On June 14, members of the Presbyterian Church USA (PCUSA) will gather in Detroit, Michigan for their biennial General Assembly meeting. A lot of eyes will be focused on this gathering, particularly those who have managed to maintain interest in the Israel-Palestine conflict in the wake of the collapse of the “peace process.”

The Presbyterians are going to revisit a vote on divestment from companies profiting from Israel’s occupation that failed in 2012 by a mere two votes. Given that narrow margin of victory (the final tally was 333-331 with two abstentions), many believe it might just pass this time. As a result, pro-divestment groups have reinvigorated their efforts to support Presbyterian divestment, while opponents have redoubled their efforts to oppose the resolution.

Leading the charge against the PCUSA’s proposal is none other than the ostensibly pro-peace J Street. One can find, even in the Jewish weekly, The Forward, opinions on the absurdity of J Street’s stance. But the opposition of even so centrist a group to the proposal sheds light on efforts to oppose any and all efforts to exert material pressure on Israel to change its policies.

The arguments against the PCUSA’s divestment proposal begin with opposition to the Boycott, Divestment, and Sanctions movement (BDS). That movement is a very broad one, and it includes strident anti-Zionists and one-staters as well as Zionists and two-staters. In general, it is fair to say that the only common thread that unites them all is the notion that the most focused effort right now must be directed at changing Israeli policy, and that to do so, economic and political pressure must be exerted.

I agree with that notion; indeed, I have been arguing that the Palestinians have ample material reason to make great compromises — while Israel does not — for over fifteen years, and that economic measures are the best way for citizens of other countries to bring that pressure to bear. Personally, I don’t agree with many of the more prominent and visible BDS tactics, such as academic boycotts of Israeli universities and some of the more over-zealous efforts to pressure artists from performing in Israel. My differences on these tactics are based on my own judgment of their efficacy.

But you simply cannot find a more unassailable proposal than the one the PCUSA is bringing forth. Knowingly or not, opposing it can only mean one thing: supporting the status quo, fighting to maintain the occupation. Of course, that is not J Street’s intention; but it is the outcome of their stance.

The PCUSA will be deciding whether or not to divest from three well-known corporations – Caterpillar, Motorola, and Hewlett-Packard (HP) — due to the fact that their business with Israel helps support the occupation. Motorola sells advanced communications technology to the Israeli military, which are routinely and specifically used in the Occupied Territories. HP “…manages all Information Technology (IT) including its operational communications, logistics and planning including the ongoing naval blockade of the Gaza Strip,” and also provides scanning equipment used by the Israeli military specifically at checkpoints in the West Bank. Caterpillar has long been a target for divestment because it sells Israel a great deal of heavy equipment, some of it customized, that is used to both build settlements and destroy Palestinian homes.

It is perfectly legitimate for the PCUSA or any other group to divert their own funds from supporting such practices. Indeed, that is, theoretically, just what is supposed to happen in a free market, open society system. The only way one can possibly equate economic action to oppose, both rhetorically and practically, such business practices is by equating opposition to the occupation with being anti-Israel. That is something that the PCUSA certainly does not wish to be. The Presbyterians are grappling internally with something that should not be a contradiction: being a friend to Jews and supporting the right of all people to freedom and justice. No Jewish individual or organization should be telling them that a decision to take their money out of international corporations that are profiting from Israel’s occupation is somehow anti-Israel.

The arguments against the Presbyterians action are, sadly, quite duplicitous. First, they collapse all economic actions against the occupation or against Israel as a whole into one category and then claim, without basis, that one particular strand of BDS activists represents all of them and, by extension, taints any economic action against the occupation. Such arguments fail a basic test of avoiding fallacious thinking, but they are, without a doubt, persuasive, especially on emotional issues.

At a recent J Street summit, the group’s president, Jeremy Ben-Ami, echoed such a view, albeit in a more subtle fashion. “Some will say that you have to go toward the path of BDS…and negative punishment that raises the cost, that drives home that this [continued Israeli occupation] is a path that has consequences,” Ben-Ami said. “That’s not the path for J Street. That’s never going to be the path that we go down. We believe that there’s a better way to talk to friends and family than to wield the big stick and bash people over the head. We have to talk with them out of love and out of concern, and we have to bring our message in a way that will really resonate.”

But in fact, the PCUSA proposal does not punish Israel in any way. Far from “bashing” anyone over the head, it is a way of removing one’s own support from abhorrent practices. None of the business activities that the PCUSA objects to have anything to do with Israeli security; they all have to do with maintaining the occupation and the concomitant, daily human rights violations endured by the Palestinians of Gaza and the West Bank. The PCUSA is saying that they will take their investments elsewhere after a decade of trying to convince these corporations to stop doing this sort of business. One must emphasize, again, that the Presbyterians did not at any time implore these or any other corporations to stop or to limit the business they do with Israel that does not support the occupation.

Only by defining, as many supporters of the status quo do, the ongoing occupation as an Israeli security measure, and thereby excusing it and blaming the Palestinians for their own lack of freedom and rights can one justify opposing the PCUSA’s measures. To be sure, there is no shortage of Jewish or Christian groups who do just that (the Orwellian-named “Presbyterians for Middle East Peace” is a shameful example of the latter). But J Street is supposed to be different. They are supposed to see the occupation as a detriment to Israel’s security and not a boon; they are supposed to see it as a threat to Israel’s future.

I’ve said before that I’ve known Jeremy Ben-Ami and many other people involved deeply with J Street for many years. I know they are not intentionally acting against peace and against Palestinian rights. But they are attempting to square a circle that cannot be bent in that direction by trying to both shield Israel from the consequences of its 47-year old occupation and, at the same time, pressing to end the occupation with nothing more than words.

It doesn’t work that way. Indeed, Ben-Ami and J Street are actually putting forth the very dangerous notion that somehow Israel is different from any other country. Governments don’t make decisions from a sense of morality or ethics; they make concessions or take risks because of pressure, whether that pressure is internal or external, military or economic, political or diplomatic. That is as true for Israel as it is for the United States, Russia, China, Zimbabwe, Luxembourg, Uganda, Chile or any other government, democratic or dictatorial. To pretend otherwise is unrealistic and counter-productive.

If one wants to see a future where Israeli Jews live in peace and security, the occupation must end. But Israelis, both the leaders and the public, are (in some ways, understandably) reluctant to make anything close to the necessary concessions and agreements. Only pressure will change the stance of the Israeli government, as is the case with any government. Opposing such pressure means supporting the occupation. J Street doesn’t mean to do that, but it is what they will be doing at the PCUSA’s General Assembly. The chance for some kind of peace lies in the hope that enough of the Presbyterians at the GA can understand that.

You have to admire the tenacity of J Street, the self-proclaimed “pro-Israel, pro-peace” lobbying group. Or maybe it’s the desperation born of running out of options. In any case, if there is to be any hope for a negotiated resolution to the Israel-Palestine conflict, J Street, however well-intentioned, is demonstrating precisely what we must not do.

Just days after the Obama Administration announced it was taking a “pause” in its efforts to broker an agreement, J Street sent out a message trying to rally the troops. In that message, they said that this moment “…is an opportunity to take stock and ask some tough questions.” Unfortunately, they make clear in the very same message that they are doing neither.

Here is what J Street refers to as “our plan”:

  • First, we’re going to urge President Obama and Secretary Kerry to stay engaged and not to walk away. Resolving this conflict remains an American and Israeli interest.
  • Second, to move forward, the Administration should put forward an American framework for a final status deal, build international support for it, and go to the parties and tell them the time has come to say yes or no to a reasonable plan for ending the conflict. So we’ll be calling for stronger American leadership, not less engagement.
  • Third, we’ll be speaking out even more strongly about the direction in which Israel is headed. Those on the farthest right of Israel’s politics have formed a “one-state caucus.” They are willing to forsake Israel’s democratic character for unending settlement expansion throughout the West Bank. That’s a choice that most of the world’s Jews disagree with and it runs counter to the values and interests of both Israel and the United States.

This plan reflects a sense of futility. There is nothing here that raises the question of why almost every round of talks for the past twenty years has ended in failure. The closest thing the U.S. can point to as a success during that period is the Wye River Agreement in 1998, when President Bill Clinton exerted personal pressure on Israeli Prime Minister Benjamin Netanyahu and, for his troubles, got Netanyahu to implement a redeployment that had already been agreed upon. Not a lot to show for over twenty years of work.

Yet J Street, in essence, advocates more of the same. The “toughest question,” and the one they don’t want to ask comes down to the internal paradox that J Street faces. On one hand, they are always advocating “robust diplomacy” on the part of the United States. On the other, J Street has consistently opposed any sort of material pressure on Israel, whether economically or diplomatically, to get them to change their policies. That they continue to hold this position goes a long way toward explaining why nothing, especially the results of Israeli-Palestinian talks, ever changes.

In 1998, Bill Clinton was able to put public pressure on Netanyahu, without having to resort to threatening U.S. military aid to Israel or really much else in the way of material pressure. But that was a different time. The reason Clinton was successful was because the specter of an Israeli Prime Minister alienating a U.S. President was a significant political problem in Israel. Indeed, it contributed significantly to Netanyahu’s defeat shortly thereafter by Ehud Barak (although, paradoxically, the right wing’s sense that Netanyahu had sold them out at Wye was at least as big a factor). In today’s Israel, as long as the people know the military relationship is intact, defying the U.S. can be a political plus, and Netanyahu has since proven that he can insult, humiliate, even spit in the proverbial face of a U.S. President without real consequence.

That’s why J Street’s prescription is so badly out of date. The rightward shift of the Israeli public since the beginning of the Second Intifada in 2000, along with the increasing clarity in recent years of the strength of virtually unconditional Congressional support for a wide array of Israeli policies, have emboldened Israeli prime ministers. They know that the United States will not exact any penalty for Israeli defiance on matters related to the Occupation (wider regional matters may be different). If further proof were needed, the opposition from within his own party to Barack Obama’s call for an Israeli settlement freeze in 2009 provided that. It is no longer sufficient for a U.S. President to make his wishes clear; Israel will not move on the ever-deepening occupation without significant, tangible pressure. But J Street opposes any such pressure.

The “tough questions” that J Street, and other groups seeking a reasonable and non-violent end to this conflict need to answer don’t stop there. The failure of not only the latest attempt by John Kerry, but of the entire process over twenty-plus years now raises a much bigger question.

To date, there has only been one path to that sort of a solution, the two-state version as envisaged by the Oslo Accords and the subsequent evolution of events. It hasn’t worked. After twenty years, the occupation is far more entrenched; the settler population has exploded and its growth will continue to accelerate; the PLO has fallen into disarray and has lost a lot of support, but no clear alternative has presented itself; the Israeli electorate has moved sharply to the right; and Washington’s ability to pressure Israel has grown weaker with each successive president since 1992.

The byword about this process has been that there is no other choice, but this is nonsense. Not long ago, Emile Nakhleh, a former Senior Intelligence Officer for the CIA suggested on this site that the two-state option was dead and new ideas, essentially variations on a one-state formula, would have to be devised.

I agree that those formulations need to be considered anew. I still don’t believe a single state will really work, but the moment demands that anyone who can make a case for any solution must be heard and taken seriously. What is most dangerous right now is falling into the comfortable trap of trying the same thing that has failed for twenty years. The only formulation that has ever been attempted was the Oslo formulation and it has failed. There is always another option. We need to find one that will work, not stubbornly cling to a fatally flawed plan that has finally died and pretend there is still even the remotest possibility that it will work.

It is precisely for this reason that I have been picking on J Street in this article: because I still believe that a two-state formulation must be found. I have nothing against a one-state outcome in principle; as long as that one state guarantees it will always offer safe sanctuary to Jews fleeing persecution– the kind that didn’t exist in World War II — I’m perfectly comfortable with it. But I have no faith that it can work, as we see all around the world the collapse of and/or violent conflicts within multi-ethnic or -confessional states (Iraq, Yugoslavia, and most recently Syria, South Sudan and Ukraine, just to name a few). Given that level of doubt, and the fact that there is currently no groundswell of political support anywhere for a one-state outcome, I cannot see how it would work. But I remain open to someone showing me how the difficulties could be dealt with, as we all must consider new options in the wake of Oslo’s death.

But a new two-state concept doesn’t really have the full advantage over one state that some may contend, if they base that contention on the idea that a two-state formulation has global acceptance. That’s because any two-state formulation must scrap Oslo and start from scratch, so it would have to be sold anew. In my view, in order to succeed, a two-state formula must include the following elements, few of which were characteristic of the Oslo Process:

  • It must be based fundamentally not on Israeli security or even Palestinian freedom, but on fully equal rights – civil, human and, crucially, national – of all the people living between the Mediterranean Sea and the Jordan River.
  • It must be based on international law, including UN Security Resolutions, the Geneva Conventions, and all other relevant international treaties.
  • It must be based on open borders and deep cooperation between the two states, rather than as much separation as possible.
  • It must not treat as legitimate “changes on the ground” that Israel has intentionally brought about to block a realistic two-state outcome, but it must also seek a path to minimize the upheaval of mass relocation of either settlers or Palestinians. An open-border system may help facilitate this.
  • It must acknowledge and respect the Palestinian refugees’ claim for return and find a way to accommodate it in a reasonable fashion that neither undermines prospects for peace nor treats the right of return as anything less than that—a right.
  • Both states must be required to produce a constitution that guarantees full and equal rights to all minorities within its borders, no matter how the state chooses to characterize itself. Such a constitution also needs to guarantee that Jews and Palestinians around the world are guaranteed that the respective states will offer them safe haven in the case of persecution.
  • Any deal will have to be enforced by the international community. Israel will hate that, and many Palestinians will see that as limiting their hard-win sovereignty. But it is extremely unlikely that these arrangements will work just because of good intentions, as Oslo proved conclusively.

That’s a basic framework that I see as workable for an equitable two-state solution. Lots of compromise on both sides, but also a practical approach that allows both Palestinians and Israelis to maintain their national identities.

Of course, I don’t expect a politically centrist, Washington-centric group like J Street to accept such a formulation. But I do expect that, if they are serious about wanting A two-state solution rather than stubbornly sticking to the failed experiment that has been referred to as THE two-state solution, they will start talking and thinking of new ideas about what such a solution will look like.

There are one-staters who advocate a secular-democratic single state. There are right-wing Israeli one-staters who advocate a single state that legally enshrines Jews as dominant above Palestinians. Those ideas are advancing today because any reasonable person understands that the Oslo process is dead and has been proven to be unworkable, and these ideas are beginning to fill that vacuum. If we want to see a two-state solution emerge, as I think we need to, we need to re-think the basis of that solution and build one that avoids all the bias and mistakes of Oslo.

J Street, as champions of the two-state solution, this is your time to show that you can truly lead. I hope you’ll take the opportunity to do so and not play scared by clinging to the only solution that has actually been tested and which led to a dead-end.

Israeli Prime Minister Benjamin Netanyahu’s trip to the United States has ended in an unprecedented failure. On the Palestinian front, the Iranian front and the domestic US front, Netanyahu’s efforts last week ran badly aground. Let’s review the categories.

Iran

Netanyahu himself illustrated his greatest failure: his attempt to divert the conversation about Iran by making a big show of intercepting a ship carrying rockets, ostensibly, according to Israel, headed for the Gaza Strip. Bemoaning the lack of global outrage that he had hoped would sabotage the talks between Iran and world powers on the nuclear issue, Netanyahu told the Israeli cabinet upon his return that: “”The goal of seizing the arms ship was to expose Iran’s true face. I say this in order to bring it to the attention of Ms. Ashton, who is now visiting Tehran, and I wish to ask her whether she asked her hosts about the shipment of weapons to terrorist organizations.”

In fact, there are very serious questions about the incident that are not being raised. It may be best that they’re not, because it is a reflection of the minor impact the incident has thus far had on the talks with Iran. The timing of the Israeli intercept was obviously staged to coincide with Netanyahu’s visit to the US to speak at the annual AIPAC conference and to meet with US President Barack Obama. As Amir Rappaport points out, the operation was being planned for months and was carried out far outside of Israeli waters, so the timing was no accident.

The plan fails in its very conception, though. At no point did Iran agree to stop its support for Hezbollah and Hamas in order to pursue these talks, nor did anyone expect them to. But other questions can be raised here as well. Was this, as Netanyahu alleges, Iran showing its “true face” as it masquerades behind the apparent moderation of Hassan Rouhani and Javad Zarif or was it, as many observers suspect, an attempt by Iranian hardliners to undermine the efforts of the moderates? Indeed, there is some question as to whether the weapons were even intended for Gaza.

It is also odd that weapons from Syria are brought to Iran to be smuggled all the way back to Gaza; the point of the Iran-Syria connection is for such flows to run in the opposite direction, although this could, perhaps, be explained by the ongoing civil war in Syria. In part, that explanation is connected to increased Israeli surveillance of Syrian munitions. That, however, raises the question of why Iran, knowing how closely Israel is watching Syria, would engage in such an operation now.

There are many questions about this incident, not the least of which is the veracity of Israel’s version of events, absent any proof they have made public about the weapons’ destination; they could have been heading for Hamas, to Islamic Jihad (as Israel claims) in Gaza, to anti-government militias in Egypt, to groups in Sudan… There is a lot here that is unclear at best in the Israeli version of events, although certainly nothing to prove that any part of it is untrue.

But what is clear is that the response from the United States and Europe is considerably less than Netanyahu had hoped for. No one believes this shows Iran’s “true face” because no one ever believed that engagement on the nuclear issue by itself was going to change Iran’s position and policy vis–à–vis Israel. What can do that, as Zarif has strongly indicated, is an agreement that the Palestinians clearly accept. So, where are we with that?

Palestinians and the Kerry peace plan

Netanyahu didn’t have much to say about peace with the Palestinians, but what little he did say was a clear attempt to negate any possibility of success on the part of US Secretary of State John Kerry. His very first remark to the fawning crowd at the AIPAC conference was a greeting “from Jerusalem, the eternal, undivided capital of Israel and the Jewish people.” Not surprisingly, this did not sit well outside the hall of sycophants at AIPAC. His only other substantive statement was a call on Palestinian President Mahmoud Abbas to recognize Israel as a “Jewish state,” something neither Jews nor Israelis can even agree to a definition of and that everyone knows is a non-starter for Abbas.

This demand is a threadbare attempt to get the Palestinians to acknowledge, before an agreement, that they have no claim to a return of refugees (fair for Israel to try to win in talks if they want, but unreasonable to demand as a precondition, as Israel generally has), that Palestinian citizens of Israel must be content with second-class status and most of all, that the Zionist historical narrative is more legitimate than the Palestinian one. No leader of any people would ever agree to such a thing, and Netanyahu is well aware of this.

But outside of the lock-step supporters of Israel in AIPAC and their fellow travelers to the right of that organization, no one is buying into this demand even though its crucial for Netanyahu. For months now, it has been getting clearer and clearer that Kerry’s efforts were likely to fail and much of what both Netanyahu and Abbas have been doing and saying has been geared toward escaping blame, especially US blame, for this likely failure. Bibi needs the demand for recognition of a “Jewish state” to be seen as reasonable, but he’s not winning the battle.

“The level of mistrust is as large as any level of mistrust I’ve ever seen, on both sides,” Kerry told a House of Representatives Appropriations Committee hearing on Wednesday. With Netanyahu now back in Israel and Abbas slated to come to Washington next week, this is a clear statement of pessimism from the one man who, whatever the reality of the talks, has insisted on maintaining a show of optimism. The prospect of failure is becoming more certain, but thus far, Netanyahu has failed to gain the upper hand in escaping blame, as Ehud Barak did with Bill Clinton in 2000.

The US domestic audience

On the US front, the situation is unprecedented. The good wishes most US citizens hold for Israel remain steady, indicating the same widespread support for Israel’s security that has always existed. But the war-weary United States is withdrawing into itself and the diminishing support for Israeli policies is a reflection of this. However, that’s far from the only cause of the new situation Israel finds itself in.

Relationships between Israeli leaders and US presidents have varied. Barack Obama is not the first to have a rocky relationship with an Israeli Prime Minister. Jimmy Carter and George H.W. Bush did not always get on well with Menachem Begin and Yitzhak Shamir, respectively. On the other hand, Bill Clinton was practically a groupie for Yitzhak Rabin and had a very warm relationship with his political successor, Ehud Barak. Similarly, George W. Bush called Ariel Sharon a mentor, and continued to get along famously with Sharon’s successor, Ehud Olmert. Yet through all these relationships, bad and good, Israel always maintained warm ties with both major US parties. AIPAC prided itself for decades on its bi-partisan reach.

Netanyahu has severely damaged that bipartisanship. From his deep ideological connection to US neoconservatives, to his barely hidden meddling in US electoral politics, he has alienated Democrats. Those Democrats remain dedicated to Israel’s security, or, in some cases, to AIPAC-directed campaign contributions. But with his repeated attempts to draw the United States into deepening conflict and possibly war with Iran, Netanyahu has forced Democrats to choose between their constituents and AIPAC. That’s a battle AIPAC would never win, but Netanyahu seemed to believe that AIPAC could do anything. For all those who accused John Mearsheimer and Stephen Walt of demonizing “Jewish power” in their book on the Israel lobby, it seems it was Netanyahu who imagined an omnipotent lobby for his country in the US and wildly overestimated their power.

While Bibi spoke to AIPAC and other US audiences, article after article — in the Huffington Post, Foreign Policy, the Washington Examiner, Israel’s YNet, and other sites – proclaimed AIPAC’s diminishing influence. It really isn’t surprising. Bibi has tried to increase US involvement in the Middle East at a time when most in the US, despite being willing to continue to fund Israel and help it out at the United Nations, want to reduce our involvement in the region. And, while Bibi can talk the talk of the US right-wing, most Jews in the United States are liberals. With voices who support the rights of Palestinians as equal to Israelis gaining prominence, US Jews are looking for ways to reconcile their liberalism with their support of Israel in a way they have not had to in the past. Bibi is trying to push them back to the old narratives, and they aren’t working.

What if Netanyahu fails?

That’s a reasonable question. Right now, there is no serious challenger to Netanyahu on the horizon, but that can change if his bungling of the US relationship becomes more of a problem for the average Israeli. The challenge could come from the right, as Avigdor Lieberman is trying to position himself to make a run at the Prime Minister’s office. But if failure with the Palestinians and with the US is at issue, Lieberman wouldn’t be the answer, and no one more moderate than Bibi is currently poised to make any kind of challenge.

Still, it is now much more likely that the peace talks are going to collapse at the end of April. Netanyahu won’t be directly blamed by the Obama administration, but if they do think it is his fault they can easily communicate that in Israel and Europe, with profound consequences for Netanyahu. Meanwhile, more and more of Europe is turning against Israel’s increasingly right-wing and rejectionist policies. That could cost Bibi dearly.

Failure might not only harm AIPAC, but it could seriously harm more moderate groups in the US like J Street. If the two-state solution appears unrealistic, J Street will have little to hang their hats on. And without the moderate alternative, US support, apart from the annual military aid, is likely to diminish as well. Unfortunately, without a Palestinian strategy to take advantage of this changing state of affairs (beginning with unifying their body politic), it’s not going to lead to better days. And such does not seem to be forthcoming.

Bibi’s gone back home now. But his trip here was notable for how much was at stake and how badly he did with it.

It’s been a difficult annual policy conference for the American Israel Public Affairs Committee (AIPAC) and its hopes of getting Congress to set the toughest possible conditions on any final nuclear agreement between Iran and the P5+1 (the U.S., Britain, France, China, and Russia plus Germany). As readers of this blog know, AIPAC entered the conference, which ran from Sunday through Tuesday, in a rather parlous state as a result of its worst foreign policy setback in a generation; specifically, its failure to muster nearly enough Democrats to gain a veto proof-majority in favor of the Kirk-Menendez sanctions bill that Obama had threatened to veto. Attacked by hard-line neoconservative groups on the right, notably the Emergency Committee for Israel (ECI) and the Republican Jewish Coalition (RJC) for sacrificing its devotion to Bibi Netanyahu’s jihad against Iran in the interests of bipartisanship — namely, not unduly alienating Democrats in Congress and thus bolstering J Street — the nation’s most powerful foreign policy lobby found itself in a seemingly dazed and unfamiliar defensive crouch, lacking until the very last moment a coherent lobbying agenda for the 14,000 attendees signed up for the proceedings.

That was bad enough. But the Russian takeover of Crimea made things worse. The event dominated the news throughout the conference, making it virtually impossible for AIPAC to break through the blanket TV news coverage of the Ukrainian crisis. Even Netanyahu’s belligerent remarks delivered to the conferees Tuesday morning, designed to psyche them up for their subsequent shleps up to Capitol Hill, were relegated to the inside pages of major national newspapers.

Even the weather refused to cooperate. The snowfall that blanketed the area Sunday night and Monday morning effectively shut down the government and downtown, closing Congressional offices, making it highly inconvenient — and, in many cases, impossible — for the usual overwhelming majority of members of Congress, who customarily make cameo appearances at the conference to ensure their good standing, to get to the convention center, and generally cast a wintry pall over the three-day proceedings.

(And then, as if to add insult to injury, on Tuesday, the same day that Israeli Prime Minister Bibi Netanyahu keynoted the conference, The Hill newspaper, which basically ignored the proceedings throughout, featured a flattering full-page profile of Jeremy Ben-Ami, while the even more influential Politico published an op-ed entitled “Why AIPAC Needs to Get With the Peace Program” by the J Street founder and president. Ouch!)

Ultimately, aside from Netanyahu’s belligerence (a embarrassingly amount of which was directed against the Boycott, Divestment, and Sanctions (BDS) movement), what did AIPAC get on the Iran front? Although the smoke has not yet completely cleared on that question, it seems they got some form of its Plan C (after losing on Plan A — the Kirk-Menendez bill — and never getting any lift from Plan B, a non-binding resolution laying out impossible conditions for a final agreement) — a Congressional letter that the group helped to draft.

There are now, however, two such letters that are being circulated in Congress for signature — one hard-line version supposedly co-written by Sens. Lindsey Graham and Robert Menendez that clearly AIPAC and Netanyahu would prefer; the second, a softer one co-authored by House Majority Leader Eric Cantor and Minority Whip Steny Hoyer. The question is, which version (both have been cleared by AIPAC) will get the most support on Capitol Hill?

As I’ve pointed out, both versions are ambiguous on key points, notably on the critical issue of whether Iran will be permitted — at least by Congress as a condition for lifting sanctions as part of any final agreement between the P5+1 — to maintain a limited uranium enrichment program on its own soil. The best analysis of the difference in both letters and the context in which they have been drafted and presented was provided yesterday in a statement by the National Iranian American Council’s (NIAC) policy director (and fellow-Seattle native), Jamal Abdi. Here it is:

…NIAC has serious concerns with the language in the Senate letter regarding demands for a final deal. NIAC outlined its position on what principles should guide Congressional action regarding U.S.-Iran diplomatic efforts in a recent letter to Congressional leadership that was signed by forty organizations. That letter urged that Congress uphold the JPOA [Joint Plan of Action agreed between the P5+1 and Iran last Nov 24], not issue demands on negotiations that contradict the interim terms or the terms outlined for a final deal in JPOA, and that Congress work with the Administration regarding the need to eventually lift sanctions.The House letter meets those standards. NIAC has minor concerns with the House letter, but will not oppose it and commends the efforts of those in the House who succeeded in securing a more balanced letter.

Unfortunately, the Senate letter does not meet those standards and NIAC therefore opposes the Senate letter.

The Senate letter uses new language to offer old ultimatums that will complicate ongoing negotiations, box-in U.S. negotiators, signal that the U.S. would violate the terms outlined in the JPOA, and serve as an invitation to hardliners in Iran to issue similar escalatory demands that will narrow options for compromise. Sections of the letter will be construed to rule out any final deal in which Iran retains a civilian enrichment program, in contradiction of the Joint Plan of Action. This, in combination with demands regarding dismantlement of infrastructure and facilities, and requiring the deal to have regional implications beyond its scope, can only interfere with the work of U.S. diplomats to resolve key concerns at the negotiating table.

NIAC urges that the Administration and Congress coordinate closely regarding ongoing negotiations and work towards the shared goal of preventing a nuclear-armed Iran and averting a disastrous war. NIAC urges that members of the Senate abstain from signing onto the Menendez-Graham letter and instead consider language that supports the ongoing negotiations towards a final deal instead of adding unnecessary complications.

Thus, in NIAC’s opinion, the House letter is preferable for understandable reasons, although the group doesn’t support it.

Now, the latest interesting development is that Senate Armed Services Committee Chair Carl Levin, who was among the first of the senior Democrats to speak out against the Kirk-Menendez bill, has endorsed the House (Cantor-Hoyer, or C-H) letter and proposed it as a substitute in the Senate for the (Menendez-Graham, or M-G) letter. My understanding is that Levin believes that, despite its ambiguity, the House letter gives the administration the room it needs to negotiate a final agreement that would presumably permit some limited enrichment. If, as expected, other Senate Democrats, such as Banking Committee Chair Tim Johnson and Intelligence Committee Chair Dianne Feinstein, follow suit, the chances are pretty good that he can get the backing of the majority caucus (although bringing around the 16 Democrats who co-sponsored the Kirk-Menendez bill will be a challenge). And, with Cantor as the chief Republican sponsor of the C-H letter, it’s almost certain that a majority of the House will sign onto that. Especially because, like the tougher M-G letter, the C-H letter has also been blessed by AIPAC.

Thus, as recently three weeks ago, AIPAC was still lobbying hard in the Senate for the Kirk-Menendez sanctions bill, which was clearly designed by its drafters to sabotage the JPOA. When it failed to win at that, it tried briefly to get a resolution that would have set out conditions — known to be unacceptable to Tehran — that a final deal with Iran would have to incorporate, but the Democratic caucus would not go along. Twice rejected, it has been forced to settle for a letter and could very well wind up with the weakest one currently on the table. (See update below)

Moreover, the difference between Netanyahu’s maximalist position — no uranium enrichment, no centrifuges, no nothing — and the House letter endorsed by AIPAC is quite large, and Bibi must be rather upset by the gap. Indeed, his strongest supporters here are very upset.

Now, it bears mentioning that the White House, fearful of their effect on the negotiations and feeling perhaps a bit triumphant after frustrating AIPAC so badly over the last couple of months, opposes both letters, which could prove problematic if and when a final agreement with Iran is reached. While Obama can use his executive authority to ease or waive many sanctions, some sanctions can only be lifted by an act of Congress. Moreover, if Obama relies on his waiver authority, there’s no guarantee that his successor, who could even be a Republican, will continue waiving. As the NIAC statement warns “It is critical that Congress work with the Administration to ensure necessary authorizations are in place to enable nuclear-related sanctions to be lifted, as outlined by the JPOA. Those authorizations do not currently exist.” Thus, the administration’s opposition to Congress expressing its views on the subject could have the perverse effect of alienating key lawmakers whose support will eventually be required to fully implement a final agreement — a point made in an ironic tweet (“Pro-Israel and Pro-Iran Lobbies Agree: Iran Cannot Lift Sanctions Without Congress”) by the Foundation for the Defense of Democracies’ (FDD) Mark Dubowitz, who has long favored waging “economic warfare” against Tehran.

UPDATE: In the battle of the two letters on the Senate side, I understand that the Menendez-Graham version has currently fetched more signatures by a margin of 34-11. The 34 on the M-G side consist of 25 Republicans and 9 Democrats, while the 11 signatories to the Levin (or Cantor-Hoyer) substitute are all Democrats. Two Democrats who did not co-sponsor the Kirk-Menendez bill have signed both letters. I’ve been told that AIPAC is now actively lobbying against the Cantor-Hoyer version, despite the fact that it cleared the letter before the co-authors circulated it. If you have a preference, you should probably call your senator’s office.

As US Secretary of State John Kerry pursues talks in Jerusalem and Ramallah, political opportunists on all sides are trying to seize the moment to advance their goals.

Kerry emerged from his second day of meetings with Palestinian President Mahmoud Abbas trying to maintain some public faith in his efforts. Between his meetings with Israeli Prime Minister Benjamin Netanyahu and Abbas, Kerry stopped to preach his gospel of hope to some visiting Jewish students from the US, and later, after his meeting with Abbas said that some progress had been made toward the framework agreement he is hoping to achieve.

Of course, this “framework” idea seems a little late, given that Kerry has only four months left from the nine that were designated as a deadline for these talks to produce an agreement. And negativity continues to flow from both the Israelis and Palestinians, who would certainly seem to be a better gauge than Kerry himself.

And with the short time frame, the last thing any of the parties need is growing concerns about their own domestic politics. Yet that is precisely what emerged this week for all three parties, albeit in very different ways for each.

In Israel, Avigdor Lieberman has been trying to re-invent his image since even before he was reinstated to his position as Foreign Minister. He has repeatedly made statements warning that Netanyahu was being too careless about the relationship between the United States and Israel. Kerry, apparently, was all too willing to help Lieberman in this effort, perhaps as a way of exerting more pressure on Bibi. Whatever the reason, Kerry met separately with Lieberman after meeting with Netanyahu, giving Lieberman another chance to reiterate his support for “continuing dialogue with the Palestinians.”

In the West Bank, Abbas could not have been pleased, though also not surprised, by the protest that awaited Kerry’s arrival in Ramallah. Organized by the Democratic Front for the Liberation of Palestine (DFLP), the protesters focused on perceived US support for Israel’s position on maintaining Israeli troops for years to come in what would ostensibly be Palestinian territory. The DFLP is a member group of the Palestine Liberation Organization, and, though it’s not a major party like Fatah in the PLO or outside it like Hamas, it is taking up the mantle in this case of representing widespread Palestinian frustration at the positions the leadership is taking. It was a clear demonstration for Kerry how strong popular objections are to the direction talks seem to be going. This highlights the question over whether Abbas can deliver popular support for the kind of agreement that would be necessary to get Netanyahu to sign on. In fact, for anyone paying any attention to popular Palestinian sentiment (which, it seems, is not a category that includes any leading US officials), the protest demonstrated just how much of a fantasy it is that an agreement that is going to permanently restrict Palestinian sovereignty over Israeli desires that are cloaked in the mantle of “security concerns” could ever pass the required referendum.

Kerry and his boss, President Barack Obama, were not immune to the swirl of domestic politics either. A trio of Republican Senators – John McCain of Arizona, Lindsey Graham of South Carolina and John Barrasso of Wyoming – just happened to stop off in Israel on their way back from Afghanistan while Kerry was there. McCain seized on the opportunity to support Netanyahu against the President of the United States by saying that he shares Netanyahu’s concerns about the security provisions of the framework proposal.

McCain and his fellow Republicans help to demonstrate the shaky domestic support Obama and Kerry have for these efforts. Opinion in the United States is generally moving away from direct involvement in foreign conflicts. However, in this case, that is mitigated by support for and feelings of friendship toward Israel that is still significant in US opinion. But even given that feeling, US opinion that the US government should not be directly involved in the conflict has been steady and has, in recent years, only trended upward. This makes for a potentially difficult situation for the White House, as the fight in Washington is between groups who want the US to engage in peacemaking and even put some moderate pressure on Israel as well as the Palestinians to come to an agreement (such as J Street) and the more established lobbying groups who prefer that the US simply give Israel the support it has come to expect in military backing and diplomatic support in international arenas but let Israel handle the Palestinians (as most prominently represented, of course, by AIPAC).

The demonstrations of domestic unease by all three parties to the process only further highlights the causes for pessimism around Kerry’s efforts. Indeed, the Palestinian protests demonstrate the dangers not only in Kerry’s failure but also in the unlikely case of success, where an agreement is struck that is obviously unacceptable to the Palestinian public. That could be an event even more potentially explosive than Kerry’s failure to get an agreement at all.

In a debate recorded by the Institute for Palestine Studies, human rights lawyer Noura Erekat squares off with Hussein Ibish, a senior fellow at the American Task Force on Palestine, about the current peace talks and the prospects of a two-state solution. There was a lot in the exchange that was interesting, and it’s worth your viewing. But one point in particular caught my attention.

Both of them were asked this question: given the fact that the U.S.-brokered peace process has dragged on for twenty years with no end in sight, is it time to consider alternatives to the two-state solution? Each interlocutor answered according to their general bent, with Ibish stubbornly clinging to the two-state solution and Erekat advocating the consideration of a single, democratic state. Though the exchange was somewhat testy, it also proved interesting, and an important one to have, though I think the place it leads is not entirely satisfying to hardcore advocates of either position: a re-evaluation of solutions without being wedded to either one- or two-state formulations.

Ibish dismisses the notion of any alternative to the current process. For him, any alternative exists in a “counter-factual” world. There’s certainly plenty of substantiation for this view. Ibish is quite correct in saying that there is a global consensus around the current two-state formulation, and it would, at best, take years to develop an alternative solution. Indeed, any alternative is likely to be bitterly opposed by Israel, and the United States would very likely back that opposition, making Europe and the Arab League very reluctant to go in the other direction, even if they wanted to.

But Ibish’s blanket dismissal is, itself, counter-factual. At one time, the notion of a two-state solution was as unthinkable as a single democratic state is today. Further, as Ibish himself acknowledges, twenty years of efforts under the Oslo process have yielded precious little for the Palestinians (many, myself included, would contend the Palestinians are worse off today than they were twenty years ago), the United States is not capable of being an even-handed broker, settlement construction has only accelerated over the years and the disparity of power between the parties remains an enormous obstacle to peace. His only response to this is that two-states is the only option before us and anything else is “counter-factual,” which is only a barely diplomatic way of calling it naïve fantasy. That’s dismissive, it’s not a good argument.

Erekat, for her part, looks at the same factors and suggests that a different approach is needed. Whereas Ibish’s adherence to the current formulation is akin to that of a zealot, Erekat is open to alternatives. She considers the reasons Ibish cites in support of the two-state solution as proof of why this approach has failed. After all, she argues, considering all the international consensus and politics around this notion, if there has been no progress toward this goal for twenty years, what is there to do but consider alternatives?

Yet as glib as Ibish is in dismissing out of hand the idea that a new approach might be necessary, Erekat seems also to blithely dismiss the existing international consensus and how difficult it would be to reorient the global political sphere to a whole new solution, one which Israel would bitterly oppose. What emerges from the conversation is a disconnect with real politics in both directions.

The feeling was similar at J Street’s recent conference. There was an undeniable sense that the flagship two-state lobbying group has arrived in a big way. Joe Biden, Martin Indyk, Nancy Pelosi, and Tzipi Livni headed what was by far the organization’s most impressive list of speakers in its five-year history of national conferences. There were many other members of Congress who also spoke or attended the conference’s various functions. The organization has clearly acquired the clout it wanted, and the refrain at the conference that, as Ibish contended, the two-state solution is the only solution was repeated over and over to raucous cheers.

Yet the repetition itself suggested some level of desperation. There was also a palpable sense that the two-state solution is in dire jeopardy.

J Street’s president Jeremy Ben-Ami pointed out that under the current formulation, Palestinians would have to allow an international force to defend the fledgling state’s borders. As Erekat notes, this is a severe infringement on perhaps the most basic tenet of sovereignty, the right to self-defense. Ben-Ami also flatly stated that the Palestinians would have to accept the fact that no refugees would return within Israel’s finally established borders.

When I asked Ben-Ami if he was concerned that these might be terms Palestinians could not accept, he responded: “I think the ultimate deal will involve sacrifices and compromises. I don’t know what they will be but they will be hard to sell and all of us will have a tough selling job to do and we have to be ready to do that.” On the other hand, Yousef Munayyer, Executive Director of the Jersualem Fund told me: “As far as Palestinians are concerned, the right of return is a human right. In my view, human rights are not negotiable.” Munayyer’s view echoes that of most Palestinians from across the political spectrum. Many (though far from all) are willing to negotiate on implementation, but there seems to be an universal agreement among Palestinians that the right of return must be fully recognized. This issue is being unwisely glossed over by supporters of the current process.

Ibish also stated that he saw little downside to the current talks “unless they completely collapse.” I actually see a very different danger. Collapse would not be so bad. Unlike in 2000, when the Camp David II talks collapsed, there are few who expect these talks to succeed, and the agreement to bring any deal to a public referendum alleviates concerns that the leaders will give away too much. These were the factors that had the Palestinian Territories at the boiling point thirteen years ago. Collapse today will not bring about a strong response, it will merely bring the situation back to where it was before John Kerry put so much effort into restarting the talks.

No, the danger here is that an agreement will be struck between the parties that will pass in an Israeli referendum but will fail in a Palestinian one, a concern I explained in detail recently. Such an outcome will allow the Palestinian public to be painted as rejectionists, which will likely make even the meager pressures on Israel from Europe and the even thinner ones from the United States disappear completely, making any process, be it geared toward one state or two, impossible to move forward for years to come.

What’s needed now is a reassessment. The terms of the current two-state process will not work. Palestine is expected to become a state with Israeli enclaves carved deep into it, in the settlements of Ma’ale Adumin and Ariel; it is expected to sacrifice its right of self-defense; and it is expected to give up on what is perhaps its most emotionally meaningful national tenet: the refugees. I can’t imagine a serious observer of the Palestinian public considering this acceptable, and ramming such an arrangement down the throats of either side is a recipe for disaster, not peace.

But that shouldn’t mean that the two-state solution must be abandoned, nor that a one-state formulation needs to remain off the diplomatic table. The issue is not one or two states, but a formulation where two nations can co-exist. We need to reject the notion that the Palestinians can accept less than full sovereignty and a substantive redress of refugee rights. We also have to accept that Israeli Jews are not going to be prepared to become a minority again, and that neither Zionism nor Palestinian nationalism are going to simply be eliminated or fade away in a sea of pragmatism.

In 1993, intrepid Israeli and Palestinian leaders really did produce an unprecedented breakthrough that resulted in the Oslo Accords. Politics and the disparity of power turned the deal sour. That can be done differently today. Hanging on to twenty years of failure is unworkable, but change for the sake of change is not a game that can be played in Palestine-Israel. One-staters and two-staters have been at odds for too long. If people of good will on both sides can come together, that can create an international political and diplomatic momentum to reframe a solution that can actually work.

Syria’s declaration that it would accept a Russian proposal to hand over its chemical weapons to an international body was the latest in a string of surprises around international concern over the ongoing, horrific civil war in that country. It is extremely premature, at this point, to declare the threat of a US escalation over, but the delay this proposal produced does go a long way toward lowering the heat on the crisis and, at minimum, stretching the timetable.

President Obama’s willingness to bring this idea to the U.N. Security Council opens the door to averting a U.S. strike and pushes back the likely strike date and a congressional vote on Obama’s decision. That has led to a collective sigh of relief, at least for the moment, throughout the country. And nowhere has that sound been louder than in the offices of the American-Israel Public Affairs Committee (AIPAC).

The debate has been a difficult one in Washington. A hawkish minority see striking Syria as a necessary deterrent, both to Bashar al-Assad reusing chemical weapons and emboldening Iran to pursue nuclear weapons, a decision hawks think will be influenced by a perception that the U.S. is so reluctant to get involved in another military escapade that it will not back up threats of using force. That’s what is meant by “protecting U.S. credibility.” But the majority of the U.S. public and, at least for the time being, the House of Representatives seems to be opposed to Obama’s idea of hitting Syria.

In one of a series of surprises around this issue, AIPAC publicly dove in to the Syria debate in DC, and faced the most daunting challenge they had in many years. One of the things that gives AIPAC its air of invincibility is their astounding record of success on Capitol Hill. One of the reasons they have that record is that they rarely get into fights they are not sure they are going to win. This one was far from that.

A vote held immediately after the president announced he was going to request authorization from Congress would have likely been unsuccessful. Some, myself included, believed that a full court press by the president combined with hard lobbying by AIPAC and the Saudis would, over the course of time, sway enough votes to give the president what he wanted. I’m pretty sure the Senate, in any case, will support Obama. The House is certainly more questionable.

If the vote in either chamber went against the president, it would mean an unprecedented loss for AIPAC. They’ve lost before, but never when they were working with, rather than against, the president of the United States. That they got involved with such an iffy proposition can only be explained by an Israeli desire to see Obama win this one, but also for the Israeli government itself — which, under Prime Minister Benjamin Netanyahu has faced unprecedented criticism for interfering in U.S. politics — to remain distant from the debate. In a most unusual development, it is Obama who keeps talking about Israel being a factor in his decision. AIPAC has adamantly refused to name Israeli concerns as a reason for their support of an attack on Syria.

Chemi Shalev, the very sharp Washington correspondent for the Israeli daily Ha’aretz wrote:

If AIPAC goes ‘all out,’ as Politico reported on Thursday, and ‘250 Jewish leaders and AIPAC activists will storm the halls on Capitol Hill beginning next week,’ but the House of Representatives nonetheless votes against the President, then the lobby’s image of invincibility, to which it owes much of its influence, will inevitably be jeopardized.

I’m not sure AIPAC’s air of invincibility would be jeopardized so much as it might be slightly diminished, another step on the unfortunately long road to normalizing the U.S. discussion of Middle East policy.

The other, younger and more moderate side of the Israel Lobby, J Street, had its own problems with the Syria issue. Internal debate in the organization had a stymying effect and left them without a position. While some were content with no stance from the “Pro-Israel, Pro-Peace” lobbying group, their silence can hurt them in the long term on the Hill.

Long-time DC observer Ron Kampeas has it just right when he says:

One of the most effective ways for lobbyists to accrue influence on the Hill is to convey to overwhelmed congresspersons and their staffers that the lobby has the expertise to help them arrive at an informed opinion. And if in addition to expertise, your lobby has a cadre of seasoned staffers who are able to shape a lawmaker’s concerns into legislative language that is likely to attract cosponsors and even achieve passage (the golden ring for a body that passes less than five percent of its proposed legislation), then you have influence.

J Street has been able to make some headway in recent years in campaign fundraising. But they have not been able to establish themselves as a reliable source of expertise on Capitol Hill. AIPAC remains a source for expert analysis, and that has a great effect on how members of Congress and their staffers, except for those few who actually have their own expertise on the Middle East, end up voting on Middle East matters. As Kampeas says, J Street wants influence, “…and answering ‘We dunno’ on Syria is not the way to go about earning it.”

J Street bills itself as the group that “has Obama’s back.” That involves giving him political cover to exert some moderate pressure on Israel to negotiate with the Palestinians, which, to date, they really have not been able to deliver (but they’re young — AIPAC also took a good number of years to build the sort of gravitas it has). J Street can also recover from the Syria crisis, as long as it doesn’t have more incidents where its own membership and leadership are so divided on an issue that they can’t take a stance.

But AIPAC has already taken a hit by openly lobbying, and declaring that it will flex serious muscle, in support of a military action that, for better or worse, is opposed by the majority of US citizens. If the issue does come to a vote, which still seems likely, and they lose one or both congressional chambers (which I don’t think will happen, but I hold a minority view), it will be a more serious blow. That’s reinforced by the fact that not only AIPAC, but also a lot of the more mainstream Jewish groups that tend to follow it, like the American Jewish Committee and World Jewish Congress, have come out forcefully behind a strike on Syria, and continued to press the point, even after the Russian proposal.

But I don’t think this will be as damaging as either Shalev or MJ Rosenberg think it will be. There is still no significant opposition to AIPAC’s lobbying power; this question was not directly connected to Israeli policy; and the most powerful tool in AIPAC’s arsenal — the public US misunderstanding of the Middle East, the Arab world and Israel, and especially the history of the Israel-Palestine conflict — is still in place, as is the perception that AIPAC speaks for, not the Jewish community as is often argued, but Jewish donors. US Jews make up a wildly disproportionate fraction of individual political gift givers, but while some large donors like Sheldon Adelson or Haim Saban are very clear about the decisive role Israel plays in where their money goes, it is far less clear how important Israel is in broader Jewish donations, and it’s virtually certain that the issue is not as prominent as is commonly argued.

Still, just by going so public with the Syria issue, AIPAC has suffered a setback, and this has not been lost on Israelis. Leaders and opinion makers in Israel from the liberal Ha’aretz to veteran Israeli diplomats are criticizing AIPAC for their actions on Syria. It’s not a huge hit, but AIPAC will feel it. If only someone, be it J Street or another group, would just take advantage of this opportunity…

Ron Dermer, the man who is rumored to be the replacement for Israel’s Ambassador to the United States, Michael Oren (who resigned today), has been compared to Karl Rove. The comparison is an apt one.

Oren, an academic who easily slipped into the role of Israeli Prime Minister Benjamin Netanyahu’s lead US propagandist, projected an image that was a bit friendlier in its Americanism. His academic stature, his experience of having written a best-selling book on the 1967 war that was very well-received in popular circles (less so in more critical academic environments) and his general demeanor was meant to soften the hardline Israeli leader’s image while still representing the Likud’s hawkish views in the US.

Dermer, whose experience is much more imbued in politics, will likely cast a different, more Machiavellian shadow. He is steeped with neoconservative connections, comes from a family that was heavily involved in politics and is undoubtedly reflective of the more hawkish strains even among the Likud. When rumors of his likely appointment first surfaced at the end of 2012, Marsha Cohen wrote this excellent and concise profile of Dermer for LobeLog.

Unlike Oren, Dermer is opposed to a two-state solution, having referred to it as a “childish matter,” though he later backed off the statement. But Dermer, who has long been a political adviser to Netanyahu and his lead speech writer, was also a key figure in arranging the controversial trip to Israel taken by then-Republican Presidential candidate, Mitt Romney prior to last year’s election. In fact, despite his father having been a Democratic mayor in Florida, Dermer’s Republican and neoconservative roots run very deep.

But Dermer understands very well the need to work in a bipartisan fashion as an Israeli representative in Washington. “I haven’t encountered [ideology] as being much of an obstacle. We don’t get into deep conversations about our world views,” Dermer told the Washington newspaper, Politico. “Did Churchill and Roosevelt have a good relationship? You have foreign affairs, and you work together on issues where you agree.”

Also unlike Oren, Dermer is prone to more direct language. When New York Times columnist Thomas Friedman wrote about the self-evident truth that the US Congress is “bought and paid for” by Israel’s lobby, Oren said that “…Unintentionally, perhaps, Friedman has strengthened a dangerous myth.” Dermer, on the other hand, went on the warpath against the Times as a whole, saying the paper, well-known for its long-standing editorial support of Israel but not necessarily its settlements, “…consistently distort(s) the positions of our government and ignore the steps it has taken to advance peace. They cavalierly defame our country by suggesting that marginal phenomena condemned by Prime Minister Netanyahu and virtually every Israeli official somehow reflects government policy or Israeli society as a whole.”

That is likely to be a good snapshot of the differing styles of Oren and Dermer, the latter being much less inclined to diplo-speak, but with a much keener knowledge of conservative US politics. This will likely to serve him well as Israel becomes more and more a right-wing issue, a shift that Netanyahu embraces. While bi-partisanship remains the byword for pro-Israel lobbying, the money from the Jewish community, which is key and which continues to pour into the political coffers of Democrats, is increasingly coming from Jews who are either Republicans or whose views on Israel break with those of many Democrats. This split among Democrats was laughably visible during the spat at the Democratic National Convention last year over the forced inclusion of a plank in the party platform opposing the division of Jerusalem.

Oren was certainly no bridge-builder. He was sharply critical of the centrist group J Street and feuded with them off and on during his tenure. Dermer will likely be even more disdainful of even the tepid criticism of Israeli policies that J Street offers, much less groups that are more forthright.

But Netanyahu is well aware that the Palestinian issue, despite John Kerry’s many travels, is dropping farther and farther down on the list of US priorities. And the likely appointment of someone like Dermer is further evidence that Netanyahu also is willing to see the US right-wing take more ownership of the pro-Israel agenda, while campaign contributions and the continuing illusion that Jewish money is closely tied to a pro-Israel agenda keeps the Democrats toeing the line.

In the long run, this sort of characterization of the Israeli image is likely to alienate more and more US citizens, including a majority of Jews. But Bibi has never cared much about the long-term view, as the comeuppance will hit Israel long after he has left office. Ron Dermer, who shares a similar outlook, is Bibi’s kind of guy.

While Secretary of State John Kerry was in Israel declaring his aim to “exhaust all the possibilities of peace” to try to stop wasting the Obama Administration’s time and energy on the futile effort to find a resolution to the Israeli occupation of Palestinian lands, Congress was illustrating once again why the United States cannot play a constructive role in this conflict.

Congressional activity this month has been largely focused on Iran and, to a lesser degree, Syria. But a few events demonstrated that, despite President Barack Obama’s lofty goals and rhetoric about peace, Congress has continued its long-term, bi-partisan shift to the right on this issue. Interestingly, one of the most illustrative examples was actually a bill in support of peace and a two-state solution to the conflict.

That bill, H.Res.238, titled “Expressing the sense of the House of Representatives regarding United States efforts to promote Israeli-Palestinian peace,” was brought by California Democrat Barbara Lee, one of the most ardent pro-peace voices in Congress. The bill is mostly unremarkable; it does nothing more than re-state what is, ostensibly, long-standing US policy. Yet, if anyone was paying any attention to the bill, they would notice that one of the provisions “calls on the Israeli Government to cease support for and to prevent further settlement expansion in the Occupied Territories.”

This is, of course, official US policy, but in practice, it is opposed by most of Congress and the Israel Lobby. Obama found out how difficult it can be to pursue US interests and enforce official US policy early in his first term when he attempted to get Israel to comply with this very idea.

The bulk of Lee’s bill, both in the preamble and the eleven “resolved” clauses, is an unequivocal praise of US peace efforts, from Ronald Reagan through Obama, and an absolute commitment to Israel’s security. Yet the bill has only four co-sponsors and was immediately referred to the House Foreign Affairs Committee, where it will quite certainly die. It is telling that on the same day Lee introduced this bill, she put out two press releases, neither of which mentions H.Res.238.

While Lee has to find a way to bulk up her pro-peace credentials quietly, so she won’t incur the wrath of AIPAC (which, despite Lee representing the very liberal areas of Berkeley and Oakland, California, is very strong in her district), those who oppose any sort of resolution of this conflict operate openly and proudly. The so-called “Israel Allies Foundation,” an ultra-right wing group which opposes any sharing of Jerusalem, will celebrate the anniversary of the Israeli occupation with an event in the Rayburn House office building of the House of Representatives. According to their announcement, the event will include speeches from Congress members while “Jewish and Christian leaders” gather with their assembled flock to pray.

As Lara Friedman of Americans for Peace Now explains, “IAF was ‘pioneered’ by far right-wing Israeli former MK Benny Elon, a longtime opponent of the two-state solution, a strong supporter of the settlement movement, a devotee of the “Jordan is Palestine” approach, and an advocate of “transfer” of Palestinians.  Elon has authored his own “peace plan” whose first point is: “Government Decision: Declaring the Palestinian Autorithy [sic] an enemy.” He and his views have long received a warm welcome from some on Capitol Hill, including as recently as February of this year.”

It is telling that, as Kerry was preparing for his latest excursion to Israel, Congress was very quiet about Israel-Palestine peace. Aside from Lee’s meaningless bill, there was hardly a peep on Capitol Hill about Kerry’s trip. Meanwhile, the Israeli cabinet was debating whether or not the two-state solution is even Israel’s position in the first place.

The situation has grown so dire that J Street, the self-proclaimed “pro-Israel, pro-peace lobby”, issued an alert to its members asking them to demand that Israel “affirm the Israeli government’s commitment to two states for two peoples.” According to their alert, “For there to be any hope of progress, the Israeli government must state unequivocally that support for a two-state solution is a core principle of its foreign policy – as it has been under every Prime Minister since Yitzhak Rabin.”

This is, however, a patent falsehood. Rabin’s position was never a two-state solution. He initiated the Oslo process, but the endgame was, quite intentionally, never defined before his death. Nor did his successor, Shimon Peres, ever affirm support for a two-state solution while in office. The next Prime Minister, Benjamin Netanyahu, ran for office on an explicitly anti-Oslo platform, and his party, the Likud Coalition, to this day expresses absolute opposition to a Palestinian state as part of its platform. Ehud Barak proposed a two-state solution of sorts, though its terms were clearly never going to be acceptable to the Palestinians. Ariel Sharon removed Israel’s settlements from Gaza, and his closest advisor, Dov Weisglass, said that the purpose of that withdrawal was to freeze the peace process, a statement Sharon never repudiated. And, while Ehud Olmert seemed to support a two-state solution, when the Palestinians offered almost total capitulation on issues of territory, Jerusalem and refugees, his government still rejected it.

J Street is understandably grasping at straws. Without the Oslo framework of a two-state solution, it has no reason to exist, and is very likely to wither and die. It is therefore desperate to maintain the illusion that the peace process as it has existed for the past twenty years is still alive, even though it is clear to any rational observer that it’s not.

Kerry’s current blitz, whether intentional or not, is going to be the final nail in the coffin. As the entire question of Palestine slips behind an Iranian and Syrian curtain for the summer, it will take a dramatic action to bring attention back to it. But that action will not come from John Kerry or Barack Obama. It might come from an Israeli government that could feel emboldened by the lack of attention on the Palestinian Territories to take the sort of actions that Naftali Bennett, who has called for annexation by Israel of 60% of the West Bank, would recommend. It could come from the Palestinians, if they finally choose to face reality and acknowledge that the United States is incapable, due to its “unshakeable bond” with Israel and the enormous influence of the Israel Lobby, of ever pressuring Israel into even the minimal concessions needed to start talks again, let alone bring them to a conclusion.

Or it could happen because this situation, in all its hopelessness and cynicism, finally erupts into sustained violence again. But whatever the outcome turns out to be, we can be sure that in the near term, the issue will move to the back burner. In the long-term, whenever it emerges, the playing field will no longer reflect acceptance of the Oslo process and its endless negotiations to nowhere.

The 2013 American Israel Public Affairs Committee (AIPAC) Policy Conference wasn’t quite the same show of arrogant power that it usually is. There seems to have been a note of unusual concern among the 13,000 or so assembled activists. And those concerns echo some of what AIPAC’s detractors have been saying for some time.

The tone was set by AIPAC’s president, Michael Kassen at the beginning of the conference. In what Ha’aretz reporter Chemi Shalev described as “… an uncharacteristic ‘adapt or die’ alarm to the American Jewish community,” Kassen warned of “the growing allure of isolationism among our new leaders”, which would include an aversion to difficult foreign policy issues…like Israel.

Kassen urged the AIPAC activists to expand the base from its overwhelmingly Jewish one, and highlighted the participation of representatives from the African-American and Latino communities in the conference. Yet, despite this outreach, The Forward’s Natan Guttman reports that “…a look at the audience made clear that AIPAC is still largely an organization made up of white Jewish activists.”

There’s more here. Orthodox Jews are disproportionately represented at AIPAC. The Orthodox community represents around 15% of all US Jews. Support among non-orthodox Jews has been dwindling in a hurry, and despite intense efforts by AIPAC to reach out to younger Jews, the crowd is heavily skewed toward grey hair. Guttman also reports that an AIPAC official he spoke to rejected the idea that AIPAC had lost many liberal Jews to the more dovish pro-Israel group J Street by saying that “…if anything, liberal activists are turning away from the issue of Israel altogether and are not seeking a different kind of political approach.”

What AIPAC seems to be facing is the fact that its base, while very active and willing to mobilize considerable wealth as well as time and energy to support the AIPAC agenda, is aging and increasingly out of touch with most Americans. This is something commentators like myself, MJ Rosenberg and groups like Jewish Voice for Peace have been contending for quite some time. And this is only the tip of the iceberg of AIPAC’s problems.

As reported by Adam Horowitz, a recent NBC News/Wall Street Journal poll showed American support for Israel as opposed to the Palestinians (who got 13%) at 45%, that 55% of Americans believe the United States should treat Israel and the Palestinians as equals, and 69% do not believe Israel and the Palestinians can reach a peace agreement. This demonstrates what the authors of the famed book The Israel Lobby, John Mearsheimer and Stephen Walt, have repeatedly stated: Americans do support Israel, but do not believe it should hold a place any more special than other US allies.

None of this is lost on AIPAC, and it was reflected, to some extent, in Kassen’s statements about Congress, where he expressed concern that many younger Congress members have a “different association” with Israel. But it doesn’t end there. The battle over Chuck Hagel’s confirmation as Secretary of Defense is also casting a shadow on AIPAC, perhaps with some permanent ramifications.

Although AIPAC wisely stayed out of the fight, that didn’t prevent the entire episode from becoming a shining example of just how strong an impact the pro-Israel lobby has on Congress. It seeped deeply into popular culture, with prominent comedian and talk show host Bill Maher openly declaring that “Based on every statement I’ve heard from every Republican in the last two years, the Israelis are controlling our government.” And Saturday Night Live may have decided not to air a skit lampooning the extent to which the Senators questioning Hagel were beholden to the Israel Lobby, but it found a bright new life on YouTube.

The more extreme groups that took on Hagel are heavily tilted toward the Republican Party, and they, in the 2012 election, tried very hard to win Jewish votes for the GOP by portraying it as the “only pro-Israel party.” They failed mostly because very few Jews actually vote based on Israel. But that polarization is undermining one of AIPAC’s major strengths, its bipartisan reach, by alienating more and more liberals and Democrats in general from Israel advocacy.

Finally, many reports from across the political spectrum have noted that AIPAC’s conference this year had a rather thin agenda. The focus was on Iran, and to a lesser extent, trying to protect aid to Israel from both the current sequester and future budget cuts. These are responsive issues — reactions to perceived threats. The conference offered scant vision of a better future for Israel, as it completely ignored the Palestinians. To some extent, one might ascribe this to Israel presently being in a state of flux without a new governing coalition. But it actually is more reflective of Israel’s own lack of interest in peace these days. And the idea of simply managing the conflict is a tough message to sell.

These aren’t new problems for AIPAC, and they’re not going away any time soon. The organization itself has taken note of them, but whether or not they will be able to deal with them is an open question. AIPAC is certainly resourceful, but the simple fact is, the playing field is changing. Americans have major economic concerns, and the entire Middle East is stirring or storming. Israel’s behavior in recent years has been more brazen and the reality of its routine violations of Palestinian human rights and its permanent denial of their civil rights has reached the awareness of more Americans — Jewish and otherwise — than ever before.

The “special relationship” has always been an AIPAC-invented fiction that comes to life because of political, not popular, pressures. It has been the shaky foundation of US policy toward Israel and much of the Middle East since the end of the Cold War and the concomitant diminishment of Israel as a strategic asset to the US. In a time where the US populace is continuing to face a level of economic stress it has not witnessed since the Great Depression, the special relationship façade will be even harder to maintain. And AIPAC is nervous, because they know it.
