. There are many ways this move can blow up in his face, and most of the roads to success are going to take more time than he has. That he has taken this step testifies to his desperation.

When, on behalf of the Palestinians, Jordan submitted its resolution to the UNSC last month, it did so under tremendous pressure from other Arab states. Abbas and Jordan’s King Abdullah had preferred to wait until France was ready with its own resolution, which the United States had strongly hinted it would support, or at least not oppose. Abbas knew full well that, even if the Palestinian resolution had mustered the nine votes needed to pass the UNSC, Washington would have vetoed it. Approval of the French version, while toothless and lacking a fixed deadline to end Israel’s occupation, would at least have had virtue of demonstrating the international community’s insistence on a two-state solution.

But internal pressure to submit the Palestinian version, as well as the external pressure that turned out to be decisive, seems to have pushed the French version to the back burner, at least for the time being. With the expected failure of the Palestinian resolution at the UNSC, Abbas was forced to carry through with his threat to sign the Rome Statute, a move that many Palestinians, including many in his own Fatah faction, had been clamoring for ever since the 2012 U.N. General Assembly vote that granted Palestine non-member observer state status, thus enabling it to join international agreements and UN specialized agencies.

In the long run, this is a move that could pay off for the Palestinians, but it carries enormous risks, especially to the PA. The most obvious and immediate threats lie with the responses that can be expected from Israel and its most important foreign backer, the new Republican-led U.S. Congress. Many in Congress have made it clear that they intend to push for suspension of aid to the PA if it signs the Rome Statute. And Israel will surely ramp up its settlement expansion and likely once again withhold taxes it collects on the PA’s behalf. The resulting economic impact could very well lead to the PA’s collapse.

That outcome has been forestalled in the past by Israel’s recognition that the security and economic costs it would inherit would be exorbitant. Israeli officials not only allowed their own cooler heads to prevail, but also urged restraint on their friends in Congress. Despite the recent splash the Labor Party made by joining forces with peace process veteran Tzipi Livni, Bibi Netanyahu’s main challenge still comes from his right in the elections scheduled for mid-March, and he can’t afford to look soft on the Palestinians.

That certainly won’t help Abbas. He knows the dangers that confront him. Moreover, the approach to the ICC carries another risk. Even if Abbas survives the Israeli-U.S. response, it is very possible that Hamas will also face charges at the ICC. The case against Hamas, while covering crimes involving far less destruction and loss of life, is also more clear-cut than one likely to be brought by the PA against Israel, whose acts in Gaza and in the day-to-day occupation of the West Bank will require lengthy investigation. Should Hamas find itself on the losing end of the law before Israel does, Abbas’s position is likely to weaken further.

Despite his moves toward internationalization, Abbas still much prefers to work with Washington. U.S. fecklessness in the face of persistent Israeli opposition to any diplomatic initiative, however, has essentially brought him to this Rubicon. And his own clear reluctance to cross it will itself likely diminish the chance of success.

Under the Rome Statute, the Palestinians will not be able to formally file any cases with the ICC prosecutor for 60 days from the date of signing. That time will certainly be used by the Obama Administration, which will no doubt argue that such a filing could bolster the Israeli Right in the critical final days of the election campaign, to pressure the Palestinians against going forward. Still, the repeated failure of the Security Council to address the occupation in any substantive way, coupled with the failed history of the U.S.-brokered peace process, has sent the Palestinian people the message, however unintentionally, that diplomacy and cooperation are dead-end strategies. That is going to lead to more Palestinians embracing the violent paths called for by Hamas and other, considerably more militant, factions.

At the same time, Palestinians have seen the futility of armed struggle over the decades. Failure at the UNSC and joining the ICC — but then forgoing charges against Israel – will only increase Palestinian despair and desperation. That will no doubt lead to more of the kind of “lone wolf” attacks that Israelis endured in 2014.

The one party that could make a difference is the European Union (EU). It can exert serious pressure on Israel of a kind even the United States cannot match. The EU accounts for nearly one-third of Israel’s export business. (By comparison, the U.S. accounts for just under one-quarter). Labeling settlement products (as some EU countries currently require, but don’t generally enforce) could be a first step. And if it is couched as a warning that sterner measures are in the offing, the impact on Israeli thinking could be significant, perhaps even a game-changer.

Indeed, ultimately, that sort of European action is what Israel fears. If the Obama administration wants to see a reversal of the downward spiral its own peace-making efforts have helped create in Israel-Palestine, it could quietly encourage the EU in that direction.

Such a course would be wise. Abbas’s strategy of relying entirely on U.S. help to pull him through has clearly failed, and his reign, whether due to a P.A. collapse or just his own advancing age, will not last much longer. He has no clear heir apparent, so what comes after is a mystery. The United States won’t exert significant pressure on Israel in the near future, and, absent some unanticipated shock, Obama’s successors in the White House are unlikely to spend as much political capital as he has on resolving the conflict. The pressure must come from Europe and from the Palestinians using whatever international tools are at their disposal.

This is, after all, just what was always demanded of the Palestinians—that they pursue their goals without recourse to violence. If a peaceful path to statehood is denied them, ongoing and escalating violence is all we can expect to see.

This past Tuesday saw the latest in a horrifyingly long line of atrocities in Jerusalem. Two armed Palestinians entered a synagogue in the Har Nof neighborhood, killed five Israeli civilians and wounded six others before police gunned the murderers down. The reactions of Israeli and Palestinian leaders are worth examining.

Hamas, unsurprisingly, praised the murders. Palestinian Authority President Mahmoud Abbas, equally unsurprisingly, condemned them unequivocally. In his official statement, Abbas said that he “…condemns the attack on Jewish worshippers in their place of prayer and condemns the killing of civilians no matter who is doing it.”

But this didn’t stop Israeli leaders from continuing their campaign to demonize Abbas, the Palestinian leader who has tried harder, made more compromises and sacrificed more of his own credibility to achieve a two-state solution than any of his predecessors.

“Abbas has intentionally turned the conflict into a religious one between Jews and Muslims, and the systematic incitement he leads against Jews…is the ‘go-ahead’ for these despicable terror attacks,” said Foreign Minister Avigdor Lieberman on Nov. 18, the day of the attack.

Economy Minister Naftali Bennett meanwhile told reporters that “Abbas, one of the biggest terrorists to have arisen from the Palestinian people, bears direct responsibility for the Jewish blood spilt… while we were busy with delusions about the [peace] process… Abbas has declared war on Israel and we must treat that accordingly.”

Not to be outdone by the rivals within his own governing coalition, Prime Minister Benjamin Netanyahu said that “This [attack] is a direct result of the incitement lead by Hamas and Abu Mazen (Abbas), incitement that the international community irresponsibly ignores.” He also dismissed Abbas’ condemnation of the attack because Abbas had said: “While we condemn this incident, we also condemn the aggression toward Al-Aqsa Mosque and other holy places and torching of mosques and churches.” To Netanyahu, such a statement, though demonstrably based on factual Israeli actions and statements, is “incitement.”

Netanyahu didn’t stop there. He accused the Palestinians of “blood libel,” a term that refers to historical incidents where false charges against Jews of ritual murder were invented to incite anti-Jewish violence.

The vast majority of Netanyahu’s venom, and that of the other Israeli leaders was directed at Abbas, despite the shameful way Hamas applauded this heinous crime. There was a touch of irony to that, as on the same day of the attack, the head of the Shin Bet, the Israeli security agency charged with internal security, had declared quite clearly that “[Abbas] is not interested in terror and is not leading [his people] to terror. Nor is he doing so ‘under the table.’”

All of this raises a question: Why is the Israeli right ignoring the low-hanging fruit of Hamas and going full bore at Abbas instead? After all, Hamas praised the attack, and Netanyahu and company could easily have stopped at tainting Abbas with the argument that he was in partnership with the Islamists via the unity government. Instead, the Israelis went much farther, to the point of virtually ignoring Hamas and the other Palestinian factions who voiced support for the attack.

The explanation for this behavior involves both the long-term and the short-term. In the short run, this is all part of Netanyahu’s broader public relations campaign linking Iran, Hamas, the Islamic State and now the Palestinian Authority. This campaign has several goals: to make it politically impossible for the United States to work with Iran against Islamic State (ISIS or IS), to make a deal between Iran and the P5+1 countries more difficult, to forestall any further international scrutiny of the siege of the Gaza Strip and to legitimize harsher Israeli measures in Jerusalem, among other goals.

On most counts, the strategy is failing, with the usual exception that Israeli actions in Gaza and Jerusalem are being downplayed, although not totally ignored. But Netanyahu’s rhetoric is having more of an effect toward his long-term goal.

The endless refrain of “Iran is ISIS, ISIS is Hamas” is designed to use the universally despised Islamic State to further de-legitimize Iran and the Palestinians. The reasons for this are obvious: to paint both Hamas and Iran as such implacable enemies that Israel would be justified in any action taken against them. But Netanyahu’s rhetoric is gradually broadening its scope of Palestinian targets. By blaming incitement from Abbas and the Palestinian Authority (PA) for the recent attack in Jerusalem, and by repeatedly pointing out that the PA is now run by a unity government (however dysfunctional) that includes Hamas, Netanyahu is, in effect, subtly folding the PA into the “Hamas-ISIS-Iran” equation.

The strategy is working in Netanyahu’s target areas: Israelis at home and Israel’s supporters abroad, and Washington. After the synagogue murders in Jerusalem, John Kerry sounded just like Netanyahu when he blamed Palestinian incitement, clearly including the PA, for the attack. He was followed by a slew of Congress members from both parties, some of whom singled out Abbas by name.

This is part of the Israeli right’s “solution” to the Palestinian-Israeli conflict. It begins with rolling back the arrangements under the Oslo Accords. The vision is something similar to what existed before the Accords were signed in 1993. Israel would have full security control in the West Bank, and the PA would be reduced to an administrative body in the increasingly isolated Palestinian cities, towns and villages. Freedom of movement for Palestinians would be increased in the hope that their economic conditions would improve (possibly through increased Palestinian employment in Israeli businesses) and that this would be enough, with increased Israeli security, to maintain relative calm.

This is a shared vision among Netanyahu, Lieberman, Naftali Bennett, and numerous other right-wing figures in Israel, even though they each present it differently. It was sketched out in broad terms in the Israeli media recently. Another prize in the arrangement for Israel is that it would diminish the PA as the international representative of the Palestinians, thus blunting the gains the Palestinians have gotten through various international recognitions of their statehood. The PA would still exist, but it would be disconnected from the Palestinian street in the Occupied Territories. This would, indeed, resemble the pre-Oslo era.

Even if Netanyahu is ousted from the Prime Minister’s office in the near future (not likely, but possible given the current political waves in Israel), another right-wing leader would certainly be his successor. Thus, the rollback of Oslo would continue, as would the freeze in the peace process. And without a visible representative Palestinian leadership, international pressure for peace would diminish, simply because there won’t be anyone to press Israel to talk to (the United States, Europe and even the United Nations will not, in any foreseeable future, push Israel to talk with Hamas).

The Israeli right believes that this is a status quo that could be maintained indefinitely, with the occasional flare-up of violence with Gaza and sporadic, but disorganized attacks by individual Palestinians from the West Bank. And since right-wing leaders will be controlling Israel until an opposition that can sway the Israeli public toward a more moderate course coalesces, the vision will be pursued.

But we’re already seeing some of the reasons why this vision is unsustainable. Israeli radicals will continue to agitate for greater Jewish control of the Temple Mount, and any right-wing Israeli government cannot simply ignore them. That will lead to more and more individual acts of violence like the one this week in Jerusalem and the several that preceded it recently.

Perhaps the Israeli right thinks they can handle that as well, and they may be correct. But there is another aspect about the pre-Oslo existence that they may be overlooking.

The separation of the Palestinian masses from the leadership of the Palestinian Liberation Organization (PLO) in the 1980s led to the development of a more grassroots, locally based Palestinian leadership. It was that leadership, not the PLO, which created the first, and by far the more successful, Intifada. Palestinians have been yearning for a new leadership, and a new generation of leaders with popular support would be most welcome among them.

The first intifada was certainly not non-violent, but it relied much more on strikes, protests and civil disobedience than the second one did. Violence was a very minor aspect of it at first, until Yitzhak Rabin’s policy of “breaking the Palestinians’ limbs” increased it. Even so, the non-violent aspects of that uprising remained front and center. It was then that the United States, and soon after, Israel, embraced the idea of peace with the PLO, in order to end the intifada and to blunt and co-opt that new Palestinian leadership.

If such a leadership arose again, it would be impossible to ignore politically, even in Washington and Tel Aviv. But Palestinians need to hope for it, because if the Obama administration is so removed from this issue that it is willing to blame Abbas for acts that he has strongly condemned, then the Oslo rollback-vision will prove successful, and there will be even less pressure on Israel to compromise. But that would also present an opportunity for the new Palestinian leadership to encourage renewed international activism aimed at economically pressuring Israel. And that could bring real change.

There is, however, a very long road between that sort of hope and where we are right now.

Take a particularly provocative and grandstanding Israeli government and shift its focus from Hamas and Gaza to Jerusalem and you have a most explosive recipe. That potion is being stirred now, and the results could shake up the status quo in a way that we have only seen a few times in Israel’s history.

Much of the recent news narrative starts with the wounding of Yehuda Glick, a US expat who emigrated to Israel as child and became one of the leaders of the self-proclaimed “Temple Mount Movement.” In reality, this chapter of the endless and bloody saga of the Old City of Jerusalem began with the last Israeli election. That poll brought into power the most radically right-wing of Israeli governments, representing an odd mixture of zealous Zionism, modern Orthodoxy in Judaism and a curious impulse to completely disregard centuries of Jewish law regarding the Temple Mount. We’ll get back to that later, but first it’s important to recognize the potential fallout from further escalation.

The recall of Jordan’s ambassador to Israel is no small matter, and it reflects just how important this issue is to the Hashemite kingdom. Despite having lost the West Bank to Israel in 1967 and having relinquished its claim to it in 1988, Jordan is still the guardian of the Jerusalem holy sites for the Muslim world. This status is precious to the Hashemites, and the prestige it brings is a crucial element for their continued hold on power.

The Israeli threats have escalated steadily since the election and then ticked up sharply in the spring, when the Netanyahu government began its anti-Hamas crackdown throughout the West Bank, under the false cover of searching for kidnap victims the Israelis already knew had been brutally murdered. Tensions and demonstrations in Jerusalem were escalating throughout the summer, while everyone’s attention was, quite understandably, focused on Gaza.

This was the inevitable result of an intensely nationalistic government believing it had finally done away with the façade of negotiations in which Jerusalem was a central issue. Brazen statements, provocative visits, and then crackdowns and harsher limits on Palestinian worshippers at al-Aqsa Mosque were all to be expected.

One question that these events raise is whether this is the intention of Prime Minister Benjamin Netanyahu or the result of his unwillingness to challenge his coalition partners and members of his own party on a passionately populist issue. I tend to lean toward the latter belief, as Netanyahu has usually shown himself to be the sort of leader who does nothing unless he’s pressured by politics. In either case, the Israeli actions have raised concerns from Washington to Brussels to Cairo and, most resoundingly, to Amman.

Despite the peace treaty with Israel being massively unpopular in Jordan, where the majority of the citizens are Palestinian, it has not been a cause for major internal upheaval. For Jordan, peace has not only brought financial and diplomatic support from the United States, it has also opened up a new market with Israel, which exports goods to Jordan and thereby to the rest of the Arab world, despite the ongoing regional boycott against Israel.

Tinderbox

But now there is unrest and unease in Jordan. King Abdullah’s support of the United States’ efforts against the Islamic State (ISIS or IS) has helped rile some of the more radical elements in Jordan, adding to the tensions that already existed between the government and more mainstream Islamist groups such as the Muslim Brotherhood. The country is undergoing a severe economic crisis, with massive unemployment, even while it is also burdened with refugees from Syria and Iraq, many of whom have sharp complaints about their treatment.

These conditions make Jordan a tinderbox. And Jerusalem is just as sure a fuse for a Jordanian tinderbox as it is for an Israeli-Palestinian one. These are the factors that led King Abdullah to recall his ambassador from Israel. Only once before, when Israel attempted to assassinate Hamas leader Khaled Meshal in Jordan, has peace between Jordan and Israel been so threatened.

The Israelis have surely given this consideration, but they likely estimate that Jordan would not dare abrogate its treaty with Israel. Such a move would surely endanger Jordan’s support from the US, and that could be fatal if, indeed, internal conflict does break out in the Hashemite kingdom. Ultimately, Israel probably believes that unless it tries to threaten the authority of the Islamic Waqf, which is the body that administrates the Temple Mount, or otherwise officially changes the status quo of the area, Jordan will not withdraw from the treaty.

That’s a reasonable assessment, but it should not be banked on too strongly. Given the precarious situation in Jordan, its leadership’s main concern now is avoiding an outbreak of civil conflict altogether. Even though the Jordanian military is far superior to that of, say, Iraq, a popular uprising triggered by conflict over the Jerusalem holy sites could quickly spread to encompass the mass dissatisfaction with both the economic conditions and Hashemite rule in the country in general. Abdullah does not want to gamble on his ability to contain all of that anger. Though unlikely, that concern does give him a reason to potentially take the bold step of ending peace with Israel, and deal with the consequences of that step later.

For Israel, such an outcome would mean near-total isolation again. Even the Sisi government in Egypt would have a difficult time continuing to work with Israel all by itself. Egyptians remember well the isolation they experienced from the rest of the Arab world after their treaty with Israel was first struck. It took a very long time, even after they were re-admitted into the Arab League, for Egypt to regain a position of some stature in the Arab world.

New Path

The entire approach the international community has taken toward Jerusalem needs to re-evaluated, and quickly. For years, Israel has treated Jerusalem as a flashpoint it could manipulate for nationalistic reasons, and for a long time, young Palestinian Muslims (sometimes all of them under the age of 50, other times the cutoff age has been as low as 35) have been unable to go to pray at the al-Aqsa Mosque. To be sure, there have also been many incidents of Palestinians using Friday prayers as a launching pad for protests and stone-throwing, sometimes down the hill at Jewish worshippers at the Western Wall.

Now, Jerusalem is being used by different parts of Israel’s governing coalition. The further right elements are crystallizing nationalist fervor around it. Netanyahu, for his part, is using the violence that Israeli actions are stirring up to blame Palestinian Authority (PA) President Mahmoud Abbas as part of his campaign to convince people that all of Israel’s opponents—IS, Iran, Hamas, and the PA as led by Abbas—are essentially the same enemy of not only Israel, but the entire world. And, of course, Hamas, and Fatah as well, are using the Israeli actions as a rallying cry, spurring people to both organized and individual acts of resistance and/or terrorism.

But it’s high time reality set in and we understood this to be an issue of nationalism manipulating religion to its ends. Many of the Jewish Temple Mount activists claim that they are pursuing a civil rights issue. After all, they argue, if the Muslim right to pray at their third holiest site is sacrosanct, shouldn’t the Jewish right to pray at their holiest site be at least as high a priority?

Sorry, but that’s not what this is about. Religious Zionism has twisted many Jewish precepts over the years. But even Israel’s chief rabbis have reiterated continuously that Jews must not pray on the Temple Mount or even walk upon it for fear of treading upon the area of the Holiest of Holies, which was inside the Temple and where only the High Priest may enter.

Religious Zionists are split on this issue, as some religious leaders have, in a rather arbitrary fashion, decided that going up to the Temple Mount is acceptable. And, it must be noted, that this notion is an entirely modern phenomenon. It is only in recent years that even religious Zionists have tried to completely negate this particular tenet of Jewish tradition, which has been undisputed for most of our history.

As with so many issues regarding Israel, this is not about Judaism. In fact, it’s not about the terms of much of mainstream Zionism, either. It is a brazen effort by far-right nationalists, some because of a radicalized messianism, some with more secular motivations, to lay claim to Jewish rule over Jerusalem as a whole. It is of a piece with the escalating efforts by Jewish Israelis to spread the colonization of East Jerusalem in the hope of making a unified, Jewish Jerusalem a fait accompli.

Israel is playing with fire on a number of levels here, with the Palestinians and with the broader Arab and Muslim worlds. Thus far, the government has been justified in its belief that the United States and Europe would do nothing more than issue the usual condemnations, not recognizing that Israel’s actions could make compromise on Jerusalem a practical impossibility.

But at some point the US and EU must recognize that if Israel continues to increase its antagonism on the issue of Jerusalem, it’s going to radicalize a lot more than just the Palestinians in East Jerusalem, as well as complicate their efforts against IS and other concerns in the Arab World. If they don’t take some action to reign Israel in soon, they will also be paying the consequences.

The obsession in politics and diplomacy with decorum–largely a relic from the past–can easily distract people from the realities of the present. Case in point, the uproar over Jeffrey Goldberg’s latest article in the Atlantic, the headline of which, The Crisis in U.S.-Israel Relations Is Officially Here, would seem important enough to warrant more attention than it has gotten so far.

Instead, the whisper of an unnamed “senior Obama administration official,” who called Netanyahu a “chickenshit,” has occupied headlines. And instead of taking a strong, or even a weak stance on Netanyahu’s repeated declarations about expanding settlement activity everywhere in Jerusalem and the West Bank, the White House has only tried to distance itself from the remark, describing it as “unauthorized” and “inappropriate.”

As Goldberg himself pointed out, the fact that Bibi is a chickenshit is not entirely a bad thing. Whatever else it does, it also makes him quite afraid to back up his rhetoric with action. Even in Gaza this summer, the ongoing slaughter seemed, from Netanyahu’s point of view, to be something that spiraled much further out of control than he had intended. Indeed, his constant shifting of the mission’s goal posts indicated the lack of any sort of planning beforehand. Political pressures kept driving him on, as they do with most of his actions. But at least the “chickenshit” was never going to attack Iran despite his bellicosity, as the United States seems to finally understand.

Being less of a leader and more of a leaf blowing in the political wind is an apt description of Netanyahu, and it is strongly suggested in Goldberg’s piece. But it also applies to the Obama administration, which has repeatedly refused to use the tools it has at its disposal to create real pressure on Israel to, at the very least, desist from its actions that are obviously intended to destroy any possibility of a two-state solution. So, chickenshit cuts both ways.

Maybe Goldberg intended the chickenshit comment to overshadow the rest of his point, maybe he didn’t. But the assertion that we are in a period of crisis for US-Israel relations is a very important one. The question is: are we?

The simple answer is no, but Goldberg is not wrong in suggesting that such a crisis could occur in the near future. One can understand why Goldberg focuses so much on personal clashes. Never in the history of Israel has there been a government that so arrogantly insulted the United States so frequently. Whether it’s Netanyahu, Finance Minister Naftali Bennett, Defense Minister Moshe Ya’alon, or some other member of the Knesset, anti-American statements have risen to unprecedented levels.

For their part, US officials have been getting just the tiniest bit harsher in their criticism of Israel, while Israeli officials escalate their anti-US rhetoric. And then there’s the endless stories about how much Obama and Netanyahu dislike each other, with Goldberg’s in the lead. The problem, of course, as it is presented in this narrative of interpersonal conflict, is bad communication, or mismatched personalities.

In reality, none of this is really about Bibi and Barack disliking each other. They do, but that is beside the point. It is the direction that Israel has decided to go in that is the problem.

Let’s start off by noting that the degree of the “crisis” is being massively overblown. There is a much bigger problem in Europe for Bibi than there is in the United States. The Europeans are actually threatening to take some action, not just calling Bibi names in whispers to reporters. Sweden’s recognition of Palestine as a state is just a first step in a series of actions that might be on the horizon from Europe, where Israel conducts the biggest share of its trade. When the United States gets to that point, as it has on occasion in the ever more distant past, then we can start wondering if there is a crisis in relations that might cause some small shift in the status quo.

The “chickenshit” epithet can apply to Obama just as much as it can to Netanyahu. He is a president with a non-confrontational style trying to govern with what is, arguably, the most defiant and combative Congress any president has ever had to deal with. And he is dealing with an Israeli government that is pursuing a very different strategy than its predecessors. The Israel of today no longer cares about the majority of the Jewish community in the United States. This Israel, correctly, determined that its ultimate desire to completely thwart a two-state solution and maintain an apartheid system over the Palestinians would never be acceptable to most American Jews. But most US Jews weren’t the ones providing the political power and, more importantly, the funding for congressional campaigns and for settlements in the West Bank.

The Jews that do provide these things, as well as the Christians, are right-wingers, either in their general politics or at least on Middle East policy (including policy toward the entire Arab world, Iran and Turkey). They are now the only ones Israel cares about. More liberal-minded devotees are not, at this stage, providing that much support for Israel, either economically or financially. Those of them who do provide this support will continue to check their otherwise liberal values at the Israeli door. The rest are not, in the estimate of the Netanyahu government, worth the compromises that must be made to garner their support.

In this circumstance, Israel has a freer hand in its actions. While Netanyahu announces more and more building plans in East Jerusalem and other sensitive parts of the Occupied Territories, Republicans, who stand a good chance of controlling both houses of Congress, are not criticizing Israeli actions in the slightest. Instead, as one would expect, they are attacking Obama for his insufficient support of Israel.

In this context, Israeli journalist Roi Ben-Yishai, one of Israel’s best, recently reported on Israel’s “new approach” to the Palestinians. It holds few surprises. Israel is not intending to return to talks, correctly believing they will be futile, and therefore would only make things worse. Israel’s assessment will remain correct until its own positions can be moderated by pressure like that of the Palestinians over the years.

The plan is then to have the quiescent Palestinian Authority (PA) assume control over Gaza and reinforce its control on the West Bank. In other words, marginalize Hamas throughout the Palestinian body politic. Under those circumstances, Israel would end the siege of Gaza and ease restrictions on movement in the West Bank as well. The idea is that the Palestinians can then build a functional economy, which Israel believes will cause the Palestinian people to oppose actions that could draw Israeli military reprisals. I rather doubt that would be the result, but right now, the delays in Palestinian international action imply that PA President Mahmoud Abbas is cooperating with Israel and Egypt on this effort, probably in the hope that this strategy would eliminate Hamas as a political rival.

This seems like another doomed plan, one that harkens back to old Israeli beliefs that Palestinian nationalism will eventually just go away. But we must recognize that this is happening with the silent approval of the United States. Egypt, in particular, would not work with Israel on such a plan if it believed that the United States would object. More to the point, the plan is also intended to provide the US with what it wants most: Palestinian silence. What American policy has always represented is the complete lack of importance placed on the welfare of the Palestinians, or anyone else (including ordinary Israelis) in the region, for that matter. The entire issue is only relevant insofar as it affects more “important” US concerns.

So, the Obama administration will likely allow Israel to proceed with its plans, even if it doesn’t believe those plans are likely to succeed. This is evident in the lack of material response to Israel’s direct challenge to the international consensus on a two-state solution.

The name-calling most recently highlighted by Goldberg merely reflects these disagreements and the fact that the increasingly populist and rightward tilt not only in the Israeli government but also in its population leads to verbose criticism of US officials, up to and including the president. Responses to such insults can be countered by Israel’s power in Congress in a way that more fundamental policy differences cannot. That frustrates some American officials, but it doesn’t provoke any material US response.

If Congress persists in pressuring the administration on its Iran policy, a pressure which most understand as directed by Jerusalem, Obama may well respond through the Palestinian issue. In that case, we might see a more direct counter to Israeli policies, such as a Security Council resolution condemning the settlements or even an “Obama Plan” basing a two-state solution on the 1967 borders and sharing Jerusalem. That would be a turn of events not seen in decades, but Israel has also never worked so hard to undermine US goals on foreign policy matters as it has on Iran.

But make no mistake, if the Palestinians get any respite from the Obama administration it will be because of Israel’s meddling through Congress on the Iran issue. It will not be due to any Palestinian action, much less on the insulting attitude of Israeli officials or the personal dislike between the current Israeli leader and the president of the United States. It is, ultimately, all about policy priorities, not personalities.

A former senior analyst for Mossad, Yossi Alpher, told an audience in Washington Thursday that Israel sees the Islamic State (ISIS or IS) as an “urgent” national security concern, but the context of his talk at the Wilson Center implied that the extremist Sunni group does not top any Israeli list of threats. In fact, Alpher seemed to suggest at times that the actions of IS, particularly in Iraq, may ultimately benefit Israel’s regional posture, particularly with respect to Iran. He also called the American decision to intervene against IS “perplexing.”

Iran, unsurprisingly, topped Alpher’s list of “urgent” Israeli security threats, but he downplayed the prospect of a nuclear deal being struck by the Nov. 24 deadline for the negotiations and focused instead on the “hegemonic threat” Iran allegedly poses. Indeed, the former director of Israel’s Institute for National Security Studies was mainly concerned with an Iran strengthened by close alliances with Iraq and Syria as well as Hezbollah in Lebanon and now potentially expanding its reach into Yemen, whose Houthi rebels have made major military gains in recent weeks.

Alpher identified the threat of extremist/terrorist organizations as Israel’s second-most urgent threat, but within that category he placed Hamas and Hezbollah ahead of IS. He allowed that IS “threatens to reach very close” to Israel, particularly if it manages to make inroads in Jordan, where polls indicate that a significant minority of the population does not see IS as a terrorist group, and where there has been vocal opposition to King Abdullah’s support for the US-led anti-IS coalition. Indeed, Alpher suggested that Israel should try to defuse current tensions over the Temple Mount, which have caused Abdullah to suffer politically at home, in order to forestall an increase of IS sympathy within Jordan.

Several of Alpher’s later remarks seemed to suggest that the activities of IS in Syria (at least those that have targeted Syrian President Bashar al-Assad) and in Iraq may actually pay dividends for Israel. If the primary threat to Israel’s security is, as Alpher claims, Iran, and not just Iran’s nuclear program but also its regional hegemonic aspirations, then any movement that opposes Assad—a long-time Iranian ally—and that threatens the stability and unity of Iraq—whose predominantly Shia government has also developed close ties with Tehran—is actually doing Israel a service. It apparently doesn’t matter if that group might also someday pose a threat to Israel. It’s in this context that Alpher described America’s decision to intervene against IS as “perplexing.” He questioned the US commitment to keeping Iraq whole, noting that an independent Kurdistan would be “better for Israel,” and said that, as far as Syria’s civil war is concerned, “decentralization and ongoing warfare make more sense for Israel than a strong, Iran-backed Syria.”

The tone of Alpher’s remarks on IS echoed a number of recent comments from top Israeli government and military figures. Earlier this month, the IDF’s chief of staff, Lt. General Benny Gantz, told the Jerusalem Post that “the IDF has the wherewithal to defend itself against Islamic State,” and then went on to describe Hezbollah as Israel’s most immediate security concern. Israeli Defense Minister Moshe Ya’alon also told PBS’s Charlie Rose on Sunday that Israel is contributing intelligence to the anti-IS coalition, but suggested that it was doing so because it has “a very good relationship with many parties who participate in the coalition,” not because it perceives IS as a near-term threat to Israel. Finally, Israeli Prime Minister Benjamin Netanyahu’s speech to the UN General Assembly on Sept. 29 made several references to IS, but only as a secondary threat to Iran’s alleged nuclear weapons program or in conflating IS with Hamas and, really, every other Islamic extremist group in the world.

Alpher made pointed criticisms of the US-led effort against IS in an exchange with Wilson Center president and former House member, Jane Harman, who pushed back against his characterization of US “mistakes” in the region. He was particularly critical of the Obama administration’s handling of Egypt, arguing that it “made things worse” by failing to support the Mubarak regime in 2011 and trying instead to “embrace” the democratically elected (and now imprisoned) Muslim Brotherhood leader Mohamed Morsi, and then by failing to welcome the military coup that eventually put current President Abdel Fattah el-Sisi in office.

Harman questioned whether a stronger show of American support for the increasingly authoritarian direction of Egypt’s politics would hinder any effort to counter the anti-Western narrative upon which much of IS’ support and recruitment is based. Alpher’s answer, and indeed a recurring theme in his remarks, was that the question of narratives and terrorist recruitment is irrelevant to an Israeli security framework that is focused only on the most immediate threats (or, as he put it, “on what will bring short-term stability”).

The emphasis on the short-term is one of the defining features of Netanyahu’s term in office, particularly in his dealings with the Palestinians, but also in Israel’s broader security posture, and it may well cause greater problems for Israel in the long-term.

The international media is currently mesmerized by the advance of Daesh (ISIS or ISIL) on the Syrian city of Kobani near the Turkish border, but Arab states and the US need to look beyond Kobani’s fate and Daesh’s territorial successes and defeats. The crumbling Levant poses a greater danger than Daesh and must be addressed—first and foremost by the states of the region.

The British colonial term, Levant, encompasses modern-day Iraq, Syria, Lebanon, Jordan, and Palestine, with a total population of over 70 million people. The population—mostly young, unemployed or underemployed, poor, and inadequately educated—has lost trust in its leaders and the governing elites.

The Levant has become a bloody playground for other states in the greater Middle East, including Egypt, Saudi Arabia, Qatar, the UAE, Iran, and Turkey. While dislocations in the Levant could be contained, the regional states’ involvement has transformed the area into an international nightmare. The resulting instability will impact the region for years to come regardless of Daesh’s short-term fortunes.

The Levantine state has become marginalized and ineffectual in charting a hopeful future for its people, who are drifting away from nationalist ideologies toward more divisive, localized, and often violent manifestations of identity politics. National political identity, with which citizens in the Levant have identified for decades, has devolved mostly into tribal, ethnic, geographic, and sectarian identities.

The crumbling state structure and authority gave rise to these identities, thereby fueling the current conflicts, which in turn are undermining the very existence of the Levantine state.

The three key non-state actors—Daesh, Hezbollah, and Hamas—have been the beneficiaries of the crumbling states, which were drawn up by colonial cartographer-politicians a century ago.

Although the so-called deep security state has been able to maintain a semblance of order around the national capital, the state’s control of territories beyond the capital is fading and is rapidly being contested by non-state actors.

This phenomenon is readily apparent in Baghdad, Damascus, Ramallah, and Gaza, partially so in Beirut, and less so in Amman. Salafi groups, however, are lurking in the background in Jordan, Lebanon, and Palestine ready to challenge state authority whenever they sense a power vacuum.

Political systems in the Levant are often propped up by domestic ruling elites, regional states, and foreign powers for a variety of parochial and transnational interests. More and more, these ruling structures appear to be relics of the past. A key analytic question thus presents itself: How long would they survive if outside economic, military and political support dries up?

Levant regimes comprise a monarchy in Jordan; a perennially dysfunctional parliamentary/presidential system in Lebanon; a brutal, teetering dictatorship in Syria; an autocratic presidency in Palestine; and an erratic partisan democracy in Iraq. They have subsisted on so-called rentier or “rent” economies—oil in Iraq, with the rest dependent on foreign aid. Providers of such aid have included Gulf Cooperation Council (GCC) countries, Iran, Turkey, the United States, the EU, Russia, and others.

Corruption is rampant across most state institutions in the Levant, including the military and the key financial and banking systems. For example, billions of dollars in US aid to Iraq following the 2003 invasion have not been accounted for.  According to the New York Times, American investigators in the past decade have traced huge sums of this money to a bunker in Lebanon.

The collapse of the Levant states in the next decade is not unthinkable. Their borders are already becoming more blurred and porous. The decaying environment is allowing violent groups to operate more freely within states and across state boundaries. Daesh is causing havoc in Iraq and Syria and potentially could destabilize Jordan and Lebanon precisely because the Levantine state is on the verge of collapse.

As these states weaken, regional powers—especially Saudi Arabia plus some of its GCC junior partners, Iran, and Egypt—will find it convenient to engage in proxy sectarian and ethnic wars through jihadist and other vigilante mercenaries.

Equally disturbing is that US policy toward a post-Daesh Levant seems rudderless without a strategic compass to guide it. It’s as if US policymakers have no stomach to focus on the “morning after” despite the fact that the airstrikes are proving ineffective in halting Daesh’s territorial advances.

Kobani aside, what should the Arab states and the United States do about the future of the Levant?

1)  Iraq.  If the Sunnis and Kurds are to be represented across all state institutions in Iraq, regional states with Washington’s help should urge Prime Minister Haider al-Abadi to complete the formation of his new government on the basis of equity and fairness. Government and semi-public institutions and agencies must be made accountable and transparent and subject to scrutiny by domestic and international regulatory bodies. Otherwise, Iraq would remain a breeding ground for terrorists and jihadists.

2)  Syria.  If Washington remains committed to President Bashar al-Assad’s removal, it should end its Russian roulette charade toward the Syrian dictator.  Ankara’s view that Assad is more dangerous in the long run than Daesh is convincing and should be accepted and acted upon.

If removing Assad remains a serious policy objective, is the US-led coalition contemplating the implementation of a no-fly zone and a security zone on Syria’s northern border any time soon to facilitate Assad’s downfall?

3)  Lebanon.  If Hezbollah and other political parties do not play a constructive role in re-establishing political dialogue and stability in Lebanon, it won’t be long before the Daesh wars enter the country. Are there regional and international pressures being put on Hezbollah to end its support of Assad and disengage from fighting in Syria?

The upcoming presidential election would be a useful barometer to assess the key Lebanese stakeholders’ commitment to long-term stability. If no candidate wins a majority, does Washington, in conjunction with its Arab allies, have a clear plan to get the Lebanese parliament to vote for a president?

Unless Lebanon gets its political house in order, religious sectarianism could yet again rear its ugly head in that fragile state and tear the country apart.

4)  Palestine.  If the Obama administration urges Israel to facilitate a working environment for the Palestinian national unity government, to end its siege of Gaza, and dismantle its 47-year occupation, Palestine would no longer be an incubator of radical ideologies.

An occupied population living in poverty, unemployment, alienation, repression, daily humiliation and hopelessness, and ruled by a corrupt regime is rarely prone to moderation and peaceful dialogue. On the contrary, such a population offers fertile recruiting ground for extremism.

5)  Iran and Saudi Arabia.  It is in the United States’ interest to engage Iran and Saudi Arabia—the two countries that seem to meddle most in the Levant—in order to stop their proxy wars in the region. These sectarian wars could easily lead to an all-out military confrontation, which would surely suck in the US and other Western powers. Israel would not be able to escape such a conflict either.

The Saudi government claims that it opposes Daesh. Yet one would ask: Why hasn’t the Saudi clerical establishment denounced—forcefully and publicly—Daesh’s ideology and rejected the so-called Islamic State Caliphate? Why is it that thousands of Daesh-jihadists are from Saudi Arabia and neighboring Gulf countries?

6)  Development.  Since Levant countries face high unemployment, it’s imperative to pursue serious job creation initiatives. Arab states, with Washington’s support, should begin massive technical and vocational education programs and entrepreneurial initiatives in the Levant countries. Young men and women should be trained in vocational institutes, much like the two-year college concept in the United States.

Vocational fields that suffer from shortages in Levant countries include plumbing, carpentry, home construction, electricity, welding, mechanics, automotive services, truck driving, computers and electronics, health services, hotels and tourism, technology management, and TV and computer repairs. Services in these fields are badly needed. But thousands of young men and women have yet to be trained to fulfill these needs.

In addition to vocational training, wealthy Arab countries should help the Levant establish funds for entrepreneurial, job-creation initiatives, and start-ups. A partnership between government and the private sector, with support from the US and other developed countries, could be the engine that drives a new era of job creation and economic growth in the region where the Daesh cancer is metastasizing.

Let’s be clear, the United States has significant leverage to help implement these policies should American leaders decide to do so. Yet one could ask why the US should make such a commitment. If Daesh is primarily a threat to Levantine countries, why can’t they deal with it? These are fair questions but, as we have discovered with Ebola, what happens in Liberia doesn’t stay in Liberia. A crumbling Levant will have ramifications not just for the region but for the United States and the rest of the world as well.

When I started getting serious about action on the Israel-Palestine conflict and the associated US foreign policy, I found it imperative to convince people that the Oslo Accords were doomed to fail. There were the obvious critiques of the accords: the lack of any sort of human rights framework, the absence of consequences for failing to abide by conditions or fulfill agreed upon commitments, and the formal recognition of Israel without any mention whatsoever of a potential Palestinian state. But I saw an even bigger obstacle.

Conventional wisdom has it that Jerusalem is the most difficult stumbling block. But I have always maintained that it is the Palestinian refugees that were the most serious obstacle to a negotiated solution.

When various compromises were discussed about Jerusalem, they were always regarded as controversial and difficult to sell. Yet in my experience, people on both sides saw pretty clearly how a compromise could be crafted. Israel was willing, at least in the past, to permit the Islamic Waqf to continue administering the Temple Mount while official sovereignty would belong to both sides–the Old City would be divided and the border of East and West Jerusalem would be part of the agreement on borders more broadly. No one thought this would be easy, of course, but Israel appeared willing to compromise on this issue, in part because it understood that this was not just a Palestinian issue, but one that the entire Muslim population of the world had a stake in. The parameters of an agreement were visible.

When the matter of the Palestinian refugees came up on the other hand, there was a visible disconnect between the sentiments among the Palestinians, both in and outside the Occupied Territories, and the diplomatic framework that was being discussed. Many observers believed that the path forward on the refugees was clearer than that for Jerusalem, even though this was an area that Israel, no matter who was in the prime minister’s office, was going to be a lot less flexible on.

They believed that to be the case because, from available evidence, it seems that Yasser Arafat was assuring the Israelis and Americans that he was prepared to essentially sacrifice the refugees’ right of return settling for some token number returning to Israel while the rest would get some sort of compensation package and some limited option of returning to the presumed Palestinian state. This was, of course, not what he was telling the Palestinian people, to whom he continually pledged that he would not compromise on the right of return.

While many hold Arafat responsible for the disconnect between diplomacy and reality, obviously not without some justification, the real problem was the disinterest that Israeli and US diplomats routinely showed toward the Palestinian people. One need go no further than to read books by key figures such as Dennis Ross or Aaron David Miller. While the complexities of Israeli politics were always dealt with in careful detail, the Palestinian side was ignored to such an extent that virtually everything you see in the writings of these and other diplomats of the day about Palestinian opinion was obtained simply by asking the Palestinian leaders. Can anyone imagine Israel being approached that way?

The Palestine Liberation Organization leadership (PLO) under Arafat was neither prepared to hold the difficult national dialogue about possible compromise on the refugee issue nor to admit to their Israeli and US interlocutors that the right of return was as core a national Palestinian value as the land itself and that public sentiment strongly opposed the sort of compromise that Israel had, not without reason, come to expect.

This held true after Arafat’s death and Mahmoud Abbas’ assumption of the leadership. In truth, even Hamas has not specifically spoken about the refugees very often, although that is largely because its agenda, unlike the PLO after the mid-1970s, remained focused on liberating all of Palestine, which would mean the refugees could simply return. The result is that the national conversation on this issue never occurred, and all through the Oslo talks, even if one believed they had any chance of going anywhere, the refugee issue hung over the table like a pendulum with a razor-sharp blade, coming nearer to splitting the table with every passing swing.

The biggest danger was that, in the case of a miracle where Israel and the Palestinians were able to agree on a lasting peace deal, the refugee issue would shatter it. In several incidents, most recently with the revelations contained in the “Palestine Papers,” confirmation of the framework around the refugees caused great concern among Palestinians.

It is not always easy for others, including myself, to fully grasp the importance of the refugee issue to Palestinians. Nor is it fully understood by others how deeply Israeli Jews fear this issue. For the Palestinians, refugees are a deeply personal as well as a national issue. After all, the accepted estimate of the number of Palestinian refugees is approximately five million, and the total global population of Palestinians is eleven million. So, pretty much every Palestinian has refugee relatives, many of them living outside the Palestinian Territories. Families, in other words, have been sundered for 66 years.

Palestine-Refugee-KeyThen there is the reality, often vastly underestimated, of how central the refugees are to Palestinian nationalism. They are as core a value as the land, Jerusalem, anything. The key to the lost home in Palestine is the overriding symbol of Palestinian nationalism, and it is the symbol of the refugee.

This is not to say that some practical and negotiated agreement cannot be reached on the issue. But thus far, that hasn’t been even remotely attempted. Instead, Israel has insisted that the right of return be forfeited and their Western allies have concurred, as have, in a more circumspect fashion, many of the regional Arab leaders, Lebanon being the main exception. That makes the issue even more sensitive, if that is possible, because for most Palestinians, the framework in which the refugees have been discussed is a surrender, and one that they do not believe the PLO leadership has the authority to make (many Palestinians argue that the right of return is an individual as well as a collective right and as such cannot be negotiated away in a collective bargaining framework. There is considerable basis for this argument).

What is needed is a national conversation, and that will take time. The debates need to happen in communities, in coffee shops and in mosques as well as on the internet and in the halls of the Palestinian Authority. Over time, a general consensus of what is and is not going to be tolerable for the majority of Palestinians, including the refugees themselves, will emerge. From there, realistic negotiations on the issue can manifest.

This needs to happen because it is the only way to turn the refugee problem from a poison pill that would almost certainly torpedo any agreement into part of the solution. The Israeli public also needs to know what the Palestinians want from the right of return.

There is no subject that the Israeli Jewish public is more united and rejectionist on than the refugee issue. Outside of the radical anti-Zionist left–a small portion of the population–you will be hard pressed to find an Israeli Jew who would agree to any significant return of refugees. You’ll find it equally difficult to find an Israeli who would acknowledge any right of return. The refugees, you see, touch on the most intimate identity crisis for Israeli Jews: the fact that Israel could have only come into existence by forcing hundreds of thousands of Palestinians out.

This “original sin” is not something that Israelis can simply live with as we in the United States can live with the legacy of slavery and the genocide of the native population here. In the US, we have left too few natives to be worried about any claims to the land, and they are far too disempowered. Slavery is considered a historical shame, but the ongoing issues of racism are largely seen by whites as the legacy of Jim Crow laws (read: apartheid) rather than of slavery. These horrific crimes are regarded by most of the white US as history, however sordid.

Israeli Jews cannot do that. No doubt, the leaders of the Zionist movement in the 1940s believed that, by now, the Palestinians would have resettled in various Arab countries and that Israel could make peace with that past in a similar way to the United States. But that view did not take into account the fact that Palestinians were going to be in refugee camps nearby, would refuse to assimilate (or be barred from it) into the countries they fled to, and would maintain a sense of national identity that kept them–much like Jews throughout the centuries–as strangers in strange lands.

The reality of the Palestinian exodus from Palestine from 1947-49 was largely known in Israel all along. In the late 1980s, Israel’s “New Historians” produced controversial, but generally accurate tomes documenting that the Palestinians did not leave of their own volition or in response to broadcasts from Arab leaders telling them to do so. They either fled or were very frequently driven from their homes.

Many Israelis are aware of all this. But, as with most nations, the people of Israel want desperately to believe in the righteousness of their country’s creation. Moreover, there is enormous fear of what the world would think if this history became more commonly known, especially in the United States and other friendly Western countries where, among supporters of Israel, this history is largely unknown or papered over with some rather incredible myths (e.g., the Palestinians of 1948–all 800,000 and more of them–just picked up and left). Even acknowledging the Palestinian right of return threatens this, creating a situation where history, even when known, produces a visceral discomfort and threatens the Jewish self-image of a just and decent people trying to finally create a home for ourselves.

By itself, that could be overcome. But for Israelis, that sensitivity is piled on top of a fear of Palestinian return that borders on hysteria. And this fear is greatly exacerbated by the lack of clarity about Palestinians’ ambitions regarding the right of return. Israeli Jews treasure, more than anything else, having a homeland where they are the majority. Having such a homeland is also very important to many Jews living in the diaspora. That importance is every bit as strong as worldwide Muslim concern over the fate of Jerusalem.

Israelis are desperately afraid that if they cease blocking the right of return, even to the extent of merely acknowledging the existence of such a right, there would be a massive influx of Palestinian refugees into Israel, which would ultimately make Jews a distinct minority. True, many argue, Jews are doing pretty well as a minority in many countries; but many countries in the world are completely bereft of any Jewish population, especially in the Arab world. And, while they won’t name it, Jews also have the same visceral fear of Palestinians that white South Africans, whites in the US and in other places have had of those they oppressed: the fear that anger over those years of oppression will result in yet another incident of Jewish persecution.

It’s easy for me to say that the fear is born only out of prejudice and misplaced feelings, that the truly hateful among the Palestinians, like the truly hateful among the Jewish Israelis can be dealt with much more efficiently when Palestinian grievances, so long left to boil, are finally addressed. But for most Israelis and Jews in many other places, they look at the former Yugoslavia or Rwanda, places where the cycle of oppression kept spinning with death greasing the wheel. Given Jewish history, it’s an understandable fear.

But it’s also a fear that must be dealt with, not pandered to. When Arafat convinced Israelis that the PLO had backed off liberating all of Palestine and would settle for the lands Israel conquered in 1967, it made a big difference in Israeli perceptions of Palestinians. Even in the toxic atmosphere of 2014, such clarity from the Palestinians on refugees would have a similar effect. This will be true even if the Palestinians’ stance turns out to be (as I believe it would if the popular will was reflected) that each and every refugee should be offered the options of return, return to a Palestinian state (if a two-state solution is ever reached) or compensation, and it is up to each to choose for her or himself. At least Israel would know what the bargaining position is.

The International Crisis Group undertook what I consider to be the first serious effort at finally taking the veil off this critical issue by releasing a report entitled, “Bringing Back the Palestinian Refugee Question,” on Oct. 9. It is a serious and pragmatic analysis of what Palestinian leaders and people can do to begin to bring this question out of the shadows and, crucially, to the center of diplomatic efforts. The recommendations include renewing and revitalizing local leadership councils in refugee camps, improving conditions for refugees as well as supporting refugees in building lives wherever they are without worrying that they are sacrificing their claims as refugees, and beginning the sort of national dialogue I have been discussing.

Now is the perfect time for such efforts, although Israel and the United States will oppose them. Even Abbas has realized that his old strategy has failed and he needs a new one. Refugees, long marginalized, have an opportunity to raise their voice and have it impact Palestinian negotiators in the future. And, despite the fact that Israelis would be vexed by such a development, it is an absolute necessity if there is ever to be a resolution to this conflict, be it one state, two state or whatever else.

This strategy will be uncomfortable for the Palestinian Authority. But it must materialize for the region to move towards substantive rather than illusionary visions of peace. We must hope that good sense can overcome fear.

Last week I commented on the unhelpful habit of throwing everything Islamist, no matter how extreme or moderate, into a single conceptual bucket and writing off the whole lot as incorrigible adversaries. That habit entails a gross misunderstanding of events and conflicts in the Middle East, and has the more specific harm of aiding extreme groups at the expense of moderate ones. Shortly afterward Dennis Ross of the Washington Institute for Near East Policy presented a piece titled “Islamists Are Not Our Friends,” which illustrates almost in caricatured form some of the misleading attributes of the single-bucket attitude that I was discussing.

Ross’s article probably is not grounded in Islamophobia, although it partly appeals to such sentiment. The piece ostensibly is about how “a fundamental division between Islamists and non-Islamists” is a “new fault line in the Middle East” that provides “a real opportunity for America” and ought to guide U.S. policy toward the region. In fact it is a contrived effort to draw that line—however squiggly it needs to be—to place what Ross wants us to consider bad guys on one side of the line and good guys on the other side. The reasons for that division do not necessarily have much, if anything, to do with Islamist orientation. Thus anyone who has been unfriendly to Hamas or to its more peaceful ideological confreres in the Muslim Brotherhood are placed on the good side of the line, Iran and those doing business with it are put on the bad side, and so forth.

Ross tries to portray something more orderly by asserting that “what the Islamists all have in common is that they subordinate national identities to an Islamic identity” and that the problem with the Egyptian Muslim Brotherhood was that “it was Islamist before it was Egyptian.” What, exactly, does that mean, with particular reference to the short, unhappy presidency of Mohamed Morsi? There were several reasons that presidency was both unhappy and short, but trying to push an Islamist-more-than-Egyptian agenda was not one of them. (And never mind that Ross is risking going places he surely would not want to go by making accusations of religious identification trumping national loyalty on matters relevant to U.S. policy toward the Middle East.) It would make at least as much sense to say that the current president, Abdel Fattah el-Sisi, was more authoritarian and more in tune with fellow military strongmen than he was Egyptian.

Where Ross’s schema completely breaks down is with some of the biggest and most contorted squiggles in the line he has drawn. He places Saudi Arabia in the “non-Islamist” camp because it has supported el-Sisi in his bashing of the Brotherhood and wasn’t especially supportive of Hamas when Israel was bashing the Gaza Strip. Saudi Arabia—where the head of state has the title Custodian of the Two Holy Mosques, the country’s constitution is the Koran, and thieves have their hands amputated—is “non-Islamist”? Remarkable. Conversely, the Assad regime in Syria, which is one of the most secular regimes in the region notwithstanding the sectarian lines of its base of support, is pointedly excluded from Ross’s “non-Islamist” side of the line because of, he says, Syrian dependence on Iran and Hezbollah. Of course, any such alliances refute the whole idea of a “fundamental division” in the region between Islamists and non-Islamists, but Ross does not seem to notice.

Getting past such tendentious classification schemes, we ought to ask whether there is a more valid basis on which we ought to be concerned about states or influential political movements defining themselves in religious terms. If we are to be not merely Islamophobes but true children of the Enlightenment, our concern ought to be with any attempt, regardless of the particular creed involved, to impose the dogma of revealed religion on public affairs, especially in ways that affect the lives and liberties of those with different beliefs.

Such attempts by Christians, as far as the Middle East is concerned, are to be found these days mainly among dispensationalists in America rather in the dwindling and largely marginalized Christian communities in the Middle East itself. In a far more strongly situated community, that of Jewish Israelis, the imposition of religious belief on public affairs in ways that affect the lives and liberties of others is quite apparent. Indeed, the demographic, political, and societal trends during Israel’s 66-year history can be described in large part in terms of an increasingly militant right-wing nationalism in which religious dogma and zealotry have come to play major roles. Self-definition as a Jewish state has been erected as a seemingly all-important basis for relating to Arab neighbors, religion is in effect the basis for different classes of citizenship, and religious zeal is a major driver of the Israeli colonization of conquered territory, which sustains perpetual conflict with, and subjugation of, the Palestinian Arabs.

When religious zealotry involves bloodshed, especially large-scale bloodshed, is when we when ought to be most concerned with its infusion into public affairs. The capacity for zealotry and large-scale application of violence to combine has increased in Israel with the steady increase of religiosity in the Israel Defense Forces (IDF) and its officer corps. A prominent exemplar of this trend is Colonel Ofer Winter, commander of the IDF’s Gilati Brigade, who has received attention for the heavily religious content of his instructions to his troops. With his brigade poised near the Gaza Strip before the most recent round of destruction there, Winter said in a letter to his troops that he looked forward to a ground invasion so that he could be in the vanguard of a fight against “the terrorist enemy that dares to curse, blaspheme and scorn the God of Israel.” After Winter’s brigade did get to join the fight, he said that a mysterious “cloud” appeared and provided cover for his forces, an event he attributed to divine intervention. Quoting from Deuteronomy, he said, “It really was a fulfillment of the verse ‘For the Lord your God is the one who goes with you to give you victory.’”

Winter’s brigade was involved in what could be described as a culmination of the synthesis of zealotry and bloodshed. When an Israeli soldier was missing and suspected (incorrectly, as it later turned out) to have been captured alive by Hamas in a battle at Rafah, Winter executed the “Hannibal” directive, an Israeli protocol according to which as much violence as necessary is used to avoid having any Israeli become a prisoner, no matter how many civilians or others are killed and no matter that the captured Israeli soldier himself is killed. Over the next several hours a relentless barrage of artillery and airstrikes reduced this area of Rafah to rubble, while Israeli forces surrounded the area so that no one could escape it alive. This one Israeli operation killed 190 Palestinians, including 55 children. There may have been other implementations of the Hannibal directive in the recent Israeli offensive in Gaza; this one is confirmed because Winter himself later spoke openly and proudly about it. Although some secular-minded private citizens in Israel have objected to the heavily religious content of Winter’s leadership, officially there does not appear to be anything but approval for anything he has said or done. He is an exemplar, not a rogue.

In short, an operation officially sanctioned and led in the name of a national god was conducted to slaughter scores of innocents as well as one of the operators’ own countrymen. We ought to think carefully about this incident and about what Colonel Winter represents when we decide how to conceive of fault lines in the Middle East, what it means to insert religion into politics or to be a religious zealot, exactly what it is we fear or ought to fear about religiosity in public affairs, and which players in the Middle East have most in common with, or in conflict with, our own—Enlightment-infused, one hopes—values.

Today, I’m asking my readers to please support the American Israel Public Affairs Committee (AIPAC). The group has been working hard on some new legislation and it’s really important to help get this bill to the floor of the Senate and the House.

According to a report in Buzzfeed, AIPAC has been working with congressional staff members for months on the bill, trying to find the formula for success. The bill would “…aim to prevent U.S. companies from participating in the (Boycott, Divestment and Sanctions against Israel) campaign without infringing on Americans’ First Amendment rights to political speech. It would also try to make the Transatlantic Trade and Investment Partnership being negotiated between the U.S. and E.U. conditional on whether the E.U. takes action to stop BDS.”

And how would they prevent US companies from participating in BDS? By “…authorizing states and local governments to divest from companies deemed to be participating in BDS,” and by denying “…federal contracts to such companies.” This bill should be at the top of the agenda for American activists in the United States who wish to see our country change its policies towards Israel and Palestine.

AIPAC hasn’t been doing very well of late. Their attempt to weasel a provision into another bill that would have allowed Israelis to enter the United States without a visa while Israel refused to make the same arrangement for US citizens raised a lot of hackles on Capitol Hill, even in some offices that are very AIPAC-friendly. The proposed provision was killed. AIPAC was unable to sway the Senate against the nomination of former Senator Chuck Hagel for Secretary of Defense. Nor has it been able to significantly impact the Obama administration’s efforts to reach an agreement with Iran on its nuclear program.

There have been a lot of failures lately, including the failure to get Congress to push hard for an attack on Syria last year. But this bill, if it ever reaches the floor, could be the biggest bust of all, with some serious ramifications for the powerful lobbying group.

Let’s just start with the First Amendment issues this raises. If this bill ever sees the light of day, AIPAC is going to try to convince people that it is similar to the laws passed forty years ago in response to the Arab League’s boycott of Israel. Put simply, it isn’t.

Those laws–the 1977 amendments to the Export Administration Act (EAA) and the Ribicoff Amendment to the 1976 Tax Reform Act (TRA)–were drawn up narrowly, to apply only in the case of abetting or cooperating with a boycott directed at Israel by other countries. The mentions of boycott “by a foreign nation” or similar words are so frequent that the meaning cannot be missed. This is no surprise, of course; Congress is loath to dictate to US businesses, and it is especially tricky where a national interest is not clearly and immediately at stake. So these laws were contrived so that they only barred supporting boycotts by foreign countries against Israel.

In the case of BDS, no government is running this program, not even the pseudo-governments of the Palestinian Territories. The Palestinian Authority (PA) has not endorsed boycotts of Israel and is, itself, completely incapable of boycotting Israeli goods and services. It is in most ways a captive market to Israel. Hamas has, frankly, paid little attention to such measures, though they have encouraged them rhetorically from time to time.

There is a call for BDS from Palestinian civil society, but that is not covered by the 1970s laws. Moreover, any law that would target BDS would need to be constructed in such a way so that it would not have made boycotts of Apartheid South Africa illegal. Those boycotts also came in response to a call from the African National Congress. If businesses could not engage in such activities, there would be great outrage.

So the Arab League boycott is moot as a basis for anti-BDS legislation. The right to boycott is also not limited by what the government decides is an acceptable boycott and what is not. People, and businesses, are free to choose with whom they will do business. Congress making such decisions violates the very essence of the First Amendment, and it is highly unlikely that such a law could pass as a result and, if it could, even less likely that it could withstand legal challenges.

The bit about the Transatlantic Trade and Investment Partnership (TTIP) is even more toxic. The point of TTIP is to make international trade between the United States and European Union easier, to reduce tariffs and lessen bureaucracy. The idea is to significantly improve the speed, and thus the volume and value, of trade between the two economic giants. Adding stipulations like ensuring that EU states are working against BDS is precisely what TTIP is designed to avoid. Whatever my own objections to TTIP (and they are many), it clearly holds great appeal for businesses on both sides of the Atlantic.

It is one thing for US citizens with influence in Washington to go along with the powerful lobbying forces defending Israel’s ability to act with impunity in the region; for the most part, that has not had a negative effect on trade. But this would be a very different matter. Now we are talking about AIPAC going up against powerful, domestic business interests. That is a whole new ballgame.

Even bringing the bill to the floor would demonstrate in a clearer way than ever before that AIPAC is willing to compromise US commercial interests and even one of the most cherished and basic freedoms the US prides itself on for the sake of Israeli interests.

Consider also that the overwhelming majority of boycott actions, divestment decisions and even popular proposals for sanctions against Israel have focused squarely on Israel’s occupation of the West Bank and Gaza. They have not targeted Israel as a whole, with the exception of some of the attempts at cultural and academic boycott. But these are not major concerns for Israel nor do they have the same impact potential as economic boycotts and divestment. So, the threat to free speech and to international trade that this bill represents would be demonstrably in the service of the settlement enterprise, the siege of Gaza and the occupation regime more generally. The mask would be off.

In reality, I very much doubt any such legislation is ever going to move forward, at least not from AIPAC. They know the problems as well as anyone and, while I don’t doubt that they are working constantly with their closest friends in Congress to see if something could work, I don’t think they’ll be successful. But if you want to see AIPAC suffer major damage, such a bill would do it. I can’t think of a better strategy to oppose AIPAC than to do everything we can to make sure this sort of doomed anti-BDS legislation hits the floor in Congress with a resounding thud.

At Ohio University, the disturbing reality of the different treatment accorded to pro-Israel, as opposed to pro-Palestinian views supports Salaita’s statement. Of course, the treatment of Salaita is, itself, rock-solid evidence of this point. That is especially true since the university’s chancellor, Phyllis Wise, has backed off her initial claim that Salaita’s de-hire was caused not by his views but by the allegedly “uncivil” way he expressed them. She has since admitted that she faced pressure from influential figures around the university, i.e. major donors.

But a report today in Ha’aretz on an incident at Ohio University offers an even clearer view. The president of the student senate at OU, Megan Marzec, used the opportunity of taking the ALS Ice-bucket challenge to make a statement about Gaza. She wore a shirt that urged divestment from Israel, stated that the blood in her bucket (which was, of course, fake) represented the Palestinians that Israel had “murdered and displaced,” and dumped the bucket over her head.

The response from the organized Jewish community on the OU campus was swift and quite typical. Ha’aretz quotes the leader of a pro-Israel campus group, Becky Sebo: “Her video has kind of torn the campus apart. My initial response was complete shock. We’ve never had any BDS [boycott, divestment and sanctions] movement on our campus, have always had a very open, welcoming community.” Now, she said, “Jewish students in particular are feeling very singled out by the video. Many Jewish students are feeling concerned about their safety and how other students will respond to these accusations against Israel.”

This hyper-sensitivity represents a complete reversal of reality, among other things. There is not a single report of Jewish students being harassed, much less assaulted, as a result of Marzec’s video. But Marzec herself has drawn death threats and hate mail. So much so that Homeland Security has gotten involved on campus. Of course, the pro-Israel groups, no doubt quite sincerely, condemned and called for an end to such acts. But let us ask the question: who has legitimate reason to fear for their safety?

There are also other dimensions to this story. Consider the words of Oren Segal, director of the Anti-Defamation League’s (ADL) Center on Extremism. “The students who want to present a non-biased pro-Israel view have their work cut out for them because there are going to be a lot of efforts to delegitimize their point of view. I anticipate we’ll see more anti-Israel activities than ever before.”

Just read those words, and the thinking is revealed. “A non-biased pro-Israel view.” That is an obvious oxymoron. If the view is pro-Israel, or if it is pro-Palestinian, it is, by definition, biased. What Segal implies here is that any unbiased view would be pro-Israel and any other conclusion can only come about as the result of bias.

And then there’s this whole argument about “de-legitimizing,” whether it is about Israel or of points of view. The working definition of this “de-legitimization” seems to be centered around any argument against Israeli policies, against Zionism, or against any kind of support for the Palestinians. The point of debate, of argument, is to establish that your view has more merit than the opposing one. That should be encouraged (as, indeed, Jewish tradition does), not feared. And certainly, it must not be stamped down.

The shallow arguments get even better. The Director of the OU’s Hillel (a national Jewish student organization), Rabbi Danielle Leshaw, demonstrated just how far the so-called “pro-Israel community” has departed from Jewish traditions and more universal values of open discussion and debating difficult issues.

“Your video marginalizes and isolates students,” Leshaw wrote in an open letter to Marzec published in The Post. “It makes Jewish parents want to bring their kids back home to the safety of the Jewish suburbs …. you need to step down, and give somebody else the chance to lead our Ohio University student population. Somebody that won’t polarize, or divide, or marginalize, or ‘other,’ or cause hysteria, or make students feel unsafe.”

Leshaw, it must be noted, is far from a conservative voice, and she is, herself, no stranger to criticizing pro-Israel programs. She also strongly disagrees with Marzec’s view of the Israel-Palestine conflict. Her call for Marzec to resign as student senate president is “Not because of your politics, but because of your lack of awareness, compassion, and mostly, because of your lack of vision.”

Let’s unpack Rabbi Leshaw’s thinking. Just how does Marzec’s video “marginalize and isolate students?” She presents a political statement, at a time when the Israeli military was acting in so brutal a manner that even their American colleagues, who are themselves quite familiar with killing civilians, were shocked. One wonders: If someone had done the exact same video during Russia’s aggression against Chechnya 15 years ago, would anyone have been concerned that Russian students were marginalized and isolated? Of course not, mostly because they wouldn’t have been and because everyone would have been applauding the strong statements against the massive damage being done to civilians, and rightly so.

Marzec’s video, Rabbi Leshaw says, “…makes Jewish parents want to bring their kids back home to the safety of the Jewish suburbs?” That is a familiar and tired argument, one that got badly worn out during the battles for school integration and during the civil rights movement. Just substitute “White” for Jewish, and the sentence says the very same thing. It is irrational fear of the other, something that needs to be confronted, not accommodated.

Rabbi Leshaw also says that Megan’s video makes “alumni want to pull their funding.” I wonder if she thought about that complaint before putting it in her letter. An apparently liberal woman believes that donors should have the ability to stop students from making controversial political statements? Would she have said the same about protests against the Vietnam War or for women’s rights back in the 1960s and 70s? Because surely there were those alumni who took similar offense to bra-burning demonstrations back then. No, it is only opposition to Israeli policies that merits such kowtowing, I suspect.

Rabbi Leshaw also says that Megan’s video “makes people threaten” the university and its programs, a disturbing echo of Israel’s self-serving and unsellable (outside of the US and Israel, that is) claim that all those Palestinian deaths were Hamas’ fault. Defying such bullying is why Rabbi Leshaw thinks Marzec should step down, rather than seeing it for what it is: precisely the sort of action that a student leader must take if they are to ever be leaders for social change outside the university. The same would be true if this was a pro-Israel statement. Those who support Israel’s policies or feel they must defend Israel should also not give in to any attempts to intimidate them into silence. It is not the opinion that matters, and on that point, Rabbi Leshaw claims to agree. So would she have the same objections if the issue was not Israel? Given her professed values, it seems doubtful.

Megan Marzac sees the Israeli occupation and then the shockingly brutal onslaught on Gaza. She believes that these should be opposed and future incidents prevented, and believes that the global Boycott Divestment Sanctions (BDS) movement is the best way to achieve that. She lacks neither awareness nor compassion. Her statement was one of condemnation of repeated and ongoing human rights violations. That demonstrates considerable awareness and compassion, whether you agree with her views or not.

Is it Marzac’s lack of vision then? Well, it is fair to say that her identification as student senate president gives the impression that she was doing this with some sort of sanction from the senate, which apparently was not the case. That’s an error, but such a mistake is hardly grounds for her removal, especially since she subsequently made it clear that this was her own action.

In any case, the notion that strong support for the Palestinians and even harsh criticism of Israel is somehow threatening to Jews has to be challenged. It is a false accusation, but more importantly, it is one in a long list of bullying tactics that seek to silence support for the Palestinians on campus and more broadly, in the public discourse. Those tactics include attempts to legislate against boycotts of Israel (all of which have failed thus far), manipulating organizations by threatening their funding, harassing media outlets when they give space for pro-Palestinian views, and claiming victimhood when they themselves are the victimizer.

Megan Marzac did what student activists should do: she made a bold statement. The response from the allegedly pro-Israel community has been nothing short of the worst kind of bullying, even aside from the extremists who have threatened her with physical harm. Do these people believe that Israel’s case is so weak that it cannot withstand public debate? It seems so, but that is only true because they are making the wrong argument. They are working to make Israel an exception to international laws of war, and supporting Israel’s regular violation of Palestinian rights through Israel’s occupation regime (as thoroughly documented by many Israeli human rights groups like B’Tselem, Yesh Din, Gisha and others). These so-called pro-Israelis are trying to defend Israeli military actions that regularly kill far more civilians than combatants, leave infrastructure devastated and make already impoverished people even more desperate.

What if they tried making the honest case that what is really needed is, quite simply, equal rights for all and a homeland where Jews and Palestinians can flee to if they are facing persecution and where both peoples can express and live their national identity, in whatever political configuration? Maybe then they wouldn’t resort to bullying tactics because they’re so terrified of an honest, open discussion in the public arena.
