The Palestinian Authority (PA) has now moved a step closer to making good on its threat to go to the International Criminal Court (ICC) and bring charges against Israel. There is little doubt that this was a move Palestinian President Mahmoud Abbas tried desperately to avoid. In the end, he was forced to do it by a combination of U.S.-Israeli rejectionism, Palestinian desperation to do something to try to end Israel’s occupation, and his own many missteps.

Abbas signed on to 18 international agreements after the quixotic attempt to pass a resolution at the United Nations Security Council (UNSC) predictably failed. Among them was the 1998 Rome Statute, which established the ICC and took formal effect in 2002. This is the step that the U.S. and Israel have warned Abbas against most strongly. Among all the “unilateral steps” the Palestinians could take (which, one should note, is no more “unilateral” than any number of actions taken by Israel on a routine basis), this is the one Israel worries about most.

The reason, of course, is obvious. Israel knows it has committed war and other international crimes—some very serious—in the course of its occupation. While Israel generally scoffs and waxes indignant at critical world opinion, it is concerned that being hauled before the ICC could further negatively impact public and elite opinion in Europe, Israel’s main trading partner, where patience with Israeli policies has grown ever thinner.

Abbas knows only too well that he risks losing what little power he has in the West Bank. There are many ways this move can blow up in his face, and most of the roads to success are going to take more time than he has. That he has taken this step testifies to his desperation.

When, on behalf of the Palestinians, Jordan submitted its resolution to the UNSC last month, it did so under tremendous pressure from other Arab states. Abbas and Jordan’s King Abdullah had preferred to wait until France was ready with its own resolution, which the United States had strongly hinted it would support, or at least not oppose. Abbas knew full well that, even if the Palestinian resolution had mustered the nine votes needed to pass the UNSC, Washington would have vetoed it. Approval of the French version, while toothless and lacking a fixed deadline to end Israel’s occupation, would at least have had virtue of demonstrating the international community’s insistence on a two-state solution.

But internal pressure to submit the Palestinian version, as well as the external pressure that turned out to be decisive, seems to have pushed the French version to the back burner, at least for the time being. With the expected failure of the Palestinian resolution at the UNSC, Abbas was forced to carry through with his threat to sign the Rome Statute, a move that many Palestinians, including many in his own Fatah faction, had been clamoring for ever since the 2012 U.N. General Assembly vote that granted Palestine non-member observer state status, thus enabling it to join international agreements and UN specialized agencies.

In the long run, this is a move that could pay off for the Palestinians, but it carries enormous risks, especially to the PA. The most obvious and immediate threats lie with the responses that can be expected from Israel and its most important foreign backer, the new Republican-led U.S. Congress. Many in Congress have made it clear that they intend to push for suspension of aid to the PA if it signs the Rome Statute. And Israel will surely ramp up its settlement expansion and likely once again withhold taxes it collects on the PA’s behalf. The resulting economic impact could very well lead to the PA’s collapse.

That outcome has been forestalled in the past by Israel’s recognition that the security and economic costs it would inherit would be exorbitant. Israeli officials not only allowed their own cooler heads to prevail, but also urged restraint on their friends in Congress. Despite the recent splash the Labor Party made by joining forces with peace process veteran Tzipi Livni, Bibi Netanyahu’s main challenge still comes from his right in the elections scheduled for mid-March, and he can’t afford to look soft on the Palestinians.

That certainly won’t help Abbas. He knows the dangers that confront him. Moreover, the approach to the ICC carries another risk. Even if Abbas survives the Israeli-U.S. response, it is very possible that Hamas will also face charges at the ICC. The case against Hamas, while covering crimes involving far less destruction and loss of life, is also more clear-cut than one likely to be brought by the PA against Israel, whose acts in Gaza and in the day-to-day occupation of the West Bank will require lengthy investigation. Should Hamas find itself on the losing end of the law before Israel does, Abbas’s position is likely to weaken further.

Despite his moves toward internationalization, Abbas still much prefers to work with Washington. U.S. fecklessness in the face of persistent Israeli opposition to any diplomatic initiative, however, has essentially brought him to this Rubicon. And his own clear reluctance to cross it will itself likely diminish the chance of success.

Under the Rome Statute, the Palestinians will not be able to formally file any cases with the ICC prosecutor for 60 days from the date of signing. That time will certainly be used by the Obama Administration, which will no doubt argue that such a filing could bolster the Israeli Right in the critical final days of the election campaign, to pressure the Palestinians against going forward. Still, the repeated failure of the Security Council to address the occupation in any substantive way, coupled with the failed history of the U.S.-brokered peace process, has sent the Palestinian people the message, however unintentionally, that diplomacy and cooperation are dead-end strategies. That is going to lead to more Palestinians embracing the violent paths called for by Hamas and other, considerably more militant, factions.

At the same time, Palestinians have seen the futility of armed struggle over the decades. Failure at the UNSC and joining the ICC — but then forgoing charges against Israel – will only increase Palestinian despair and desperation. That will no doubt lead to more of the kind of “lone wolf” attacks that Israelis endured in 2014.

The one party that could make a difference is the European Union (EU). It can exert serious pressure on Israel of a kind even the United States cannot match. The EU accounts for nearly one-third of Israel’s export business. (By comparison, the U.S. accounts for just under one-quarter). Labeling settlement products (as some EU countries currently require, but don’t generally enforce) could be a first step. And if it is couched as a warning that sterner measures are in the offing, the impact on Israeli thinking could be significant, perhaps even a game-changer.

Indeed, ultimately, that sort of European action is what Israel fears. If the Obama administration wants to see a reversal of the downward spiral its own peace-making efforts have helped create in Israel-Palestine, it could quietly encourage the EU in that direction.

Such a course would be wise. Abbas’s strategy of relying entirely on U.S. help to pull him through has clearly failed, and his reign, whether due to a P.A. collapse or just his own advancing age, will not last much longer. He has no clear heir apparent, so what comes after is a mystery. The United States won’t exert significant pressure on Israel in the near future, and, absent some unanticipated shock, Obama’s successors in the White House are unlikely to spend as much political capital as he has on resolving the conflict. The pressure must come from Europe and from the Palestinians using whatever international tools are at their disposal.

This is, after all, just what was always demanded of the Palestinians—that they pursue their goals without recourse to violence. If a peaceful path to statehood is denied them, ongoing and escalating violence is all we can expect to see.

The Israeli government is headed for yet another round of elections. Although the official election date for the next Knesset is November 7, 2017, no one ever expected this government to last that long. The voting will likely take place in March of 2015.

What do the new elections mean outside of Israel? Nothing very good, I’m afraid. For the most part, any elections held in the foreseeable future are going to cement the status quo even further, and where they don’t do so, elections will mean a shift even further rightward.

In the short term, Europe will likely agree with the United States to keep doing what they’re doing now with regard to an Israeli-Palestinian agreement, which is nothing. But in the long term, they are both likely to be saddled with an Israeli government that will be even more blatant about its refusal of any accommodation with the Palestinians, and even more insistent on building more and more settlements, especially in Jerusalem.

There is, however, a good deal of flux in Israeli politics right now. Prime Minister Benjamin Netanyahu has seen his popularity plummet. His Gaza operation over the summer is not being viewed positively in Israel, as many see no difference in the situation with Gaza today from earlier in the year. Israelis may agree with many of his stances, but they’re not as keen on the way he executes his policies—they see Netanyahu as having eroded the relationship with the United States and having failed to stem the increasing hostility toward Israel in the rest of the world.

But more than anything else, Bibi’s economic policies have driven down his ratings. Although the Israeli economy writ large is relatively healthy, economic disparity within Israel, even among Israeli Jews, has never been worse, as the distribution of wealth in Israel rivals the extremely skewed scale we have grown accustomed to in the United States. And just like Americans in the United States, most Israelis are primarily concerned with the economy, jobs, and supporting their families—not foreign policy.

Another similarity between the United States and Israel is the lack of leadership options. Only some 33% of Israelis believe Netanyahu is the best man for the prime minister’s job, and his approval rating is around that same figure. But that puts him far ahead of any other major player on the Israeli scene. The next most popular choice for prime minister, according to the polls, is Isaac Herzog of the Labor Party at around 17%. Netanyahu’s Likud Party also polls significantly higher than any other party, so the overwhelming likelihood is that Netanyahu will win another election.

But the real question is what his coalition would look like. As we’ve seen in the last several Israeli elections, cobbling together a governing coalition is no easy feat. It requires serious compromises that could result in the same prime minister being forced to take on rather different policies depending on the coalition. The right-wing coalition that came to power in 2013 pushed Netanyahu into even more hawkish positions than he already held, both internationally and domestically. What would the next one do?

The current government, led by Netanyahu’s right-wing Likud Coalition, consists of the Russian/right-wing Yisrael Beiteinu (Israel, Our Home) party headed by Avigdor Lieberman; HaBayit HaYehudi (Jewish Home) headed by Naftali Bennett; Yesh Atid, a centrist party led by former television anchor Yair Lapid; and Ha’Tnuah, headed by Tzipi Livni. While all of these parties have clashed with Netanyahu at one time or another, Lapid and Livni are the most at odds with Bibi right now.

Netanyahu would certainly try to form a new coalition without Lapid or Livni. Between Likud and the other two far-right parties currently in the coalition, Netanyahu could reasonably count on around 50 seats in the next Knesset. Sixty-one seats are needed to form a governing coalition. But while Bennett has warmed up to Netanyahu, Lieberman, whose party formed a joint ticket with Netanyahu in the last election, has become a political enemy. So how will Netanyahu cobble together a coalition?

Netanyahu’s Likud and Bennett’s HaBayit Hayehudi are currently polling at about 40 seats between them, perhaps a few more. Another twenty or so would then be needed to form the next government. One candidate is the ultra-Orthodox Shas party. They will want to address their core demands, which are generally based on the economic concerns of their constituency: lower-income Jews of Iberian and Middle Eastern descent. They used to support a theoretical two-state solution, but have recently shifted farther to the right on the issue of the occupation and have always been firm about not dividing Jerusalem. Shas is polling between six and ten seats.

United Torah Judaism is an Ashkenazi coalition party (Jews of European descent, excluding Iberia) that is similar to Shas, but more devoted to maintaining the place of religion in Israel and less interested in foreign policy matters, including the occupation. UTJ will bring 7 or 8 seats.

If, as Netanyahu has suggested, he forms a coalition with the religious parties, it seems very possible that between Likud, and the three religious parties, he could get very close or possibly even exceed the 61-seat threshold. But he’s likely to need one more party, and while Labor, Livni, and Lapid all refuse to rule out being in a Netanyahu-led coalition, they will all face tremendous internal pressure not to do so, and, in any event, Bibi almost certainly doesn’t want them, lest he perpetuate the same unstable coalition he is trying to get out of now.

In all of this, there is a wild card, in the form of a new player in the election game. Popular ex-Likud figure, Moshe Kahlon has formed a party of his own, as yet unnamed, and it figures to be a key player in the next election. Kahlon, who is very well-liked among the Israeli public for having reformed the cellular communications industry, left Likud because he felt it had “lost its way.” He is a classic Likud hawk more in the mold of Menachem Begin than Netanyahu. But his real appeal exists in the fact that like Begin and very much unlike Netanyahu, he tends to emphasize economic equality and social welfare. He would not promote the blatant racism Netanyahu does, and that might help a bit with the current internal strife. He would also want to try to maintain a peace process, even while he holds positions on the occupation and security that are not far away from Bibi’s. Current polls have his new party winning between 9 and 12 seats.

So, what kind of government comes out of all this? Kahlon may, in many ways, hold the key to that question. The most likely coalition would consist of Likud, HaBayit HaYehudi, Shas and Kahlon’s party, with UTJ possibly tagging along or replacing Shas. The price of the latter parties’ agreements would be some change in economic and social policies in Israel. This could amount to a government that does more to assuage popular domestic anger than the current one, but is even more hawkish on the occupation. Kahlon could also turn into a somewhat more powerful version of Livni in the next government. His party would likely hold considerably more seats and he is much more popular with Israelis than Livni ever was.

If Kahlon does better in the election than currently projected, he could also possibly be the one to form the next government. Kahlon would not necessarily have to out-poll Likud to do this. He would merely need to have enough seats and support from other parties to convince Israeli President Reuven Rivlin (who despises Netanyahu and whose appointment to the presidency Bibi tried to block) that he stands a better chance of forming a coalition than Netanyahu does. That’s an unlikely move for him, but not out of the question since Kahlon could, if he wished, form a broad based government that could include Yisrael Beiteinu, Yesh Atid, and Labor, as well as Shas and UTJ. Such a government would be far more likely to renew the peace process, but, especially given the increasing apathy or even militancy with which most Israelis view the occupation, no more likely to actually move it forward.

Considered in that light, there might be reason to hope that an even more extreme right-wing government takes power. Perhaps that would fan the small sparks we are seeing from Europe toward real pressure on Israel. But when it comes right down to it, neither scenario is promising.

The obsession in politics and diplomacy with decorum–largely a relic from the past–can easily distract people from the realities of the present. Case in point, the uproar over Jeffrey Goldberg’s latest article in the Atlantic, the headline of which, The Crisis in U.S.-Israel Relations Is Officially Here, would seem important enough to warrant more attention than it has gotten so far.

Instead, the whisper of an unnamed “senior Obama administration official,” who called Netanyahu a “chickenshit,” has occupied headlines. And instead of taking a strong, or even a weak stance on Netanyahu’s repeated declarations about expanding settlement activity everywhere in Jerusalem and the West Bank, the White House has only tried to distance itself from the remark, describing it as “unauthorized” and “inappropriate.”

As Goldberg himself pointed out, the fact that Bibi is a chickenshit is not entirely a bad thing. Whatever else it does, it also makes him quite afraid to back up his rhetoric with action. Even in Gaza this summer, the ongoing slaughter seemed, from Netanyahu’s point of view, to be something that spiraled much further out of control than he had intended. Indeed, his constant shifting of the mission’s goal posts indicated the lack of any sort of planning beforehand. Political pressures kept driving him on, as they do with most of his actions. But at least the “chickenshit” was never going to attack Iran despite his bellicosity, as the United States seems to finally understand.

Being less of a leader and more of a leaf blowing in the political wind is an apt description of Netanyahu, and it is strongly suggested in Goldberg’s piece. But it also applies to the Obama administration, which has repeatedly refused to use the tools it has at its disposal to create real pressure on Israel to, at the very least, desist from its actions that are obviously intended to destroy any possibility of a two-state solution. So, chickenshit cuts both ways.

Maybe Goldberg intended the chickenshit comment to overshadow the rest of his point, maybe he didn’t. But the assertion that we are in a period of crisis for US-Israel relations is a very important one. The question is: are we?

The simple answer is no, but Goldberg is not wrong in suggesting that such a crisis could occur in the near future. One can understand why Goldberg focuses so much on personal clashes. Never in the history of Israel has there been a government that so arrogantly insulted the United States so frequently. Whether it’s Netanyahu, Finance Minister Naftali Bennett, Defense Minister Moshe Ya’alon, or some other member of the Knesset, anti-American statements have risen to unprecedented levels.

For their part, US officials have been getting just the tiniest bit harsher in their criticism of Israel, while Israeli officials escalate their anti-US rhetoric. And then there’s the endless stories about how much Obama and Netanyahu dislike each other, with Goldberg’s in the lead. The problem, of course, as it is presented in this narrative of interpersonal conflict, is bad communication, or mismatched personalities.

In reality, none of this is really about Bibi and Barack disliking each other. They do, but that is beside the point. It is the direction that Israel has decided to go in that is the problem.

Let’s start off by noting that the degree of the “crisis” is being massively overblown. There is a much bigger problem in Europe for Bibi than there is in the United States. The Europeans are actually threatening to take some action, not just calling Bibi names in whispers to reporters. Sweden’s recognition of Palestine as a state is just a first step in a series of actions that might be on the horizon from Europe, where Israel conducts the biggest share of its trade. When the United States gets to that point, as it has on occasion in the ever more distant past, then we can start wondering if there is a crisis in relations that might cause some small shift in the status quo.

The “chickenshit” epithet can apply to Obama just as much as it can to Netanyahu. He is a president with a non-confrontational style trying to govern with what is, arguably, the most defiant and combative Congress any president has ever had to deal with. And he is dealing with an Israeli government that is pursuing a very different strategy than its predecessors. The Israel of today no longer cares about the majority of the Jewish community in the United States. This Israel, correctly, determined that its ultimate desire to completely thwart a two-state solution and maintain an apartheid system over the Palestinians would never be acceptable to most American Jews. But most US Jews weren’t the ones providing the political power and, more importantly, the funding for congressional campaigns and for settlements in the West Bank.

The Jews that do provide these things, as well as the Christians, are right-wingers, either in their general politics or at least on Middle East policy (including policy toward the entire Arab world, Iran and Turkey). They are now the only ones Israel cares about. More liberal-minded devotees are not, at this stage, providing that much support for Israel, either economically or financially. Those of them who do provide this support will continue to check their otherwise liberal values at the Israeli door. The rest are not, in the estimate of the Netanyahu government, worth the compromises that must be made to garner their support.

In this circumstance, Israel has a freer hand in its actions. While Netanyahu announces more and more building plans in East Jerusalem and other sensitive parts of the Occupied Territories, Republicans, who stand a good chance of controlling both houses of Congress, are not criticizing Israeli actions in the slightest. Instead, as one would expect, they are attacking Obama for his insufficient support of Israel.

In this context, Israeli journalist Roi Ben-Yishai, one of Israel’s best, recently reported on Israel’s “new approach” to the Palestinians. It holds few surprises. Israel is not intending to return to talks, correctly believing they will be futile, and therefore would only make things worse. Israel’s assessment will remain correct until its own positions can be moderated by pressure like that of the Palestinians over the years.

The plan is then to have the quiescent Palestinian Authority (PA) assume control over Gaza and reinforce its control on the West Bank. In other words, marginalize Hamas throughout the Palestinian body politic. Under those circumstances, Israel would end the siege of Gaza and ease restrictions on movement in the West Bank as well. The idea is that the Palestinians can then build a functional economy, which Israel believes will cause the Palestinian people to oppose actions that could draw Israeli military reprisals. I rather doubt that would be the result, but right now, the delays in Palestinian international action imply that PA President Mahmoud Abbas is cooperating with Israel and Egypt on this effort, probably in the hope that this strategy would eliminate Hamas as a political rival.

This seems like another doomed plan, one that harkens back to old Israeli beliefs that Palestinian nationalism will eventually just go away. But we must recognize that this is happening with the silent approval of the United States. Egypt, in particular, would not work with Israel on such a plan if it believed that the United States would object. More to the point, the plan is also intended to provide the US with what it wants most: Palestinian silence. What American policy has always represented is the complete lack of importance placed on the welfare of the Palestinians, or anyone else (including ordinary Israelis) in the region, for that matter. The entire issue is only relevant insofar as it affects more “important” US concerns.

So, the Obama administration will likely allow Israel to proceed with its plans, even if it doesn’t believe those plans are likely to succeed. This is evident in the lack of material response to Israel’s direct challenge to the international consensus on a two-state solution.

The name-calling most recently highlighted by Goldberg merely reflects these disagreements and the fact that the increasingly populist and rightward tilt not only in the Israeli government but also in its population leads to verbose criticism of US officials, up to and including the president. Responses to such insults can be countered by Israel’s power in Congress in a way that more fundamental policy differences cannot. That frustrates some American officials, but it doesn’t provoke any material US response.

If Congress persists in pressuring the administration on its Iran policy, a pressure which most understand as directed by Jerusalem, Obama may well respond through the Palestinian issue. In that case, we might see a more direct counter to Israeli policies, such as a Security Council resolution condemning the settlements or even an “Obama Plan” basing a two-state solution on the 1967 borders and sharing Jerusalem. That would be a turn of events not seen in decades, but Israel has also never worked so hard to undermine US goals on foreign policy matters as it has on Iran.

But make no mistake, if the Palestinians get any respite from the Obama administration it will be because of Israel’s meddling through Congress on the Iran issue. It will not be due to any Palestinian action, much less on the insulting attitude of Israeli officials or the personal dislike between the current Israeli leader and the president of the United States. It is, ultimately, all about policy priorities, not personalities.

Former American diplomat Aaron David Miller is a frequent and worthwhile contributor to US foreign policy discussions in both Washington and the news media. His long career in Middle East diplomacy and strong focus on Israel have enabled him to clarify for the general public the many difficulties that exist under the surface of these issues. Unfortunately, as shown by his recent piece in Foreign Policy magazine, he sometimes obscures them as well.

Miller correctly points out that the Israel-Palestine conflict is not the major source of regional instability and that Secretary of State John Kerry was foolish to imply that the lack of progress on this issue had in some way become a contributing factor to the rise of the group that calls itself the Islamic State. But he also elides the enormous amount of responsibility the United States has and continues to hold not only for the Israel-Palestine conflict itself, but also for the difficulty in making any progress on the issue, let alone resolving it.

Miller states it explicitly: “Washington isn’t responsible for the impasse…The primary responsibility for fixing the problem lies with Israelis and Palestinians, and the lack of resolution is a direct result of their lack of leadership and ownership.”

That is unequivocal nonsense. It adds yet another layer to the enduring myths that surround the long-term lack of progress on this conflict. It is not lack of leadership and ownership that is the problem, it is the massive imbalance of power between the two parties that is the single biggest obstacle to a resolution. And that is an area where the United States is a major factor.

The power imbalance leads to a very simple reality: Israel has very little incentive to compromise. It is a regional superpower militarily, it has by far the most stable government in the Middle East, and it’s a member of the Organization for Economic Cooperation and Development (OECD), with a relatively strong economy. Israelis would undoubtedly prefer a cessation to the Palestinian rocket fire that periodically flares up as it did this past summer, and certainly want to stop incidents such as the one on October 22, when a Palestinian drove into a Jerusalem light rail station, killing an infant and wounding seven other people. But these concerns are not nearly enough to sway Israelis into the sort of compromises that would be bare minimums for a deal with the Palestinians.

From Israel’s point of view, the Palestinians’ minimal demands include a free Gaza and West Bank, including the Jordan Valley, a shared Jerusalem and the recognition of Palestinian refugee rights. In each case, there is a huge risk perceived by the Israelis.

Indeed, because most Israelis believe the narrative telling them that when Israel withdrew from Gaza and Southern Lebanon, all it got in return was rocket fire, they see a similar but much graver risk of that repeated outcome in the West Bank. In fact, most Israelis join their prime minister in rejecting the idea of giving up the Jordan Valley, a huge chunk of the occupied West Bank.

Sharing Jerusalem, and particularly the area of the Temple Mount, conjures fears of the years from 1949-67 when Israelis could not visit the holiest site in Judaism. More than that, Israel’s capture of the Old City in 1967 has become a powerful nationalistic symbol—a compromise on this issue strikes at the very heart of Israeli identity, and that arouses passionate responses.

The refugee question, which I explored in depth recently, is also seen by virtually all Israelis as implying the end of the Jewish State, something they desperately want to avoid. Finally, Israelis remain bitterly divided ideologically on many points, and there is a deep fear that making compromises will set off civil disturbances between secular, religious, nationalist and liberal camps within the country. Recent events around the Gaza war, where demonstrators for peace were repeatedly attacked, give credence to this fear.

The point is not to argue about the legitimacy or realism, or absence thereof, behind any of these fears. They are there, and they must be contended with in some fashion. But that involves confronting those fears, which, in turn, implies that Israelis perceive some pressure—be it military, economic or political—that forces them to take risks. The rewards of peace are, at best, uncertain to Israelis who don’t trust Palestinian intentions and perceive rising militancy in the Arab world and therefore an uncertain future no matter what commitments the current Arab regimes may offer. After all, as many contend, these governments may not be around for long.

Due to its position of relative power, the potential incentives for Israel are negative. The Israeli reaction to the Boycott, Divestment and Sanctions (BDS) campaign, which has not yet had any significant economic effect (though it has certainly altered the public discourse), is a testament to how worried Israel is at the prospect of true economic pressure. The Israeli government’s reaction to the EU’s relatively minor moves to adhere to its own laws regarding partnering on projects in the Occupied Territories and labeling products imported from the West Bank is further proof of this trend.

But whenever Europe, which is an even more indispensable trade partner for Israel than the US, has started to move in this direction, the United States has worked hard behind the scenes to change European minds. In a similar, but far more visible and impactful way, the US has used its veto power repeatedly at the UN Security Council to protect Israel from any consequences of its constant violations of international law. And we do this despite Israel’s defiance of stated US policy in the region.

These are the realities that Miller’s viewpoint elides. They have nothing to do with the Islamic State, and Miller is correct to chide Kerry for trying to tie the two together. But this ongoing hand-wringing about how the Israelis and Palestinians can’t be brought together needs to end. Even more, the nonsensical view that this is due to the personal mistrust between Benjamin Netanyahu and Mahmoud Abbas has to be shunted into the dustbin. Roosevelt and Churchill didn’t trust Stalin at Yalta. Gerry Adams and David Trimble in Northern Ireland didn’t trust each other either, and many of us who were paying attention at the time can remember the constant accusations of bad faith they hurled back and forth, which were very similar to what Netanyahu and Abbas say about each other today. Yet there are also other examples of leaders coming together. It is becoming a cliché, but it is nonetheless true that peace is made between enemies, not between friends, and it is also generally made between parties that neither like nor trust each other.

The reason this is even an issue in the Israel-Palestine conflict is because of the imbalance of power. Because Israel is so powerful and because US policymakers—for reasons that have nothing to do with the Palestinians or the occupation—continue to see Israel as an indispensable ally in security, intelligence and business matters, diplomacy has become ineffective. That’s why we keep hearing excuses for the ongoing failure. Miller makes one of the classic excuses. But it all covers up for US fecklessness and for the fact that, despite the pronouncements, peace between Israel and the Palestinians may be official US policy, but it is not a high priority. Kerry, in a credit to his character and his naiveté, tried to buck this, but found that he didn’t have the diplomatic tools he thought he had.

For all of these reasons, the US bears an enormous responsibility for the ongoing and deepening conflict in Israel and the Occupied Territories. And yet, that doesn’t mean the US needs to be doing more to resolve it.

On the contrary, the US needs to do less. The American commitment to Israel’s military superiority is now law, but even without that, the ties between the US and Israeli militaries, intelligence communities and businesses are extremely deep. There is no realistic path to threatening these things.

But that doesn’t mean the United States has to keep acting to thwart European efforts to raise the price of its occupation for Israel. Nor does it mean that the US has to keep running interference for Israel at the Security Council. Most of all, it does not mean the US has to keep insisting on its exclusive role as the mediator of this conflict.

If the United States simply refrains from doing these things, and takes no other action to pressure Israel, the change in the status quo would be enormous. But that would, itself, be a major shift in US policy on the ground. And it is not going to happen as long as we delude ourselves into believing the status quo is not our fault and that we bear no responsibility for changing it.

It’s hard not to cringe watching the United States careen around the Middle East these days, dispensing bombs, money and political fealty in various doses depending on the crisis of the day to a series of supposed allies that take turns slapping us around while demanding our protection.

These unseemly and contradictory scenes are emblematic of the crumbled bookends of America’s foreign policy in the Middle East that lies scattered around the regional landscape. It’s the rubble of a broken foreign policy paradigm conceived in an earlier era that has ceased its usefulness in the 21st century.

America’s Cold-War era regional foreign policy, which has seen us construct a series of partnerships in Cairo, Tel Aviv, Riyadh, Doha, Abu Dhabi and Islamabad, is no longer relevant to US and regional interests. Moreover, it’s difficult to conceive of a more unattractive group of states to align ourselves with—all of whom engage in behaviors that do not serve American interests and that are inconsistent with our values. It’s time to recast the Sunni-state plus Israel alliance that characterizes American foreign policy in the Middle East.

The busted bookends of our policy are slapping us in the face on a nearly daily basis. On the one hand, we had Bibi Netanyahu on one of his usual forays to the White House, openly dissing President Obama and even suggesting at one point that criticisms of Israel’s ongoing and continuous annexation of Palestinian territory were “un-American.” Thanks for the lecture, Bibi.

Never mind that the United States has implemented what amounts to an expensive social and military corporate welfare program to prop up a state, Israel, which by World Bank standards is among the wealthiest countries in the world. Who’s fooling who, exactly?

Next, we were treated to Vice President Joe Biden bowing down to Gulf State familial sheiks and apologizing to them for openly stating the obvious—that these repressive and autocratic monarchies have to varying degrees supported Sunni extremist groups battling the Iranian-backed Assad regime in the Syrian Civil War.

It’s hard to imagine that these erstwhile allies didn’t think they had American backing in Syria given our own 35-year undeclared war against Iran in which we have sold these states some of the most advanced defense equipment in the world—presumably to protect them from the Iranians.

Vice President Biden has had a long history of sticking his foot in his mouth. As someone that sat through many Senate Foreign Relations Committee hearings over the years, it was clear to everyone that he was/is not one of the deepest thinkers to come from the world’s greatest deliberative body.

Whatever his failings, however, Biden is the second in command of the world’s greatest democracy and the leader of the free world. It was unsettling to see him cap-in-hand before the very sheiks that we have been protecting for the last 35 years.

Never mind that the US has now taken it upon itself to start blasting away at the group that calls itself the Islamic State (ISIS or Daesh) in one of the most mysterious and ill-conceived imperial policing operations in recent US history—in part to protect the autocratic Middle Eastern monarchies that refuse to take any responsibility for their actions.

Last, but not least, we have Secretary of State John Kerry again ricocheting around the region, recently at a donor’s conference pledging $212 million to help “rebuild” Gaza, while simultaneously stating that the current status quo between America’s two client-state antagonists (Israel and the Palestinian Authority) is not sustainable.

There is something surreal about the idea of the United States offering to spend more taxpayer money to rebuild buildings that were destroyed by American-provided bombs and planes in the first place—bombs that will no doubt be freely replenished the next time Hamas and Israel decide to start blasting away at one another.

The reality is that all parties regard the status quo as completely sustainable, in part because they are supported by American money and, in Israel’s case, unlimited political support. America’s political leaders show no interest in placing any meaningful leverage on the parties. Absent any political will to pressure the parties—particularly Israel—it is manifestly unclear why any further money or effort should be expended in trying to solve this long-running dispute. Besides, we could use that $212 million at home to rebuild the dilapidated Lincoln tunnel or one of our many deteriorated highway bridges.

Meanwhile, back at the ranch, the neoconservatives that got us into the Iraq war are desperately trying to undo a possible nuclear deal with Iran—presumably so we and/or the Israelis can start another war to preserve Israel’s nuclear monopoly in the Middle East. Never mind that such a deal creates the opportunity for the United States and Iran to begin cooperation on a host of regional issues in which we share important interests. Détente with Iran would be good for American strategic interests—stakes that far outweigh anything involved in the Arab-Israeli dispute or in our bombing raids in Iraq and Syria.

How did we get to this point? How is it that the United States is shoved around and made fun of like the poor village idiot by a collection of alleged allies that just keep on cashing our checks while making fun of us as soon as our back is turned?

In the end, of course, the joke is really on us. The fact is that the United States will continue to be embarrassed by supposed friends until it decides that it doesn’t want to be pushed around in front of the international community. That requires acknowledging that the two Cold War-era “twin pillar” alliances with the Sunni autocracies and Israel need to be recast. The contradictions in each of these partnerships have now become so incongruous that not even we can square the circle.

The idea of the United States now offering up money to clean up the mess created by the American-made bombs dropped by its Israeli client state aptly describes the depths to which the US has plunged. Gulf Sheiks embarrassing the US vice president provides just another layer of icing on a cake that has been in the oven for far too long. Israel lobbyists fanning out on Capitol Hill to torpedo a nuclear deal with Iran while Israel cashes our checks bespeaks an out of control ally that has lost all sense of decorum and proportion.

The contradictions of American regional policy that have seen us dispense billions of dollars in arms and money to ungrateful and ungracious allies in Cairo, Tel Aviv, Riyadh, Doha, Abu Dhabi and Islamabad while simultaneously protecting them can no longer be reconciled. It’s time for a paradigm change.

Instead, the United States should leave these countries to their own devices and their own quarrels. Most importantly, they should solve their own problems. Perhaps we might have better fortunes in the long run in building a more integrated and peaceful regional order with other states. Anything would be an improvement over what we have now.

Oh, and another thing—let’s stop turning the other cheek the next time one of our supposed allies starts swinging.

When I started getting serious about action on the Israel-Palestine conflict and the associated US foreign policy, I found it imperative to convince people that the Oslo Accords were doomed to fail. There were the obvious critiques of the accords: the lack of any sort of human rights framework, the absence of consequences for failing to abide by conditions or fulfill agreed upon commitments, and the formal recognition of Israel without any mention whatsoever of a potential Palestinian state. But I saw an even bigger obstacle.

Conventional wisdom has it that Jerusalem is the most difficult stumbling block. But I have always maintained that it is the Palestinian refugees that were the most serious obstacle to a negotiated solution.

When various compromises were discussed about Jerusalem, they were always regarded as controversial and difficult to sell. Yet in my experience, people on both sides saw pretty clearly how a compromise could be crafted. Israel was willing, at least in the past, to permit the Islamic Waqf to continue administering the Temple Mount while official sovereignty would belong to both sides–the Old City would be divided and the border of East and West Jerusalem would be part of the agreement on borders more broadly. No one thought this would be easy, of course, but Israel appeared willing to compromise on this issue, in part because it understood that this was not just a Palestinian issue, but one that the entire Muslim population of the world had a stake in. The parameters of an agreement were visible.

When the matter of the Palestinian refugees came up on the other hand, there was a visible disconnect between the sentiments among the Palestinians, both in and outside the Occupied Territories, and the diplomatic framework that was being discussed. Many observers believed that the path forward on the refugees was clearer than that for Jerusalem, even though this was an area that Israel, no matter who was in the prime minister’s office, was going to be a lot less flexible on.

They believed that to be the case because, from available evidence, it seems that Yasser Arafat was assuring the Israelis and Americans that he was prepared to essentially sacrifice the refugees’ right of return settling for some token number returning to Israel while the rest would get some sort of compensation package and some limited option of returning to the presumed Palestinian state. This was, of course, not what he was telling the Palestinian people, to whom he continually pledged that he would not compromise on the right of return.

While many hold Arafat responsible for the disconnect between diplomacy and reality, obviously not without some justification, the real problem was the disinterest that Israeli and US diplomats routinely showed toward the Palestinian people. One need go no further than to read books by key figures such as Dennis Ross or Aaron David Miller. While the complexities of Israeli politics were always dealt with in careful detail, the Palestinian side was ignored to such an extent that virtually everything you see in the writings of these and other diplomats of the day about Palestinian opinion was obtained simply by asking the Palestinian leaders. Can anyone imagine Israel being approached that way?

The Palestine Liberation Organization leadership (PLO) under Arafat was neither prepared to hold the difficult national dialogue about possible compromise on the refugee issue nor to admit to their Israeli and US interlocutors that the right of return was as core a national Palestinian value as the land itself and that public sentiment strongly opposed the sort of compromise that Israel had, not without reason, come to expect.

This held true after Arafat’s death and Mahmoud Abbas’ assumption of the leadership. In truth, even Hamas has not specifically spoken about the refugees very often, although that is largely because its agenda, unlike the PLO after the mid-1970s, remained focused on liberating all of Palestine, which would mean the refugees could simply return. The result is that the national conversation on this issue never occurred, and all through the Oslo talks, even if one believed they had any chance of going anywhere, the refugee issue hung over the table like a pendulum with a razor-sharp blade, coming nearer to splitting the table with every passing swing.

The biggest danger was that, in the case of a miracle where Israel and the Palestinians were able to agree on a lasting peace deal, the refugee issue would shatter it. In several incidents, most recently with the revelations contained in the “Palestine Papers,” confirmation of the framework around the refugees caused great concern among Palestinians.

It is not always easy for others, including myself, to fully grasp the importance of the refugee issue to Palestinians. Nor is it fully understood by others how deeply Israeli Jews fear this issue. For the Palestinians, refugees are a deeply personal as well as a national issue. After all, the accepted estimate of the number of Palestinian refugees is approximately five million, and the total global population of Palestinians is eleven million. So, pretty much every Palestinian has refugee relatives, many of them living outside the Palestinian Territories. Families, in other words, have been sundered for 66 years.

Palestine-Refugee-KeyThen there is the reality, often vastly underestimated, of how central the refugees are to Palestinian nationalism. They are as core a value as the land, Jerusalem, anything. The key to the lost home in Palestine is the overriding symbol of Palestinian nationalism, and it is the symbol of the refugee.

This is not to say that some practical and negotiated agreement cannot be reached on the issue. But thus far, that hasn’t been even remotely attempted. Instead, Israel has insisted that the right of return be forfeited and their Western allies have concurred, as have, in a more circumspect fashion, many of the regional Arab leaders, Lebanon being the main exception. That makes the issue even more sensitive, if that is possible, because for most Palestinians, the framework in which the refugees have been discussed is a surrender, and one that they do not believe the PLO leadership has the authority to make (many Palestinians argue that the right of return is an individual as well as a collective right and as such cannot be negotiated away in a collective bargaining framework. There is considerable basis for this argument).

What is needed is a national conversation, and that will take time. The debates need to happen in communities, in coffee shops and in mosques as well as on the internet and in the halls of the Palestinian Authority. Over time, a general consensus of what is and is not going to be tolerable for the majority of Palestinians, including the refugees themselves, will emerge. From there, realistic negotiations on the issue can manifest.

This needs to happen because it is the only way to turn the refugee problem from a poison pill that would almost certainly torpedo any agreement into part of the solution. The Israeli public also needs to know what the Palestinians want from the right of return.

There is no subject that the Israeli Jewish public is more united and rejectionist on than the refugee issue. Outside of the radical anti-Zionist left–a small portion of the population–you will be hard pressed to find an Israeli Jew who would agree to any significant return of refugees. You’ll find it equally difficult to find an Israeli who would acknowledge any right of return. The refugees, you see, touch on the most intimate identity crisis for Israeli Jews: the fact that Israel could have only come into existence by forcing hundreds of thousands of Palestinians out.

This “original sin” is not something that Israelis can simply live with as we in the United States can live with the legacy of slavery and the genocide of the native population here. In the US, we have left too few natives to be worried about any claims to the land, and they are far too disempowered. Slavery is considered a historical shame, but the ongoing issues of racism are largely seen by whites as the legacy of Jim Crow laws (read: apartheid) rather than of slavery. These horrific crimes are regarded by most of the white US as history, however sordid.

Israeli Jews cannot do that. No doubt, the leaders of the Zionist movement in the 1940s believed that, by now, the Palestinians would have resettled in various Arab countries and that Israel could make peace with that past in a similar way to the United States. But that view did not take into account the fact that Palestinians were going to be in refugee camps nearby, would refuse to assimilate (or be barred from it) into the countries they fled to, and would maintain a sense of national identity that kept them–much like Jews throughout the centuries–as strangers in strange lands.

The reality of the Palestinian exodus from Palestine from 1947-49 was largely known in Israel all along. In the late 1980s, Israel’s “New Historians” produced controversial, but generally accurate tomes documenting that the Palestinians did not leave of their own volition or in response to broadcasts from Arab leaders telling them to do so. They either fled or were very frequently driven from their homes.

Many Israelis are aware of all this. But, as with most nations, the people of Israel want desperately to believe in the righteousness of their country’s creation. Moreover, there is enormous fear of what the world would think if this history became more commonly known, especially in the United States and other friendly Western countries where, among supporters of Israel, this history is largely unknown or papered over with some rather incredible myths (e.g., the Palestinians of 1948–all 800,000 and more of them–just picked up and left). Even acknowledging the Palestinian right of return threatens this, creating a situation where history, even when known, produces a visceral discomfort and threatens the Jewish self-image of a just and decent people trying to finally create a home for ourselves.

By itself, that could be overcome. But for Israelis, that sensitivity is piled on top of a fear of Palestinian return that borders on hysteria. And this fear is greatly exacerbated by the lack of clarity about Palestinians’ ambitions regarding the right of return. Israeli Jews treasure, more than anything else, having a homeland where they are the majority. Having such a homeland is also very important to many Jews living in the diaspora. That importance is every bit as strong as worldwide Muslim concern over the fate of Jerusalem.

Israelis are desperately afraid that if they cease blocking the right of return, even to the extent of merely acknowledging the existence of such a right, there would be a massive influx of Palestinian refugees into Israel, which would ultimately make Jews a distinct minority. True, many argue, Jews are doing pretty well as a minority in many countries; but many countries in the world are completely bereft of any Jewish population, especially in the Arab world. And, while they won’t name it, Jews also have the same visceral fear of Palestinians that white South Africans, whites in the US and in other places have had of those they oppressed: the fear that anger over those years of oppression will result in yet another incident of Jewish persecution.

It’s easy for me to say that the fear is born only out of prejudice and misplaced feelings, that the truly hateful among the Palestinians, like the truly hateful among the Jewish Israelis can be dealt with much more efficiently when Palestinian grievances, so long left to boil, are finally addressed. But for most Israelis and Jews in many other places, they look at the former Yugoslavia or Rwanda, places where the cycle of oppression kept spinning with death greasing the wheel. Given Jewish history, it’s an understandable fear.

But it’s also a fear that must be dealt with, not pandered to. When Arafat convinced Israelis that the PLO had backed off liberating all of Palestine and would settle for the lands Israel conquered in 1967, it made a big difference in Israeli perceptions of Palestinians. Even in the toxic atmosphere of 2014, such clarity from the Palestinians on refugees would have a similar effect. This will be true even if the Palestinians’ stance turns out to be (as I believe it would if the popular will was reflected) that each and every refugee should be offered the options of return, return to a Palestinian state (if a two-state solution is ever reached) or compensation, and it is up to each to choose for her or himself. At least Israel would know what the bargaining position is.

The International Crisis Group undertook what I consider to be the first serious effort at finally taking the veil off this critical issue by releasing a report entitled, “Bringing Back the Palestinian Refugee Question,” on Oct. 9. It is a serious and pragmatic analysis of what Palestinian leaders and people can do to begin to bring this question out of the shadows and, crucially, to the center of diplomatic efforts. The recommendations include renewing and revitalizing local leadership councils in refugee camps, improving conditions for refugees as well as supporting refugees in building lives wherever they are without worrying that they are sacrificing their claims as refugees, and beginning the sort of national dialogue I have been discussing.

Now is the perfect time for such efforts, although Israel and the United States will oppose them. Even Abbas has realized that his old strategy has failed and he needs a new one. Refugees, long marginalized, have an opportunity to raise their voice and have it impact Palestinian negotiators in the future. And, despite the fact that Israelis would be vexed by such a development, it is an absolute necessity if there is ever to be a resolution to this conflict, be it one state, two state or whatever else.

This strategy will be uncomfortable for the Palestinian Authority. But it must materialize for the region to move towards substantive rather than illusionary visions of peace. We must hope that good sense can overcome fear.

Once again, in his speech Wednesday at the United Nations, President Obama revealed the reduced importance of the Israeli-Palestinian conflict on his agenda. He also revealed just how out of touch his entire country is with respect to reality.

The Israel-Palestine conflict was the last specific global issue mentioned by Obama in his address to the UN General Assembly, and his wording was straight out of the playbook. It was also only mentioned briefly and without any hint that the United States would be taking any action at all on the issue.

Here’s what he said:

Leadership will also be necessary to address the conflict between Palestinians and Israelis. As bleak as the landscape appears, America will never give up the pursuit of peace. The situation in Iraq, Syria and Libya should cure anyone of the illusion that this conflict is the main source of problems in the region; for far too long, it has been used in part as a way to distract people from problems at home. And the violence engulfing the region today has made too many Israelis ready to abandon the hard work of peace. But let’s be clear: the status quo in the West Bank and Gaza is not sustainable. We cannot afford to turn away from this effort – not when rockets are fired at innocent Israelis, or the lives of so many Palestinian children are taken from us in Gaza. So long as I am President, we will stand up for the principle that Israelis, Palestinians, the region, and the world will be more just with two states living side by side, in peace and security.

Could this have been any emptier? Just last month, Israel and Hamas were engaged in the biggest uptick in violence since the Second Intifada was in full swing.

The message from Obama comes through, though: We’re no longer interested in forcing the parties to the table. The subtext behind that is a US surrender to the stubbornness of the far-right wing government running Israel these days. The US will stop pressuring Israel for talks, and indeed, it already has. The question this raises, of course, is how the Obama administration will respond when and if the Palestinian Authority makes good on its repeated threats to bring this issue to the UN and the International Criminal Court.

In such a case, Obama will undoubtedly condemn the Palestinians’ “unilateral action”de facto US policy dictates that when the Palestinians take action, it is to be condemned, but when Israel does the same thing, it is, at worst, “unhelpful.” Yet the real question for the Palestinians is whether the United States will have any other response outside of some pro forma public statement. Obama’s hands-off approach seems to imply that it will not, though Palestinian President Mahmoud Abbas would be unwise to count on that.

But there’s another piece of this statement worth examining. Obama said, as he has many times, that the situation is unsustainable. He also notes that one myth that has long been held by many has been exposed as false by recent events: the notion that Palestine is the key source of instability in the region.

Obama is correct about the exposed old myth, but he merely spouts another in its place. Of course the occupation will not remain the same as it is today. It has changed some of its characteristics, almost always to the detriment of the Palestinians, many times since 1967. But the essence of the matter, the relationship between an occupying power and an occupied people locked in a conflict over land, rights, narratives, nationalism and competing claims of justice, has endured quite well over those years.

The Israeli right-wing was long aware, and often stated, that their subjugation of the Palestinians was not the main cause of instability in the region. Of course, there was a time when there was a much stronger argument for that myth. When the many Arab regimes, throughout most of the 20th century, were comfortably entrenched in power, things were pretty stable, as they often are under dictatorships that maintain their control. Under those circumstances, the cry of “Free Palestine” was heard much more loudly, as it was the only one the dictators would permit. Due to many factors (especially the US invasion of Iraq), that stability was shattered and, as one would expect, much of the Arab world, while not forgetting the Palestinians, demonstrated a focus on the miserable conditions they themselves were living in, and conflicts within their own countries. Thus, the myth was exposed.

But we need no shakeup like the Arab Awakening to see that the claim that the occupation is “unsustainable” is a myth. We really need only see that it has endured for more than 47 years, and when circumstances did threaten the status quo, Israel adapted its occupation to meet those circumstances. The most obvious example of that is the massive tightening of the occupation and even more massive expansion of settlements that constituted Israel’s response to the Oslo Accords.

Of course, it is a truism that any oppressive regime eventually meets its demise. That is clearly not what Obama means when he calls the occupation “unsustainable.” Rather, he means what so many others mean: Israel cannot continue to hold millions of Palestinians without rights. But, like so many other myths around Israel-Palestine, this one doesn’t bear scrutiny. Israel has done this for 47 years, and can do it for the foreseeable future. The demise of the occupation regime will come, as the demise of all regimes eventually come. But there is nothing particularly unsustainable about this one.

The Israeli right has become the Israeli mainstream, and they are busily coming up with ideas for how to sustain this occupation or, as Foreign Minister Avigdor Lieberman likes to put it, to “manage” the conflict. They recognize that the fear, ingrained in the thinking of many of the early Zionist philosophers of a Jewish Israel ruling over a majority of disenfranchised Muslim and Christian Arabs is unfounded. It turns out that contrary to the expectations of the early Zionist thinkers, Israelis can live with denying rights to Arabs, and the world is prepared to tolerate it, despite the clucking of tongues it evokes.

This issue can be traced back all the way to Theodor Herzl, and it was actively dealt with by Israel’s first Prime Minister David Ben-Gurion and, most notably, by the person in charge of land acquisition for the Jewish National Fund both before and after the State of Israel was established, Yoseph Weitz. In modern times, this notion has been expressed as a “demographic time bomb,” most notably by Netanyahu’s predecessor, Ehud Olmert.

But there’s no reason to believe this is really a problem. After all, according to the February 2014 report of Israel’s Central Bureau of Statistics, there are about 6,119,000 Jews in Israel and the West Bank. Between the West Bank, Gaza and Israel, there are some 5,894,631 Palestinians, according to the CIA World Factbook. Given the different population growth rates, Palestinians will be a majority very soon, but the day that happens, what is going to change? On the ground, in day to day life, what will be different than the day before?

The answer, of course, is that nothing will change and the Israeli right wing understands this. The United States, on the other hand, does not appear to. More to the point, the many activists who believe that Jews going from 51% of the population to 49% of it will suddenly mean that Israel is an apartheid state, as both Olmert and another former Prime Minister, Ehud Barak warned, also do not understand that when that line is crossed nothing will change. Nothing will change when that so-called demographic time bomb goes off.

So, while right wing leaders like Naftali Bennett consider ways to continue to “manage” the Palestinians indefinitely, Obama and a great any others, in the United States, Israel, Europe and even some among the Palestinians, continue to engage in myth-making and wishful thinking.

If this conflict is ever to be resolved, the only path to it entails full acknowledgment of the realities, on the ground, in the international diplomatic sphere and in politics. Anyone who truly believes that the demographic counter clicking down to under 50% Jewish will somehow shock the Israeli people and their government into recognizing the injustice of the occupation is engaging in fantasy. Such demographic changes are gradual, and this cushions the change so it is not a shock. In 1960, Whites, who were always an overwhelming minority, made up less than 20% of the population of South Africa, and Jews are unlikely to ever be anywhere near that small a minority in Israel-Palestine.

This is only one of many myths that need to be abandoned for any kind of resolution to be possible. It’s no less important to dispel these fanciful notions than it is to counter the stereotypes of Palestinians that are so widely held in the United States, Israel and elsewhere (like “they just want to kill the Jews” for instance). One way we will know people are serious about taking on this vexing conflict is when we see them abandon false notions and recognize that Israel-Palestine can contribute to a better world simply by ending the injustice and violence. When that’s the motivation, and it is applied to both sides, we’ll be getting somewhere.

In his speech at the University of Illinois at Urbana-Champaign, Professor Steven Salaita, who was “de-hired” quite suddenly after the university’s chancellor faced strong pressure from major donors objecting to Salaita’s tweets about Israel’s massive military campaign in Gaza, issued this warning: “As the Center for Constitutional Rights and other groups have been tracking, this is part of a nationwide, concerted effort by wealthy and well-organized groups to attack pro-Palestinian students and faculty and silence their speech. This risks creating a Palestinian exception to the First Amendment and to academic freedom.”

At Ohio University, the disturbing reality of the different treatment accorded to pro-Israel, as opposed to pro-Palestinian views supports Salaita’s statement. Of course, the treatment of Salaita is, itself, rock-solid evidence of this point. That is especially true since the university’s chancellor, Phyllis Wise, has backed off her initial claim that Salaita’s de-hire was caused not by his views but by the allegedly “uncivil” way he expressed them. She has since admitted that she faced pressure from influential figures around the university, i.e. major donors.

But a report today in Ha’aretz on an incident at Ohio University offers an even clearer view. The president of the student senate at OU, Megan Marzec, used the opportunity of taking the ALS Ice-bucket challenge to make a statement about Gaza. She wore a shirt that urged divestment from Israel, stated that the blood in her bucket (which was, of course, fake) represented the Palestinians that Israel had “murdered and displaced,” and dumped the bucket over her head.

The response from the organized Jewish community on the OU campus was swift and quite typical. Ha’aretz quotes the leader of a pro-Israel campus group, Becky Sebo: “Her video has kind of torn the campus apart. My initial response was complete shock. We’ve never had any BDS [boycott, divestment and sanctions] movement on our campus, have always had a very open, welcoming community.” Now, she said, “Jewish students in particular are feeling very singled out by the video. Many Jewish students are feeling concerned about their safety and how other students will respond to these accusations against Israel.”

This hyper-sensitivity represents a complete reversal of reality, among other things. There is not a single report of Jewish students being harassed, much less assaulted, as a result of Marzec’s video. But Marzec herself has drawn death threats and hate mail. So much so that Homeland Security has gotten involved on campus. Of course, the pro-Israel groups, no doubt quite sincerely, condemned and called for an end to such acts. But let us ask the question: who has legitimate reason to fear for their safety?

There are also other dimensions to this story. Consider the words of Oren Segal, director of the Anti-Defamation League’s (ADL) Center on Extremism. “The students who want to present a non-biased pro-Israel view have their work cut out for them because there are going to be a lot of efforts to delegitimize their point of view. I anticipate we’ll see more anti-Israel activities than ever before.”

Just read those words, and the thinking is revealed. “A non-biased pro-Israel view.” That is an obvious oxymoron. If the view is pro-Israel, or if it is pro-Palestinian, it is, by definition, biased. What Segal implies here is that any unbiased view would be pro-Israel and any other conclusion can only come about as the result of bias.

And then there’s this whole argument about “de-legitimizing,” whether it is about Israel or of points of view. The working definition of this “de-legitimization” seems to be centered around any argument against Israeli policies, against Zionism, or against any kind of support for the Palestinians. The point of debate, of argument, is to establish that your view has more merit than the opposing one. That should be encouraged (as, indeed, Jewish tradition does), not feared. And certainly, it must not be stamped down.

The shallow arguments get even better. The Director of the OU’s Hillel (a national Jewish student organization), Rabbi Danielle Leshaw, demonstrated just how far the so-called “pro-Israel community” has departed from Jewish traditions and more universal values of open discussion and debating difficult issues.

“Your video marginalizes and isolates students,” Leshaw wrote in an open letter to Marzec published in The Post. “It makes Jewish parents want to bring their kids back home to the safety of the Jewish suburbs …. you need to step down, and give somebody else the chance to lead our Ohio University student population. Somebody that won’t polarize, or divide, or marginalize, or ‘other,’ or cause hysteria, or make students feel unsafe.”

Leshaw, it must be noted, is far from a conservative voice, and she is, herself, no stranger to criticizing pro-Israel programs. She also strongly disagrees with Marzec’s view of the Israel-Palestine conflict. Her call for Marzec to resign as student senate president is “Not because of your politics, but because of your lack of awareness, compassion, and mostly, because of your lack of vision.”

Let’s unpack Rabbi Leshaw’s thinking. Just how does Marzec’s video “marginalize and isolate students?” She presents a political statement, at a time when the Israeli military was acting in so brutal a manner that even their American colleagues, who are themselves quite familiar with killing civilians, were shocked. One wonders: If someone had done the exact same video during Russia’s aggression against Chechnya 15 years ago, would anyone have been concerned that Russian students were marginalized and isolated? Of course not, mostly because they wouldn’t have been and because everyone would have been applauding the strong statements against the massive damage being done to civilians, and rightly so.

Marzec’s video, Rabbi Leshaw says, “…makes Jewish parents want to bring their kids back home to the safety of the Jewish suburbs?” That is a familiar and tired argument, one that got badly worn out during the battles for school integration and during the civil rights movement. Just substitute “White” for Jewish, and the sentence says the very same thing. It is irrational fear of the other, something that needs to be confronted, not accommodated.

Rabbi Leshaw also says that Megan’s video makes “alumni want to pull their funding.” I wonder if she thought about that complaint before putting it in her letter. An apparently liberal woman believes that donors should have the ability to stop students from making controversial political statements? Would she have said the same about protests against the Vietnam War or for women’s rights back in the 1960s and 70s? Because surely there were those alumni who took similar offense to bra-burning demonstrations back then. No, it is only opposition to Israeli policies that merits such kowtowing, I suspect.

Rabbi Leshaw also says that Megan’s video “makes people threaten” the university and its programs, a disturbing echo of Israel’s self-serving and unsellable (outside of the US and Israel, that is) claim that all those Palestinian deaths were Hamas’ fault. Defying such bullying is why Rabbi Leshaw thinks Marzec should step down, rather than seeing it for what it is: precisely the sort of action that a student leader must take if they are to ever be leaders for social change outside the university. The same would be true if this was a pro-Israel statement. Those who support Israel’s policies or feel they must defend Israel should also not give in to any attempts to intimidate them into silence. It is not the opinion that matters, and on that point, Rabbi Leshaw claims to agree. So would she have the same objections if the issue was not Israel? Given her professed values, it seems doubtful.

Megan Marzac sees the Israeli occupation and then the shockingly brutal onslaught on Gaza. She believes that these should be opposed and future incidents prevented, and believes that the global Boycott Divestment Sanctions (BDS) movement is the best way to achieve that. She lacks neither awareness nor compassion. Her statement was one of condemnation of repeated and ongoing human rights violations. That demonstrates considerable awareness and compassion, whether you agree with her views or not.

Is it Marzac’s lack of vision then? Well, it is fair to say that her identification as student senate president gives the impression that she was doing this with some sort of sanction from the senate, which apparently was not the case. That’s an error, but such a mistake is hardly grounds for her removal, especially since she subsequently made it clear that this was her own action.

In any case, the notion that strong support for the Palestinians and even harsh criticism of Israel is somehow threatening to Jews has to be challenged. It is a false accusation, but more importantly, it is one in a long list of bullying tactics that seek to silence support for the Palestinians on campus and more broadly, in the public discourse. Those tactics include attempts to legislate against boycotts of Israel (all of which have failed thus far), manipulating organizations by threatening their funding, harassing media outlets when they give space for pro-Palestinian views, and claiming victimhood when they themselves are the victimizer.

Megan Marzac did what student activists should do: she made a bold statement. The response from the allegedly pro-Israel community has been nothing short of the worst kind of bullying, even aside from the extremists who have threatened her with physical harm. Do these people believe that Israel’s case is so weak that it cannot withstand public debate? It seems so, but that is only true because they are making the wrong argument. They are working to make Israel an exception to international laws of war, and supporting Israel’s regular violation of Palestinian rights through Israel’s occupation regime (as thoroughly documented by many Israeli human rights groups like B’Tselem, Yesh Din, Gisha and others). These so-called pro-Israelis are trying to defend Israeli military actions that regularly kill far more civilians than combatants, leave infrastructure devastated and make already impoverished people even more desperate.

What if they tried making the honest case that what is really needed is, quite simply, equal rights for all and a homeland where Jews and Palestinians can flee to if they are facing persecution and where both peoples can express and live their national identity, in whatever political configuration? Maybe then they wouldn’t resort to bullying tactics because they’re so terrified of an honest, open discussion in the public arena.

I’d like to pose a question. Do you believe that someone who writes the following letter should be forced out of his position as chaplain at an Ivy League university?

To the Editor:

Deborah E. Lipstadt makes far too little of the relationship between Israel’s policies in the West Bank and Gaza and growing anti-Semitism in Europe and beyond.

The trend to which she alludes parallels the carnage in Gaza over the last five years, not to mention the perpetually stalled peace talks and the continuing occupation of the West Bank.

As hope for a two-state solution fades and Palestinian casualties continue to mount, the best antidote to anti-Semitism would be for Israel’s patrons abroad to press the government of Prime Minister Benjamin Netanyahu for final-status resolution to the Palestinian question.

One can, to be sure, disagree with the opinion Bruce Shipman, a former chaplain from Yale, expressed—I certainly do. Anti-Semitism is not the same as opposition to Israeli policiesthe two are quite distinct and plenty of Jew-haters fully support even more aggressive and brutal policies either because they hate Muslims and Arabs more than Jews or because they have some apocalyptic vision of where such Jewish behavior might take the Jews.

Anti-Semitism does not increase due to Israel’s behavior. Anti-Semitic activity might, as haters see an opportunity to cloak their hate in something else. But bigotry has a life of its own. More to the point, Israelis will not behave like “good Jews” in order to stem a theoretical rising tide of anti-Semitism. That’s not why Israel should end its occupation, should end its siege of Gaza, and should recognize, with full faith, that Palestinians have the same national, civil and human rights as Israeli Jews. Politics doesn’t work this way, but civil society should be pushing for these things because they are a moral imperative. And Israel should pursue such a course because it is the only way its citizens will ever know peace and security.

So, yes, I think Shipman was wrong. But he was hardly expressing hatred towards Jews. He was speaking out of obvious concern for both Israelis and Palestinians and a hope for a peaceful resolution to the conflict. He may have been wrong about Israeli actions causing anti-Semitism, but he is not the only person who believes this and there is room for reasonable debate on that point. In any case, he was certainly not saying that Israel’s actions justified anti-Semitism. And yet, he was forced to resign.

Is this really where we’ve ended up? Yes. Ideas are fully policed on this issue. Academia, which is precisely the place that disagreements, and especially controversial ideas, are supposed to be debated with civility, has become one of the most heavily policed arenas. The recent controversy at the University of Illinois, where Professor Steven Salaita was “de-hired” because of his outspoken statements on Twitter about Israel’s massive onslaught on Gaza, has now grown to the point where it is threatening the university’s administration. Yet they have not reversed their decision to date.

It’s not like controversial views on both sides of the Israel-Palestine conflict are under such attack. Thane Rosenbaum, for example, called on Israel to kill Palestinian civilians. His op-ed in the Wall Street Journal generated a lot of controversy, but his position at New York University’s School of Law was never in danger, and I wouldn’t want it to be.

Opinions, even hateful ones, need to be out in the open. How can they otherwise be countered? Instead, when it comes to Israel, we have gone entirely in the other direction, but only on one side of the question.

Bruce Shipman, apparently, resigned “voluntarily,” not wanting to create or be in the middle of further controversy at Yale. But there never should have been any such pressure on him. There is no conceivable stretch that can turn what Shipman wrote, regardless of how much anyone disagrees with him, into hate speech. Short of that, any individual should be able to express an opinion. That is especially true about community leaders, which school chaplains obviously are, and the academic world.

So enough with the false allegations of anti-Semitism, which are insulting to those like myself who have experienced physical violence from anti-Semitism. Enough with the extremists supporting the worst Israeli policies whoapparently knowing that their case cannot withstand open debatethreaten and pressure those who raise opposing opinions (I have received death threats from such people as well).

It’s high time for everyone to agree that ideas can and should be debated. Islamophobes and others who do not acknowledge Palestinians’ basic human rights have a national platform with FOX News. More legitimate defenders of Israeli policies and those who are deeply opposed to those policies should also be able to voice their views in public. Everyone who is interested in the Israel-Palestine conflict should agree with this fair and just principle. The only ones who can’t, it would seem, are the naysayers who oppose legitimate debate. I wonder why.

This month the Wall Street Journal reported that the Obama administration had slowed the shipment of hellfire missiles to Israel after it bombed a UN school in Gaza on Aug. 3 with the US-made weapon. The White House has insisted that weapons transfers to Israel have not been suspended or halted, and that the administration is only “taking extra care to look at these shipments.” Yet some analysts understood the unusual decision as a warning message to Tel Aviv about the use of disproportionate force. Whether or not that’s true, it’s no secret that the United States is Israel’s biggest source of military assistance, even if the White House has not been completely aware of the extent of that support.

Two years ago, Congress passed the United States-Israel Enhanced Security Cooperation Act (P.L. 112-150), which reiterated, as a matter of policy, the US commitment “to help the Government of Israel preserve its qualitative military edge amid rapid and uncertain regional political transformation.” It expressed the non-binding “sense of Congress” favoring various possible avenues of cooperation: providing Excess Defense Articles to Israel; enhanced operational, intelligence, and political-military coordination; expediting the sale of specific weaponry including F-35 joint strike fighter aircraft, refueling tankers, and “bunker buster” bombs; as well as an US-Israel cooperative missile defense program and additional aid for Israel’s Iron Dome anti-rocket system.

Iron Dome: Approaching $1 billion—and Beyond

Iron Dome, a dual mission system built by Israeli defense contractor Rafael Advanced Defense Systems, which doubles as a very short range air defense system and an interceptor of incoming rockets, mortars and artillery, has received $720 million in American funding since the program’s inception in 2011. Israel currently has nine batteries, each costing about $100 million. The price tag for every Tamir missile fired by the Iron Dome system costs an estimated minimum of $50,000, with two missiles responding to every incoming rocket that is considered a threat to Israeli lives and property.

US support for Iron Dome will soon surpass $1 billion. In March, the Pentagon asked for $176 million for the program for Fiscal Year 2015, which begins Oct. 1, but the Senate Appropriations defense subcommittee raised the Iron Dome appropriation to $351 million on July 15—more than half the $621.6 million it had appropriated for Israeli missile defense for the upcoming year. A week later, Defense Secretary Chuck Hagel sent a letter to Senate leaders and key committee chairpersons relaying the Israeli government’s request for an immediate $285 million of emergency allocation for Iron Dome. On Aug. 1—a Friday afternoon—the House (398-8) and Senate both approved adding an additional $285 million to Iron Dome’s funding, which was followed by President Obama’s signature the following Monday morning.

As of last week, according to Y-Net, Iron Dome reportedly had a 90% success rate during the first month of  “Operation Protective Edge,” intercepting more than 600 rockets headed toward Israeli population centers from Gaza.

Autopilot Foreign Policy 

After Israel’s bombing of the UN school in Gaza, and the huge loss of Palestinian civilian lives due to the war, the Obama administration apparently became aware that it was unformed about, and had very little control over US military assistance to Israel. Indeed, the Wall Street Journal reported Aug. 14 that President Obama had just discovered that the US military was authorizing and providing weapons shipments to Israel without his knowledge.

Unknown to many policy makers, Israel was moving on a separate track to replenish supplies of lethal munitions being used in Gaza and to expedite the approval of the Iron Dome funds on Capitol Hill.

On July 20, Israel’s defense ministry asked the US military for a range of munitions, including 120-mm mortar shells and 40-mm illuminating rounds, which were already stored at a pre-positioned weapons stockpile in Israel.

The request was approved through military channels three days later but not made public. Under the terms of the deal, the Israelis used US financing to pay for $3 million in tank rounds. No presidential approval or signoff by the secretary of state was required or sought, according to officials.

The White House then instituted a review process over armaments being shipped to Israel, instructing the Pentagon and the US military to hold a transfer of Hellfire missiles. According to Haaretz:

Against the backdrop of American displeasure over IDF tactics used in the Gaza fighting and the high number of civilian casualties caused by Israel’s massive use of artillery fire rather than more precise weapons, officials in the White House and the State Department are now demanding to review every Israeli request for American arms individually, rather than let them move relatively unchecked through a direct military-to-military channel, a fact that slows down the process.

One senior US official said the decision to tighten oversight and require the pre-approval of higher-ranking officials for shipments was intended to make clear to Israel that there is no “blank check” from Washington in regards to the US-made weapons that the Israel Defense Forces (IDF) uses in Gaza.

For its part, the State Department has denied reports that it has been kept in the dark about US to Israel weapons transfers. Last week spokeswoman Marie Harf disagreed with the WSJ‘s assessment that the executive branch had been blindsided, and attributed any apparent delay to “inter-agency process.”

The Times of Israel has since reported that the holdup of the Hellfire missiles has been resolved; the weapons will soon be on their way. Although the anonymous Israeli official who operated as a source for the story didn’t specify when the weapons would be arriving, according to Israel’s Channel 10 news, “the incident is behind us.”
