Tuesday’s release by the Senate Intelligence Committee of its long-awaited report on the torture by the CIA of detainees in the so-called “war on terror” does not go far enough, according to major U.S. human rights groups.

While welcoming the report’s release, the subject of months of intensive and sometimes furious negotiations between the Senate Committee’s majority and both the CIA and the Obama administration, the groups said additional steps were needed to ensure that U.S. officials never again engage in the kind of torture detailed in the report.

“This should be the beginning of a process, not the end,” said Anthony Romero, executive director of the American Civil Liberties Union (ACLU). “The report should shock President Obama and Congress into action, to make sure that torture and cruelty are never used again.”

He called, among other steps, for the appointment of a special prosecutor to hold the “architects and perpetrators” of what the George W. Bush administration called “enhanced interrogation techniques” (EITs) accountable and for Congress to assert its control over the CIA, “which in this report sounds more like a rogue paramilitary group than the intelligence gathering agency that it’s supposed to be.”

He was joined by London-based Amnesty International which noted that the declassified information provided in the report constituted “a reminder to the world of the utter failure of the USA to end the impunity enjoyed by those who authorised and used torture and other ill-treatment.

“This is a wake-up call to the USA; they must disclose the full truth about the human rights violations, hold perpetrators accountable and ensure justice for the victims,” said Amnesty’s Latin America director, Erika Guevara.

The Senate Committee’s report, actually a 524-page, partially-redacted summary of a still-classified 6,300-page report on the treatment of at least 119 terrorist suspects detained in secret locations overseas, accused the CIA not only of engaging in torture that was “brutal and far worse” than has previously been reported, but also of regularly misleading the White House and Congress both about what it was doing and the purported value of the intelligence it derived from those practices.

Water-boarding, for example, was used against detainees more often and in more of the CIA’s “black sites” than previously known; sleep deprivation was used for up to a week at a time against some suspects; others received “rectal feeding” or “hydration’; and still others were forced to stand on broken feet or legs.

In at least one case, a detainee was frozen to death; in the case of Abu Zubayda, an alleged “high-value” Al Qaeda detainee who was subject to dozens of water-boardings, the treatment was so brutal, several CIA officers asked to be transferred if it did not stop.

While the CIA officers and former Bush administration officials, notably former Vice President Dick Cheney, have long insisted that key information – including intelligence that eventually led to the killing of Osama bin Laden — was obtained from EITs, the report concluded that these techniques were ineffective.

Seven of 39 detainees who were subject to the most aggressive EITs provided no intelligence at all, while information obtained from the others preceded the harsh treatment, according to the report, which relied on the CIA’s own cables and reports.

In some cases, detainees subjected to EITs gave misinformation about “terrorist threats” which did not actually exist, the report found. Of the 119 known detainees subject to EITs, at least 26 should never have been held, it said.

Intelligence Committee Chairwoman Dianne Feinstein, who fought hard for months to release the report over the CIA’s fierce objections, wrote in its Forward that, in the aftermath of the 9/11 Al Qaeda attacks, “she could understand the CIA’s impulse to consider the use of every possible tool to gather intelligence and remove terrorists from the battlefield, and CIA was encouraged by political leaders and the public to do whatever it could to prevent another attack.”

“Nevertheless, such pressure, fear and expectation of further terrorist plots do not justify, temper or excuse improper actions taken by individuals or organizations in the name of national security,” according to Feinstein.

For his part, CIA director John Brennan, a career CIA officer appointed by Obama whose role in the Bush administration’s detention programme remains cloudy, “acknowledge(d) that the detention and interrogation program had shortcomings and that the Agency made mistakes.”

“The most serious problems occurred early on and stemmed from the fact that the Agency was unprepared and lacked the core competencies required to carry out an unprecedented, worldwide program of detaining and interrogating suspected al-Qa’ida and affiliated terrorists.”

But he also defended the EITs, insisting that “interrogations of detainees on whom EITs were used did produce intelligence that helped thwart attack plans, capture terrorists, and save lives.” A fact sheet released by the CIA claimed, as an example, that one detainee, after undergoing EITs, identified bin Laden’s courier, which subsequently led the CIA to the Al Qaeda chief’s location.

With several notable exceptions, Republicans also defended the CIA and the Bush administration’s orders to permit EITs. Indeed, the Intelligence Committee’s Republican members released a minority report that noted that the majority of staff had not interviewed any CIA officers directly involved in the programme.

“There is no reason whatsoever for this report to ever be published,” said the Committee’s ranking Republican, Sen. Saxby Chambliss. “This is purely a partisan tactic” which he said was designed to attack the Bush administration. Republicans also warned that the report’s release would endanger U.S. service personnel and citizens abroad by fuelling anti-American sentiment, especially in the Muslim world.

But Sen. John McCain, who was himself tortured as a prisoner of war in the Vietnam war, defended the report, calling it “a thorough and thoughtful study of practices that I believe not only failed their purpose …but actually damaged our security interests, as well as our reputation as a force for good in the world.”

McCain has championed efforts to pass legislation outlawing torture, particularly because Obama’s 2009 executive orders prohibiting such practices could be reversed by a future president.

Passage of such a law – whose prospects appear virtually nil in light of Republican control of both houses of Congress for the next two years – is one of the demands, along with release of the full report, of most human-rights groups here.

“The Obama administration and Congress should work together to build a durable consensus against torture by pursuing legislation that demonstrates bipartisan unity and fidelity to our ideals,” said Elisa Massimino, director of Human Rights First.

Many groups, however, want Obama to go further by prosecuting those responsible for the EIT programme, a step that his administration made clear from the outset it was loathe to do.

“We renew our demand for accountability for those individuals responsible for the CIA torture programme,” said Baher Azmy, the legal director of the Center for Constitutional Rights, which has represented a number of detainees at Guantanamo, including Abu Zubaydah, in U.S. courts. “They should be prosecuted in U.S. courts; and, if our government continues to refuse to hold them accountable, they must be pursued internationally under principles of universal jurisdiction.”

“The report shows the repeated claims that harsh measures were needed to protect Americans are utter fiction,” according to Human Rights Watch executive director Kenneth Roth. “Unless this important truth-telling process leads to prosecution of the officials responsible, torture will remain a ‘policy option’ for future presidents.”

Noting that health professionals, including doctors and psychologists also played a role in the EITs, Physicians for Human Rights (PHR) also called for legal accountability. “For more than a decade, the U.S. government has been lying about its use of torture,” said Donna McKay, PHR’s executive director.

“The report confirms that health professionals used their skills to break the minds and bodies of detainees. Their actions destroyed trust in clinicians, undermined the integrity of their professions, and damaged the United States’ human rights record, which can only be corrected through accountability,” she said.

Yesterday a Senate hearing was held on the Obama administration’s “targeted killing” program, which you can watch here. It resulted in headlines like this. To date, discussions about President Obama’s use of “kill lists” and assassinations of those deemed as threats to US national security have mostly ranged from criticism and reform recommendations to outright support. But operating independently of the constraints associated with Washington think tanks and Congress is award-winning journalist Jeremy Scahill, who remains a sharp throne in the sides of those who claim that drone warfare enables the US to engage in clean wars. Indeed, the shift towards robotic warfare with no oversight, which has also taken the lives of American citizens, may not be that clean at all, explained Scahill to Amy Goodman of Democracy Now! yesterday:

I called it Dirty Wars because, you know, particularly in this administration, in the Obama administration, I think a lot of people are being led to believe that there’s—there is a such thing as a clean war and that the drone and what’s called targeted killing—I mean, I use that term myself, but it’s actually not—if you think about it, it’s actually not a very appropriate term for what’s going on, because it’s—as we know, these strikes are anything but targeted, in many cases, and we don’t know the—we don’t even know the identities of many of the people that we’re killing in intentional strikes. So, I called it Dirty Wars because there is no such thing as a clean war, and drone warfare is not clean, but also as a sort of allusion to how we’ve returned to the kind of 1980s way of waging war, where the U.S. was involved in all these dirty wars in Central and Latin America, in Guatemala, Nicaragua, Honduras, and beyond. And we’re using—you know, we’re in a world right now where the U.S. is using proxies, that effectively are death squads, in Somalia to hunt down people that the U.S. has determined are enemies. We’re using mercenaries. President Obama continues to use mercenary forces in various wars, declared and undeclared, around the world. You also have the aiding of dictatorships and other, you know, right-wing governments around the world and propping them up. It’s very similar to what Reagan and company were doing in Central America.

I’m looking forward to reading Scahill’s book on this important topic, which is shaping how the world perceives the United States and perhaps impacting national security in a way that officials are not paying enough attention to. Ending a long and controversial battle, the U.S. Senate Tuesday voted 58-41 to confirm former Republican Sen. Chuck Hagel as President Barack Obama’s new secretary of defence.

The confirmation, which followed a more-lopsided 71-27 vote to end a Republican-led filibuster against the decorated Vietnam War veteran, broke mainly along party lines, with four Republican senators joining the 52 Democrats and two independents in the chambre in voting to approve the nomination.

The vote marked a major defeat for hard-line neo-conservatives, notably the Emergency Committee for Israel (ECI) and its chairman, Republican operative Bill Kristol, whose “Weekly Standard” magazine and website published a constant stream of charges against the former Nebraska senator, ranging from anti-Semitism to deep hostility toward Israel, since word that Hagel was Obama’s preferred candidate for the post in mid-December.

ECI and several other well-funded “astro-turf” groups tried first to pre-empt the nomination, which came in January, and then to derail it by promoting a filibuster by Republicans and persuading – albeit unsuccessfully — key Democratic senators considered susceptible to pressure by more-mainstream Israel lobby groups to defect.

In grueling eight-hour testimony late last month, as well as one-on-one meetings with senators, however, Hagel, who served in the Senate from 1997 to 2009, reassured doubters that he was both a strong supporter of Israel’s security and, despite a number of previous public statements suggesting that military action against Iran’s nuclear facilities would be grave mistake, he would indeed recommend such a course of action if all diplomatic efforts to curb Tehran’s nuclear programme fell short.

In a statement issued after the vote, Kristol insisted that ECI was “proud” of its role during the confirmation battle, adding that, “We are heartened that that the overwhelming majority of senators from one of the major parties voted against confirming Mr. Hagel.”

Hagel will now join his fellow-Vietnam War veteran, Secretary of State John Kerry, as one of the three top national-security officials in the cabinet, along with Obama’s national security adviser, Tom Donilon, White House Chief of Staff and former deputy national security adviser Denis McDonough, Vice President Joe Biden, as well as U.N. Amb. Susan Rice, as the president’s key foreign-policy advisers.

Yet to be confirmed is Obama’s choice for director of the Central Intelligence Agency (CIA), John Brennan, the top counter-terrorism official in the White House during most of Obama’s first term.

While Hagel is the only Republican among the top national-security officials, he is widely seen as generally sharing their worldview on key foreign-policy and defence issues – notably, the desirability of maintaining a “light military footprint”, especially in the Middle East; “engaging” actual and potential geo-political foes through diplomacy; using military power only as a last resort; and relying more on multilateral institutions, such as the U.N. and NATO, and regional actors, to address key crisis situations, sometimes derisively referred to by neo-conservatives and other hawks as “leading from behind”.

One basic tenet of their beliefs was expressed by former Pentagon chief Robert Gates two years ago when he told Army cadets: “Any future defence secretary who advises the president to again send a big American land army into Asia or into the Middle East or Africa should ‘have his head examined,’ as Gen. (Douglas) MacCarthur so delicately put it.”

As Vietnam veterans who came to believe that the war in Indochina was a major strategic error – as well as a waste of U.S. blood and treasure – Hagel and Kerry are regarded as particularly sceptical of the effectiveness of military action and of “nation-building” and counter-insurgency strategy – a scepticism also shared by Biden, whose influence on foreign policy is seen as having risen over the past two years.

Biden’s top foreign-policy aide for many years, Tony Blinken, has now taken McDonough’s place as deputy national security adviser.

Indeed, in a column published over the weekend, foreign-policy insider par excellence, David Ignatius, warned that Obama’s second-term team is so unified in their general foreign-policy outlook that Obama “is perilously close to groupthink”.

While both Kerry, who hails from the liberal-international wing of the Democratic Party, and Hagel, who is close to the rapidly disappearing “realist” wing of the Republican Party (of which Gates was also a part), both voted in 2002 to give George W. Bush the authority to go to war in Iraq, they did so with considerable reservations at the time and, within a year of the invasion, began criticising what Obama himself called a “dumb” war.

Hagel’s criticism of the Iraq war – as well as his neutrality in the 2008 race between Obama and Republican Sen. John McCain – has been cited as a major reason why most Republicans opposed his nomination, although not to the extent of supporting an indefinite filibuster against it.

But most political analysts here believe most Republican senators would have gone along with the nomination – as is customary for most presidential cabinet appointees – had the neo-conservatives and their funders, as well as elements of the more-mainstream Israel lobby, not mounted such a vigorous and expensive effort to defeat him.

Unlike most members of Congress, for whom the influence of the Israel lobby looms very large, Hagel spoke out publicly about what he believed were Israel’s poor treatment of Palestinians, the urgent necessity of a two-state solution, the importance of engaging Hamas in a peace process, and the potentially catastrophic dangers of an Israeli or U.S. military attack on Iran.

In at least one interview, he also spoke out against the “intimidate(ing)” influence of what he called the “Jewish lobby” – a phrase for which he was later accused of anti-semitism, and for which he subsequently apologised. (A major component of the Israel lobby consists of evangelical Christians, a core Republican constituency.)

Indeed, during his grueling and less-than-impressive eight-hour confirmation hearing, Republicans focused their questioning almost exclusively on his views regarding Israel and Iran.

Indeed, “Israel” was mentioned 179 times (Iran 171) – more often than Iraq (30), Afghanistan (27), Russia (23), Palestine or Palestinian (22), Syria (18), North Korea (11), Pakistan (10), Egypt (9), China (5), NATO (5), Libya (2), Bahrain (2), Somalia (2), Al-Qaeda (2), and Mali, Jordan, Turkey, Japan, and South Korea (once each) combined.

The questioning was so Israel-centred that the popular satirical weekly television programme, Saturday Night Live, even devoted a skit broadcast over the web depicting Hagel’s Republican inquisitors competing to avow their devotion to the Jewish state.

But whether Hagel will indeed play a key role in determining U.S. policy toward Israel remains to be seen. For now, the much bigger challenge he faces is the implications of the so-called budget sequestration that appears certain to take effect Mar. 1 and as a result of which the Pentagon could face as much as 600 billion dollars in cuts to its budget over the next 10 years in addition to the almost-500 billion dollars in cuts that have already been mandated.

Ironically, the impact of the sequestration on the Pentagon’s budget is also seen as potentially disastrous to the neo-conservatives who opposed Hagel.

Given their strong conviction that Israeli security and global stability rests primarily on U.S. military power, they have spoken out strongly against growing Republican complacency about the effects of sequestration on the Pentagon, fearing that it heralds a resurgence of isolationist sentiment in the party. But instead of focusing primarily on rallying Republicans to compromise with Obama on the budget, they spent significantly more time and resources on defeating Hagel.

The confirmation hearings of John Brennan for director of the Central Intelligence Agency serve as the latest searing reminder of the intellectual rigamortis gripping the national security establishment and how brain dead we have become as a country in addressing strategy and strategic issues.

The sole focus of these hearings has been the country’s ongoing love affair with targeted assassinations carried out by drones against our Islamic extremist adversaries.

Instead of engaging in a real debate over the efficacy of these assassinations as an element of counter-terrorism strategy, we are left with the voices of Republicans who see nothing wrong with the state drawing up its monthly assassination lists and those of Democrats who worry about civil rights issues and want judges to review who the government proposes to assassinate each month.

If ever there was an example of tactics in search of a strategy, this is it. Sadly, this is only the latest example of the national security establishment confusing the two.

This country has witnessed the substitution of tactics for strategy during the last decade as a series of military and civilian leaders have trumpeted the benefits of “counterinsurgency strategy” as the correct approach to our wars in Iraq and Afghanistan. Yet counterinsurgency is nothing more than a tactical approach on the battlefield, which, by the way, has mostly failed miserably when attempted by western militaries over the last century. It is not a strategy.

Killing terrorists by whatever means is also tactics masquerading as strategy — just like counterinsurgency. Our focus on assassinating suspected terrorist foes both by hellfire missiles from above and by Special Forces kicking in doors on the ground in fact reflects a specific approach to counter-terrorism called leadership decapitation. You won’t hear this mentioned in the hearings — but this is the strategic issue under discussion, without, of course, being discussed.

Leadership decapitation as a strategy is short-sighted, bound to ultimately fail, and may in fact increase threats to our country. What is the evidence to support this assertion and where has leadership decapitation been tried? The answer exists in almost every irregular war undertaken by occupying armies over the last century.  The French perfected the technique during their occupation of Algeria in one celebrated example, though that war didn’t turn out well for them. Another current day example is Israel, which has routinely assassinated its adversaries in its futile attempt to prevent terrorist attacks over the last 60 years. Just as the French could not kill their way to victory in Algeria, Israel cannot kill its way to peace and security.

Although you might not realize it, the United States is by far the greatest modern day practitioner of leadership decapitation. How has this strategy worked out for us and why isn’t Brennan being asked about it in his confirmation hearings?

I recall sitting in on a briefing in Afghanistan back in 2010 and seeing the obligatory power point slide with all the red “X’s” through the Taliban’s leadership structure in the province I was visiting.  Stupidly, of course, I mentioned to the briefer: “Well, we must be winning, then.” He laughed and responded: “You could have shown up here for every year for the last few years and seen the exact same slide. They just keep coming back.”

Therein lies the problem. The US has implemented the tactic of leadership decapitation on an industrial scale in Afghanistan over the last three years under the military leadership of General Stanley McChrystal and then his successor, David Petraeus. Both unleashed the Joint Special Operations Command (JSOC) in Afghanistan just as they did in Iraq. In Iraq during 2007 and 2008, JSOC killed many Iraqis, which helped cover the US retreat but that’s about it. JSOC teams and the CIA drone mavens have also killed a lot of the Taliban, but has the Taliban given up?

Setting aside the moral and ethical issues related to state assassinations of people without due process, the broader strategic issue remains — we can’t kill our way out of disputes with Islamic militants that are currently on the receiving end of our hellfire missiles. They will keep coming back until a political settlement is reached or until they are all dead. Since we can’t kill them all, the war will go on.

Still worse, by intervening in what are essentially local political disputes in countries like Yemen, Mali and Afghanistan, we run the risk of provoking exactly the kind of attacks against us that we are supposed to be trying to forestall.

Leadership decapitation is a prescription for never ending war, which may be useful for political purposes in some US quarters (like it is in Israel), but remains a terrible strategy. Just ask the Israelis how it has worked out for them. Despite the comforting illusion of the cost-free, push-button war offered by our standoff drone strikes and our darkly clad soldiers jumping out of helicopters to gun down suspected terrorists, we are playing a dangerous game that may only increase threats to this country.

As much as we might want to believe otherwise, there is no military solution to the political problem of extremist violence. It is a square peg being inserted into a round hole. Al Qaeda-inspired militancy around the Islamic world is at heart a violent protest against modernity that commands no broadly based popular political support. Do we see Saudi citizens (or any citizens, anywhere, for that matter) mounting the barricades in a revolution supporting Al Qaeda’s call for a return to the caliphate? We should let Al Qaeda die its natural death. If anything, America’s military interventions in the developing world have prolonged the relevance of the handful of militants flocking to this banner.

At the very least, sound strategic thinking would deliver us the kind of debate that is so desperately needed on the strategic choices facing this country as we try to decide how best to protect ourselves. The recent confirmation hearings offered us the chance to explore these issues, but the silence from both the executive and legislative branches is deafening.

This country is tumbling into a de facto era of apparently endless drone wars with no critical assessment or alternative views being offered. It’s hard not to draw the parallel to Joseph Conrad’s Heart of Darkness, with the United States ceaselessly lobbing missiles into an unpoliceable, dark, and impenetrable interior just as the ship did in Conrad’s story — firing away futilely at unseen targets in a world gone mad.

Mr. Brennan is the president’s chief counterterrorism adviser and the architect of this model. In a recent speech, he claimed that there was “little evidence that these actions are generating widespread anti-American sentiment or recruits for A.Q.A.P.,” referring to Al Qaeda in the Arabian Peninsula.

Mr. Brennan’s assertion was either shockingly naïve or deliberately misleading. Testimonies from Qaeda fighters and interviews I and local journalists have conducted across Yemen attest to the centrality of civilian casualties in explaining Al Qaeda’s rapid growth there. The United States is killing women, children and members of key tribes. “Each time they kill a tribesman, they create more fighters for Al Qaeda,” one Yemeni explained to me over tea in Sana, the capital, last month. Another told CNN, after a failed strike, “I would not be surprised if a hundred tribesmen joined Al Qaeda as a result of the latest drone mistake.”

Rather than promote the author of a failing strategy, we need a C.I.A. director who will halt the agency’s creeping militarization and restore it to what it does best: collecting human intelligence. It is an intelligence agency, not a lightweight version of Joint Special Operations Command. And until America wins the intelligence war, missiles will continue to hit the wrong targets, kill too many civilians and drive young men into the waiting arms of our enemies.

Senate Majority Leader Harry Reid (D-NV) blocked a vote on this year’s defense budget authorization act because of provisions in the bill that the Obama administration says will tie its hands when dealing with terrorism suspects. Reid explained his impending move on the Senate floor Monday before issuing a letter Tuesday to the Democratic chairman and ranking Republican on the Senate Armed Services Committee. On the floor Monday, Reid said:

But I also say, Mr. President, in its present form, I’m going to have some difficulty bringing this bill to the floor. It contains provisions relating to the detention of terrorism suspects that in the words of national security adviser John Brennan would be, and I quote, “disastrous. It would tie the hands of our counterterrorism professionals by eliminating tools and authorities that have been absolutely essential to their success.

To show you how extremely important it is that we do something about these provisions in this bill that are just wrong, both the Judiciary Committee in the Senate and the Intelligence Committee in the Senate have asked for hearings on this provision in this bill.

In a September speech, Brennan, a deputy national security adviser, decried any “rigid, inflexible approach” to terrorism that would stop the Obama administration from taking its “practical, flexible, results-driven approach that maximizes our intelligence collection and preserves our ability to prosecute dangerous individuals.”

A day after his floor comments, Reid sent a letter the Armed Services Chairman Carl Levin (D-MI) and Ranking Member John McCain (R-AZ) informing them that he didn’t intend to bring the National Defense Authorization Act to the floor until it was stripped of the detention provisions. In the letter, Reid objected to:

[T]he authorization of indefinite detention in section 1031, the requirement for mandatory military custody of terrorism suspects in Section 1032, and the stringent restrictions on transfer of detainees in Section 1033. [...]

I strongly believe that we must maintain the capability and flexibility to effectively apply the full range of tools at our disposal to combat terrorism. This includes the use of our criminal justice system, which has accumulated an impressive record of success in bringing terrorists to justice.

In his floor speech, Reid cited a compromise over last year’s National Defense Authorization Act, which originally included a repeal of the Don’t Ask, Don’t Tell policy on gays in the military. Republicans filibustered the authorization and Democrats relented, taking the DADT repeal out of the bill and agreeing to put it forward later as a separate vote. Reid asked that McCain take the same approach to the terrorism detention provisions in this year’s authorization.
