With a 72-hour truce apparently holding in Gaza and Israel having ended its ground operation, now seems like a fair time to assess where things stand. Has anyone emerged from this war in a better position? Is there anything that can, at least in a cynical and Machiavellian sense, be called a victory?

Palestine

It goes without saying that the overwhelming majority of the physical destruction was borne by the people of Gaza. At this point, the numbers are just horrifyingly grim: 1,968 dead — 1,626 of whom were civilians — and 7,920 wounded. While we don’t have a precise percentage, we do know that there are at least 2,111 children and 1,415 women among the wounded.

The already mangled sole power plant in Gaza was damaged even further, leaving most of the strip without electricity. The United Nations Development Program estimates between 16 and 18,000 homes were severely damaged or destroyed and over half a million Gazans (out of a population of roughly 1.8 million) have been internally displaced.

As one report put it, “…almost every piece of critical infrastructure, from electricity to water to sewage, has been seriously compromised by either direct hits from Israeli air strikes and shelling or collateral damage.”

This is clearly the worst hit Gaza has taken, demonstrably more severe than Operation Cast Lead (2008-09). Even so, there seems to be no appetite there for a return to the status quo ante from the mass media, social media or my own interactions; the call for an end to the seven-year Israeli blockade of Gaza as part of a lasting ceasefire persists.

Concomitantly, Hamas, though still facing the same problems as before (an inability to pay civil employees, increasing isolation in the region due to the decline of the Muslim Brotherhood and little leverage of their own to address Gaza’s economic woes) has been strengthened politically by Israel’s onslaught.

Once again, Hamas survived without conceding, and that grants them a considerable boost. It won’t last forever, of course, but they have re-established themselves as the leaders in confronting Israel. The unity agreement between Hamas and Fatah has also apparently survived the fighting, though in practice the destruction of Gaza’s infrastructure makes implementation there much more difficult. Palestinian unity was the primary reason that Israeli Prime Minister Benjamin Netanyahu lied to the Israeli public about the fates of the three murdered Israelis in June — the event that sparked the spiral into this violence. That, too, can be counted as a victory.

The relationship between the Palestinian Authority and Hamas is very unclear. It seemed strained in June, as Israel swept through the West Bank under the pretext of looking for the three youths who they knew were already dead. Palestinian President Mahmoud Abbas continued his security cooperation with Israel during this time and even prevented demonstrations against Israel’s actions after the fighting started in Gaza.

But as the fighting wore on, Abbas, who at first supported Egypt’s ceasefire proposal that Hamas could not accept, began supporting Hamas’ demands to end the fighting. By the end, Abbas was accusing Israel of war crimes, threatening to sign the Rome Statute and thereby bringing Israel to the International Criminal Court, and calling for the blockade of Gaza to be lifted. Officially, the PA has not broken the unity agreement — another major victory for Hamas.

Yet Hamas could not have missed the signals of this round. They managed to increase global awareness of the blockade, but found themselves being pressured by the Arab League. Turkey and Qatar remain Hamas’ only allies, but they proved largely ineffectual against the United States, Egypt, and the Saudis (despite the Saudi rhetoric, which was varied and clearly unsympathetic to Hamas but sympathetic to Gazan civilians).

At this point, efforts again appear geared at getting the PA back into the business of controlling Gaza’s borders. For Hamas, that will be a mixed blessing. If it happens with the unity agreement intact, then Hamas will have won itself a clear place in the Palestinian political system, and Israel will have to accept it if they let the PA administer the border crossings. Israel won’t like that at all, but the US, Egypt and the Saudis may push hard for such an arrangement in the interest of stability. This would also be a step toward ending Hamas’ control over the strip, to the extent that there is anything that can legitimately be called Palestinian control in Gaza.

Israel

The Israelis are not buying into Prime Minister Netanyahu’s claim of decisive victory in this operation, but they are overwhelmingly supportive of his decisions. In part, this reflects an appreciation of reality — Israel did a lot of damage in Gaza, but didn’t do itself a lot of good. The other part is that most Israelis believe that Netanyahu didn’t really want things to go this far.

Bibi whipped his country into a racist frenzy when those young men were kidnapped. Knowing Israeli sensibilities as he does, Bibi knew that their deaths would end the story, but a kidnapping would continue to enrage hard-line sectors of the Jewish populace. The idea was to drum up popular support for a series of actions against Hamas which, Netanyahu hoped, would shatter the Palestinian unity deal.

But Bibi’s right flank immediately started pressuring for escalation. Bibi didn’t want that, but once Hamas started fighting back in earnest, the political pressure for a broader operation was more than he could resist. The pressure continued, as did Hamas’ firepower, probably more than Bibi expected them to use. As matters escalated, Netanyahu had to keep re-defining the mission’s goals. First it was punishing Hamas for the murders, then it was a “quiet for quiet” arrangement — in other words a straight up ceasefire.

That idea was not met with public approval. By this time, Israelis were considerably frightened. Hamas’ rockets were penetrating much farther into Israel than ever before, and while the Iron Dome defense system limited the actual damage, it did not limit the spread of fear. So, the Israeli goals became diminishing Hamas’ rocket ability and eliminating what Israel called “terror tunnels.”

The tunnels are very frightening to Israelis and Israel appears to have eliminated them. But there are two big problems with this narrative. Firstly, destroying the tunnels was the main focus of the ground operation, but Egypt managed to destroy hundreds of them without a military attack; they simply flooded them from the Egyptian side. The second problem is that, while Israeli fears about the tunnels are understandble, it’s worth noting that Israel has known about them for quite a while and Hamas hadn’t used them until this round of fighting began.

So what, really, did Israel achieve? It caused Hamas to use about two-thirds of its rockets, but those can be replenished, and at the point of the ceasefire, Hamas and other factions were still firing at will. Israel destroyed Hamas’ tunnels, but they had been there for years and were posing only a potential threat. Israel meanwhile failed to destroy the unity agreement, at least for now.

These gains were bought by Israel at the price of Palestinian blood, and a higher domestic death toll than Israel is accustomed to (67, including three civilians). As much as it appears like Tel Aviv doesn’t care about that price, it is clear that Israel’s image took a major hit in this engagement. Formerly sympathetic media showed injured Gazan children and destroyed neighborhoods. Even the United States expressed concern about the disregard for civilian life and called the attack on a United Nations school that was housing refugees “disgraceful.” The UK is now reviewing all military sales to Israel, and Spain has suspended all military sales.

Those things should not be overstated. England and Spain are merely expressing their displeasure at Israel’s total disregard for civilian life in Gaza and will re-commence their sales to Israel in due course. Despite its occasional statements, the US has repeatedly defended Israel throughout this episode and is using the ceasefire to send more supplies to its ally.

Still, Israel has definitely come out of this appearing far more villainous than Hamas. That’s going to make a difference going forward. Israel may no longer be able to bury the issue of the Gaza blockade, a form of collective punishment that has only helped solidify Hamas’ rule in Gaza and has deprived the people while failing to prevent the buildup of Hamas’ rockets. No one bought into the anti-Iran portion of Netanyahu’s rhetoric, another failure for Israel. Even in the US Jewish community, this onslaught shook a lot of pro-Israel faith and sent other Jews out of their living rooms and into the streets.

I see nothing but an illusion of victory here for the Israeli right. And for the rest of the country, the surge in extreme nationalism made Israel look a lot more like a fascist state than the Middle East’s “only democracy.”

The United States

There’s really little to say here. The US will look back at its actions in the Middle East in 2014 as one of the lowest periods in its diplomatic history. Secretary of State John Kerry failed to broker a ceasefire, and when he finally got one, it was broken within two hours. While both sides had different stories about who really broke the ceasefire, the Israeli narrative dominated and allowed Netanyahu to tell the United States not to “second-guess him” about Hamas.

Leaks to Israeli media disparaged both President Barack Obama and Kerry. The US again showed the world that while it does have the power to pressure Israel, it is not going to use it, no matter how bloody Israel’s actions become or how many times it insults its American patron. The US meanwhile stands alone in defending Israel’s actions.

The Obama administration has occasionally had some good ideas about the Middle East, but has repeatedly shown it doesn’t have a clue about how to implement them. It paints itself as an advocate for peace, but shows no willingness to back up its words in the face of Israeli resistance. That’s why it’s more important now than ever for Europe or some other outside party to push its way past the US in dealing with this issue.

When Israel, or any country, engages in armed conflict with a guerrilla group, even if that group controls significant territory and resources, it is a virtual truism that the longer the fighting persists, the greater the gains for the non-state actor. In Gaza, Hamas’ quasi-governmental position still leaves it in the role of the guerrilla enemy. And with the events of the past few days, it is worth asking if Israel is not losing this “war.”

The Israeli government is pointing to several objectives, chiefly the destruction of some tunnels in Gaza that lead into Israel and at degrading and diminishing Hamas’ ability to fire rockets. While the frequency of rocket fire from Gaza has decreased somewhat in the last few days, it has obviously not stopped. And when the heat dies down, Israelis are bound to notice that the tunnels Netanyahu is making such a point about had not been used for infiltration until after the fighting began.

By the same token, Israelis might also notice that, at this writing, 35 Israelis have been killed, three of them civilians. In the five and half years since the end of Operation Cast Lead, a grand total of 38 Israelis were killed by Palestinians, combining both Gaza and the West Bank, 10 of them civilians. When a sober assessment of all this is made in Israel, the result might not look top good if Netanyahu has so little to show for it.

Hamas, on the other hand, may have quite a bit to toot their collective horns about. Yes, the death toll, which is now topping 700, is horrific, as is the number of injured (now over 4,100), not to mention the damage to Gaza’s already crumbling infrastructure and the destruction of 500 homes, some 16 mosques and two hospitals. But Hamas, despite having lost a lot of popularity over the years, is standing up to Israel and insisting on an end to its siege of the Gaza Strip, which is preventing many common goods from getting in and just about all exports from going out.

Moreover, Hamas has put all of Israel on high alert, disrupting daily life not just in the south, but as far north as Haifa, and as far east as Jerusalem. Residents of Tel Aviv are not living in “the bubble” they did five years ago; now they are repeatedly hustling to shelters when warning sirens go off. Most importantly of all, Hamas forced US and European airlines to suspend all flights to Israel for two days when a rocket from Gaza came within a mile of Ben Gurion International (BGI) airport.

That victory might be far more profound than what anyone in Gaza has so far realized. In the United States, the Federal Aviation Administration (FAA), which is as apolitical as a federal agency can get, suspended flights to Israel for obvious reasons: in the wake of the downing of the Malaysian flight over Ukraine, a rocket coming that close to BGI was too much of a risk for the FAA to take.

But in the United States, any decision that Israel doesn’t like instantly becomes politicized, even though it is obvious to anyone who knows anything about the US government that the president had nothing to do with this call — it is entirely within the FAA’s bailiwick. But Israel complained that the decision sent “the wrong message,” to which the State Department replied, “The only consideration in issuing the notice was the safety and security of our citizens.”

Former New York City Mayor Michael Bloomberg immediately flew to Israel and stated that he felt as safe there as anywhere. But Bloomberg’s grandstand play also serves to undermine the rationale for this entire operation by Israel — after all, if it is that safe when fire is being exchanged, how can Israel justify their own losses, let alone the far more massive toll of death and destruction in Gaza?

Republican Senator Ted Cruz, never one to let a lunatic theory pass by unexploited, went so far as to accuse President Barack Obama of using “…a federal regulatory agency to launch an economic boycott on Israel, in order to try to force our ally to comply with his foreign-policy demands.” No kidding, he really said that.

With all of this tumult resulting from one rocket, Hamas can certainly claim a major win in this regard.

Hamas has also made political gains. Palestinian President Mahmoud Abbas has been working to help find a ceasefire formula. In the past, Hamas would disavow Abbas’ authority to negotiate for them, but they have not done so this time. That’s because Abbas is arguing for Hamas’ terms for a ceasefire. That makes Abbas, rather than any Egyptian or Turkish leader, the contact point between Hamas and Israel. It also symbolically demonstrates that the Palestinians have a unified government — Abbas is presenting himself as the leader of all of Palestine, including Gaza, without saying so or ruffling any of Hamas’ feathers.

Israel’s goal in starting this round of fighting was to destroy the unity deal between the Palestinian Authority and Hamas. Thus far, the opposite seems to have materialized. Abbas is in agreement with Hamas’ goals, and is apparently fully representing them. That represents a major failure for Netanyahu. But that outcome is far from assured.

The statement by Hanan Ashrawi, a member of the Palestine Liberation Organization (PLO) executive committee, that the Palestinians would now pursue their goals through the international judicial system, seemed like a potential game-changer. It is telling, though, that after Ashrawi made her statement, welcomed by many of us who advocate for an equitable international judicial system and see its value for the Palestinians, there has been virtually no follow-up.

Indeed, going, for example, to the International Criminal Court (ICC) might have very different effects than one might imagine for the Palestinians. Unlike the United Nations Human Rights Council, which is really the one place at the UN that Israel’s complaints of unfair treatment have real merit, the ICC is not a politically driven body. Its unfortunate bias against poor countries, countries that do not have great power backing and, particularly, sub-Saharan African countries is based on what cases are brought before it, and that, sadly, is entirely dictated by politics.

But if the ICC were to investigate the fighting in Gaza, it might well be inclined to investigate both sides. And, if Palestine, with its new-found recognition as a state, were to go to the ICC, they would be placing themselves under its jurisdiction. The simple fact is that, while Israel has devastated civilians, Hamas has also been targeting civilians, albeit with much less success. That, however, is also a crime. But Israel has not joined the ICC, so it is not under ICC jurisdiction. The ICC could not compel any of its leaders to appear, much less answer charges.

Israel is reportedly considering a ceasefire deal that would be modeled after the 2006 accord achieved in Lebanon. If that were followed, the PA would assume control over Gaza. Hamas might have a tough time arguing with that, given their defense of the unity government. The PA would have, presumably, the same armament it has in the West Bank, but all other factions would be forced to disarm, surrender rockets and dismantle tunnels under international inspection. And in exchange, Israel would end its blockade of Gaza’s coastline and ease restrictions at the border crossings.

That sort of agreement would absolutely represent a Palestinian victory, but it would also mean Hamas would no longer exercise control over Gaza. They would sacrifice their ability to re-launch an armed resistance until they could find a way to re-arm clandestinely. That might prove very difficult — they haven’t been very successful at it in the West Bank, largely due to PA efforts. For the group itself, it would mean a major loss. But the objectives of the current fighting would have been achieved — ending the siege and preserving the unity government.

Netanyahu would also claim victory in such an event. But it would remain clear that the Palestinians were now unified and speaking with one voice. Abbas could no longer see Hamas as an opposition party, but as part of his constituency, and this whole experience seems to have forced him out of his habit of going along with US and Israeli diktats. The Palestinians would be strengthened politically, even as they lose Hamas’ paltry military capabilities. Netanyahu would have also failed to destroy the unity government, which is what this was all about. But a nullified Hamas would be an easy image to present as a victory to the Israeli people, who have been lied to by Bibi from the beginning and are thus largely unaware of the real aims of this onslaught.

It remains to be seen if such a ceasefire agreement is actually being considered. I really can’t see Bibi agreeing to it; he is absolutely obsessed with keeping the Palestinians divided, and his stated refusal to even consider a two-state solution means he is obsessed with good reason. I’m not at all sure Hamas would accept such a deal, even though it might boost them politically. And right now, it is Hamas, not Israel, who is dealing from a position of strength. Despite the pounding Gaza is getting, Hamas seems to have gotten the issue of lifting the siege on the table, as even the US keeps saying that the “underlying issues” must be dealt with, and even when the EU is scolding Hamas, they are also calling Israel’s acts “criminal.”

When Hamas initially refused the ceasefire, I understood, but also believed that they would eventually be forced to take that deal, and that their refusal would result in many more dead Palestinians. That latter part has proven true, and it is still possible that Israel, the US and Egypt will eventually force Hamas to accept the terms they dictated. But it’s looking less and less likely that the Egyptian ceasefire accord will be the one Hamas has to accept. Is it worth the price in blood? Only the people of Gaza can answer that question.

The two ceasefire proposals aimed at ending the accelerated violence in Gaza and Israel also offer one of the best illustrations of the Israel-Palestine conflict. The circumstances and the content of each proposal demonstrates very well why outside pressure is necessary to end this vexing, seemingly endless struggle and just how differently Israelis and Palestinians view both current events and the conflict as a whole.

Let’s look at the two proposals. Egypt, acting as the United States normally does, worked out the details of its ceasefire idea primarily with Israel. The deal reflects the Israeli and Egyptian agenda: it mostly follows the formula of “quiet for quiet,” essentially bringing back the status quo ante of early June. It offers Hamas a vague promise of future negotiations to address the siege of the Gaza Strip. But this is hardly something Hamas will put stock in. The 2012 ceasefire agreement, which was negotiated by then-Egyptian President Mohamed Morsi, a man much friendlier to Hamas than the current Egyptian leadership, also made such a promise and it never came to anything. Finally, Egypt says it is willing to open the Rafah border crossing between Gaza and Egypt more widely but only if Hamas allows Palestinian Authority security to police it instead of their own people.

It’s not hard to see why Hamas viewed that offer, and its exclusion from the talks, more like a call to surrender than a ceasefire. Indeed, that’s what it was. The offer was likely made with the expectation that Hamas would refuse it. That is one reason, along with the fact that I don’t see them getting a better deal from continued fighting, that I thought Hamas should have taken it. But it is perfectly understandable that they did not.

Hamas recently confirmed its terms for a ceasefire: Israel should lift the siege it has imposed on the strip for the last seven years, and release all the prisoners it arrested last month during its sweep of the West Bank while the Netanyahu government was keeping the Israeli public and the world from immediately finding out that the three youths who were ostensibly being searching for were already dead. In exchange, Hamas would agree to a ceasefire.

Those terms are undoubtedly unacceptable for Israel, and Egypt for that matter. They won’t because they don’t have to. Each of them, by themselves, is far more powerful militarily than Hamas. Together, they are even more so, and they have the backing of the United States, quite openly. More discreetly, they also have the backing of much of the Arab leadership in Saudi Arabia and most of the Gulf states, which, with the exception of Qatar, generally despise Hamas and the Muslim Brotherhood, Hamas’ ideological forebears.

Therefore, Israel and Egypt will follow the most basic rule of international politics: might makes right. They will ignore minor details like peace, security for both Gazans and Israelis, and most of all, international law. They will do this because they can.

But really, what is Hamas demanding? That they be set free from a crippling siege that has remained in full force with only minor and occasional amelioration through ceasefires and flare-ups alike. That seems like a perfectly reasonable demand, an expectation, even, especially since Israel claims that it is no longer an occupying power in Gaza. Inside, that may be true, but Israel controls the airspace, the offshore areas and the overwhelming majority of Gaza’s borders, except for the southern one, which Egypt controls. It permits only limited amounts of supplies into the strip, bars many things like chemicals and building materials entirely and allows almost no exports. According to most international law experts, Israel has the responsibilities of an occupying power proportionate to the control it exerts. Thus, Israel is not responsible for internal policing of Gaza, but it is responsible for the effects of its control — meaning the siege is illegal.

Hamas, and most Palestinians, surely see the demand to lift the siege as a minimal one. Hamas is not, after all, demanding that the entire occupation regime be lifted for a ceasefire to take place, nor that Israel, for example, repair the damage it has done to Gaza’s only power plant or compensate Gaza for the destruction of its airport.

But the majority of Israelis see the siege as a defensive measure. They believe lifting it will enable Hamas to reload with much more and better weapons and then they will strike much harder and might, at that point be able to deliver a real blow to Israel, something far beyond their ability right now. Most Israelis do not see the Egyptian proposal as a Hamas surrender, but rather as a very reasonable return to the status quo ante.

Israelis believe their leaders when they say they are not targeting Gazan civilians, despite the rather conclusive evidence to the contrary (such as bombing an open beach with children playing on it, destroying a hospital with patients in it, bombing the homes of Hamas leaders with their families inside, etc.). Palestinians see the destruction of civilians, homes, and Gaza’s infrastructure as justifying firing rockets at Israel. Israelis see Hamas as willing to sacrifice its own civilians in order to kill Jews. Palestinians see Israel as offering them a choice of being bombed to death relatively quickly or starved to death more slowly.

The point is not whether one view or the other is right or wrong (we all obviously have an opinion on that, myself included). The point is that these are two completely irreconcilable views. When we combine that with the massive imbalance of both political and, especially, military power involved and the sense both sides have that they cannot afford to be seen as letting the “violence of the other” dictate the terms of the ceasefire, we see the impasse. So where does that leave us?

Ultimately, it is more than likely that Israel’s overwhelmingly greater ability to cause death and destruction, along with the fact that Hamas (and Gaza in general) has very few countries willing to stand up for it in the international arena, will force Hamas to accept a deal that closely resembles the one they just rejected. But all that will do is reset the clock to ticking down to the next round.

If there were a genuine desire to find a way to stop this endlessly repeating loop, there would need to be forceful international mediation. Such mediation cannot come from those countries that stand with Israel against Hamas (Egypt, the US) nor those who have the reverse position (Turkey, Qatar). It can only come from an international delegation, either under the auspices of the UN or in the form of a committee from a variety of countries. There would need to be international guarantees and sanctions applied to both sides (and, crucially, actually enforced) for violations of any agreement.

That, of course, is not something Israel would ever accept. It has no reason to sacrifice its impunity, because it has might — militarily, economically and politically — on its side. And as long as that is true, it simply has no good reason to moderate its position. In this regard, it acts like any other country. And the ineffectual Hamas rockets, terrifying though they may be to so many in Israel, are not coming anywhere near giving Israel any incentive to change.

The bottom line: it is the United States, which unconditionally runs interference for Israel in the Security Council and which arms Israel and completely ignores the fact that Israel uses US-made weapons in blatant contravention of US law, that is fueling this fire. It will support Israel in its refusal to allow any other outside party to mediate, and will certainly ensure that Israel retains its impunity. And the US will do this against the better judgment of its president and secretary of state, both of whom are well aware that the security of Israelis and the very lives of Palestinians both depend on ending the 47-year old occupation, lifting the siege of Gaza and allowing the Palestinians to achieve their freedom. Such is the effect of domestic politics in the United States, and it is playing out in blood in the Gaza Strip right now.

As former top State Department intelligence specialist Wayne White points out for Lobe Log, in the absence of a tenable ceasefire agreement, the quagmire that is the Syrian civil war will likely intensify, thereby only worsening post-Assad scenarios.

“The bottom line is that a sort of Catch-22 situation is continuing on the diplomatic front,” wrote White last week. “[T]he side that believes it has the upper hand and will eventually prevail militarily (currently the opposition) is unlikely to accept a truce because a ceasefire would interfere with its ability to sustain intense military pressure on the other side.”

Anyone hoping for even a temporary cessation to the deadly violence would have been shattered by Bashar al-Assad’s rare speech in Damascus on Sunday, where he thanked his base for showing “the whole world that Syria is impervious to collapse and the Syrian people impervious to humiliation.” The defiant president refused to step down while claiming he was ready to talk with the opposition. But as White noted, Assad did so while urging his supporters to continue fighting against the “bunch of criminals” who oppose him.

This political gridlock makes creative diplomacy appear all the more important in bringing an end to the ongoing carnage that’s ravaging the country. Asked if the Iranians should be included in diplomatic efforts, former top CIA analyst Paul Pillar told Lobe Log that ”Any multilateral diplomatic initiative has a better chance of success if all the parties with leverage to exert are included.”

Pillar is well aware of the fact that this may be easier said than done. UN and Arab League mediator Lahkdar Brahimi remains in between a rock and a hard place — expected to please everyone while not being able to please anyone. The brutal force that the government deployed to crush what were initially peaceful protests seems to have pushed both sides beyond the point of no return. Presently, the opposition’s recent disgust with Brahimi’s choice of Russia as the venue for his recent truce initiative has been overshadowed by the regime’s accusations of Brahimi’s “bias toward sides known for conspiring against Syria and the Syrian people.”

It was in this atmosphere of hopelessness that news surfaced Wednesday of over 2,130 Syrian prisoners being released by the regime in exchange for 48 Iranians abducted during what they claimed to be a religious pilgrimage in August. (The opposition had said that the Iranians were members of Iran’s Revolutionary Guard, which Tehran adamantly denied.) The massive exchange again raises the question of whether Iran has a role to play in bringing an end to the Syrian crisis.

This question may be more difficult to answer now than it was when the fighting first broke out over a year ago. On the one hand, the prisoner swap supports the argument that Iran holds considerable influence over Assad’s government and could help shift events toward a “peace process”. Throughout last year, Iran tried to inject itself into diplomatic processes taking place over Syria by, for example, supporting a failed United Nations-Arab League peace plan and making is own proposal in December.

On Syria, Iran is pursuing a dual track policy of support for the Syrian Government as it faces internal instability, while pressing Damascus to take measures to reduce tensions, open the grounds for negotiations with the opposition and find a path towards national unity and conciliation,” said Ambassador Seyed Hossein Mousavian, the former spokesperson for Iran’s nuclear negotiating team (2003 to 2005) and now a visiting scholar at Princeton University.

“Iran can play a major constructive role on the Syrian crisis,” he said.

That Iran reportedly included Syria in its five-point proposal presented during nuclear talks in Moscow last June could be an indication that it would be willing to bargain away its support for the regime — if it was provided with enough incentive. (Recall how the government of Mohammad Khatami reportedly offered to end Iran’s material support to Palestinian groups opposing Israel in a March 2003 proposal for “broad dialogue” with the US that was rejected by the Bush administration.)

On the other hand, this prisoner swap, which amounts to about 44 Syrians for every 1 Iranian, displays the extent to which Iran is tied to Assad’s repression. If the war in Syria is really about the major powers that are backing each side (Russia, Iran and China for the regime, and Turkey, Saudi Arabia, Qatar and Western countries for the opposition), and since the fall of Assad would indeed be a “major blow” to the Iranians, can Tehran really be expected to help its foes?

For now, talks with Iran over its nuclear program are expected to resume shortly, even if they’re already off to a bad start. But as the fighting in Syria produces ongoing suffering while the Israeli-led campaign against Iran’s nuclear program continues to involve the potential of a costly military conflict, considering all options on the Syrian diplomatic table be more important now than ever.

“If the Iranians are excluded from a joint effort to do something helpful, they are only more likely to do something unhelpful, said Pillar, who advocates a more flexible US negotiating posture with Iran.

“Engagement with Iran over Syria also can reap secondary benefits in other areas, such as the negotiations over Iran’s nuclear program, by expanding channels of communication and bargaining space,” he said.

The vote in the United Nations General Assembly on the Palestinian application for non-member status is a foregone conclusion. They’re going to win and it’s not really going to matter much, at least in the short term. Nonetheless, the decidedly warped world of diplomacy around the Israel-Palestine conflict has managed to give us a small degree of drama around the bid, which is also illustrative of why there seems to be so little hope for change.

I posted a draft of the resolution on my blog earlier this month. You can see the final version here (pdf). There is simply nothing there that anyone with even the mildest interest in resolving the conflict could have the slightest objection to. This says a lot about where Israel and the US stand. No, the drama lies outside, with the Israeli-US-UK efforts to scuttle the initiative.

It’s been clear for quite some time that the Palestinian Liberation Organization (PLO) was not going to back down from bringing this resolution to the UNGA. At this stage, any threatening actions by Israel or the US could cause the PLO’s collapse, which Israel very much wants to avoid. So they had no way to stop the initiative from going forward and instead tried to change the substance of the resolution.

That, too, failed, but the changes they tried to make are instructive. Israel wanted to change or insert three conditions, none of which made any sense for the Palestinians. The US took the three conditions whole cloth and tried to convince the Palestinians to insert them. When that failed, it was passed off to the UK, who could offer the Palestinians something the US could not — namely, a yes vote on the UNGA resolution if they agreed to these conditions. Based on various reports, it seems that the Palestinians simply wanted to end the debate and went ahead and submitted the proposed resolution to forestall further discussion of it.

So, all the attempts at change seem to have failed. But the truth is that there is very little here for Israel to be worried about, at least for the time being. And this is why their reaction, as well as those of the US and UK, are all very telling. Let’s look at the three conditions Israel wanted to insert:

  1. 1. Israel wanted the resolution to state that the Palestinians would not seek membership in the International Criminal Court (ICC). Had the Palestinian Authority (PA) agreed to this, it would have sacrificed the one tangible benefit it gets from the General Assembly’s recognition of its non-member status. The other benefits are a matter of prestige and hopefully some diplomatic weight. But this is something the Palestinians can actually use at some point. Israel does not want to answer to the ICC, a court in which it is not a member, but whose decisions can make Israel more uncomfortable and give weight to protest movements, especially in Europe, where there is much more regard for international law than in the United States.
  1. Indeed, had the PA agreed to something like this, the reaction in the West Bank might have been as bad as if they had agreed to withdraw the resolution altogether. That issue only gets magnified in the wake of Hamas emerging from the latest Israeli bombing campaign in Gaza not only alive, but strengthened politically and with a ceasefire whose terms are surprisingly favorable to the government of Gaza.
  1. I strongly suspect that while the possibility of Palestine going to the ICC is probably the single most vexing aspect of this move in Israel’s eyes, they also probably knew that this was a non-starter, and perhaps didn’t even really want the PA to agree, as it might have spelled doom for the quisling Authority. In any case, it was a foregone conclusion that Palestinian President Mahmoud Abbas would refuse Israel’s condition.
  1. 2. Israel wants a clause stressing that this is a symbolic decision that grants no sovereignty over the West Bank, Gaza Strip or East Jerusalem. This was just an attempt at bullying. The UNGA resolution is, by definition, symbolic. It does not carry the weight of law, but merely expresses the view of the GA, as far as such weighty matters as sovereignty are concerned. Yes, specific statuses in the GA can allow the Palestinians access to certain international bodies, but there is no recognition of sovereignty here, nor could there be.
  1. Israel wants this kind of statement to blunt the impact of the resolution in the diplomatic field, but really it wouldn’t do much of that either. It was just a way to diminish the Palestinians’ claim on paper, and more than anything else, it was a lead-in to the one thing Israeli Prime Minister Benjamin Netanyahu really hoped to get out of this.
  1. 3. Israel wants any decision to include a Palestinian commitment to renewing direct negotiations with Israel without preconditions. This has become Netanyahu’s Holy Grail. He would love nothing more than the continuing sham “peace process” to drag on while settlements expand. But he also knows too much had already been discussed in the Oslo process, and fears, perhaps with some reason, that US President Barack Obama might eventually press for an endgame along the lines of the Clinton Parameters. Even if he doesn’t, Bibi doesn’t want to maintain the framework of withdrawal from more than 90% of the West Bank and some sort of sharing of East Jerusalem.
  1. For Netanyahu, “no preconditions” is a mantra, but one which means something very different than what the term implies. “No preconditions” means starting from absolute zero from the Palestinian point of view. It means no presumption that the 1967 borders are the starting point for discussion, or that there is any legitimate Palestinian claim to East Jerusalem. It means forgetting the Oslo Accords, other than perhaps the lines that Netanyahu wants to hold talks with the starting point at the facts on the ground. Those facts involve the settlements, including those in East Jerusalem that cut the city off from the rest of the West Bank and hemmed Bethlehem in, among other Palestinian towns. They include separation between the West Bank and Gaza and no presumption that they must be rejoined.
  1. Within that framework, any land Israel surrenders, any settlement or outpost Israel evacuates, is a “concession” to the Palestinians and more than that, a gift and symbol of Israeli largesse. Given not only Netanyahu’s right-wing orientation, but the even more radical rightward tilt of his party and, even more, his coalition, this is the only way he could sit and talk with the Palestinians, even if it is just for show.
  1. In other words, no preconditions means no to any Palestinian conditions at all and yes to plenty from the Israelis. 

Ultimately, Israel knew it would have to tolerate this Palestinian move. It really couldn’t even respond to it without risking its West Bank subcontractor whose demise would mean that Israel would have to foot much more of the bill for its occupation. So, they tried to get the one thing they thought they had at least an outside shot at: talks without preconditions.

Israel’s failure to achieve that goal is not surprising. But the buy-in Netanyahu got from both the US and UK is something we should all be looking at. Abbas didn’t break off talks with Netanyahu on principle, or even because of settlement expansion itself. He broke them off because he knew that, after 17 years of negotiations in the shadow of expanding settlements, the clock had expired and the Palestinian people would no longer tolerate such a state of affairs. The peace process had been exposed as a sham to cover an entrenching occupation, and only a complete halt to settlement construction would allow Abbas to come back to the table without seriously risking the existence of the PA.

Maybe the US and UK knew that Abbas would not accept the “no preconditions” condition and that’s why they felt comfortable pressing for it. But I doubt it. Both countries simply want to see talks resume, fearing the stalemate and vacuum diplomatic silence produces while Hamas continues to establish itself as the more credible Palestinian leadership body.

And what choice do the US and UK have? The same choice they’ve always had, the same one that was always the only way this was ever going to be resolved: pressure both sides — but especially the powerful and comfortable one, Israel — to make the deal. (Pressure on Israel has been totally absent, while both the US and UK are quite practiced in pressuring the Palestinians). Remind them that the exports they both depend on, the cooperation they both need, will no longer be so forthcoming if they don’t achieve a lasting peace.

And, of course, that is an option that neither country is willing to take for no good reason other than domestic politics. This isn’t about forcing anything on anyone. Israel and the Palestinians are perfectly free to choose their own course, but if they choose one that is contrary to US or UK interests, those countries can also choose not to do business with them. This wouldn’t exactly cripple either nation, but domestic politics continue to rule the day, and the craven leaderships in both countries cannot even conceive of such actions.

Let’s keep this short. Hamas-run Gaza in the midst of conflict with Israel has just played host to the Secretary General of the Arab League, the Prime Minister of Egypt and the Foreign Ministers of Turkey, Iraq, Jordan, Lebanon, the Palestinian Authority, Qatar, Tunisia, Saudi Arabia and Sudan. Prior to this escalation, regional developments had obviously shifted in Hamas’s favor, including a visit to Gaza by the Emir of Qatar and the commitment to provide some $400 million. Hamas has again proven that it can create a degree of mutual deterrence with Israel, that it is taken seriously by Israel, and can bargain effectively with Israel, from securing prisoner releases to securing commitments barring IDF incursions into Palestinian territory, right back to claiming success in having driven Israel from Gaza. Just to rub it in, on the same day that the IDF was committing not to enter Gaza, its troops were busy conducting raids and arrests throughout the West Bank.

What’s more, Gaza is likely to witness more rapid economic growth than the West Bank in the next period, not only because there is a lower base to start from, but also given the likelihood of delivery of assistance commitments from Turkey, Qatar and elsewhere (initially for reconstruction—think of the rebuilding in southern Lebanon and Beirut neighbourhoods after 2006). The Palestinian balance has shifted, full stop.

Fatah and the PLO cannot be dismissed in Palestinian politics, but their longstanding approach of currying American favor, in the hope of delivering Israel absent the creation of Palestinian leverage and assets, has run its course. They appear to have missed the boat in leading a popular campaign of unarmed struggle and the PA’s security cooperation with Israel looks distinctly unseemly in the eyes of many Palestinians. Palestinian unity remains an obvious need but that is far from easy to secure.

Listen, I think the principles for a cease-fire are in place. An end to the siege, that’s what Hamas wants. An end to the siege of the targeting of their leadership. What does Israel want? Israel wants Hamas to stop firing rockets, especially the Fajr-5 and the Fajr-3 long-range rockets, at their populations.

Certainly there’s a good exchange there. But what it’s going to take is Egyptians or somebody, Egyptians are going to be it, providing the security and the guarantees on such — on such an agreement. That’s very hard for the Egyptians to do. They don’t want to be responsible for Gaza. So we’re going to have to provide — somebody is going to have to provide inducement for them to do so. I think that’s the broad outlines of a cease-fire. A long-term cease-fire. And I think it’s very doable.

If current diplomacy fails, pent up rage on both sides, a cycle of tit-for tat-retaliation, Hamas’ hopes for greater Arab assistance, and a yearning to emerge from this latest round of heavy fighting on better footing than either side did from the last face-off in 2008-2009 could sustain Israeli-Hamas violence for quite a while. Without a change for the better very soon, Israel almost certainly will initiate a ground assault into portions of Gaza in order to inflict damage severe enough to compel Hamas to accept a ceasefire.

Israel’s Operation Cast Lead during Dec. 2008 – Jan. 2009 forced Hamas to stand down, greatly reducing Hamas’ rocket launches against Israel for the better part of 3 years after large portions of Gaza were severely damaged and 1,400 Palestinian were killed in the course of an extremely lopsided battering (13 Israelis were killed). Even in street fighting that so often favors the weaker side, many Hamas fighters seemed less than thoroughly braced for that sort of bruising conflict. This time, however, in addition to the use of longer range rockets, Hamas fighters reportedly have undergone better training for a face-off with Israeli ground forces in Gaza on their own turf. They also apparently have secured supplies of improved surface-to-air missiles for use against low-flying helicopters and aircraft as well as better anti-tank missiles. Also, Hamas’ hopes for more meaningful regional support have risen considerably, particularly with a new Muslim Brotherhood-led government in Egypt right next door.

As for the Israelis, the jarring arrival of Hamas rockets in the Tel Aviv area and just south of Jerusalem warn of burgeoning Hamas capabilities that make securing little more than another prolonged lull less appealing than it was back in 2009. The Israeli leadership hopes to force a more enduring ceasefire upon Hamas. This ambitious agenda might lead the Israelis to take an even harsher action than in the last round of fighting. In fact, Sunday’s wave of Hamas rocket attacks against Tel Aviv, Ashdod, Beersheba, and Ashkelon is just the sort of development that could drive the Netanyahu government to set in motion Israeli ground attacks.

Although Hamas believes its chances of receiving more robust outside Arab support have improved, the tactical balance of raw military power between Israel and Hamas once again most likely will dominate the bulk of this confrontation, as has been the case in the past. Despite its longer-range rockets and some improvements in the likely performance of its armed militants against Israeli ground forces, Israel’s military superiority across the board remains staggering.

Overhead Israeli drones pass real time intelligence to the Israeli military on Hamas activity and movements, and Israeli combat aircraft swoop down to pounce quickly using various types of bombs on most all launching areas of Hamas rockets. Meanwhile, Israeli heavy artillery and armored units have been massing to add far more firepower if needed against desired targets or to facilitate Israeli ground incursions. Moreover, the vast majority of Hamas’ crudely guided rockets do relatively little damage, while practically every Israeli bomb, artillery shell, or tank round inflicts heavy structural — and typically also human — losses on the densely populated Gaza Strip. Finally, Israel is completely free to resupply its forces in the south with more munitions, weaponry of all types, and fresh reinforcements of trained combat personnel. By contrast, Hamas can receive — at most — only relatively small dribs and drabs of military resupply since Gaza is surrounded on three sides by heavily reinforced Israel army and naval forces, and Hamas-controlled border crossings and tunnels along Gaza’s smaller Egyptian frontier will remain under intensified Israeli observation and aerial interdiction.

The Israeli leadership may delay ground incursions to allow last-minute diplomacy to play out before engaging in more costly military operations. This way, the Israeli Defense Forces (IDF) would be better prepared once ground action is ordered. And although the IDF would take heavier losses than it is experiencing now by pushing into Gaza, the plight of Hamas fighters and civilians in the path of Israeli forces would be far worse. Fighting on one’s own ground provides some limited tactical advantage, but against such a skilled, far more heavily armed opponent with complete air supremacy, it also means the resultant property destruction and collateral casualties occur within your own community. During Operation Cast Lead almost four years ago, approximately 100 Palestinians died in Gaza for every Israeli struck down by Hamas. A similarly lopsided balance of casualties could occur once again.

All talk of “proportional response” regarding Israeli intentions aside, with the huge arsenal at Israel’s disposal and Gaza’s congestion, a vastly disproportionate casualty count favoring Israel is inevitable. And it remains very much in Israel’s unspoken interest to inflict disproportionate casualties for punitive purposes. In all past Israeli military endeavors meant to suppress rocket fire into Israel (whether from Gaza or Lebanon) severe casualties were inflicted on the perpetrators as well as nearby infrastructure and populations viewed as supporting those Israel sought to silence. And should an Israeli ground incursion commence, such casualties among Gazans would spike precipitously as intense firepower would be directed onto areas just ahead of advancing Israeli forces to suppress the ability of Hamas to do the same to advancing Israeli infantry and armored vehicles.
