Although the Obama administration appears to be currently focused on resisting calls to increase sanctions on Iran while negotiations over its nuclear program are in session, the far more dangerous “military option” is alive and well in Washington despite its many pitfalls.

Senator-elect Tom Cotton (R-Ark) told a group of reporters on Dec. 3 that Congress should be considering the “credible use [of] force,” against Iran, according to the Free Beacon. Cotton, who described the ongoing negotiations with Iran as “a sham,” also said the US should consider arming Israel with bunker-buster bombs that could penetrate Iran’s underground nuclear facilities.

A day later, Dennis Ross, Ray Takeyh and Eric Edelman—all of whom have served in the US government—echoed their previous calls for a greater threat of force against Iran in the Washington Post. “The president would be wise to consult with Congress on the parameters of an acceptable deal and to secure a resolution authorizing him to use force in the event that Iran violates its obligations or seeks a breakout capacity,” they wrote Dec. 4.

While the White House has considerably lowered the volume on its insistence that “all options are on the table,” it has maintained the mantra. “We will not let Iran acquire a nuclear weapon—period,” said Vice President Joe Biden on Dec. 6, according to Reuters. “End of discussion. Not on our watch.”

Of course, President George W. Bush considered the so-called “military option” against Iran’s nuclear infrastructure in 2006, but rejected it. The notion of “surgical” air strikes is also absurd: Bush was told taking out Iran’s nuclear infrastructure would require a massive effort. And despite its repeated threats, Israel does not have the capability with which to launch such an effort (unless it resorted to nuclear weapons). Only the US has a sufficiently robust conventional capability to do so. However, the military challenge is greater now than it was back in 2006.

The Military Option Lives On

Iranian Supreme Leader Ali Khamenei declared in June 2014 that the Americans “have renounced the idea of any military actions.” Khamenei was likely reacting to President Obama’s West Point speech a week before. Referring to military action in general, the president said: “Just because we have the best hammer does not mean every problem is a nail.” However, asked for a reaction to Khamenei’s assertion, the White House highlighted another passage in the speech on Iran: “…we reserve all options in order to prevent Iran from obtaining a nuclear weapon.”

Possibly extending the threat into the future, leading Democratic presidential contender for 2016 Hillary Clinton repeated the mantra in March of this year. While arguing that the diplomatic process with Iran should be given enough time to work, she also said she was “Personally skeptical” of Iranian intentions. “[L]et’s be clear, every other option does remain on the table,” she added, according to Haaretz.

Various American pundits (be they hawks or those who are sensitive to Israeli views on the matter) have since labored to keep the military option alive. Harvard Law Professor Alan Dershowitz declared in TV interview on Nov. 24 that if diplomacy fails, the US “should use its military facilities and ability to prevent Iran from developing nuclear weapons.” Israel also keeps the heat on the US by threatening to strike Iran if Washington fails to do so. Dershowitz, however, noted correctly that an Israeli attack “could only ‘set back’ Iran’s nuclear program for a few years.”

Israeli vs. US Military Action

Aside from using nuclear weapons, Israel does not have an effective military option. The extreme range involved greatly reduces the power of Israel’s military reach. Additionally, finding routes to and from the target is dicey, with most countries certain to oppose use of their airspace.

Flying through Turkey is a leading option, but Ankara would not grant permission, and could try to interfere. Cooperation between Israel and some of the Arab Gulf states (sharing the same dim view of Iran) reportedly has increased. But if a southern corridor were available—even if GCC aerial tankers refueled Israeli aircraft en route—the Israelis could only severely damage a few key targets.

By contrast, with access to the Gulf and the Indian Ocean, plus its bases close to Iran, the US could mount a vastly more powerful effort. Carrier battle groups, other naval assets, and large numbers of US Air Force combat aircraft could be used.

Iranian Military Preparations

Despite its public scoffing, Iran is aware that it could face a robust military assault at some point and has thus been busy since 2006 upgrading its ability to deter or confront an attack.

Iran has upgraded its military radar and missile systems with assistance from sources such as China and Russia, as well as a variety of equipment and expertise secured through less official channels. Iran has also enhanced its large arsenal of MiG-29 fighter aircraft and several formerly Iraqi SU-24 fighter-bombers that were flown to Iran at the outset of the First Gulf War. Iran’s navy has also expanded its inventory of missile-equipped fast-attack vessels to confront a more modern navy with an asymmetric threat: “swarming” enemy vessels (overwhelming them with large number of smaller craft).

The most significant upgrade to Iran’s air defense was to have been the potent Russian S-300 anti-aircraft/ missile system. However, in response to a greatly tightened UN arms embargo in 2010, Moscow suspended the deal.

The Iranians claim to be developing their own version of the S-300 (the “Bavar-373”). They also claim to have produced their own models of a host of other foreign air, air defense and naval systems.

Many of these claims are dubious, but as with its own impressive Shahab series surface-to-surface ballistic missile program, Iran has developed quite impressive technical military-related capabilities. Some upgrades and even a few of these indigenous systems probably have been successfully fielded. I observed impressive Iranian improvisation while covering the Iraq-Iran War from inside the US Intelligence Community. For example, the Iranians kept advanced US F-14 fighters in the air far beyond all Pentagon estimates, even producing a large number of parts needed for basic maintenance and minor overhauls.

The Military Option Means War

Veteran investigative journalist Seymour Hersh consulted me regarding his April 2006 New Yorker article about Bush administration deliberations concerning the military option against Iran. My intelligence credentials told me that Hersh had assembled, effectively, a surprising amount of information on the military planning presented to President Bush.

Hersh revealed that one military option included the use of tactical nuclear weapons to destroy vast underground facilities such as the Natanz enrichment complex. Hersh felt, as I do, that as a part of such planning, extreme options are provided, but such an option was highly unlikely to be part of any realistic plan.

Nonetheless, even conventional US military action to destroy or cripple all known Iranian sites, would, as envisaged in 2006, involve a massive effort. The Pentagon anticipated as many as 2,000 military combat flights and a possible duration of a week. Why? In order to reach Iran’s array of nuclear sites, US combat planes would have to smash Iranian defenses leading to and around the targets.

Although unclear back then, it is also possible once the US had decided to go that far, it would also hit Iran’s ballistic missile inventory, manufacturing, and test sites. This would target what many US officials (and the Israelis) consider a potentially nuclear-related sector of Iran’s military-industrial complex: a formidable delivery capability.

Iran would hardly remain passive while all this unfolded. Therefore, the US would have to anticipate attempts by Iran’s large air force to intercept incoming US aircraft, as well as sea- and air-borne attacks against US naval vessels. Finally, dozens of Iranian anti-ship missile sites flanking the Strait of Hormuz would have to be taken out. Given Iran’s post-2006 military upgrades, US aerial combat missions and the length of the assault would have to be increased. Slugging it out with Iran’s anti-aircraft defenses, confronting its air force, fending off its navy, and striking nuclear targets would effectively add up to war.

Among the many adverse consequences, perhaps the greatest concern would be radioactive contamination stemming from attacking sites near large Iranian civilian populations. The Arak reactor complex and a number of other nuclear-associated sites are close to or practically within Isfahan. The Natanz enrichment facility is less than 30 miles from the smaller city of Kashan. And the Fordow nuclear enrichment complex is situated near over a million people who call the holy city of Qom their home. International outcry over radiation leaks, civilian casualties, and other collateral damage could exceed that resulting from the assault itself.

With so many aircraft missions involved, another is the possibility that a few would be damaged or experience in-flight failures, with aircrew falling into Iranian hands. US diplomatic efforts to secure the return of downed flyers would be inevitable (for which Iran would surely exact a high price).

A particularly ominous result could be the very real possibility of an Iranian break with the International Atomic Energy Agency (IAEA) in order to pursue—with lots of expertise and perhaps more residual nuclear capabilities than thought—a nuclear weapon, although probably defensive (precisely what such an attack would try to forestall).

Once hostilities are initiated, Iran might also not end them definitively. While Iran might do very little (or nothing) to sustain the military confrontation, the US could be saddled with the seemingly endless task of keeping large air and naval forces in the Gulf as a precaution against potential retaliation, particularly against frightened Arab Gulf states (several of which could have aided the US effort). Such an open-ended commitment and prolonged instability in the Gulf could become a nightmare for Washington—and plenty of other countries around the globe.

A new Brookings Institution paper, “Preventing a Nuclear-Armed Iran,” has rightly attracted considerable attention. The author, Robert Einhorn, has a distinguished record and was Special Adviser for Non-Proliferation and Arms Control at the State Department from 2009 to 2013. His recommendations must be seen as authoritative.

The paper addresses the issues that are at the center of the ongoing negotiations in Vienna between Iran and the P5+1 (the US, Britain, France, China, and Russia plus Germany). Einhorn recommends key requirements for an acceptable agreement with Iran — requirements designed to prevent Iran from having a rapid breakout capability and to deter a future Iranian decision to build nuclear weapons.

Preventing a rapid breakout capability

Iran’s development of a capability to enrich uranium has been at the core of Western concerns about Iran’s nuclear programme for over a decade. The two enrichment facilities that Iran has built, at Natanz and Fordow, are being used to produce low-enriched uranium for civil purposes but could be used to produce highly enriched uranium for military purposes.

The Nuclear Non-Proliferation Treaty (NPT) prohibits the manufacture of nuclear weapons by states such as Iran but does not prohibit the possession of enrichment facilities. The West’s negotiators therefore have a delicate task: they must contrive to persuade Iran to accept restrictions on its use of this technology — restrictions that would give the UN Security Council enough time, reacting to evidence, to prevent Iran from producing enough weapons-grade uranium for one device (i.e. from “breaking out”).

Einhorn explains that the breakout timeline depends on the numbers and types of centrifuges used and on the nature of the uranium feedstock available for a breakout attempt (for instance, if the feedstock is already low-enriched much less time is required than if it is un-enriched).

He goes on to describe the implications of limiting Iran to between 2000 and 6000 first-generation centrifuges. This creates the impression that these are the sorts of numbers that ought to be agreed to in Vienna. That is unfortunate, because Iran has already installed 19,000 first-generation centrifuges and is using 10,000 of them — and Iran’s President Hassan Rouhani has ruled out the dismantling of any existing capabilities (which his political opponents could portray as a humiliating surrender of Iranian rights).

Einhorn’s choice of what looks like an unrealistically low figure appears to stem from wanting to give the UN Security Council several months to react to evidence of a breakout attempt. However, as he himself implies, several months would be useful only if the Security Council were to want to impose sanctions before opting for force.  In reality, since sanctions have proved ineffective as a tool for coercing Iran, the council would be well-advised to opt for force within a matter of days, and could do so if the P5+1 had pre-agreed that this would be the most appropriate response (see below).

A related concern is possible Iranian development of more advanced centrifuges. With a few thousand third-generation machines, using a low-enriched feedstock, only a few weeks would be required to break out. This concern could be resolved by placing limits on the scope of Iran’s centrifuge R&D, as Einhorn recommends. But tight limits may not be negotiable.

Yet another concern relates to the plutonium-producing potential of a 40MW reactor under construction at Arak. Einhorn describes ways in which this potential could be reduced. Recent Iranian statements suggest that they, too, are working up some proposals. So this concern is likely to be largely allayed, although the risk of a plutonium-based breakout may not be totally eliminated.

Deterring an Iranian decision to build nuclear weapons

In the absence of watertight solutions to these breakout concerns (or to concern that Iran might break out using a small clandestine facility) the West’s negotiators will do well to devote at least as much effort to deterring breakout as to trying to make rapid breakout impossible.

Since 2007 US National Intelligence Estimates have drawn attention to the importance of influencing the cost/benefit calculations of Iran’s leaders, implying that this is likely to be the most effective way of ensuring that Iran does not become a nuclear-armed state.

The framers of the NPT perceived that the treaty’s impact would hang on the ability of parties to recognise a national security interest in supporting nuclear non-proliferation and disarmament. Consequently the only deterrents envisaged in the treaty are verification of nuclear material use by the International Atomic Energy Agency (IAEA), the risk that non-compliance will result in UN sanctions or authorisation of force, and the certainty that non-compliance will lead to a loss of prestige and exclusion from the society of the treaty’s adherents (currently 190 states).

Since 2003 President Rouhani has shown that he understands all this very well. He knows that Iran would pay a high price for breaching its non-proliferation obligations and that acquiring nuclear weapons would bring no benefit, since Iran is not in need of a nuclear deterrent. The signs are that his political opponents, too, have figured that out.

All this needs to be borne in mind when determining whether any additional (going beyond the NPT) deterrents are necessary in the current context.

Einhorn believes that they are.  The most questionable of his recommendations are that: 

  • The Security Council should agree in advance on how to react to any evidence of an attempt to break out or other serious violation of the agreement under negotiation in Vienna;
  • The US Congress should pass a standing authorisation for the use of military force (AUMF) in the event of evidence that Iran has taken steps to abandon the agreement and move towards producing nuclear weapons;
  • The US administration should indicate publicly how it would react to such evidence. 

These recommendations betray a flawed understanding of Iranian psychology. Such public threats would be seen in Iran as humiliating, and would be resented. That resentment could be used to stir up opposition to the agreement and could even end up providing a motive for ditching it. The threats would serve no practical purpose since leading Iranians are already well aware of what they would risk were they to attempt breakout.

More in keeping with Iranian psychology and a more effective deterrent would be a private P5+1 intimation that they will be united in urging the Security Council to authorise force in the event of evidence of a breakout attempt. Nothing more is needed. Iranian diplomats are highly intelligent. 

Conclusion

This paper is heartening. It offers reason to think that the Vienna negotiators can succeed in producing a resolution of Western concerns that Iran will have an interest in respecting. However, as Iran’s Foreign Minister Mohammad Javad Zarif likes to remind us, a resolution will require flexibility from both sides. The West must try to avoid the over-bidding (in pursuit of over-insurance) that doomed the 2004-05 negotiations between Iran and the E3 (the UK, France and Germany).

Robert Einhorn, who served as the State Department’s special advisor on non-proliferation and arms control under President Barack Obama until less than a year ago, has issued an important report, “Preventing a Nuclear-Armed Iran: Requirements for a Comprehensive Nuclear Agreement,” which no doubt reflects much of the thinking of the administration’s main negotiators. It was presented at the Brookings Institution, Einhorn’s current employer, Monday morning with reactions from Dennis Ross of the Washington Institute for Near Policy (WINEP) and Frank N. von Hippel of Princeton’s Woodrow Wilson School. Unfortunately, I was unable to attend but I just noticed that an audio recording of the session is available here

For the short version — the report is some 56 pages long — you should read the Introduction and Summary (pp. 4-10), but Barbara Slavin also published an article about the report on Al-Jazeera America if you want to read an even shorter account that summarizes the main points, highlighting what are likely to be the more contentious provisions. Hopefully, we will be able to offer a real expert’s analysis of the report’s recommendations on the blog by the weekend. Laura Rozen also wrote up a summary on her blog for Al-Monitor.

While, as Einhorn acknowledges, his recommendations could prove problematic to the Iranians, the fact that the ongoing negotiations appear to be proceeding smoothly clearly suggests that the basic elements that he lays out as part of an eventual agreement are not deal-breakers. Indeed, I’m pretty certain the U.S. negotiating team has already put much of this on the table, and the Iranians clearly haven’t rejected any of it.

That said, I find one recommendation particularly objectionable; specifically, one related to actions designed to “convey clearly to Iran’s leaders that any attempt to abandon constraints and pursue nuclear weapons would be met with a firm international response that would be highly damaging to Iran’s interests” in the event that a comprehensive agreement is reached.

The Congress should take legislative action to give the president prior authorization to use military force in the even t of clear evidence that Iran has taken steps to abandon the agreement and move toward producing nuclear weapons.

In other words, as part of the process of sealing a comprehensive accord that would also see Congress lifting nuclear-related sanctions against Iran, Einhorn is calling for an Authorization for the Use of Military Force (AUMF) to be given to the president — any president, presumably, for the life of the accord. While this may help undermine opposition to lifting sanctions as part of a final agreement, I have serious questions about its wisdom under any circumstances. Not only would the Iranians consider this a highly aggressive gesture comparable to putting a “gun to [their] head,” but anyone — especially Democrats — who remembers the uses to which the October 2002 AUMF were eventually put by George W. Bush must surely find this a rather frightening prospect. Imagine if Jeb or Marco or Ted is sitting in the Oval Office. Besides, look what happened to the proposed AUMF on Syria. Will an AUMF really be politically necessary to get enough support to lift nuclear-related sanctions if a comprehensive agreement along Einhorn’s thinking is reached? And think of all the potential provocateurs — Israel’s right-wing leadership and its backers here, Saudi Arabia, the MEK — who would be lining up to try to blow up an agreement by, among other things, offering doctored evidence of non-compliance to a nervous or complicit White House. While most of Einhorn’s proposals recommendations appear on their face (at least to a non-technical person) to be reasonable, an AUMF just seems irresponsible.

Syria’s declaration that it would accept a Russian proposal to hand over its chemical weapons to an international body was the latest in a string of surprises around international concern over the ongoing, horrific civil war in that country. It is extremely premature, at this point, to declare the threat of a US escalation over, but the delay this proposal produced does go a long way toward lowering the heat on the crisis and, at minimum, stretching the timetable.

President Obama’s willingness to bring this idea to the U.N. Security Council opens the door to averting a U.S. strike and pushes back the likely strike date and a congressional vote on Obama’s decision. That has led to a collective sigh of relief, at least for the moment, throughout the country. And nowhere has that sound been louder than in the offices of the American-Israel Public Affairs Committee (AIPAC).

The debate has been a difficult one in Washington. A hawkish minority see striking Syria as a necessary deterrent, both to Bashar al-Assad reusing chemical weapons and emboldening Iran to pursue nuclear weapons, a decision hawks think will be influenced by a perception that the U.S. is so reluctant to get involved in another military escapade that it will not back up threats of using force. That’s what is meant by “protecting U.S. credibility.” But the majority of the U.S. public and, at least for the time being, the House of Representatives seems to be opposed to Obama’s idea of hitting Syria.

In one of a series of surprises around this issue, AIPAC publicly dove in to the Syria debate in DC, and faced the most daunting challenge they had in many years. One of the things that gives AIPAC its air of invincibility is their astounding record of success on Capitol Hill. One of the reasons they have that record is that they rarely get into fights they are not sure they are going to win. This one was far from that.

A vote held immediately after the president announced he was going to request authorization from Congress would have likely been unsuccessful. Some, myself included, believed that a full court press by the president combined with hard lobbying by AIPAC and the Saudis would, over the course of time, sway enough votes to give the president what he wanted. I’m pretty sure the Senate, in any case, will support Obama. The House is certainly more questionable.

If the vote in either chamber went against the president, it would mean an unprecedented loss for AIPAC. They’ve lost before, but never when they were working with, rather than against, the president of the United States. That they got involved with such an iffy proposition can only be explained by an Israeli desire to see Obama win this one, but also for the Israeli government itself — which, under Prime Minister Benjamin Netanyahu has faced unprecedented criticism for interfering in U.S. politics — to remain distant from the debate. In a most unusual development, it is Obama who keeps talking about Israel being a factor in his decision. AIPAC has adamantly refused to name Israeli concerns as a reason for their support of an attack on Syria.

Chemi Shalev, the very sharp Washington correspondent for the Israeli daily Ha’aretz wrote:

If AIPAC goes ‘all out,’ as Politico reported on Thursday, and ‘250 Jewish leaders and AIPAC activists will storm the halls on Capitol Hill beginning next week,’ but the House of Representatives nonetheless votes against the President, then the lobby’s image of invincibility, to which it owes much of its influence, will inevitably be jeopardized.

I’m not sure AIPAC’s air of invincibility would be jeopardized so much as it might be slightly diminished, another step on the unfortunately long road to normalizing the U.S. discussion of Middle East policy.

The other, younger and more moderate side of the Israel Lobby, J Street, had its own problems with the Syria issue. Internal debate in the organization had a stymying effect and left them without a position. While some were content with no stance from the “Pro-Israel, Pro-Peace” lobbying group, their silence can hurt them in the long term on the Hill.

Long-time DC observer Ron Kampeas has it just right when he says:

One of the most effective ways for lobbyists to accrue influence on the Hill is to convey to overwhelmed congresspersons and their staffers that the lobby has the expertise to help them arrive at an informed opinion. And if in addition to expertise, your lobby has a cadre of seasoned staffers who are able to shape a lawmaker’s concerns into legislative language that is likely to attract cosponsors and even achieve passage (the golden ring for a body that passes less than five percent of its proposed legislation), then you have influence.

J Street has been able to make some headway in recent years in campaign fundraising. But they have not been able to establish themselves as a reliable source of expertise on Capitol Hill. AIPAC remains a source for expert analysis, and that has a great effect on how members of Congress and their staffers, except for those few who actually have their own expertise on the Middle East, end up voting on Middle East matters. As Kampeas says, J Street wants influence, “…and answering ‘We dunno’ on Syria is not the way to go about earning it.”

J Street bills itself as the group that “has Obama’s back.” That involves giving him political cover to exert some moderate pressure on Israel to negotiate with the Palestinians, which, to date, they really have not been able to deliver (but they’re young — AIPAC also took a good number of years to build the sort of gravitas it has). J Street can also recover from the Syria crisis, as long as it doesn’t have more incidents where its own membership and leadership are so divided on an issue that they can’t take a stance.

But AIPAC has already taken a hit by openly lobbying, and declaring that it will flex serious muscle, in support of a military action that, for better or worse, is opposed by the majority of US citizens. If the issue does come to a vote, which still seems likely, and they lose one or both congressional chambers (which I don’t think will happen, but I hold a minority view), it will be a more serious blow. That’s reinforced by the fact that not only AIPAC, but also a lot of the more mainstream Jewish groups that tend to follow it, like the American Jewish Committee and World Jewish Congress, have come out forcefully behind a strike on Syria, and continued to press the point, even after the Russian proposal.

But I don’t think this will be as damaging as either Shalev or MJ Rosenberg think it will be. There is still no significant opposition to AIPAC’s lobbying power; this question was not directly connected to Israeli policy; and the most powerful tool in AIPAC’s arsenal — the public US misunderstanding of the Middle East, the Arab world and Israel, and especially the history of the Israel-Palestine conflict — is still in place, as is the perception that AIPAC speaks for, not the Jewish community as is often argued, but Jewish donors. US Jews make up a wildly disproportionate fraction of individual political gift givers, but while some large donors like Sheldon Adelson or Haim Saban are very clear about the decisive role Israel plays in where their money goes, it is far less clear how important Israel is in broader Jewish donations, and it’s virtually certain that the issue is not as prominent as is commonly argued.

Still, just by going so public with the Syria issue, AIPAC has suffered a setback, and this has not been lost on Israelis. Leaders and opinion makers in Israel from the liberal Ha’aretz to veteran Israeli diplomats are criticizing AIPAC for their actions on Syria. It’s not a huge hit, but AIPAC will feel it. If only someone, be it J Street or another group, would just take advantage of this opportunity…

Why has Russian Foreign Minister Sergey Lavrov made his dramatic proposal for the Syrian government to not only put its chemical weapons under international control, but also destroy them? There are two possibilities.

This could be a Russian attempt to avert the US military strike on Syria that President Obama called for in response to the Syrian government’s use of chemical weapons against so many of its own citizens on Aug. 21. Fully understanding that support for such a move is weak within Congress, among America’s allies, and in Western public opinion, Moscow hopes that its diplomatic initiative will prevent a strike that would weaken the Assad regime’s ability to defeat its opponents with conventional weapons.

In light of both Soviet and post-Soviet Russian diplomatic efforts, the chance that such cynical motives underlie Lavrov’s initiative cannot be ruled out. But there is another possibility. Considering that Moscow has heretofore denied that Damascus has or ever would use chemical weapons, Lavrov’s proposal could be seen as a stark warning to Assad: either surrender your chemical weapons to international control and destruction, or Moscow will do nothing to defend you against an American strike.

The truth is that these two possible motives are not mutually exclusive. Russia could be simultaneously trying to rally forces in the West wishing to prevent a strike and warning Damascus that its use of chemical weapons last month went too far — even for Moscow.

One thing, though, is certain: Lavrov only made this proposal because Obama has issued a credible threat to strike Syria.

Bashar al-Assad may have accepted the Lavrov proposal because he understands that Saddam Hussein’s non-compliance with the UN Security Council’s weapons of mass destruction inspection program in 2002-03 was seized upon by the Bush administration as justification for a US-led invasion. It is doubtful, though, that Assad will give up his chemical weapons even at Moscow’s behest if he does not feel the threat of a debilitating American attack (even if it’s not an outright invasion).

The immediate reaction of both the Senate and President Obama to the Lavrov proposal has been talk of delaying any such attack — which is exactly what Moscow and Damascus wanted. For the US to incentivize Assad to actually surrender his chemical weapons Washington must maintain the threat of a large-scale attack against him unless Assad complies immediately.

You’re no doubt aware by now of a proposal by Russian Foreign Minister Sergei Lavrov for Syria to hand over its (still only accidentally acknowledged) chemical weapons to international control, which his Syrian counterpart Walid al-Moualem said Syria “welcomes”. Syrian ally Russia was jumpstarted into action after Secretary of State John Kerry apparently went off script in London today by floating the proposal (suggested over a year ago by former Senator Richard G. Lugar) and doubting its feasibility in the same sentence after CBS reporter Margaret Brennan asked if there was any way Syria could avert military action:

Sure, if he could turn over every single bit of his chemical weapons to the international community, in the next week, turn it over. All of it, without delay and allow a full and total accounting for that, but he isn’t about to do it and it can’t be done, obviously.

While it’s too soon to get excited with the proposal’s details still in the making, Kerry’s words have taken on a life of their own  (though some have suggested this was at least somehow related to a behind-the-scenes diplomatic maneuver). The State Department and White House seem to have forgotten to talk to each other before issuing statements on all this earlier today. State Department Deputy Spokesperson Marie Harf called Kerry’s words “hypothetical” and “rhetorical” and said the Russian proposal was considered “highly unlikely”. She also — wait for this — categorically stated that “the Secretary was not making a proposal.” Later the White House said during its daily press briefing that it would take a “hard look” at the Russian proposal, but Press Secretary Jay Carney also repeatedly emphasized that all this would not have occurred without the credible threat of force against President Bashar al-Assad’s alleged actions. He meanwhile urged Congress to vote for an Authorization for Use of Military Force (AUMF) against Syria, which the administration has been strongly pushing for, and which Kerry’s words may have now endangered.

Speaking at the White House during a Forum to Combat Wildlife Trafficking immediately after Carney’s appearance, former Secretary of State Hillary Clinton said she had just met with President Obama and seemed to have the most updated speech on the issue:

…if the regime immediately surrendered its stockpiles to international control as was suggested by Secretary Kerry and the Russians, that would be an important step. But this cannot be another excuse for delay or obstruction.

While many are labelling Kerry’s words a “gaffe”, Clinton strategically tried to frame it as a purposeful move by Kerry, being forced, of course, to include the Russians. Perhaps the White House is hoping everyone will eventually forget Harf’s opposing description.

In any case, here’s Deputy National Security Advisor for Strategic Communications and Speechwriting Ben Rhodes with the most recent WH statement:

It should also be noted that earlier in the day UN Secretary-General Ban Ki-moon had said following the Russian announcement that he was “considering urging the Security Council to demand the immediate transfer of Syria’s chemical weapons and chemical precursor stocks to places inside Syria where they can be safely stored and destroyed” if it was proven that chemical weapons have been used.

It will be interesting to see how Obama tackles all this during his many scheduled interviews today and during his speech to the nation Tuesday night wherein he will urge for military action against Syria, especially considering how a majority of Americans continue to oppose it, even after the release of those horrific videos of the Syrian victims of the Aug. 21 attack.

Sometimes history happens at the moment when no one is looking.  On weekends in late August, the president of the United States ought to be playing golf or loafing at Camp David, not making headlines.  Yet Barack Obama chose Labor Day weekend to unveil arguably the most consequential foreign policy shift of his presidency.

In an announcement that surprised virtually everyone, the president told his countrymen and the world that he was putting on hold the much anticipated U.S. attack against Syria.  Obama hadn’t, he assured us, changed his mind about the need and justification for punishing the Syrian government for its probable use of chemical weapons against its own citizens.  In fact, only days before administration officials had been claiming that, if necessary, the U.S. would “go it alone” in punishing Bashar al-Assad’s regime for its bad behavior.  Now, however, Obama announced that, as the chief executive of “the world’s oldest constitutional democracy,” he had decided to seek Congressional authorization before proceeding.

Obama thereby brought to a screeching halt a process extending back over six decades in which successive inhabitants of the Oval Office had arrogated to themselves (or had thrust upon them) ever wider prerogatives in deciding when and against whom the United States should wage war.  Here was one point on which every president from Harry Truman to George W. Bush had agreed: on matters related to national security, the authority of the commander-in-chief has no fixed limits.  When it comes to keeping the country safe and securing its vital interests, presidents can do pretty much whatever they see fit.

Here, by no means incidentally, lies the ultimate the source of the stature and prestige that defines the imperial presidency and thereby shapes (or distorts) the American political system.  Sure, the quarters at 1600 Pennsylvania Avenue are classy, but what really endowed the postwar war presidency with its singular aura were the missiles, bombers, and carrier battle groups that responded to the commands of one man alone.  What’s the bully pulpit in comparison to having the 82nd Airborne and SEAL Team Six at your beck and call?

Now, in effect, Obama was saying to Congress: I’m keen to launch a war of choice.  But first I want you guys to okay it.  In politics, where voluntarily forfeiting power is an unnatural act, Obama’s invitation qualifies as beyond unusual.  Whatever the calculations behind his move, its effect rates somewhere between unprecedented and positively bizarre — the heir to imperial prerogatives acting, well, decidedly unimperial.

Obama is a constitutional lawyer, of course, and it’s pleasant to imagine that he acted out of due regard for what Article 1, Section 8, of that document plainly states, namely that “the Congress shall have power…  to declare war.”  Take his explanation at face value and the president’s decision ought to earn plaudits from strict constructionists across the land.  The Federalist Society should offer Obama an honorary lifetime membership.

Of course, seasoned political observers, understandably steeped in cynicism,dismissed the president’s professed rationale out of hand and immediately began speculating about his actual motivation.  The most popular explanation was this: having painted himself into a corner, Obama was trying to lure members of the legislative branch into joining him there.  Rather than a belated conversion experience, the president’s literal reading of the Constitution actually amounted to a sneaky political ruse.

After all, the president had gotten himself into a pickle by declaring back in August 2012 that any use of chemical weapons by the government of Bashar al-Assad would cross a supposedly game-changing “red line.”  When the Syrians (apparently) called his bluff, Obama found himself facing uniformly unattractive military options that ranged from the patently risky — joining forces with the militants intent on toppling Assad — to the patently pointless — firing a “shot across the bow” of the Syrian ship of state.

Meanwhile, the broader American public, awakening from its summertime snooze, was demonstrating remarkably little enthusiasm for yet another armed intervention in the Middle East.  Making matters worse still, U.S. military leaders and many members of Congress, Republican and Democratic alike, were expressing serious reservations or actual opposition. Press reports evencited leaks by unnamed officials who characterized the intelligence linking Assad to the chemical attacks as no “slam dunk,” a painful reminder of how bogus information had paved the way for the disastrous and unnecessary Iraq War.  For the White House, even a hint that Obama in 2013 might be replaying the Bush scenario of 2003 was anathema.

The president also discovered that recruiting allies to join him in this venture was proving a hard sell.  It wasn’t just the Arab League’s refusal to give an administration strike against Syria its seal of approval, although that was bad enough.  Jordan’s King Abdullah, America’s “closest ally in the Arab world,”publicly announced that he favored talking to Syria rather than bombing it.  As for Iraq, that previous beneficiary of American liberation, its government wasrefusing even to allow U.S. forces access to its airspace.  Ingrates!

For Obama, the last straw may have come when America’s most reliable (not to say subservient) European partner refused to enlist in yet another crusade to advance the cause of peace, freedom, and human rights in the Middle East.  With memories of Tony and George W. apparently eclipsing those of Winston and Franklin, the British Parliament rejected Prime Minister David Cameron’s attempt to position the United Kingdom alongside the United States.  Parliament’s vote dashed Obama’s hopes of forging a coalition of two and so investing a war of choice against Syria with at least a modicum of legitimacy.

When it comes to actual military action, only France still entertains the possibility of making common cause with the United States.  Yet the number of Americans taking assurance from this prospect approximates the number who know that Bernard-Henri Lévy isn’t a celebrity chef.

John F. Kennedy once remarked that defeat is an orphan.  Here was a war bereft of parents even before it had begun.

Whether or Not to Approve the War for the Greater Middle East

Still, whether high-minded constitutional considerations or diabolically clever political machinations motivated the president may matter less than what happens next.  Obama lobbed the ball into Congress’s end of the court.  What remains to be seen is how the House and the Senate, just now coming back into session, will respond.

At least two possibilities exist, one with implications that could prove profound and the second holding the promise of being vastly entertaining.

On the one hand, Obama has implicitly opened the door for a Great Debate regarding the trajectory of U.S. policy in the Middle East.  Although a week or ten days from now the Senate and House of Representatives will likely be voting to approve or reject some version of an Authorization for the Use of Military Force (AUMF), at stake is much more than the question of what to do about Syria.  The real issue — Americans should hope that the forthcoming congressional debate makes this explicit — concerns the advisability of continuing to rely on military might as the preferred means of advancing U.S. interests in this part of the world.

Appreciating the actual stakes requires putting the present crisis in a broader context.  Herewith an abbreviated history lesson.

Back in 1980, President Jimmy Carter announced that the United States would employ any means necessary to prevent a hostile power from gaining control of the Persian Gulf.  In retrospect, it’s clear enough that the promulgation of the so-called Carter Doctrine amounted to a de facto presidential “declaration” of war (even if Carter himself did not consciously intend to commit the United States to perpetual armed conflict in the region).  Certainly, what followed was a never-ending sequence of wars and war-like episodes.  Although the Congress never formally endorsed Carter’s declaration, it tacitly acceded to all that his commitment subsequently entailed.

Relatively modest in its initial formulation, the Carter Doctrine quickly metastasized.  Geographically, it grew far beyond the bounds of the Persian Gulf, eventually encompassing virtually all of the Islamic world.  Washington’s own ambitions in the region also soared.  Rather than merely preventing a hostile power from achieving dominance in the Gulf, the United States was soon seeking to achieve dominance itself.  Dominance — that is, shaping the course of events to Washington’s liking — was said to hold the key to maintaining stability, ensuring access to the world’s most important energy reserves, checking the spread of Islamic radicalism, combating terrorism, fostering Israel’s security, and promoting American values.  Through the adroit use of military might, dominance actually seemed plausible.  (So at least Washington persuaded itself.)

What this meant in practice was the wholesale militarization of U.S. policy toward the Greater Middle East in a period in which Washington’s infatuation with military power was reaching its zenith.  As the Cold War wound down, the national security apparatus shifted its focus from defending Germany’s Fulda Gap to projecting military power throughout the Islamic world.  In practical terms, this shift found expression in the creation of Central Command (CENTCOM), reconfigured forces, and an eternal round of contingency planning, war plans, and military exercises in the region.  To lay the basis for the actual commitment of troops, the Pentagon established military bases, stockpiled material in forward locations, and negotiated transit rights.  It also courted and armed proxies.  In essence, the Carter Doctrine provided the Pentagon (along with various U.S. intelligence agencies) with a rationale for honing and then exercising new capabilities.

Capabilities expanded the range of policy options.  Options offered opportunities to “do something” in response to crisis.  From the Reagan era on, policymakers seized upon those opportunities with alacrity.  A seemingly endless series of episodes and incidents ensued, as U.S. forces, covert operatives, or proxies engaged in hostile actions (often on multiple occasions) in Lebanon, Libya, Iran, Somalia, Bosnia, Kosovo, Saudi Arabia, the Sudan, Yemen, Pakistan, the southern Philippines, and in the Persian Gulf itself, not to mention Iraq and Afghanistan.  Consider them altogether and what you have is a War for the Greater Middle East, pursued by the United States for over three decades now.  If Congress gives President Obama the green light, Syria will become the latest front in this ongoing enterprise.

Profiles in Courage? If Only

A debate over the Syrian AUMF should encourage members of Congress — if they’ve got the guts — to survey this entire record of U.S. military activities in the Greater Middle East going back to 1980.  To do so means almost unavoidably confronting this simple question: How are we doing?  To state the matter directly, all these years later, given all the ordnance expended, all the toing-and-froing of U.S. forces, and all the lives lost or shattered along the way, is mission accomplishment anywhere insight?  Or have U.S. troops — the objects of such putative love and admiration on the part of the American people — been engaged over the past 30-plus years in a fool’s errand?  How members cast their votes on the Syrian AUMF will signal their answer — and by extension the nation’s answer — to that question.

To okay an attack on Syria will, in effect, reaffirm the Carter Doctrine and put a stamp of congressional approval on the policies that got us where we are today.  A majority vote in favor of the Syrian AUMF will sustain and probably deepen Washington’s insistence that the resort to violence represents the best way to advance U.S. interests in the Islamic world.  From this perspective, all we need to do is try harder and eventually we’ll achieve a favorable outcome.  With Syria presumably the elusive but never quite attained turning point, the Greater Middle East will stabilize.  Democracy will flourish.  And the United States will bask in the appreciation of those we have freed from tyranny.

To vote against the AUMF, on the other hand, will draw a red line of much greater significance than the one that President Obama himself so casually laid down.  Should the majority in either House reject the Syrian AUMF, the vote will call into question the continued viability of the Carter Doctrine and all that followed in its wake.

It will create space to ask whether having another go is likely to produce an outcome any different from what the United States has achieved in the myriad places throughout the Greater Middle East where U.S. forces (or covert operatives) have, whatever their intentions, spent the past several decades wreaking havoc and sowing chaos under the guise of doing good.  Instead of offering more of the same – does anyone seriously think that ousting Assad will transform Syria into an Arab Switzerland? — rejecting the AUMF might even invite the possibility of charting an altogether different course, entailing perhaps a lower military profile and greater self-restraint.

What a stirring prospect!  Imagine members of Congress setting aside partisan concerns to debate first-order questions of policy.  Imagine them putting the interests of the country in front of their own worries about winning reelection or pursuing their political ambitions.  It would be like Lincoln vs. Douglas or Woodrow Wilson vs. Henry Cabot Lodge.  Call Doris Kearns Goodwin.  Call Spielberg or Sorkin.  Get me Capra, for God’s sake.  We’re talking high drama of blockbuster proportions.

On the other hand, given the record of the recent past, we should hardly discount the possibility that our legislative representatives will not rise to the occasion.  Invited by President Obama to share in the responsibility for deciding whether and where to commit acts of war, one or both Houses — not known these days for displaying either courage or responsibility — may choose instead to punt.

As we have learned by now, the possible ways for Congress to shirk its duty are legion.  In this instance, all are likely to begin with the common supposition that nothing’s at stake here except responding to Assad’s alleged misdeeds.  To refuse to place the Syrian crisis in any larger context is, of course, a dodge.  Yet that dodge creates multiple opportunities for our elected representatives to let themselves off the hook.

Congress could, for example, pass a narrowly drawn resolution authorizing Obama to fire his “shot across the bow” and no more.  In other words, it could basically endorse the president’s inclination to substitute gesture for policy.

Or it could approve a broadly drawn, but vacuous resolution, handing the president a blank check.  Ample precedent exists for that approach, since it more or less describes what Congress did in 1964 with the Tonkin Gulf Resolution, opening the way to presidential escalation in Vietnam, or with theAUMF it passed in the immediate aftermath of 9/11, giving George W. Bush’s administration permission to do more or less anything it wanted to just about anyone.

Even more irresponsibly, Congress could simply reject any Syrian AUMF, however worded, without identifying a plausible alternative to war, in effect washing its hands of the matter and creating a policy vacuum.

Will members of the Senate and the House grasp the opportunity to undertake an urgently needed reassessment of America’s War for the Greater Middle East?  Or wriggling and squirming, will they inelegantly sidestep the issue, opting for short-term expediency in place of serious governance?  In an age where the numbing blather of McCain, McConnell, and Reid have replaced the oratory of Clay, Calhoun, and Webster, merely to pose the question is to answer it.

But let us not overlook the entertainment value of such an outcome, which could well be formidable.  In all likelihood, high comedy Washington-style lurks just around the corner.  So renew that subscription to The Onion.  Keep an eye on Doonesbury.  Set the TiVo to record Jon Stewart.  This is going to be really funny — and utterly pathetic.  Where’s H.L. Mencken when we need him?

It’s not clear whether Bill Kristol went to the dentist Thursday and had a prolonged reaction to the Sodium Pentothal he was administered or whether he’s become desperate over the prospect that neoconservatives are losing their hold over the GOP (even his Keep America Safe co-founder, Liz Cheney opposes attacking Syria), but his lead editorial in this week’s Weekly Standard makes public the kind of argument one suspects he usually reserves for the back rooms and private dinner parties with impressionable “princes” of the Republican Party for whom he can serve as their private Machiavelli. The cynicism shown here is truly remarkable. After summarily dispensing with the “statesmanship” argument as to why Republicans should vote yes on President Obama’s AUMF  — and statesmanship has nothing to do with the plight of the Syrian people or the use of chemical weapons; it’s all about U.S. power and credibility — he moves on to the “crass political reasons” why they should do so. Those reasons deserve to be quoted at length:

A Yes vote is in fact the easy vote. It’s actually close to risk-free. After all, it’s President Obama who is seeking the authorization to use force and who will order and preside over the use of force. It’s fundamentally his policy. Lots of Democrats voted in 2002 to authorize the Iraq war. When that war ran into trouble, it was President Bush and Republicans who paid the price. [Editor's note: don't tell that to Hillary Clinton.] If the Syria effort goes badly, the public will blame President Obama, who dithered for two years, and who seems inclined to a halfhearted execution of any military campaign. If it goes well, Republicans can take credit for pushing him to act decisively, and for casting a tough vote supporting him when he asked for authorization to act.

A No vote is the risky vote. In fact, the risk is all on the side of voting No. The only thing that can get Obama off the hook now is for Republicans to deny him authorization for the use of force against the Assad regime. Then the GOP can be blamed for whatever goes wrong in Syria, and elsewhere in the Middle East, over the next months and years. And plenty will go wrong. It’s a Yes vote that gets Republicans in Congress off the hook.

A Yes vote seems to be statesmanlike. …In fact, many voters do like to think they’re voting for someone who has at least a touch of statesmanship, and so casting what appears superficially to be a politically perilous vote could well help the stature of Republicans with many of their constituents back home.

It’s true that a Yes vote will be temporarily unpopular with the base. To support Obama now may seem to invite primary opposition from challengers who would be more in tune with popular sentiment to stay out of the Syrian civil war. For a few weeks after the vote, Republicans will hear such rumblings. But at the end of the day, Republican primary voters are a pretty hawkish bunch. It’s hard to believe they’re going to end up removing otherwise conservative representatives or senators in favor of challengers who run on a platform whose key plank is that Republicans should have voted to let an Iran-supported, terror-backing dictator with American blood on his hands off the hook after he’s used chemical weapons. What’s more, primary elections are more than half a year away. Republican senators and congressmen will have plenty of time to reestablish their anti-Obama credentials by fighting Obama on Obama-care, immigration, the debt ceiling, and a host of other issues.

A Yes vote can also be explained as a vote to stop the Iranian nuclear program. Syria is an Iranian proxy. Assad’s ability to use chemical weapons is a proxy for Iran’s ability to move ahead unimpeded in its acquisition of nuclear weapons. To bring this point home, soon after voting to authorize the use of force against the Assad regime, Republicans might consider moving an authorization for the use of force against the Iranian nuclear weapons program. They can explain that Obama’s dithering in the case of Syria shows the utility of unequivocally giving him the authority to act early with respect to Iran. An Iran debate would pretty much unite Republicans and conservatives and would help mitigate political problems arising from a Yes vote on Syria. The issue of Iran will most likely come to a head before Election Day 2014, probably even before primary elections earlier next year. An Iran resolution means the Syria vote won’t be the most important vote Republicans cast in this session of Congress—it won’t even be the most important foreign policy vote.

Of course, these arguments are also being made with Republicans by AIPAC and other institutions of the Israel lobby, but not nearly so publicly. Which, in my view, makes this such a remarkable document.

This week’s Weekly Standard appears devoted almost entirely to the Syria vote, with featured contributions by Fred Barnes, Reuel Marc Gerecht, Gary Schmitt, Fred Kagan, and Stephen “Case Closed” (a reference to his book purportedly proving Saddam’s ties to al-Qaeda) Hayes (who just came out with a paywalled op-ed actually opposing Obama’s AUMF unless it’s amended to authorize a much bigger commitment). Schmitt directs his comments at the 2016 Republican presidential aspirants — the three senators currently considered most likely to run (Marco Rubio, Rand Paul, and Ted Cruz) have voted against or indicated opposition to the AUMF — in ways similar to Kristol’s:

No doubt, there are conservatives who, like the president, want simply to pivot away from the Middle East altogether and believe that’s what the public wants as well. But what the public wants today and what it sees as important down the road will almost certainly not be the same. In 1999, John McCain went against the majority of his congressional GOP colleagues, supported a military intervention in Kosovo, and stole a march on his nomination opponents in appearing more presidential. He was joined by then-governor George W. Bush in support of the intervention, and soon enough the polls showed a majority of Americans in agreement.

On the other side of the coin, another senator with presidential aspirations, the relatively hawkish Democrat Sam Nunn, voted in 1991 against the congressional authorization for the first Gulf war and now admits it was the greatest mistake of his career.

In short, conservatives, especially those thinking that they could be sitting in the Oval Office one day, ought to think long and hard before they reject a sensible, if not perfect, authorization for the use of force.

So, it’s clear that Kristol and the Weekly Standard see the upcoming vote as a critical test of their enduring influence over the Republican Party.

An acquaintance who, like me, used to work on foreign affairs in the U.S. government, told me the other day that he thought that, in going after Bashar al-Assad, President Barak Obama had decided on an approach more akin to Bush 41 (carefully building a consensus) than Bush 43 (you are either with us or against us). He added that, to make a success of bombing Syria as Bush 41 made of bombing Iraq in the first Gulf War, the president didn’t just need the support of the Congress and the public but also of NATO, the Arab League, and a coalition of the willing. But the obstacles Obama faces are much greater than those George H. W. Bush did and I don’t think the analogy to the first Gulf War really holds.

The circumstances today are totally different than in 1990, when strong impulses to rally behind the United States borne of the Cold War continued to animate allied decisions. There is no longer a common external threat to draw other countries into formation behind us. Two decades of perceived American indifference to allied and friendly views on a wide range of issues have taken their toll, especially in the Middle East and Europe. The Syrian issue, although greatly complicated by foreign players within the region and beyond it, has no global context of Manichean struggle to channel reactions to it.

In 1990-1991, as the USSR collapsed, the Russians ceased to be a significant factor in the Middle East, erasing the bipolar order of the past and freeing Saddam wrongly to assume that he could act on his own and with impunity against Kuwait. In 2013, the region is driven by regional rather than global dynamics but, thanks to events in Egypt and Saudi disillusionment with the U.S. policies of the past thirteen years, Russia is on the make and poised for a comeback as a strategic player in the Middle East.

In 1990, the world’s Muslims were solidly anti-communist and mostly well-disposed to the United States. Anti-communism is now an irrelevancy. The fallout from 9/11, the failed American pacification campaigns in Iraq and Afghanistan, and U.S. identification with Israel’s attacks on Lebanon and Gaza have replaced Muslim goodwill with animosity. The appeal of American values has been tarnished by numerous abuses, and the worldwide credibility of U.S. intelligence is low. The British defection from the enterprise leaves our pretensions to speak and act for the “international community” in tatters. (The poodle has left the American lap and walked off the job. The French are halfheartedly applying for the position. They aren’t house-trained and will want too much to get it.)

Major actors in the international community, such as it is, value the institutions that embody it, the U.N., the U.N. Charter, and international law, to none of which the U.S. has deferred, except highly selectively, since our Kosovo intervention with NATO in October 1998. Fifteen years of selective adherence to treaties and laws greatly detract from the credibility of our claim now to be acting to enforce the Geneva Convention of 1929 in Syria, especially when the “international community” as well as the Arab League and our own allies have declined to authorize us to do so. Abroad, we are not seen as righteous vigilantes on behalf of humanitarian principles but as proponents of the theses that military might confers right, that military actions trump diplomacy (which is mostly just for show), and that political solutions are for wimps. There will be no international rally behind an essentially unilateral U.S. attack on Syria. On the contrary, if we carry out such an attack, it will further diminish our international standing and leadership. Illegal actions to enforce legality are the very definition of cynicism.

When Saddam invaded Kuwait in 1990, it was a clear and abrupt challenge to the rule of law in the post-Cold War era, not to mention an obvious threat by a single, very selfish state to monopolize the world’s major sources of energy. From the outset, the U.S. and Saudi Arabia sought and received U.N. authorization to “form a posse” to deal with these challenges. The atrocities in Syria are the product of a civil war, not of a violation of any other country’s sovereignty. The situation in Syria is also an unfolding humanitarian catastrophe that has been allowed to fester for over two years, with respect to which the U.N. has been marginalized and is now ignored by us and some other players. Whatever happens, it is highly unlikely that we will accede to the desire of other great powers that we defer to the U.N. and hence to their interest in international norms of behavior. For this reason, President Obama is likely to take a drubbing from allies, friends, and adversaries alike at the upcoming G-20 meeting in St. Petersburg, where he must make the case for what he has unilaterally decided but Congress has yet to approve.

To my mind, the most interesting and significant aspect of what has just happened — the issuance of an order to attack, followed by its sudden suspension until Congress can review it — is the domestic rediscovery of the fact that wars cannot be successfully mounted or sustained without a measure of domestic political backing. (In tactical terms, this is an attempt to share the political blame and pin the charge of vacillation and weakness on the Republican House.) There is a chance that, in the course of debating the order to attack Syria, someone will actually read our Constitution (Article I, Section 8, Clause 11) on how wars are to be legally authorized. I note that, in his statement Saturday, the president claimed inherent authority to make war. I hope that this concept, like the divine right of kings in its pedigree, is appropriately challenged in the debate. Unfortunately, the divine right of legislatures, an equal problem in the breakdown of the separation of powers and hence the operation of our system of government, will not be challenged.

Getting our country, our government, and the president’s authority in foreign affairs into the multiple conundrums in which they now find themselves was the work of many administrations and Congresses, not just poor Mr. Obama (as the venerable Israeli peace activist, Uri Avnery aptly termed him in a recent column). I don’t think anyone could envy the position our president is now in domestically or internationally. He was dealt a bad hand. He has not played the game in such a way to pick up better cards since. Now his bluff has been called.

In light of Amb. Hunter’s post about the important constitutional implications of Obama’s decision to seek an Authorization for the Use of Military Force (AUMF) from Congress, I wanted to make a few quick observations about the move and some of its possibilities.

1) This could set the stage for a long-overdue debate about the role of the United States in the post-Cold war, post-Iraq War world. Poll after poll has shown a great ambivalence in public opinion over whether the U.S. should act as the world’s policeman (no) and whether it should sustain its military dominance and its ability to act unilaterally if its security is threatened (yes). As Amb. Hunter pointed out,  a serious debate would also address Washington’s “indispensability” and what that means, as well as whether the U.S. is willing to act, unilaterally if necessary, to uphold what it regards as “international norms.” These are huge questions that began to be debated in Congress over the Libya intervention but never captured public attention in a major way, in part because a) Obama, as commander-in-chief, never felt obliged to seriously engage in it; and b) the UN Security Council had authorized military action, thus giving it an international legitimacy which, at least at this point, action against Syria is very likely to lack. 

2) The coming debate is likely to expose and exacerbate deepening fissures in the Republican Party over Washington’s role in the world. With the exception of Ron Paul and John Huntsman, all of the Republican primary candidates in the 2012 election ran on what might be called a neo-conservative/aggressive-nationalist foreign-policy platform which today is best embodied by Sens. McCain and Graham, the mainstream media’s go-to Republican foreign-policy spokesmen.  It’s significant that in a statement issued shortly after Obama’s announcement today, the duo suggested they could not support “isolated military strikes in Syria that are not part of an overall strategy that can change the momentum on the battlefield, achieve the President’s stated goal of Assad’s removal from power, and bring an end to this conflict…” By taking such a position, they clearly invite opposition from a pretty broad range of their fellow-Republican lawmakers (especially in the House) associated with the non-interventionist (some would say neo-isolationist) positions associated with Ron Paul, and the realist stance represented by someone like Sen. Corker, as well as fiscal conservatives associated with the Tea Party. (Not that these three groups are entirely discrete factions.) The debate could really turn into a battle royal among the Republicans over who speaks for the party when it comes to foreign policy.

3) Similarly, Democrats are likely have a difficult time bringing their ranks into line. Many of them will be torn between their loyalty to Obama and the White House (and their historic fear of being called soft on the enemy of the day) on the one hand, and anti-war forces on the other. The latter have time to mobilize their troops against military action in a major way and, in any event, play a much stronger role in the party at the grassroots level (to which House members, in particular, have to pay attention), than inside the Beltway.

4) One other point worth noting. The proposed AUMF includes an intriguing “whereas” clause that suggests an important change of position with respect to Iran’s participation at Geneva 2.0, if it should come to pass:

Whereas, the conflict in Syria will only be resolved through a negotiated settlement, and Congress calls on all parties to the conflict in Syria to participate urgently and constructively in the Geneva process…”

Of course, the invitation for Iranian participation is not made explicit, but Obama hinted at this during his PBS interview last week, as pointed out by Barbara Slavin.
