The nation’s current attempt at catharsis through a gargantuan report prepared by the Democratic staff of a Senate committee exhibits some familiar patterns. Most of them involve treating a government agency as if it were Dorian Gray’s portrait, which can take on all the hideous marks of our own transgressions while we present ourselves as pure and innocent. The saturation coverage of the report and most early comment about it have displayed several misconceptions and misdirections.

One misconception is that we, the public, and our representatives in Congress are learning something new from this report that better enables us to make policies and set national priorities—better than we already could have done, based on what we already knew about this whole unpleasant business. In fact, the main directions of the activity in question and even many of the relevant gory details have long been public knowledge. Many people seem to believe that wallowing in still more gory details is a form of expiation. The basis for that belief is hard to understand.

The report itself and almost all the coverage of it misses what is the main, big story—missed perhaps because we ourselves are characters in it. The story is that the American people, and thus our political leaders, have had a major change in fears, mood, and priorities from the early days after the 9/11 until the present. In the aftermath of 9/11 Americans were far more militant, more willing to take on costs and risks, and more willing to compromise long-held values in the name of counterterrorism. The interrogation techniques that are now the subject of controversy and abhorrence were condoned or even encouraged back then by our political leaders in both the executive and legislative branches. As time has gone by without another terrorist spectacular in the U.S. homeland, pendulums have swung back, moods have changed again, and old values have reasserted themselves. It is difficult for anyone, but perhaps most of all for elected politicians, to admit this kind of inconsistency. Thus we get the current effort to focus ignominy on a single agency, where people who were on the tail end of that entire political process happened to work, as a substitute for such admission.

This is by no means the first time that waves of fear in America have resulted in deviation from liberal values, with the deviation later becoming a source of shame and regret. There is a long history of this, going back at least to the Alien and Sedition Acts in the eighteenth century. Another example, now universally seen as a black mark on American history, was the internment during World War II of American citizens of Japanese ancestry.

Another misconception is that because a report comes from a Congressional committee or some ad hoc commission, it is the Voice of God and the ultimate source of truth on whatever subject it addresses rather than what it really is, which is one particular set of perspectives or opinions. Another official pronouncement is the CIA’s report on the report, which for anyone who bothers to look at it comes across as a sober and balanced treatment of the subject that carefully differentiates between the valid observations in the Senate committee staff’s report and the significant errors in it. The CIA’s report was prepared under senior officers who had no stake in the interrogation program. It is by no means the reaction of someone in a defensive crouch. Unfortunately few people will look at that report and make any effort to learn from it. The Washington Post barely mentioned its existence, let alone any of the substance in it, in its saturation coverage of the Senate committee report.

Anyone who did bother to look and learn from the CIA report would realize how mistaken is another notion being widely voiced: that the abusive interrogation techniques were the result of an agency or elements within it “running amok.” The program in question was authorized by the topmost authorities in the executive branch, as those authorities have confirmed in their public statements or memoirs. Congressional overseers were informed, according to the instructions of those topmost authorities and according to standard practice with sensitive covert actions. Overseers had ample opportunities to object but did not.

A final misconception being displayed from people on various sides of this issue is that the question of whether any useful information was gained from application of the controversial techniques has to be treated in an all-or-nothing manner. People, including authors of the Senate committee report, wishing to make an anti-torture statement seem to believe that they have to argue that the techniques never gained any useful information. They don’t have to argue that. In acting as if they do, they are exhibiting another American trait, which the political scientist Robert Jervis noted almost four decades ago, which is to resist recognizing that there are trade-offs among important values. The coercive interrogation techniques involve such a trade-off. One can accept that the techniques did yield some information that contributed to U.S. security and still oppose any use of such techniques because they are contrary to other important American values, as well as hurting the standing of the United States abroad and yielding bad information along with the good. This is the position expressed by former CIA director Leon Panetta.

Amid all that is misleading in the committee report itself and in reactions to it, some kudos are in order for other reactions. One compliment should go to the Obama White House, which provided in its statement on the subject a principled declaration that torture is wrong along with some recognition of the public emotions and moods that underlay what was done several years ago. A particularly graceful touch was a reference to how “the previous administration faced agonizing choices” in how to secure the United States amid the post-9/11 fears. This fair and correct way of framing the recent history was the opposite of what could have been a partisan “those guys did torture and we didn’t” approach.

Also worthy of compliments in the same vein is Senator John McCain, who made an eloquent speech on the floor of the Senate opposing any use of torture. McCain often is as hard-minded a partisan warrior as anyone, but on this matter he spoke on the basis of principle.

Finally, kudos should go to the CIA for not going into a defensive crouch but instead recognizing deficiencies in performance where they did exist and, unlike the Senate committee report, coming up with specific recommendations for improvement. This response, too, represented important American values. As Director of National Intelligence James Clapper noted in his own statement, “I don’t believe that any other nation would go to the lengths the United States does to bare its soul, admit mistakes when they are made and learn from those mistakes.”

Finally, someone in the US government has followed through on President Barack Obama’s judgment that CIA-conducted and “-outsourced” torture—let’s call it by its common name—is “not who we are” as a nation.  Finally, the Senate Select Committee on Intelligence has given us a (still heavily-redacted) account of what the CIA did between 2002 and 2006.

There is good as well as bad news in all of this mess.  After all, the Senate Committee (or at least its Democratic members) was prepared to see the United States “come clean” about some practices that—certainly in hindsight and, for people of any true moral sense, as should have been obvious at the time—are unacceptable  to a civilized society.

How many other countries would have done the same? Quite a few it turns out, at least 28 at last count, in what are typically known as “truth and reconciliation commissions.” Notable have been those in South Africa, Argentina, and Chile. However, by contrast with crimes in those countries, mostly against their own people, what was done by US government officials and their paid servants—some US “contractors” and some foreign governments—directly affected only a few people; most of them were avowed enemies of the United States; and at least some of whom were involved in the worst foreign attack on the continental US since 1814.

The published part of the report actually contains few surprises, other than to reveal that some of the “Enhanced Interrogation Techniques (EITs), an antiseptic euphemism like the Vietnam War’s “termination with extreme prejudice,” was much more brutal than hitherto reported.  More details than previously known were provided by how officials of the Central Intelligence Agency lied to Congress—a felony—and also, supposedly, to senior officials in the George W. Bush White House (which had its own share of the cover-up).  Further, the report confirmed what many terrorism experts and insiders-now-outsiders had said before: that such techniques rarely if ever produce “actionable” intelligence and certainly not in this case.

Thus, the argument is now being made widely around the world that the United States—self-styled since 1630 as a City Upon a Hill,  the producer of regular human rights reports about  every other country on the planet, and a list-keeper of other peoples’ misdeeds—has confessed to its own inhumane acts.

Yes, that is still part of the (relatively) good news.  Senator Dianne Feinstein (D-Ca.) and her Senate committee did not have to release the report. While the journalism community would continue to sniff at the edges of scandal, and awareness of thus-and-so would long be whispered around Washington, the full picture could have probably been buried, not quietly, but still buried.

The unalloyed bad news comes in different forms. As the inevitably-to-be-leaked list grows of foreign countries that either allowed the CIA to build private, purpose-built prisons or even took part in the “extraordinary rendition” of US terrorism suspects (to be tortured away from prying American eyes), there will be domestic embarrassment for some political leaderships that have not already been called to account (e.g., as has happened in Poland). As President Obama summed it up this week: “These techniques did significant damage to America’s standing in the world and made it harder to pursue our interests with allies and partners.”

The “bad guys,” especially the thugs of the world who have been subjected to American criticism or who themselves engage in immoral actions—like al-Qaeda, Islamic State (ISIS or IS), and a host of brutal governments, many but not all in the Middle East—will now claim a US precedent for what they do, and terrorist groups will use the Senate Committee revelations as a recruiting tool.

By any standard, the US is not in their league as a miscreant.  There is the issue of provocation to balance against the immorality of the CIA’s torture program. But at the same time, there is also the issue of efficacy—was the immorality worth the price? As President Obama said of the report this week: “It reinforces my long-held view that these harsh methods were not only inconsistent with our values as a nation, they did not serve our broader counterterrorism efforts or our national security interests.” They were not only wrong; they didn’t work.

More bad news will be felt immediately by America’s diplomats abroad.  They will just have to hunker down, stick to the talking points that Washington gives them and, we hope, contrast our openness (though it took far too long) with rampant terrorism and state oppression by people who would not dream of repentance or accountability. We can also expect Schadenfreude on the part of some of our closest allies, including in Europe. “Too bad about what happened in the United States, tut, tut,” they will say. Some friendly governments will face popular resistance to cooperating with the US in other actions abroad, as this report comes hard on the heels of revelations about the National Security Agency’s spying on foreign leaders.  However, these views will be tempered among those who recognize that damage to America’s standing could also negatively impact  them, since they still need us as a security guarantor, a point that was underscored earlier this year by Russia’s invasion of Ukraine.

We are already seeing the worst of the bad news, and it is at home.  Senator John McCain (R-Az.), who himself was tortured in a North Vietnamese prison, has welcomed the issuance of the report; but for most other Republican members of Congress, it is the Democrats and Barack Obama who are somehow to blame for this whole business. They contest the evidence and claim that water-boarding and other EITs did indeed help forestall further terrorism on our shores.  They see a witch hunt by the current administration, although President Obama said in April 2009 that “For those who carried out some of these operations within the four corners of legal opinions or guidance that had been provided from the White House, I do not think it’s appropriate for them to be prosecuted.” (Whether such a pledge should have been made is another matter.) The Attorney General, Eric Holder, followed through on that pledge in August 2012 by dropping two prominent cases. Even worse are former officials of the CIA who have joined the chorus in arguing that what was done protected the nation. Their efforts at self-justification add to the case that the CIA needs a thorough house-cleaning.  The agency’s leaders during the period in question should be denied any further government service. Those who lied to Congress should be prosecuted; the lawyers who justified the breaking of laws should be disbarred. (If that could be done to a sitting president for lying about sex, surely it should be done in this case.)  And no one should be allowed to get away with saying, however they phrase it, “We were just following orders.”  That line of argument fell to pieces at Nuremberg almost seven decades ago. Prosecution?  Maybe not—though it would be true to the rule of law and would send a useful message. No further government service? Definitely. Actions, whatever the sincerity of motives, must have consequences.

Maybe some larger good can begin to come out of all this. I do not mean just, as President Obama has said:  “I will continue to use my authority as president to make sure we never resort to those methods again.” That is a worthy goal—though all-too-likely of short duration, as can be testified to by those of us who remember the hearings in the 1970s by the Senate’s Church Committee, whose report and resulting national debate should have stopped in its tracks what the CIA did after 9/11.

The larger good can be a recognition that accountability needs to be returned to government, in general – a quality that has never been in great supply. The last senior political figure to quit over an issue of principle and policy was Secretary of State Cyrus Vance in 1979, following the abortive hostage rescue mission in Iran.  While Britain tried to sort out responsibility after its prime minister, Tony Blair, misled his country into joining the 2003 US invasion of Iraq, we have never done so and never will. We have never held accountable the small group of senior officials who consciously misled not just the president of the United States but also the American people, thereby leading the country into one of the most costly mistakes ever in US engagement abroad.

There can be no doubt that we are a great nation; we are basically a moral society, and the overwhelming majority of people in government, including most but unfortunately not all elected politicians, Republicans and Democrats, are so as well and work to do what they think is the best for our country.

The Senate Select Committee on Intelligence has started us thinking once again about the demands of creating “a more perfect union” and has reminded us that “eternal vigilance is the price of liberty.” Let us hope that we also make a serious start on raising both the standard and the practice of accountability, across the board, to validate President Obama’s statement: “Today is also a reminder that upholding the values we profess doesn’t make us weaker, it makes us stronger and that the United States of America will remain the greatest force for freedom and human dignity that the world has ever known.”

Tuesday’s release by the Senate Intelligence Committee of its long-awaited report on the torture by the CIA of detainees in the so-called “war on terror” does not go far enough, according to major U.S. human rights groups.

While welcoming the report’s release, the subject of months of intensive and sometimes furious negotiations between the Senate Committee’s majority and both the CIA and the Obama administration, the groups said additional steps were needed to ensure that U.S. officials never again engage in the kind of torture detailed in the report.

“This should be the beginning of a process, not the end,” said Anthony Romero, executive director of the American Civil Liberties Union (ACLU). “The report should shock President Obama and Congress into action, to make sure that torture and cruelty are never used again.”

He called, among other steps, for the appointment of a special prosecutor to hold the “architects and perpetrators” of what the George W. Bush administration called “enhanced interrogation techniques” (EITs) accountable and for Congress to assert its control over the CIA, “which in this report sounds more like a rogue paramilitary group than the intelligence gathering agency that it’s supposed to be.”

He was joined by London-based Amnesty International which noted that the declassified information provided in the report constituted “a reminder to the world of the utter failure of the USA to end the impunity enjoyed by those who authorised and used torture and other ill-treatment.

“This is a wake-up call to the USA; they must disclose the full truth about the human rights violations, hold perpetrators accountable and ensure justice for the victims,” said Amnesty’s Latin America director, Erika Guevara.

The Senate Committee’s report, actually a 524-page, partially-redacted summary of a still-classified 6,300-page report on the treatment of at least 119 terrorist suspects detained in secret locations overseas, accused the CIA not only of engaging in torture that was “brutal and far worse” than has previously been reported, but also of regularly misleading the White House and Congress both about what it was doing and the purported value of the intelligence it derived from those practices.

Water-boarding, for example, was used against detainees more often and in more of the CIA’s “black sites” than previously known; sleep deprivation was used for up to a week at a time against some suspects; others received “rectal feeding” or “hydration’; and still others were forced to stand on broken feet or legs.

In at least one case, a detainee was frozen to death; in the case of Abu Zubayda, an alleged “high-value” Al Qaeda detainee who was subject to dozens of water-boardings, the treatment was so brutal, several CIA officers asked to be transferred if it did not stop.

While the CIA officers and former Bush administration officials, notably former Vice President Dick Cheney, have long insisted that key information – including intelligence that eventually led to the killing of Osama bin Laden — was obtained from EITs, the report concluded that these techniques were ineffective.

Seven of 39 detainees who were subject to the most aggressive EITs provided no intelligence at all, while information obtained from the others preceded the harsh treatment, according to the report, which relied on the CIA’s own cables and reports.

In some cases, detainees subjected to EITs gave misinformation about “terrorist threats” which did not actually exist, the report found. Of the 119 known detainees subject to EITs, at least 26 should never have been held, it said.

Intelligence Committee Chairwoman Dianne Feinstein, who fought hard for months to release the report over the CIA’s fierce objections, wrote in its Forward that, in the aftermath of the 9/11 Al Qaeda attacks, “she could understand the CIA’s impulse to consider the use of every possible tool to gather intelligence and remove terrorists from the battlefield, and CIA was encouraged by political leaders and the public to do whatever it could to prevent another attack.”

“Nevertheless, such pressure, fear and expectation of further terrorist plots do not justify, temper or excuse improper actions taken by individuals or organizations in the name of national security,” according to Feinstein.

For his part, CIA director John Brennan, a career CIA officer appointed by Obama whose role in the Bush administration’s detention programme remains cloudy, “acknowledge(d) that the detention and interrogation program had shortcomings and that the Agency made mistakes.”

“The most serious problems occurred early on and stemmed from the fact that the Agency was unprepared and lacked the core competencies required to carry out an unprecedented, worldwide program of detaining and interrogating suspected al-Qa’ida and affiliated terrorists.”

But he also defended the EITs, insisting that “interrogations of detainees on whom EITs were used did produce intelligence that helped thwart attack plans, capture terrorists, and save lives.” A fact sheet released by the CIA claimed, as an example, that one detainee, after undergoing EITs, identified bin Laden’s courier, which subsequently led the CIA to the Al Qaeda chief’s location.

With several notable exceptions, Republicans also defended the CIA and the Bush administration’s orders to permit EITs. Indeed, the Intelligence Committee’s Republican members released a minority report that noted that the majority of staff had not interviewed any CIA officers directly involved in the programme.

“There is no reason whatsoever for this report to ever be published,” said the Committee’s ranking Republican, Sen. Saxby Chambliss. “This is purely a partisan tactic” which he said was designed to attack the Bush administration. Republicans also warned that the report’s release would endanger U.S. service personnel and citizens abroad by fuelling anti-American sentiment, especially in the Muslim world.

But Sen. John McCain, who was himself tortured as a prisoner of war in the Vietnam war, defended the report, calling it “a thorough and thoughtful study of practices that I believe not only failed their purpose …but actually damaged our security interests, as well as our reputation as a force for good in the world.”

McCain has championed efforts to pass legislation outlawing torture, particularly because Obama’s 2009 executive orders prohibiting such practices could be reversed by a future president.

Passage of such a law – whose prospects appear virtually nil in light of Republican control of both houses of Congress for the next two years – is one of the demands, along with release of the full report, of most human-rights groups here.

“The Obama administration and Congress should work together to build a durable consensus against torture by pursuing legislation that demonstrates bipartisan unity and fidelity to our ideals,” said Elisa Massimino, director of Human Rights First.

Many groups, however, want Obama to go further by prosecuting those responsible for the EIT programme, a step that his administration made clear from the outset it was loathe to do.

“We renew our demand for accountability for those individuals responsible for the CIA torture programme,” said Baher Azmy, the legal director of the Center for Constitutional Rights, which has represented a number of detainees at Guantanamo, including Abu Zubaydah, in U.S. courts. “They should be prosecuted in U.S. courts; and, if our government continues to refuse to hold them accountable, they must be pursued internationally under principles of universal jurisdiction.”

“The report shows the repeated claims that harsh measures were needed to protect Americans are utter fiction,” according to Human Rights Watch executive director Kenneth Roth. “Unless this important truth-telling process leads to prosecution of the officials responsible, torture will remain a ‘policy option’ for future presidents.”

Noting that health professionals, including doctors and psychologists also played a role in the EITs, Physicians for Human Rights (PHR) also called for legal accountability. “For more than a decade, the U.S. government has been lying about its use of torture,” said Donna McKay, PHR’s executive director.

“The report confirms that health professionals used their skills to break the minds and bodies of detainees. Their actions destroyed trust in clinicians, undermined the integrity of their professions, and damaged the United States’ human rights record, which can only be corrected through accountability,” she said.

Hyping the Islamic State (ISIS or IS) threat risks generating flawed policies. The White House probably is a source of frustration, as its critics claim, but others seem too eager to commit US combat troops. Meanwhile, the administration, under constant pressure regarding the US effort, has not done enough to energize the anti-IS coalition that President Obama worked so hard to assemble. This inclines allies to believe Washington will do the heavy lifting for them.  Although addressing IS full-bore (and unilaterally) might seem appealing to some, this urge undermines the patience needed for more sensible courses of action.

The Hagel Affair

The resignation of Defense Secretary Chuck Hagel last month resulted in criticism that the White House is unreceptive to outside views, such as expanding the US military effort against IS. Excessive micromanagement of military related issues by the White House (including the phone line to commanders in Afghanistan that bypassed Hagel) has also been cited.

Past Presidents have done likewise. In overseas crises, many presidents created their own channels, giving White House officials more power than cabinet secretaries. Franklin Roosevelt often relied on Harry Hopkins over Secretary of State Cordell Hull, Richard Nixon used Henry Kissinger in lieu of William Rogers, and Colin Powell found himself outside the Bush administration’s inner circle. Perhaps the most extreme example of presidential micromanagement was Lyndon Johnson’s handling of the Vietnam War.

The Obama White House has long had dicey relations with the Pentagon. This has been, according to the Pentagon’s side of the argument, the source of delays and confusing policy directions on several issues, with the White House accused of falling into “group think.”  For his part, Hagel had complained in the early fall to National Security Advisor Susan Rice in a memo about a lack of cohesion in US policy toward IS.

Nonetheless, White House micromanagement or Pentagon-White House difficulties aside, Obama’s reluctance to ramp up the US military effort against IS excessively seems well founded. Of course, Hagel’s position is not entirely clear, but escalation had been advocated by Hagel’s two predecessors: Robert Gates and Leon Panetta.

Costs of US Escalation

IS appears ready to endure lopsided casualties to inflict some on American combat troops. And IS could follow through on this hope. Not only are its combatants fanatics, the radical Sunni militia also employs deadly suicide bombings against foes in close-up urban combat (as we’ve seen in Kobani). Additionally, IS likely hopes to get a hold of at least a few US military prisoners for filmed beheadings. So why hand IS exactly what it wants?

With large urban areas to be cleared just in Iraq—from Fallujah to Mosul—US combat troops would also likely incur casualties in excess of those suffered in 2003-08 against somewhat less fanatical Sunni Arab insurgents and Shi’a militias during the war.

American military difficulties could be further magnified by reduced interest on the part of Iraq’s Shi’a-dominated government in making the political concessions needed to split Sunni Arab tribes and other secular elements away from IS and marshal its own forces more swiftly. After all, why should Baghdad go the extra mile if the US seems willing to take care of Baghdad’s IS problem militarily?

Recently, despite lost ground in and around Ramadi west of Baghdad, Iraqi and Kurdish forces have made gains between Baghdad and Kurdish Regional Government (KRG) territory to the north. Moving up Iraq’s central line of communications, Iraqi forces have driven IS from some important territory. The siege of the vital Baiji refinery complex has been lifted, and gains have been made in the demographically mixed Diyala Governate northeast of Baghdad.

Meanwhile, Iraqi Kurds continue to push IS slowly westward. Baghdad and the KRG reached a temporary oil agreement yesterday that should clear the way for greater cooperation elsewhere, like battling IS.  Bitter quarrelling under former Prime Minister Nouri al-Maliki left Iraqi-KRG relations in shambles.

Struggling to rebound from severe reverses last summer, however, the Iraqi Army is in no position to mount a major offensive deep into IS holdings. However, successful Iraqi and Kurdish attacks demonstrate the vulnerability of IS’s vast perimeter. Strong IS forces cannot be everywhere at once to repel various challenges and adequately support ongoing attacks (such as its effort against Kobani).

In terms of a military threat, IS has been largely contained. It cannot advance northward against Turkey; isolated pro-IS sympathies exist in Jordan, but the highly professional Jordanian Army would be a tough nut to crack; and in Iraq, most all Shi’a and Kurdish areas lie outside IS control and are fighting hard to maintain this status. In Syria, IS could advance against weaker rebel forces like the Free Syrian Army, but it seems obsessed with seizing Kobani despite heavy losses.

Coalition and US Escalation

The anti-IS coalition the White House assembled is contributing relatively little to the overall military effort, despite Secretary of State John Kerry’s glowing rhetoric at today’s coalition conclave in Brussels. The air campaign is mainly an American show. Committing more US assets would make it easier for others already foot-dragging over contributions to continue dithering. Now is not the time to ramp up US military efforts, but rather to pressure allies to increase their own contributions.

The bulk of IS’s reinforcements in the form of foreign fighters flow through NATO ally Turkey. The CIA in September and the UN more recently sharply increased their estimate of the number of foreign fighters reaching the Islamic State. To date, Turkey has been more helpful to IS than the coalition because of its passivity. If it cannot be pressured to vigorously interdict incoming fighters, IS would be able to replace many lost fighters—although with less experienced cadres.

The White House (and other allies) must press Turkey harder. President Obama delayed air support for beleaguered Syrian Kurds for two weeks in deference to Turkish concerns (allowing IS to gain a foothold inside Kobani). Even today’s 60-nation gathering seems short on clear goals, let alone a robust military agenda on contributions.

Admittedly, although the Administration has done too little diplomatic spadework, its leverage overseas probably has been undermined by American politicians, pundits, and many in the media demanding an expanded US effort. 

Bottom Line

IS remains a daunting foe, so it will not be defeated easily, soon, or completely. To Americans pressing urgently for quick solutions, this is difficult to accept. But comments like one yesterday by Congresswoman Ileana Ros-Lehtinen, Chair of the House Foreign Relations Middle East and North Africa Sub-Committee, suggesting IS could damage everyone’s way of life are typical of exaggerations impeding objective policymaking.

Yet those claiming the air campaign has been ineffective are also naïve. IS has mostly ground to a halt. In some places, like Kobani, IS is hemorrhaging combat casualties. Meanwhile IS’s infrastructure, leadership, training camps, heavy weapons, oil refineries, and lines of communication have been hammered by the ongoing aerial bombardment. This week, assets in IS’s “capital” of Raqqa, Syria were also subjected to a wave of airstrikes.

Many want IS crushed quickly out of fear of IS attacks against the American homeland. Yet, as we saw in Afghanistan in 2001-02 with al-Qaeda, the combatants would not be completely rounded up should substantial US forces be sent in. Many hundreds at the very least would escape to find refuge elsewhere. In that scenario, IS would likely shift toward an international terrorist mode, posing an even greater threat to the United States. Therefore, a more collective effort—forcing IS to truly understand that it faces dozens of foes and not just a few—would be a wiser way forward. It is meanwhile imperative to strip IS of as many of its non-extremist Sunni Arab allies as possible, so they do not have to be dealt with militarily.

Until 1:04 PM on April 18, 1983, Robert Clayton Ames was little known outside U.S. foreign policy and intelligence circles. On that day he died, along with 62 other casualties in and around the U.S. Embassy in Lebanon, then a familiar landmark on Beirut’s seaside corniche.

The building suffered devastating damage when a pickup truck laden with 2,000 pounds of explosives was driven into the lobby. Ames, the influential Director of the Near East and South Asia division within the CIA’s Directorate of Intelligence, was on a visit to Lebanon, which President Ronald Reagan declared a “strategic interest” for the U.S. following Israel’s game-changing invasion the prior year.

A former National Intelligence Officer, Ames’ intelligence assessments carried weight in Washington where he enjoyed access to Secretary of State George Shultz. He had arrived in Beirut in April 1983 carrying the outline of an agreement that would be announced the following month. Mediated between Israel and Lebanon by Shultz, the May 17 agreement called for the withdrawal of Israeli forces from Lebanon, but with the proviso that the Syrians would also withdraw their soldiers.

Hours before his death, Ames shared the details with Mustafa Zein, a longtime Lebanese confidante, a wielder of wasta (connections), which are far more important in Lebanon than institutions or laws. Zein urged irreverently that the agreement be printed on very thin paper so it might be used in the toilet. Ames enjoyed the joke, a hint of his own cynicism about the prospect that then-President Hafez al-Assad would yank his forces from Lebanon, particularly at a time when the high blown but mutually contentious hopes of Israel and the United States were deflating.

The agreement did accomplish one thing, perhaps its hidden motive: it helped repair a rupture in U.S.-Israeli relations that had been provoked by the clash of their rival agendas in Lebanon. Otherwise, Zein got it right.

Defective policy

One of the many virtues of Kai Bird’s impressive volume, The Good Spy: The Life and Death of Robert Ames, is that he offers a fine-grained, if sometimes gruesome account, of the destruction of the embassy as well as the broader tableau for U.S. engagement in a Middle East that would become more vicious and venomous.

The U.S. intervened in Lebanon in support of a political order that was being upended, in significant measure as a result of the rise of the large Shi’a community. It was this community that bore the brunt of brutish Israeli behavior that bred enmity to Israel and to its protective uncle. Ames and his fellow intelligence officers were deeply skeptical of U.S. policy in Lebanon. They worried about growing dangers, but their political masters were slow to grasp the reality. At the time, I felt that the understanding in the White House of the evolving situation in Lebanon lagged months behind the reality on the ground.

There were precedents for the deadly attack, including similar incidents in December 1981 when the Iraqi Embassy was demolished, and in November 1982 when an Israeli intelligence center near the southern city of Tyre was decimated. Yet, the scale of destruction came as a shock to U.S. policymakers. Bird reports that two vehicle barriers that might have impeded the April attack were gathering dust in a warehouse.

Credible evidence — reprised by Bird — points to Iran as the progenitor of the April attack as well as the even more massive bombings in October 1983 against the U.S. Marine Barracks and a building housing French Paratroopers that killed more than 300 soldiers. Bird offers new details about the role of the Iranian Revolutionary Guard officials in Lebanon, including Ali Reza Asgari, who he links to both attacks.

Iran found ready partners, especially among young militants inspired by the 1979 “Islamic Revolution,” including a young man by the name of Imad Mughniyeh, born in Tayr Dibbah (Bird mangles the name of the village) in southern Lebanon.

The notorious Mughniyeh (assassinated in Damascus in 2008), while not the mastermind according to Bird, did have a key hand in the embassy bombing. He is credited with lots of deadly mischief and terrorism in the ensuing years, but details remain murky, including in Bird’s account. As one retired Agency officer wryly notes, “when in doubt, and we are always in doubt about this, blame Mughniyeh.”

A very good spy

Ames joined the CIA in late 1960. The slow-paced early chapters of the book offer glimpses of his early career as a spy and his pre-CIA service as a young draftee assigned to a secluded intelligence station in Eritrea where his fascination with Arabic and the Arab world on the opposite shore of the Red Sea emerged.

All of Ames’ Agency assignments were in challenging locales. He served in Aden, in 1968-69, in the waning days of British control and the first and violent days of the former protectorate’s independence and subsequent estrangement from the West. Even so, he proved an adept recruiter of sources, a talent for which he gained admiration around the Agency.

He subsequently served in Saudi Arabia and Lebanon — countries affected profoundly but differently by the magnetic appeal of Arab nationalism, especially from the lips of Egypt’s Gamal Abdel Nasser. Ames kept his emotions in his pocket, like when he witnessed a botched execution in Saudi Arabia and simply murmured to a colleague that they should leave. That was, he reasoned, how things were done in Arabia.

He was not immune to the fervor of the period though. When Nasser was felled by a heart attack in 1970, he composed a poem reading in part: “A light went out, an era ended.” And so it had. Nasser’s exit opened the way for contending Arab dreams based on state nationalism or the idealism of Islamism.

After his death, he was described by CIA Director William Casey as “the closest thing to an irreplaceable man”. In part, Casey’s tribute honored Ames for his success in penetrating the Palestinian resistance in the early 1970s, which he did largely on his own initiative, retrospectively gaining the blessing of the CIA Director. His key source was the flamboyant Ali Hassan Salameh, who Yasser Arafat trusted and entrusted with maintaining a conduit to the United States.

Salameh, who headed the organization’s intelligence apparatus, was a rival of Palestinian Liberation Organization (PLO) chieftain Salah Khalaf (Abu Iyad), creator of Black September. Salameh headed Force 17 (Mughniyeh had once been a member), the Fatah Special Ops unit, and he operated on the margins of Black September. He was suspected by the Israelis of involvement in the kidnapping and deaths of Israeli Olympic athletes at Munich in 1972. Bird offers an ambivalent assessment of his role.

Ames maintained an extraordinary relationship with Salameh, with whom he brokered effective security cooperation in Lebanon, including guarantees for the safety of U.S. diplomats. Ames warned the Palestinian that the Israelis were gunning for him (they succeeded in 1979). Recall that in the 1970s, the prospect of an independent Palestinian state was well beyond the pale, and the PLO was reflexively decried as a terrorist group. Within Washington circles, the usual formula for accommodating Palestinian aspirations was to be found in an arrangement with Jordan that came well short of an independent Palestinian state.

Ames is credited with ghostwriting the peace initiative announced by Ronald Reagan on September 1, 1982, which Prime Minister Menachem Begin quickly rejected. Begin had approved the June invasion of Lebanon and Defense Minister Ariel Sharon’s objective of crushing Palestinian nationalist aspirations. He had no intention of accepting even an autonomy scheme with Jordan.

Ames, for his part, was oddly optimistic about the initiative, which many of his colleagues viewed as a “non-starter,” a “fool’s errand”. Given the access to power that Ames enjoyed, he was grasping what was feasible in the Washington context, but in doing so he was contradicting what his deep knowledge of the Arab world would have taught him was necessary to accommodate Palestinian aspirations.

To give Ames his due, when the Oslo Accords between the PLO and Israel were signed a decade later, he was credited by his colleagues with opening the door that made possible the acceptance of the PLO as a respectable diplomatic actor.

Knowledgeable readers will appreciate the author’s nuanced account. General readers will find the book accessible, lucid and rewarding. There are many more nuggets to be mined and assayed from The Good Spy, but within the confines of a concise review that will have to wait.

Robert Ames worked in a murky environment populated by people with plenty of dirt under their nails and blood on their hands; not people whose moral probity stands up well to scrutiny under bright lights. He would probably appreciate the bitter irony that Ali Reza Asgari, the Iranian intelligence officer who played a key role in bringing his life to a terrible end, defected in 2009 and is now living someplace in America under an assumed identity after being drained of his many secrets. That was the milieu in which the good spy thrived and then perished.

U.S. military spending has leveled off, and the Pentagon is looking at some fairly serious reductions after 2015. Last month, President Obama finally pulled the various threads of his foreign policy approach into a “doctrine” that emphasizes incremental diplomacy and leaves military intervention as a last resort.

We are, it would seem, at an epochal moment in U.S. history. The Reagan and Bush Jr. administrations attempted to deepsix the Vietnam syndrome and resurrect the U.S. military as the principle tool of U.S. foreign policy. But after the failures of Iraq and Afghanistan, the syndrome has returned in an industrial-strength version. Finally, it seems as if the United States is willing to take the cop out of cooperation.

But before we stick flowers into the barrels of the Special Forces’ combat assault rifles and celebrate the transformation of the CIA’s drones into Amazon delivery vehicles, let’s evaluate what will likely be a very substantial backlash to the Obama doctrine. Depending on what happens in the mid-terms and more importantly the next presidential elections in 2016, we might be looking at yet another effort to drive a stake through the heart of the Vietnam-Afghanistan-Iraq syndrome and reassert, once again, American military power.

In the last presidential election, we narrowly escaped a return to the foreign policy of the 1980s with Mitt Romney. Next time around, the hawks from both major parties minus the libertarians — the War Party — may well offer something considerably more retrograde: perhaps a return to the 1890s and a celebration of American empire under Teddy Roosevelt.

But it won’t be just one war — Remember the Maine, to hell with Spain! — that the War Party will want the Pentagon to prepare to fight. Nor will it be the two or two-and-a-half wars of the Cold War heyday. Instead, the next generation of U.S. militarists — the Project for the NewNew American Century — will be talking about girding our loins for three wars. Before detailing this three-front global conflict, let me explain how we’ve been at this point already twice in the recent past.

Long before Obama unveiled his doctrine, the last two Democrats in the White House also tried, in their half-hearted ways, to restrain the Pentagon and elevate the State Department. For Jimmy Carter, his first two years in office marked the high point of détente and the military drawdown from the Vietnam years. Even though he turned considerably more hawkish in the second half of his term, Carter became a symbol of everything weak about the Democratic Party and its foreign policy. The events of 1979 — the Soviet invasion of Afghanistan, the Iranian revolution — also conspired against President Malaise. Carter’s opponent in the 1980 election, Ronald Reagan, promised to stand up to the Russians, the Iranians, and anyone else who dared challenge Old Glory.

Bill Clinton, too, presided over a reduction of the U.S. military leviathan in the wake of the end of the Cold War. Clinton was by no means a pacifist. The United States was involved in the wars in former Yugoslavia and several attacks on al-Qaeda and its ilk during the 1990s. But the great sin of the Clinton administration, to its critics on the right, was its commitment to multilateralism. The Clinton administration actually seemed to believe in the United Nations and such associated efforts as the International Criminal Court. Beginning in 1997, the Project for the New American Century (PNAC) pushed a program that would eerily resemble the eventual foreign policy of the George W. Bush presidency, including a major uptick in military spending and regime change in Iraq. As in 1979, the events of September 11 helped to propel U.S. foreign policy in a different direction.

PNAC is dead and gone, and the Bush doctrine is buried in the sands of the Middle East. Obama has reached back to the earlier traditions of his Democratic predecessors for inspiration, borrowing a measure of modesty from Carter and a measure of multilateralism from Clinton. And Obama has encountered the same congressional resistance to his de factotempering of American exceptionalism. Behind the Obama doctrine lurks a certain implicit assumption: that a safety net of international norms can both cushion the relative decline of the United States and contain the rise of other powers like China. Of course, Washington would like to game the system as much as possible to prolong the U.S. unipolar moment and ensure a comfortable imperial retirement. If all goes according to plan, the only conflicts that will take place will be over the terms of America’s golden parachute and our 401(k) plan (to be negotiated at trade talks, with Chinese investors, and with European banks).

But nothing ever goes according to plan. And here are three reasons why, drawn entirely from recent headlines.

On May 1, China set up an oilrig in the South China Sea in waters that Vietnam also claims. Vietnam has used YouTube to show China ramming its ships. Both sides have fired water cannons at each other. Chinese fighter jets patrol the sky above the disputed territory. Vietnam and U.S. allies Japan, South Korea, and the Philippines have all pressed Washingtonto check China’s more assertive claims to territory in the East and South China Seas. They want a more vigorous Pacific pivot to Asia.

On May 11, voters in two regions in eastern Ukraine supported greater autonomy in a referendum rejected by the central government in Kiev. Russian President Vladimir Putin has vowed to intervene if the interests of ethnic Russians in Ukraine are threatened. Although he has promised to withdraw the 40,000 troops currently near the border, no such troop movements have been detected. Clashes between Ukrainian government forces and separatists in eastern Ukraine threaten to spiral into a civil war. New NATO members in East-Central Europe are wary of Russia’s more assertive claims to territory near their eastern borders. Polish Defense Minister Tomasz Siemoniak, for instance, has called on the United States to “re-pivot” to Europe.

Then there’s Africa, where the United States created a new Africa Command shortly before Obama took office and where the Pentagon has recently ramped up its operations to more than a mission a day. Boko Haram, a radical Islamist group that seeks to turn Nigeria into an Islamic state, kidnapped more than 200 girls from their school last month. It’s only the latest act of extremism from a group that Washington put on the foreign terrorism list last year. It’s not clear whether the Nigerian radicals have any ties to al-Qaeda. But the war on terrorism has entered a new phase in which smaller U.S. forces partner with governments on the ground in Africa to battle non-state actors. Although some in the United States have called for an “African pivot,” no one in the region has issued such an invitation. They don’t really have to. We’re already there.

So far, the Obama administration has been rather cautious in addressing all three of these challenges. The U.S. Navy maintains more than half of its fleet in the Pacific, the Army still has bases in Europe, and Special Forces are deployed throughout Africa. But the administration has not advised military intervention in any of the three cases (though the use of drones and some “boots on the ground” in Africa certainly go beyond mere non-military strategies).

It’s also not likely that a Republican president would do anything appreciably different, although the party has practically Photoshopped Neville Chamberlain into the Oval Office. Marco Rubio (R-FL), who is likely to throw his hat in the ring for 2016, has called for perhaps the strongest responses to Russia and China. But even he has stopped short of calling for actual U.S. military intervention. After all, Americans are now thoroughly cynical about sending U.S. troops to fight overseas.

But remember: the United States maintained its two-war doctrine more as a yardstick for measuring how much money to allocate to the Pentagon. In the 1980s, hawks were not pushing the United States to start a war with the Soviet Union or Iran. Rather, they wanted to maintain the capabilities to fight both wars simultaneously if need be.

Here’s the nightmare scenario for 2016. The War Party will fight against any cuts in Pentagon spending and argue for upping the allocation in order to fight three wars simultaneously: against Russia, against China, and against non-state actors wherever they threaten U.S. interests. Sound unlikely? The Bush administration was able to transform a ragtag group of crazies — which, admittedly, had directly attacked the United States and killed nearly 3,000 people — into the “heirs of all the murderous ideologies of the twentieth century.” Imagine what the War Party, if it controlled the White House and Congress, could do with the likes of Russia, China, and the heirs of the heirs of all those murderous ideologies? If we’re lucky, we’ll avoid any outright conflict. But the price will nevertheless be bankruptcy. Forget about that imperial 401(k) plan.

It’s often pointed out that the British Empire finally collapsed because of the debts incurred by England during World War II. Washington extended London a mountain of loans to fight the war, and when the loans came due, the United States effectively replaced England as the hegemon of the “free world.”

But the process was not so cut and dried. “In July 1950, on the eve of the Korean War,” writes Tony Judt in Postwar, “Britain had a full naval fleet in the Atlantic, another in the Mediterranean and a third in the Indian Ocean, as well as a permanent ‘China station.’ The country maintained 120 Royal Air Force squadrons worldwide and had armies or parts of armies permanently based in Hong Kong, Malaya, the Persian Gulf and North Africa, Trieste and Austria, West Germany and the United Kingdom itself.” Five years after the end of World War II, someone forgot to give the British the news that their term was over.

The United States that Barack Obama inherited in 2008 was similarly a “dead empire walking,” and China now serves as the bankroller that the United States was in the 1940s. A prudent president, Obama has attempted to maintain U.S. position in the world at a lower cost and with less blowback. His critics on the left, myself included, want less empire and more prudence. But we must also acknowledge the deluge that might come après Obama and make the last few years seem like halcyon days.

If the War Party wins in 2016, all bets are off. We will prepare to fight in the Eurasian heartland, the South China Sea, and the resource-rich lands of Africa — because if we don’t fight them there, we’ll have to fight them here. Just when it seemed like we were about to give peace a chance, the United States will suddenly revert to a three-war doctrine. 2016 will be 1979 and 2001 all over again. And, as we all know, bad luck always comes in threes.

Enemies, innocent victims, and soldiers have always made up the three faces of war. With war growing more distant, with drones capable of performing on the battlefield while their “pilots” remain thousands of miles away, two of those faces have, however, faded into the background in recent years. Today, we are left with just the reassuring “face” of the terrorist enemy, killed clinically by remote control while we go about our lives, apparently without any “collateral damage” or danger to our soldiers. Now, however, that may slowly be changing, bringing the true face of the drone campaigns Washington has pursued since 9/11 into far greater focus.

Imagine if those drone wars going on in Pakistan and Yemen (as well as the United States) had a human face all the time, so that we could understand what it was like to live constantly, in and out of those distant battle zones, with the specter of death. In addition to images of the “al-Qaeda” operatives who the White House wants us to believe are the sole targets of its drone campaigns, we would regularly see photos of innocent victims of drone attacks gathered by human rights groups from their relatives and neighbors. And what about the third group — the military personnel whose lives revolve around killing fields so far away — whose stories, in these years of Washington’s drone assassination campaigns, we’ve just about never heard?

After all, soldiers no longer set sail on ships to journey to distant battlefields for months at a time. Instead, every day, thousands of men and women sign onto their computers at desks on military bases in the continental United States and abroad where they spend hours glued to screens watching the daily lives of people often on the other side of the planet. Occasionally, they get an order from Washington to push a button and vaporize their subjects. It sounds just like — and the comparison has been made often enough — a video game, which can be switched off at the end of a shift, after which those pilots return home to families and everyday life.

And if you believed what little we normally see of them — what, that is, the Air Force has let us see (the CIA part of the drone program being off-limits to news reporting) — that would indeed seem to be the straightforward story of life for our drone warriors. Take Rene Lopez, who in shots of a recent homecoming welcome at Fort Gordon in Georgia appears to be a doting father. Photographed for the local papers on his return from a tour in Afghanistan, the young soldier is seen holding and kissing his infant daughter dressed in a bright pink top. He smiles with delight as the wide-eyed child tries on his military hat.

From an online profile posted to LinkedIn by Lopez last year, we learn that the clean-cut U.S. Army signals intelligence specialist claims to be an actor in the drone war in addition to being a proud parent. To be specific, he says he has been working in the dark arts of hunting and killing “high value targets” using a National Security Agency (NSA) tool known as Gilgamesh.

That tool is named after a ruthless Sumerian king who ruled over Uruk, an ancient city in what is now Iraq. With the help of the massive trove of NSA documents leaked by Edward Snowden, Glenn Greenwald and Jeremy Scahill recently explained that Gilgamesh is the code name for a special device mounted on a Predator drone that can track the mobile phones of individuals without their knowledge by pretending to be a cell phone tower.

Lopez’s resumé yields more details on what Gilgamesh is capable of. The profile writer claims that he “supervised a team of four personnel supporting the lead targeting force in Laghman and Nuristan provinces [in Afghanistan]. Assisted top-level commanders with developing concepts, approaches, and strategies to Capture/Kill HVTs [high value targets].”

Last year, on completing his time in the military, Lopez says he took a civilian job operating Gilgamesh for Mission Essential, an intelligence contractor providing technical support for Pentagon drones. For that company, he says he conducted “pattern of life analysis” and provided support for “targeting and strike operations.” Lopez lives in Grovetown, Georgia, home to a joint Army-NSA code-breaking and language translation operation, involving 4,000 personnel that, since 9/11, has taken the lead in analyzing real-time data feeds from Central Asia and the Middle East.

Gilgamesh is just one of several NSA tools used on drones to track targeted cell phones. Another program, Shenanigans, was designed specifically for use by the Central Intelligence Agency. According to other documents leaked by Snowden, an operation code-named Victorydance used these tools in March 2012 to map every computer, router, and mobile device in Yemen.

What do men like Lopez actually think about the sort of human destruction, not to speak of the destabilization of whole regions, that Gilgamesh and its like help to unleash? In his online job pitch, Lopez indicates straightforward pride in his work: “My efforts, both as a contractor and in the military, yielded success in identifying, locating, and tracking high value targets, and protection of U.S. and coalition forces.” It would be easy enough to assume that the kind of analytical work such remote pilots do would result in a sense of job satisfaction and little more. And that, it turns out, would be a mistake.

Haunted by Death

In recent months, the first evidence that drones are not only killing thousands in distant lands, but also creating an unexpected kind of blowback among the pilots themselves, provides a curious parallel to the Epic of Gilgamesh, the 5,000-year-old poem about the Sumerian king. In the ancient saga, the gods are said to have sent Enkidu to befriend the cruel king and divert him from the oppression of his subjects. When the pair travel together to slay a monster named Humbaba, Gilgamesh begins to have nightmares about death and war, causing him to question their plan.

Today, like Gilgamesh of old, signals intelligence personnel connected to the drone programs have started reporting themselves haunted by the deaths that they have participated in, and plagued by the knowledge that, in the end, they often had next to no idea who they were actually killing. The publicity about a “kill list” in the White House has left the impression that those who find themselves on the other end of a drone-launched missile have been carefully identified and are known to the drone pilots. “People get hung up that there’s a targeted list of people,” one drone pilot told the Intercept two months ago. His view, however, was quite different: “It’s really like we’re targeting a cell phone. We’re not going after people — we’re going after their phones, in the hopes that the person on the other end of that missile is the bad guy.”

Brandon Bryant, a 28-year-old U.S. airman, whose squadron has been credited with 1,626 kills, was among the first to be openly critical of the impact of remote tracking and targeting, of, that is, robot war. Bryant was a “sensor operator,” which meant that he operated the cameras on the drone aircraft as part of a three-person team that included a pilot and an intelligence analyst.

In an interview with GQ magazine last October, Bryant offered a vivid description of a targeting operation in Afghanistan he took part in when he was just 21. “This figure runs around the corner, the outside, toward the front of the building. And it looked like a little kid to me. Like a little human person,” he said. “There’s this giant flash, and all of a sudden there’s no person there.”

Bryant says he asked the pilot: “Did that look like a child to you?” The message came back from another intelligence analyst: “Per the review, it’s a dog.”

After six years, Bryant couldn’t take it any more. He saw a therapist who diagnosed him with post-traumatic stress disorder. This was a novel, even shocking development for an airman who had hardly ever come close to a battlefield. Bryant was suitably taken aback and, as a result, began speaking out against the system of killing he had been enmeshed in and what it does both to the killers and those killed. “Combat is combat. Killing is killing. This isn’t a video game,” he wrote in an angry tirade on Facebook. “How many of you have killed a group of people, watched as their bodies are picked up, watched the funeral, then killed them, too?”

Killing for the CIA

Bryant’s campaign against drone war without accountability took on new life in late April when Tonje Hessen Schei, a Norwegian filmmaker, released her film Drone. In it, Bryant reveals that his former colleagues in the Air Force had not just been carrying out drone strikes on the battlefields of Afghanistan and Iraq where the military was involved in open warfare. They were also conducting the strikes in the supposed CIA drone assassination campaigns in Pakistan and Yemen.

This was news. The CIA’s “covert” drone wars in those countries were, it turns out, secretly Air Force operations. “The CIA might be the customer, but the Air Force has always flown it,” Bryant says in the film. “A CIA label is just an excuse to not have to give up any information. That is all it has ever been.”

Schei’s film also reveals the name of the U.S. Air Force unit that does the CIA killing — the 17th Reconnaissance Squadron at Creech Air Force Base in Nevada. “From what I was able to gather, it was pretty much confirmed they were flying missions almost exclusively in Pakistan with the intent to strike,” Michael Haas, another drone pilot, told Chris Woods at the Guardian.

Thanks to the film, Bryant made an unusual connection in the world of drone pilots — to the victims of Washington’s drone campaign, previously just so many pixels on a screen to him. Invited to Belgium and Norway to speak at the premieres of Schei’s film, he met with Shahzad Akbar, a Pakistani lawyer who runs the Foundation for Fundamental Rights and has been leading a campaign to put a face — quite literally — on the death and destruction CIA drone strikes have caused in his country.

Faces of the Victims

Up in the mountains of Khyber Pakhtunkhwa in northern Pakistan, a giant image of an orphan girl is now laid out next to the mud houses of the locals. She is nameless, but according to her photographer, Noor Behram, she lost her parents in a drone strike in 2010 in the village of Dande Darpa Khel. Her picture, the size of a soccer playing field, is a product of Akbar’s planning with the help of JR, a French street artist, and Clive Stafford-Smith, the founder of Reprieve, a British human rights organization. Their intent: to create images of the victims of Washington’s drone wars that could be seen from the sky. Smaller images have, in fact, been placed on rooftops in Waziristan. Their target audience: drone pilots like Bryant, Haas, and Lopez who, searching for targets to kill, might just see the face of the child of one of their previous victims. (The Bureau of Investigative Journalism, which keeps a tally of drone victims in Pakistan, offers a provisional figure of up to 957 civilians, including as many as 202 children, killed between 2004 and the present day.)

For the last five years, Akbar and Smith have worked tirelessly on similar projects. One of their first efforts was to reveal the name of the CIA station chief in Pakistan: Jonathan Banks.  In December 2010, they brought a $500 million lawsuit against him in that country, causing him to flee. The next summer they put together a collection of Noor Behram’s photographs of the dead, as well as their relatives and neighbors, that was exhibited in London.

Last year, Akbar even made plans to take the relatives of drone victims to testify before the U.S. Congress. Though he himself was denied entry to the country, he succeeded. Rafiq-ur-Rehman and his two children, nine-year-old Nabila-ur-Rehman and 13-year-old Zubair-ur-Rehman, did speak at a special hearing arranged by Representative Alan Grayson.

Now, with the unexpected support of a small but growing group of former drone pilots, a campaign against “targeted killings” might well take on a new life in the U.S. At least six other drone pilots have already spoken anonymously to Woods, largely confirming what Bryant and Haas have said publicly.

The Strain of Long-Distance War

There is evidence that other drone pilots are also beginning to crack under the pressure of drone war. Two recent studies by the Air Force strongly suggest that Bryant’s PTSD diagnosis is no anomaly, that no matter how far you may be from the battlefield, you never quite leave it.

Published in June 2011, the first study by Wayne Chappelle, Joseph Ouma, and Amber Salinas of the School of Aerospace Medicine at Wright-Patterson Air Force Base in Ohio concluded that nearly half of the drone pilots studied had “high operational stress.” A number also had “clinical distress” — that is, anxiety, depression, or stress severe enough to affect them in their personal lives. The study attributed this to long “flying” hours and erratic shifts, but did not compare drone pilots to those in combat aircraft fighting above the battlefield.

A second study by Jean Otto and Bryant Webber of the Armed Forces Health Surveillance Center and the Uniformed Services University of the Health Sciences, published in March 2013, compared drone pilots to those performing standard military missions. The level of stress, it found, was almost the same, a surprising conclusion for those who assumed that drone pilots were essentially video gamers.

“Remotely piloted aircraft pilots may stare at the same piece of ground for days,” Otto told the New York Times. “They witness the carnage. Manned aircraft pilots don’t do that. They get out of there as soon as possible.”

Some believe that drone stress is significantly related to a major shortage of pilots for such planes. A Government Accountability Office report released in April tersely notes that “high work demands on RPA [remotely piloted aircraft] pilots limit the time they have available for training and development and negatively affects their work-life balance.”

Speaking from the Heavens

There is, however, likely to be far more to it than that. After Bryant came forward, for instance, Heather Linebaugh, a former drone intelligence analyst, broke her silence, too. Writing in the Guardian in late December, she summed up the largely unpublicized failure of Washington’s drones this way: “What the public needs to understand is that the video provided by a drone is not usually clear enough to detect someone carrying a weapon, even on a crystal-clear day with limited cloud and perfect light. The feed is so pixelated, what if it’s a shovel, and not a weapon? We always wonder if we killed the right people, if we destroyed an innocent civilian’s life all because of a bad image or angle.” (And she didn’t even point out that, in the areas being attacked in Pakistan and Yemen, carrying a weapon is commonplace and not necessarily a sign that you are a “terrorist.”)

Linebaugh explained that, under these circumstances, a “mistake” had terrible consequences, and not just for those erroneously targeted, but even for the pilots. “How many women and children have you seen incinerated by a Hellfire missile? How many men have you seen crawl across a field, trying to make it to the nearest compound for help while bleeding out from severed legs?” She added, “When you are exposed to it over and over again it becomes like a small video, embedded in your head, forever on repeat, causing psychological pain and suffering that many people will hopefully never experience.”

And don’t count on Linebaugh being the last drone analyst to speak out, either. Whether future Rene Lopezes ever actually look down from the computerized “heavens” and see the picture of that little Pakistani orphan girl, we already know that they will see horrors that are likely to prove hard to absorb.

It is this third face of war, along with those of the “enemy” and innocent victims, which provides the crucial evidence that the drone project, Obama’s remote control campaign, is a failure; that it is not clinical but bloody and riddled with error; that it creates enemies even as it kills others; that it is, above all, no more a video game for those who fly the planes and loose the missiles than it is for those who die in distant lands.

Once again revelations concerning the genesis of Israel’s undeclared nuclear weapons program are attracting notice.

Two nuclear experts, Victor Gilinsky and Roger J. Mattson, have again raised questions as to how Israel might have acquired the nuclear materials needed to build its nuclear bombs in a provocatively titled article, “Did Israel steal bomb-grade uranium from the United States?”  

Why now? The Interagency Security Classification Appeals Panel (ISCAP), the nation’s highest classification authority, has released a number of top-level government memoranda that may provide additional grounds for suspecting that during the 1960s, bomb-grade uranium from the Nuclear Materials and Equipment Corporation (NUMEC) reprocessing plant in Apollo, Pennsylvania made its way into Israel’s nuclear weapons program. “The newly released documents also expose government efforts, notably during the Carter administration, to keep the NUMEC story under wraps, an ironic twist in view of Jimmy Carter’s identification with opposition to nuclear proliferation,” write Gilinsky and Mattson in the Bulletin of Atomic Scientists.

Four years ago, in March 2010, the two researchers wrote “Revisiting the NUMEC Affair” for the Bulletin. They contended there was abundant evidence available from declassified documents to support suspicions that at least some of the 337 kg. of radioactive materials that had gone missing from NUMEC in the 1960s from the plant in Apollo had been stolen and taken to the nuclear research reactor in Dimona, Israel. The cited documents also reveal that the FBI, CIA, the Atomic Energy Commission (AEC) and members of the top echelons of the U.S. national security establishment were aware that NUMEC’s founder and president, Zalman Shapiro, not only had ties to Israeli intelligence officers and operatives with science-related job descriptions, but had also allowed them into the NUMEC plant.

Among them was Rafael Eitan, a “chemist” for Israel’s Defense Ministry who also happened to be a former Mossad officer, as well as the handler of naval intelligence spy, Jonathan Pollard, who has been in the news recently. Just how much was already known about Eitan’s role in NUMAC’s “diversion” of nuclear materials to Israel, and the extent of Israeli espionage activities conducted in the U.S. — second only to that of the KGB according to one top-level source quoted by name — is evident from a 1986 article by Washington Post reporter Charles Babcock about the Pollard case.

Grant W. Smith, Director of the Institute for Research: Middle Eastern Policy (IRmep) followed up Gilinsky and Matson’s 2011 disclosures with a report based on documents obtained under the Freedom of Information Act (FOIA) and other documentary evidence including corporate filings, office diaries and unguarded interviews. The report was published in January 2012 as a book titled, Divert! NUMEC, Zalman Shapiro and the diversion of US weapons grade uranium into the Israeli nuclear weapons Program. According to Smith, former CIA Tel Aviv station chief John Hadden claimed that NUMEC was “an Israeli operation from the beginning.”

Gilinksy and Mattson, initially more circumspect in drawing conclusions than Smith — in part because the released documents are highly redacted – credited Smith with having kept up the pressure for the release of more declassified documents. On March 18 the ISCAP released 84 additional pages (PDF) of previously classified documents related to concerns about the illegal diversion of weapons-grade nuclear material from NUMEC to Israel’s nuclear weapons program. The new documents include:

  • A letter dated April 2, 1968 from CIA Director Richard Helms to Attorney General Ramsey Clark about a large loss of uranium from NUMEC. In 1965, the AEC had acknowledged the possibility of missing nuclear materials having been diverted, but had tried to play it down.
  • An FBI memorandum (03/09/1972) discussing “the distinct possibility” that NUMEC’s director, Zalman Shapiro, had been responsible for the diversion of special nuclear materials.
  • Notes from a briefing of President Jimmy Carter’s National Security (07/28/1977) by Theodore Shackley, the CIA’s Associate Deputy Director, revealing that then-CIA Director George W. Bush had briefed President-elect Jimmy Carter about “the NUMEC problem” in December 1976, even before Carter had taken office.
  • A memorandum to Carter from National Security Adviser Zbigniew Brzezinski (08/02/1977) that expressed dismay not only about careless accounting practices used to keep track of uranium in NUMEC’s possession and lax AEC oversight, but even more at the considerable interest in NUMEC’s loss of nuclear materials among certain members of Congress, which Brzezinski considered  “dangerous.” Determined to broker a peace deal between Israel and Egypt, the last thing Carter wanted were revelations confirming Israel had nuclear weapons, particularly if they had been created with materials from the U.S., so Carter shut down the NUMEC investigation.
  • Declassified wiretap transcripts of conversations between Shapiro and venture capitalist David Lowenthal that reveal illegal storage practices, which led to a dangerous nuclear spill.

In their most recent article for the Bulletin, Gilinsky and Mattson sum up what the various declassified documents, including those most recently released, confirm about NUMEC’s probable role in providing Israel with highly enriched uranium with which to produce nuclear weapons:

NUMEC’s unexplained losses were a significantly larger proportion of its output of highly enriched uranium than was the case for other firms that dealt with nuclear materials. Sloppy accounting and lax security made the plant easy to rob without detection. NUMEC had commercial relationships with Israel’s defense and nuclear establishments and regularly made sizeable nuclear shipments to Israel, which at that time were not checked by the AEC.  NUMEC’s owners and executives had extremely close ties to Israel, including to high Israeli intelligence and nuclear officials. Israel had strong motives to obtain the highly enriched uranium before it was producing enough plutonium for weapons. High-level Israeli intelligence operatives visited the NUMEC plant. Israeli intelligence organizations were used to running logistically complicated, risky operations to support nuclear weapons development, and it would have been very much out of character for them to pass up an opportunity like this.

Why does it matter now?

Despite its continuing denials, it is almost universally recognized that Israel possesses nuclear weapons, and there’s next to zero likelihood Israel will give them up. Does it matter how Israel got its nuclear materials half a century ago, and if so, why?

1.  The environmental disaster NUMEC left behind. NUMEC’s carelessness in handling its toxic nuclear waste left behind an environmental disaster that has barely been addressed. Cleaning up the Shallow Land Disposal Area in Parks Township, Pennsylvania, contaminated by radioactive leakage from drums of toxic chemical and radioactive waste dumped by NUMEC and its successors — the Atlantic Richfield Co. and BWX Technologies (also known as Babcock & Wilcox) – may cost as much as half a billion dollars, according to the Army Corps of Engineers and the Wall Street Journal. The cleanup began in 2011 but was halted soon afterwards, and it won’t resume until 2015. In the hands of a new contractor, the cleanup may last a decade, and even then the chances of success are uncertain. Declassification of more NUMEC-related documents could facilitate the cleanup and even reduce its cost by disclosing details about where and how the toxic nuclear materials were discarded.

2. The proposed release of Israeli spy Jonathan Pollard. A CIA damage assessment of the Pollard case was declassified in December 2013. Although Pollard himself was only a small cog in the Israeli espionage network, Smith points out that none of the files handed over by Pollard to his handler, Rafael Eitan, part of the Israeli team visiting NUMEC in 1968, have ever been returned. He recommends that “if President Obama releases Pollard, it should be preceded by the belated return of the massive trove of classified documents he stole for Israel as well as all purloined nuclear materials and technologies.”

3.  Undermining assertions of  U.S. commitment to transparency in governance. “Nearly 50 years have passed since the events in question,” Gilinsky and Mattson contend. “It is time to level with the public. At this point it is up to the president himself to decide whether to declassify completely the NUMEC documents, all of which are over 30 years old. He should do so. We know that is asking a lot given the president’s sensitivity about anything involving Israel, and especially anything relating to Israeli nuclear weapons. But none of his political concerns outweigh his responsibility to tell the US public the historical truth it deserves to know.”

4.  Undermining U.S. commitment to nuclear nonproliferation. “We’ve lost a great deal of respect around the world on the subject of nonproliferation,” Gilinsky told Global Security Newswire (GSN) in an e-mail interview. “The president doesn’t even acknowledge that Israel has nuclear weapons, which means no one in the government can…Leveling on [this] affair, painful as it might be in the short run, would be a step toward what you might call a reality-based policy in this area.”

5. Future relations with Iran and North Korea. Mattson opined to GSN that disclosure of whatever the U.S. knows about the disappearance and diversion of nuclear materials from NUMEC would be to Washington’s advantage in dealing with Iran and North Korea, irrespective of whether or not Israel was the perpetrator of nuclear theft. In negotiating with Iran and North Korea, “it is important for all sides to come to the table openly and honestly, as they declare their various interests in the deal they are trying to strike.” U.S. credibility would be enhanced by the full declassification of documents from the 1960s and 70s, especially if  these documents were to reveal that the U.S. has been frank and forthright about NUMEC. If the U.S. hasn’t been honest up until now, Mattson sees the NUMEC document declassification as an opportunity to “atone for past mistakes and go back to the negotiating table refreshed by the experience” thereby setting an example for states that it accuses of duplicity.

The CIA and the Senate Select Committee on Intelligence (SSCI) have been embroiled for several weeks in a dispute over the declassification of a sweeping Senate report, the product of an investigation into the George W. Bush-era CIA’s so-called “enhanced interrogation” program. The SSCI’s chair, Senator Dianne Feinstein (D-CA), has accused the CIA of removing documents related to the investigation from the committee’s computers, and of attempting to intimidate committee staffers by requesting a Justice Department review into how the committee was able to obtain an internal CIA review of the program. Now, as the White House and CIA review the SSCI report for declassification, its major findings have been leaked to the public, and they reveal that the CIA’s use of enhanced interrogation techniques, and the conditions under which it held its detainees, were “brutal and far worse than the agency communicated to policymakers.”

While the public still does not know what the committee’s report says (the committee voted 11-3 on April 3 to declassify its executive summary and conclusions, but the CIA and White House must conduct a final review before it can be released), members of the committee have talked openly about its findings. Senator John McCain said that the report “confirms…that the cruel, inhuman and degrading treatment of prisoners is not only wrong in principle and a stain on our country’s conscience, but also an ineffective and unreliable means of gathering intelligence.” Defenders of the program, like Fox News contributor Liz Cheney, argue that it produced important intelligence that helped the United States to thwart terrorist plots and to degrade Al-Qaeda’s capacity to sponsor further attacks, but what we know of the findings of the SSCI report contradicts that argument. Not that it should matter; any debate over the enhanced interrogation program must, as Vincent Warren of the Center for Constitutional Rights has argued, reckon the morality of torture, not its effectiveness.

It is torture that we’re talking about, euphemisms like “enhanced interrogation” aside. In a remarkable editorial in the April 11 Washington Post, former contract interrogator Eric Fair described what he saw and did during his time in Iraq:

In April 2004 I was stationed at a detention facility in Fallujah. Inside the detention facility was an office. Inside the office was a small chair made of plywood and two-by-fours. The chair was two feet tall. The rear legs were taller than the front legs. The seat and chair back leaned forward. Plastic zip ties were used to force a detainee into a crouched position from which he could not recover. It caused muscle failure of the quads, hamstrings and calves. It was torture.

Fair concludes that the “stain” of the torture program demands a full accounting, for the sake of the nation as well as those who participated in the program directly.

History tells us that we should not be surprised by the Obama administration’s reluctance to fully investigate allegations of wrongdoing by its predecessor. Barack Obama made it very clear, even before he took office, that he preferred to “look forward as opposed to looking backward” when it came to the subject of investigating potential Bush administration crimes, and he has adhered to that position over the past five-plus years.

Obama is not the first president to turn a blind eye to possible transgressions by a former administration. The obvious example of this phenomenon was Gerald Ford’s decision to pardon Richard Nixon for any crimes related to the Watergate scandal, in 1974. But Ford had been Nixon’s Vice-President, making his act somewhat understandable. Bill Clinton’s decision not to investigate alleged crimes that took place under the Reagan and George H.W. Bush administrations was, as Robert Parry notes, motivated by the same desire to focus on advancing his own agenda, to “look forward as opposed to looking backward,” which Obama intimated as president-elect.

While it may behoove a particular administration to avoid the appearance of vindictiveness toward previous administrations, the decision not to investigate something as pernicious as the officially sanctioned torture of prisoners sacrifices the US’ credibility in the long run. It should not go unnoticed, for example, that while the US Ambassador to Kosovo is urging that nation to conduct a tribunal over the issue of organ trafficking by Kosovar Albanian militias in order to “build up its international credibility,” two branches of the US government are openly at odds over whether to even publicly acknowledge the past abuses of our “interrogation” program. It probably doesn’t go unnoticed that while the US refuses to reckon with its abuse of detainees, it is also refusing to issue a visa to Iran’s newly appointed UN Ambassador on the grounds that he was a background participant in the 1979 takeover of the US embassy in Tehran (he’s now part of Iran’s “reformist” camp). If the US can’t honestly reflect on its own past, how does it have the standing to demand the same of other nations?

The CIA’s resistance to a candid assessment of its torture program, even under an administration that firmly and officially disavowed that program upon taking office, speaks to an overall unwillingness to face accountability for any excesses wrought by the US’ ongoing “War on Terror.” While the Senate has investigated the failures in pre-war intelligence that led to the Iraq War, there has been no consequence to anyone involved in those failures. It is safe to say that there will be no consequences for anyone involved in the torture program as well, given the Obama administration’s deference to CIA efforts to stonewall even the release of a report detailing what actually took place.

It is impossible to imagine, then, that any future administration will have any interest in reckoning with other morally and legally questionable national security policies of this period, like the use of drones or the enlargement of the surveillance state. When it comes to the “War on Terror,” the rule seems to be “what’s past is past.”

Earlier this week the European Parliament passed a resolution condemning the US drone program and expressing its concern over the desire of some European states to build a program of their own. Here in the US few have paid attention. But if the resolution signals a more serious commitment on the part of Europe to publicly disclaim the legal and policy architecture of the US’s “targeted killing” program, then the White House’s legal footing, which is already on thin ice, could become untenable in the face of near-unanimous global opposition.

The resolution, which is non-binding as a matter of European law, “expresses…grave concern over the use of armed drones outside the international legal framework,” which goes against US pretensions of acting within the bounds of law in conducting its “targeted killing” program. In doing so the European Parliament rejects the novel legal doctrines that the US has used to support its activities in the “global war on terror,” arguing that traditional jus ad bellum and jus in bello rules do not need to be revised in light of the threat posed by transnational terror groups (as the US has long alleged). This is a striking challenge to the United States and its claims to compliance with international norms, and is a sharp reminder of the twin reports from UN Special Rapporteurs last year (whose work is cited in the resolution itself).

This also comes on the heels of a New York Times report that the US is considering adding a US citizen, Abdullah al-Shami, to the White House’s “kill list”. Besides the significant constitutional issues at stake in a unilateral presidential decision to kill a US citizen without due process, international human rights law is implicated as well. The focus on human rights law as the appropriate legal frame, which is evident throughout the Parliament’s resolution, thus takes on added significance in the wake of this report.

More importantly, the resolution signals to other EU bodies that now is the time for unified European action to publicly oppose the US’s “targeted killing” program; to limit the use of drones both globally and in a distinctly European context; and to hold criminally responsible those that assist what the Parliament regards a potentially criminal action on the part of the United States. In fact, as part of its “action program” the Parliament’s resolution “urges the [European] Council to adopt an EU common position on the use of armed drones,” which would be binding on all EU member-states. Such a legislative gambit could include provisions providing for “judicial review of drone strikes…and effective access to remedies [for victims].” Both have thus far largely been barred in European courts.

Such would spell serious trouble for the United States and its continued ability to conduct drone warfare across international borders. It is one thing for official criticism to be done in private and for US and European legal scholars to haggle over applicable laws in the US’s conflict with al-Qaeda. It is entirely another thing for the US’s closest allies to so publicly rebuke the White House (especially one that professes to care as much about toeing the line of the law as this one does) and to threaten to open its court system to the victims of what it regards as “unlawful drone strikes.” While legislative action from the European Council and Commission remains unlikely, the vote count on the Parliament’s resolution (534-49) suggests that sentiment against “targeted killings” has begun to overcome Europe’s squeamishness about upsetting its powerful ally.

This week also saw the respected British human rights organization, Reprieve, submit a communication to the International Criminal Court to start an investigation of NATO personnel complicit in the CIA drone program. Of course, none of this bodes well for the United States. Whereas the Bush administration expressed contempt towards international law and thus was treated in kind from its practitioners, the Obama administration has at least demonstrated concern for international norms and struggled to describe its drone policies as compliant with the law. But as US allies and human rights NGOs close in on the White House, the Obama administration will be forced to either proclaim its adherence to international law and end its “targeted killing” policies, or abandon any pretension to international law-compliance altogether. The sooner the better, too, because the growing outcry against the US’ drone policies shows no signs of losing steam.
