The new year may have brought with it some signs of progress toward a comprehensive deal between world powers and Iran, lending credence to one of Graham Fuller’s 2015 predictions for the Middle East. However, any movement toward a nuclear agreement must now contend with a potentially game-changing complication: the desire of a new and more hawkish Republican-led Congress to impose additional sanctions on Iran regardless of how the talks are progressing.

The Associated Press reported on Friday that the P5+1 (the US, UK, France, Germany, Russia, and China) had reached a tentative agreement with Iranian negotiators on a plan to have Tehran ship some portion of its stockpiled low enriched uranium (LEU) to Russia. The agreement would presumably be along the lines of the arrangement that was first reported by IPS’s Gareth Porter in October whereby Iran’s stockpiled LEU, as well as much of its newly enriched LEU, would be converted by the Russians into fuel for its Bushehr civilian nuclear facility.

If the AP report is accurate, the deal could represent a major breakthrough in one of the core areas of dispute between the parties: the size of Iran’s uranium enrichment program. The P5+1 have sought to limit the number of centrifuges that Iran would be allowed to operate under the terms of a deal in order to lengthen the amount of time it would take the Iranians to produce enough highly enriched uranium (HEU) for a single nuclear bomb if it chose to pursue one (Iran’s “breakout time”). But Iran has balked at the idea of reducing its centrifuge program. However, another element in the “breakout time” calculation (part of the so-called “Rubik’s Cube” of a final nuclear deal) is the amount of LEU that Iran has stockpiled. Were Iran to agree to ship its LEU (which can be fairly easily enriched to levels required for weaponization) to Russia for conversion into fuel rods (which cannot be easily converted to a weaponizable form), then Iran’s “breakout time” could be extended with only a relatively minor –and perhaps even no — reduction in Iran’s current centrifuge capacity.

It should be noted that the AP report contained no specifics, saying simply that “both sides in the talks are still arguing about how much of an enriched uranium stockpile to leave Iran.” It also offered no indication that the deal would motivate the US/P5+1 negotiators to alter their demand that Iran cut its current number of operating centrifuges by over 50%, to 4500, under a final deal. In addition, Iran’s foreign ministry quickly dismissed the AP report, with spokeswoman Marzieh Afkham saying that “no agreement has been reached yet on any of the issues [being discussed] during nuclear talks,” although that denial could reflect diplomatic posturing on Iran’s part.

Other news out of Tehran, however, has offered a more encouraging sign that the sides may be moving closer to a deal. Iranian President Hassan Rouhani on Sunday argued that Iran should be prepared to accept some limits on its uranium enrichment program if doing so could help achieve a larger aim:

Speaking to an economic conference in Tehran, Rouhani both countered hard-line critics worried Iran will give up too much while also attempting to signal his administration remains open to negotiation with the six-nation group leading the talks.

If “we are ready to stop some types of enrichment which we do not need at this time, does it mean we have compromised our principles and cause?” Rouhani asked.

He responded: “Our cause is not linked to a centrifuge. It is connected to our heart and to our willpower.”

Rouhani’s remarks caused a bit of a social media storm, with some reputable analysts, including Suzanne Dimaggio who heads the Iran initiative at the New American Foundation, suggesting that a final deal is on the horizon.

Additionally, Rouhani seemed to suggest that he could put the terms of a final nuclear deal to a national referendum, possibly in order to bypass potential opposition from hardliners in the Majles (Iran’s parliament) and higher up the country’s religious and political hierarchy. As Juan Cole notes, the results of such a referendum could still be overruled by Iran’s Supreme Leader, Ayatollah Ali Khamenei, but Khamenei may be reluctant to overrule the will of a majority of the Iranian public.

Unfortunately, these positive developments take place amid the rise of a new threat to the ongoing negotiations, not from hardliners in Iran’s parliament but rather from hardliners in the newly installed (as of Saturday) US Congress. Senator Lindsey Graham (R-SC) visited Israel late last month and told Israeli Prime Minister Benjamin Netanyahu that there would be a vote on the previously stymied Kirk-Menendez bill (to impose additional sanctions on Iran) sometime in January, and that the new Congress would “follow [Netanyahu’s] lead” on dealing with Iran and the nuclear talks. Putting aside the astonishing sight of a US senator pledging allegiance to a foreign leader, sanctions are a clearly decisive issue for Tehran. The imposition of another round of broad US sanctions, even if they are made conditional on Iran abandoning the talks or breaking its obligations under the existing negotiating framework, would strengthen hardliners in Tehran who have long argued that Washington cannot be trusted. The Obama administration has pledged to veto any additional sanctions on Iran so long as talks are ongoing, but that may not matter; Senator Marco Rubio (R-FL) told reporters last week that he expects the new Congress to pass a new sanctions bill with veto-proof majorities in both the House and the Senate.

The most recent extension of the talks called for a final framework to be in place by March 1 and for a full deal to be reached by July 1. It seems likely that most Republicans in Congress will do their best to scuttle the talks before either of those deadlines can be reached, putting negotiators (who will meet again Jan 15. in Geneva) on an even tighter timeframe.

I offer the following longer terms predictions about the Middle East for 2015.

  1. ISIS will decline in power and influence. I have stated earlier that I do not believe ISIS is viable as a state; it lacks any coherent and functional ideology, any serious political and social institutions, any serious leadership process, any ability to handle the complex and detailed logistics of governance, and any opportunity of establishing state-to-state relations in the region. Additionally it has alienated a majority of Sunni Muslims in the world, regardless of deep dissatisfactions among Sunnis in Iraq and Syria. Ideally ISIS should fail and fall on its own, that is, without massive external, and especially Western, intervention that in some ways only strengthens its ideological claims. To be convincingly and decisively defeated, the idea of ISIS, as articulated and practiced, needs to demonstrably fail on its own and in the eyes of Muslims of the region.
  2. The role of Iran as an actor in the region will grow. Despite all the hurdles, I feel optimistic about US negotiations with Iran. Both parties desperately need success in this regard. Normalization is ludicrously long overdue and necessary to the regional order. Furthermore, Iran and Turkey, are the only two “real” governments in the region today with genuine governance based on some kind of popular legitimacy—for all their faults. Turkey is democratic, Iran semi-democratic (presidential elections, while not fully representative, really matter.) These two states espouse many of the aspirations of the people of the region in ways no Arab leader does. The Gulf will be forced to accommodate itself to the reality of a normalized Iran; the two sides have never really been to war, despite all the occasional bellicose noises that have emerge from them periodically over the past century. Iran is post-revolutionary power with a vision of a truly sovereign Middle East free of western domination– none of the Arab states truly are. Iran’s influence in the region will also grow in supporting growing regional challenges to Israel’s efforts to keep the Palestinians under permanent domination.
  3. President Erdoğan in Turkey will find his influence beginning to crumble in 2015. After a brilliant prime-ministership for the first decade of AKP power, he has become mired in corruption charges and has lashed out in paranoid fashion against any and all who criticize or oppose his increasingly irrational, high-handed, and quixotic style of rule. He is in the process of damaging institutions and destroying his and his party’s legacy. I continue to have faith that Turkey’s broader institutions, however weakened by Erdoğan, will nonetheless suffice to keep the country on a basically democratic and non-violent track until such time as Erdoğan loses public confidence—which could be sooner rather than later.
  4. Russia will play a major role in diplomatic arrangements in the Middle East, an overall positive factor. Russia’s ability to play a key diplomatic (and technical) role in resolving the nuclear issue in Iran, and its important voice and leverage in Syria represent significant contributions to resolution of these two high-priority, high-risk conflicts that affect the entire region. It is essential that Russia’s role be accepted and integrated rather than seen as a mere projection of some neo-Cold War global struggle—a confrontation in which the West bears at least as much responsibility as Moscow. The West has insisted on provoking counter-productive confrontation with Moscow in trying to shoehorn NATO into Ukraine. Can you imagine an American reaction to a security treaty between Mexico and China, that included stationing of Chinese weapons and troops on Mexican soil?
  5. The Taliban will make further advances towards gaining power within the Afghan government. After 13 years of war in Afghanistan the US failed to bring stability to the country as a whole, or to eliminate the Taliban as a major factor in the national power equation. The Taliban is much more than an Islamist movement; it has in many ways been a surrogate for nationalist Pashtun power within Afghanistan (although not accepted as such by all Pashtun). The Pashtun lost out big when the Taliban government was overthrown by the US in 2001; inclusion of mainstream Taliban within the new government is essential to future Afghan stability. The Taliban will seek to strengthen their power on the ground this year in order to enhance their powers of political demand in any possible future negotiations over power sharing. They cannot be functionally excluded. Desperately needed stability in Pakistan also depends in part upon such a settlement.

OK, that’s enough predictive risks for one year…

President Barack Obama’s move towards normalization of relations with Cuba has generated lots of hope and analyses that a similar development may take place with Iran. Jim Lobe, founder of the Lobe Log and Washington Bureau Chief of the Inter Press Service, is one such observer. His recent article offers an excellent elaboration of the arguments. I rarely comment on writings by others, but his article deserves a response.

Lobe writes, “In my opinion, Obama’s willingness to make a bold foreign policy move [on Cuba] should—contrary to the narratives put out by the neoconservatives and other hawks—actually strengthen the Rouhani-Zarif faction within the Iran leadership who are no doubt arguing that Obama is serious both about reaching an agreement and forging a new relationship with the Islamic Republic.”

As someone who has spent 25 years trying to mend relations between the US and Iran, I wish Mr. Lobe and his liberal allies were right, and that their “neoconservative” opponents were wrong in their assessments that after Cuba comes Iran; unfortunately they are not. The truth is that Obama cannot so easily unlock the 35-year US-Iran entanglement that involves complex forces, including an Islamic Revolution.

First, Iranian Foreign Minister Javad Zarif and President Hassan Rouhani used to tell Supreme Leader Ali Khamenei that Obama could be trusted, but after 14 months and many rounds of negotiations, they have now subscribed to Khamenei’s line that the US cannot be trusted. Iran’s nuclear program has already been reduced to a symbolic existence but the promised relief from key sanctions, Rouhani’s main incentive to negotiate, is nowhere on the horizon.

During the meeting in Oman between Kerry and Zarif just before the November 24, 2014 deadline for reaching a “comprehensive” deal, as disclosed by the parliamentarian Mohammad Nabavian in an interview, “[Secretary of State] Kerry crossed all Iranian red lines” and Zarif left for Tehran “thinking that the negotiations should stop.” One such red line concerns Iran’s missile program, which is now included in the negotiations over Iran’s nuclear program.

In a recent letter to his counterparts throughout the world regarding the talks and why a comprehensive deal was not struck last November, Zarif writes that “demands from the Western countries [i.e., the US] are humiliating and illegitimate” and that the “ball is now in their court.” Partly reflecting this disappointment, the Rouhani Government has increased Iran’s defense and intelligence budgets for 2015 by 33 percent and 48 percent respectively (the Iranian calendar begins on March 21).

Second, Zarif and Rouhani could not make the “beyond-the-NPT” concessions that they have made if the supreme leader had not authorized them. The argument that Khamenei and his “hardline” supporters are the obstacle misses the fact that while they have raised “concern” about Iran’s mostly unilateral concessions and the US’s “rapacious” demands, they (particularly the supreme leader) have consistently backed the negotiations and the Iranian negotiators.

Third, Lobe’s thinking suggests that the problem between the two governments is a discursive and personal one: if Khamenei is convinced that Obama is a honest man, then a nuclear agreement would be concluded and a new relationship would be forged between the two countries. What this genus of thinking misses is a radical “Islamic Revolution” and its “divine” Nizam (regime) that stands between Washington and Tehran.

The Islamic Revolution has been anti-American from its inception in 1979 (and not just in Iran), and will remain so as long as the first generation revolutionary leaders rule. The US has also been hostile to the theocratic regime and has often tried to change it. No wonder Khamenei and his people view the US as an “existential threat,” and to fend it off, they have built a “strategic depth” extending to Syria, Iraq, Lebanon, Yemen and other countries.

Fourth, several times in the past the Iran watchers in the West have become excited about elections that have produced “moderate” governments, making them naively optimistic that a change in relations between the US and Iran would follow. What they miss is that the Islamic “regime” (nizam) and the Islamic “government” are two distinct entities, with the latter totally subordinated to the former.

Specifically, the Nizam (where the House of Leader and revolutionary institutions reside) is ideological and revolutionary, whereas the government has often been pragmatic. Indeed, in the last 35 years, the so-called hardliners have controlled the executive branch for less than 10 years. The division of labor should be easy to understand: the Nizam guards the divine Islamic Revolution against any deviation and intrusion while the government deals with earthly butter and bread matters.

Fifth, to avoid a losing military clash with the US and at the same time reduce Washington’s ability to change its regime or “liberalize” it, the Islamic Republic has charted a smart policy towards the US: “no-war, no-peace.” The US has also followed a similar policy towards Iran to calm both anti-war and anti-peace forces in the conflict. Thus, for over 35 years, US-Iran relations have frequently swung between heightened hostility and qualified moderation (in Khamenei’s words, “heroic flexibility”).

Sixth, the Cuban and Iranian cases are fundamentally dissimilar. True, the Castros were also anti-American and are first-generation leaders, but Fidel is retired and on his deathbed while his brother Raul has hardly been as revolutionary as Fidel. Besides, with regard to US-Cuban normalization, Fidel and his brother can claim more victory than Obama; after all, the Castros did not cave in, Obama did. Furthermore, the Castros are their own bosses, head a dying socialist regime, and are the judges of their own “legacy.”

In sharp contrast, Khamenei subscribes to a rising Islam, heads a living though conflicted theocracy, and subsists in the shadow of the late Ayatollah Khomeini who called the US a “wolf” and Iran a “sheep,” decreeing that they cannot coexist. Indeed, in the Cuban case, the US held the tough line while in the case of Iran, the refusal to reconcile is mutual. Furthermore, the Cuban lobby is a passing force and no longer a match for the world-wide support that the Cuban government garners. Conversely, in the Iranian case, Obama has to deal with powerful Israeli and Arab lobbies, and the Islamic Republic does not have effective international support.

On the other hand, we also have certain similarities between the Cuban and Iranian cases. For example, both revolutions have been subject to harsh US sanctions and other forms of coercion that Obama called a “failed approach.” Obama is also in his second term, free from the yoke of domestic politics, and wishes to build a lasting legacy. Despite these similarities, the differences between the Iranian Islamic regime and the Cuban socialist system make the former a tougher challenge for Obama to solve.

Finally, while I do not think that the Cuban course will be followed for Iran any time soon, I do think that certain developments are generating the imperative for an US-Iran reconciliation in the near future. On Iran’s side, they include a crippled economy facing declining oil prices, a young Iranian population demanding transformative changes, and the gradual shrinking of the first-generation Islamic revolutionary leaders.

On the US side, the changes include an imperial power increasingly reluctant to use force, rising Islamic extremism, growing instability in the Persian Gulf and the larger Middle East, and the difficulty of sustaining the “no-war, no-peace” status quo in the absence of a “comprehensive” deal on Iran’s nuclear program. However, on this last issue, in Washington and Tehran, pessimism now far outweighs optimism, a rather sad development. Let us hope that sanity will prevail.

Lindsey Graham, who is not a stupid person, can be so embarrassing. Speaking at a press conference alongside Israeli Prime Minister Benjamin Netanyahu in Jerusalem Saturday, Graham said the following in response to Bibi’s call for “more sanctions, and stronger sanctions” against Iran.

But you, above all others, have said that sanctions are what got Iran to the table, and it will be the only thing that brings them to a deal that we can all live with.

I’m here to tell you, Mr. Prime Minister, that the Congress will follow your lead. [Emphasis added.]

What a remarkable thing to say to a foreign leader when he’s hosting you in his country, especially when the president of your own country is clearly not happy with that prime minister’s approach to this particular problem.

But that’s not all he said. He implied that people in the US intelligence community, which has insisted for more than seven years now that Iran has not made a decision to build a nuclear weapon, should have their driver’s licenses revoked whenever they return from overseas assignments, meetings or vacations.

To those who believe the Iranians have not been trying to develop a nuclear weapon, if you come to America, you should not be allowed to drive on our highways. Clearly, this regime for years has been deceiving the international community, has been trying to pursuit [sic], in my view, a nuclear weapon.

And then there’s this little gem offered to a leader who, as prime minister or the leader of the opposition, has steadfastly opposed the peace-making efforts of three US presidents, including George W. Bush, and who enthusiastically encouraged the United States to invade and occupy Iraq, among other incredibly stupid moves.

And what brings me here so many times, is common and shared values and common and shared enemies.

The fate of one country determines the fate of the other.

God bless the people of Israel, and you can count on the United States Congress, Republican and Democrat, to be there for you when you need us the most. [Emphasis added.]

Now, to be fair to Graham, he did not explicitly endorse Netanyahu’s call for “more sanctions, and stronger sanctions” despite his promise that Congress will follow Bibi’s “lead” in dealing with Iran. Instead, he promised that Congress will vote on the Kirk-Menendez bill, or what I originally called the “Wag the Dog Act of 2014,” next month, the approval of which, according to virtually all knowledgeable observers, will result in the collapse not only of the negotiations over Iran’s nuclear program, but also of the international sanctions regime. (For a more specific analysis, you can examine Ed Levine’s assessment of the bill after it was introduced last year.)

Graham, like Netanyahu himself, also insisted that he supports the administration’s efforts to negotiate a deal. “I would love nothing better than a diplomatic solution to the Iranian nuclear ambitions,” he said. “I support the Administration’s effort to try to bring this to a peaceful conclusion.” But then he went on to insist that any final agreement must include the abandonment by Tehran of its uranium enrichment capabilities—a demand that all of the P5+1 (US, UK, France, Russia, China plus Germany) consider totally unrealistic.

Now, Graham often has had a problem with getting a little carried away in his public rhetoric. Reacting to President Obama’s State of the Union Address last January, and particularly his remarks about imposing sanctions against Iran, the South Carolina senator warned that “the world is literally about to blow up.” At the 2010 Halifax International Security Forum, Graham reportedly stunned the audience—and apparently embarrassed his hosts—by calling for a full-scale attack on Iran beyond its nuclear facilities.

So my view of military force would be not to just neutralize their nuclear program, which are probably dispersed and hardened, but to sink their navy, destroy their air force and deliver a decisive blow to the Revolutionary Guard. In other words, neuter that regime.

But then last June, Graham, while on the rounds of the Sunday talk shows and apparently freaked out about Islamic State’s sweep in northern and western Iraq, called for Washington to work with Iran (and presumably with the hated Revolutionary Guard) to protect Baghdad. The US has to “have to have some dialogue with the Iranians that says, ‘let’s coordinate our efforts,’ but has some red lines,” he said on one show. “The Iranians can provide some assets to make sure Baghdad doesn’t fall,” he said on yet another. “We need to coordinate with the Iranians. To ignore Iran and not tell them, ‘Don’t take advantage of this situation,’ would be a mistake.”

More recently, Graham denounced the Republican-led House Intelligence Committee’s report on Benghazi as “full of crap.”

It’s pretty clear that Graham can sometimes get excitable, especially when the TV cameras are rolling.

Assuming that the Kirk-Menendez bill does come to the floor next month, however, the big question is whether it will attract enough Senate Democrats to render its passage veto-proof (because there’s no doubt whatsoever that Obama will veto it). That will take 33 Democrats and/or independents and/or Republicans. At this point, I think the president should not have too much trouble getting those votes, and the fact that Graham has now taken the lead on this while on foreign soil will likely make it easier for Obama to get the Democratic support he needs. But Graham’s assurance that a Republican-led Congress will “follow [Netanyahu’s] lead” (against a US president, if necessary) should prompt a few of his fellow-Republicans to reflect just a little on the implications of such deference by a powerful US senator to a foreign leader.

Graham also had a lot to say about Hamas and withholding funding for the United Nations if it becomes more involved in seeking an Israeli-Palestinian settlement. You can read the whole transcript of his appearance with Netanyahu here and judge for yourself.

Following President Barak Obama’s decision to restore diplomatic ties with Cuba, it is remarkable to see so much speculation about whether this will set a precedent for a restoration of US ties with Iran

The word “remarkable” is chosen deliberately because, on the face of it, the two situations seem so different. The Cuban revolution has long since lost its force, with few true adherents outside of the gerontocracy, while that in Iran, if somewhat attenuated, still has a major, perhaps decisive, impact on society as well as on foreign policy.

Further, any geopolitical arguments for US efforts aimed at isolating Cuba, themselves imperfect at best, died with the Soviet Union, 23 years ago this week. But the geopolitics for the US to continue trying to isolate Iran are alive and well, flowing from some basic disagreements, not least the Iranian nuclear program but also Iran’s support for Syria’s Bashar al-Assad, for Hezbollah and, to a lesser degree, for Hamas. These cannot just be wished away, in contrast to the outmoded argument that somehow Cuba could act as another country’s proxy or could destabilize any part of its neighborhood.

So what can we make of a possible connection with Iran? At one level, what Mr. Obama has done takes the United States at least one step beyond the quixotic American practice of deciding whether to have diplomatic relations with other countries based at least in part on how we view their governments. (If we don’t like them or what they do, we call them “regimes,” which is a dead giveaway.)

Few other countries in the world impose their standard of a nation’s behavior, at home or abroad, in deciding whether to have at least some semblance of normal diplomatic intercourse—though there are major exceptions, such as the unwillingness of a number of Arab countries to deal formally with Israel. The US also tends to lose from imposing a test of purity regarding another country’s government or its international behavior. Not only do many countries not follow our lead but, more importantly, we deprive ourselves of the capacity to gain direct experience of the other country’s leaders.

Of course, it is rarely true that diplomatic relations are totally severed: some contacts are inevitable and are conducted by so-called “protecting powers.” In Iran, the US protecting power is Switzerland; in the United States, Iran’s protecting power is Pakistan. (All members of the United Nations also have diplomats in New York, and informal corridor contacts can always take place, “plausibly denied.”)

This round-about practice can have its price, however. For example, in 2003, when the US was about to invade Iraq—thus “putting the wind up” Iran’s clerical leadership—the Iranians made a proposal, through the Swiss, which, if it had worked out (a big imponderable) could have wrapped up the nuclear issue at that time. But in part because of the indirect nature of the proposal, the US was able simply to ignore it—such was the attitude of the US administration at the time to anyone in the Middle East out of step with US preferences. That would have been harder to do if American and Iranian diplomats had been dealing directly with one another.

Despite President Obama’s break with the tired old precedent regarding what governments we are prepared to deal with, he is not likely to follow suit with Iran, at least not just to tidy things up. US domestic politics is a major factor. The “Cuba lobby” may still have an important role to play in Florida’s politics—one of the “swing states” in US presidential elections—but the passage of time and a rising generation of young Cuban-Americans has attenuated the lobby’s power. Not so in regard to the domestic lobby that wants no part of relations with Iran. This lobby is mostly Israeli-inspired, but also includes some Christian evangelicals and a lot of neoconservatives, especially in Congress, who are not prepared to compromise with any government that is a challenge to the United States.

We thus cannot expect a “Nixon to China” opening to Iran, as much as that would bring us into line with the practice of most nations on the planet in terms of diplomatic relationships. Indeed, Obama will have enough trouble selling the opening to Cuba to Congress—whose Republican majority come January would love to deal him a setback, whatever the merits of the case. And without congressional action, a lot of what the president has in mind can’t be done. At least in this case, executive action has severe limits. Selling an opening to Iran that would have practical consequences, like the freeing-up of trade and investment with Cuba, could only be done if Iran came across on issues important to the US, with the nuclear program topping the list.

It also takes two to make something like this work. Despite the potential for success in the negotiations between Iran and the so-called P5+1 countries on the former’s nuclear program, and despite the pressures exerted on the Iranian economy both by Western sanctions and by the Saudi-driven drop in the price of oil, it is not clear that Iran wants improved relations with the United States, at least unless the US were willing to remove at least a large part of the economic sanctions. This the United States will not do without a nuclear agreement. In fact, the hostile reception in much of Congress to the opening to Cuba has not helped the climate needed to foster success in the negotiations with Iran over its nuclear program: if a relatively simple thing like getting rid of congressional strictures on dealing with a tired old Cuban oligarchy that has long since ceased posing any threat to any US national security interest is so difficult to achieve, Iranian skeptics can wonder whether President Obama could deliver on any agreement that would include sanctions-lifting. No doubt, the same point has occurred to US domestic opponents of any deal with Iran.

The geopolitics of Iran’s situation has a further twist. Despite the emphasis put on the Iranian nuclear program and the pressures from the Israeli and other domestic lobbies, this is only part of the story. Several countries in the Middle East oppose Iran’s reemergence into regional society for a much broader set of reasons and—for at least some of them—the nuclear issue is simply the one that most easily catches the attention and support of outsiders, particularly the United States.

Sunni countries oppose “apostate” Shia Iran, an ideological point reinforced by the fact that most of Saudi Arabia’s oil reserves are located in the Eastern Province, with its large Shia population. Iran also supports the Alawite-dominated Syrian government, another poll of the region’s Sunni-Shia civil war. Other Gulf Arab states (though not Oman) also feel threatened by Iran, for reasons that have nothing to do with the nuclear question. Turkey would just as soon see Iran continue to be isolated, and this also applies to Israel, which does not want to see Washington and Tehran reconciled, even if the nuclear issue were resolved, at least without a major and credible change in Iran’s attitude toward the Jewish state.

Judged in its own terms, President Obama’s opening to Cuba is a useful departure from a sclerotic policy of many US administrations that has long outlived its value for the United States, if it ever indeed had any value. But while it does say something about the president’s cast of mind, in and of itself the new Cuba policy will not have much if any influence on US policy toward Iran. In fact, if fears on the part of the opponents of change see Obama as likely to continue cleaning up the past—as a president who has fought his last electoral battle—they may simply ramp up their opposition to a sensible US approach to the current talks with Iran.

Here is where the president needs to show his mettle: to persevere with the negotiations with Iran over its nuclear program, provided, of course, that Iran’s leaders will do the same. Success could then open up possibilities for the two countries to work together on areas of compatible interests, including Afghanistan, freedom of navigation in the Persian Gulf, countering Islamic State forces, and exploring possibilities for stability in Iraq. Such a course would put US national interests ahead of domestic politics, which is what we expect our presidents to do.

Since Obama’s announcement last week that he will normalize relations with Cuba, a number of commentators have analyzed what impact this might have on US-Iranian ties, particularly with respect to the ongoing negotiations on Iran’s nuclear program.

Aside from neoconservatives, such as Elliott Abrams, and other hawks, like Lindsey Graham and John McCain—who predictably deplored the move and worried that Obama’s move portends US surrender at the negotiating table—the Wilson Center’s Aaron David Miller was one of the first to do a more thoughtful analysis of what it might mean for Iran policy. In his post, entitled “After Cuba Comes Iran,” Miller argued that, despite the key differences between the two countries, Obama’s decision to normalize ties with Havana “should be a clear sign of where he might like to go with Iran on the nuclear issue in coming months.”

Paul Pillar, a regular contributor to the National Interest, also alluded to the possibility that the Cuba initiative, coupled with Obama’s more assertive policy shifts on immigration and climate change, could indeed indicate where Obama wants to go with Iran and expressed the hope that these moves will encourage him to inject into the US negotiating position the flexibility that will be needed to conclude an agreement.

In another important contribution published by Voice of America Tuesday, the Atlantic Council’s Iran expert, Barbara Slavin argued what I’ve been thinking (but hadn’t put pen to paper) for the past week:

For those in the Iranian government who are pushing for a long-term nuclear deal with Washington, seeing Obama use his presidential authority to relieve the embargo against Cuba despite the vocal objection of some in Congress should increase confidence that he can waive key nuclear-related sanctions against Iran in a similar fashion.

In my opinion, Obama’s willingness to make a bold foreign policy move that is certain to provoke heated opposition from not insignificant domestic constituencies (that are also overrepresented in Congress) should—contrary to the narratives put out by the neoconservatives and other hawks—actually strengthen the Rouhani-Zarif faction within the Iran leadership who are no doubt arguing that Obama is serious both about reaching an agreement and forging a new relationship with the Islamic Republic.

 

I asked Farideh Farhi—whose analysis of internal Iranian politics and foreign policy is, as far as LobeLog (among many others) is concerned, the best available—about this Wednesday. She replied by email as follows:

I think Obama did himself a lot of good in changing the perception of him in Iran, as well as the rest of the world, as a weak and indecisive president. I think that perception just received a beating and will help those in Tehran who are making the case that Obama is serious and can deliver on substantial sanctions relief or that he is the best person to deal with (given the fact that he is relieved of election pressures). To be sure, all this will be focused on nuclear negotiations and not normalization of relations that developed in the Cuba situation, but if it happens, it will certainly be a breakthrough that may gradually open the path towards normalization.

Farideh pointed in particular to the official reaction by Iran’s Foreign Ministry to Obama’s Cuba announcement as offering some indication about how it was being interpreted in Tehran. That statement emphasized the president’s acknowledgment that more than 50 years of isolation and sanctions against Cuba had not worked and “I do not believe we can continue doing the same thing for over five decades and expect a different result.” Obama’s remarks about having learned “from hard-earned experience that countries are more likely to enjoy lasting transformation if their people are not subjected to chaos,” according to Farideh, were also likely to be seen favorably in Tehran as Obama’s repudiation of “regime change.” (Related points were made in another analysis, “If It’s True on Cuba, It’s True on Iran,” published in the Huffington Post by Trita Parsi and Ryan Costello shortly after Obama’s announcement.)

I would add that the fact that the Castro brothers, who have “resisted” Yanqui imperialism and “global arrogance” for even longer than Tehran, are now willing to establish a new relationship with their own “Great Satan” may also count for something in the internal debate that swirls around Ayatollah Khamenei’s office. If, after all, revolutionary Cuba is willing to turn the page with their historic nemesis—defiance of which has largely defined Cuba’s out-sized standing and status in the world—shouldn’t hardcore revolutionaries around Khamenei at least consider the idea, if not of normalisation (which appears out of the question for the moment), then at least moving with greater confidence toward some rapprochement?

That view is shared by Kenneth Katzman, the senior analyst of Iran, Iraq, Afghanistan and Persian Gulf Affairs at the Congressional Research Service. “I think we should also not minimize how the Cuba rapprochement might play in the inner counsels in Tehran,” he said in an email. “Surely, Rouhani and Zarif can now go to the Supreme Leader and say ‘The Castro brothers are at least as distrustful of the United States as you are, and they were able to reach a deal with the United States. Why wouldn’t you do the same??”

Of course, opponents of Obama’s normalization of ties with Cuba will try to rally a Republican-led Congress behind their efforts to restrain Obama’s efforts by, among other measures, denying funding for an embassy, refusing to confirm a nominee as ambassador, and introducing legislation designed to constrain the president’s authority to waive or lift certain sanctions or further ease the trade embargo. And, if they succeed, particularly with respect to the sanctions issue, there’s no doubt that such action will be used by hard-liners in Tehran to argue that Obama lacks the power to follow through on any promises he makes about lifting sanctions and related concessions, in a nuclear deal.

But it’s pretty clear that Obama is determined to fight such actions, and it’s most unlikely that anti-Castro diehards like Marco Rubio and Ileana Ros-Lehtinen will be able to gather enough Democratic supporters to overcome a presidential veto. Indeed, given the strong support for Obama’s action from such quarters as the US Chamber of Commerce, the National Foreign Trade Council, and various agricultural lobby groups whose members are eager to significantly increase their exports to Cuba, normalization’s foes may find it more difficult than they anticipate to rally a large majority of Republicans behind them despite the party leadership’s determination to deny Obama any kind of foreign policy success.

At the same time, any serious effort by the anti-Castro forces on Capitol Hill will pose some difficult questions for key players on Iran, especially the Israel lobby and the various groups associated with it. The Cuba and Israel lobbies have worked closely together for decades—their common interests have converged perfectly in the persons of the outgoing chair of the Senate Foreign Relations Committee and former House Foreign Committee chair Ileana Ros-Lehtinen. And now is the moment when the Cuba lobby needs all the help it can get. Moreover, if the leadership of the Israel lobby believes that normalization with Cuba will make a nuclear deal and rapprochement with Iran substantially more likely, will it decide that this is a fight worth fighting? Of course, the leadership is not monolithic, especially on a question that, at least on the face of it, is so far removed from Israel itself, and it will be very difficult to mobilize all but the lobby’s most right-wing constituents behind preventing normalization with Cuba. But it will be fascinating to watch.

What a difference a few months make. During much of 2014, Russian President Vladimir Putin was riding high. Russia seized Crimea from Ukraine quickly and relatively bloodlessly. Putin was also able to help pro-Russian forces in eastern Ukraine effectively secede from the rest of the country and prevent the Ukrainian government from retaking these areas. Western governments howled in protest and even imposed economic sanctions on Russia, but were unable to force Putin to back down. Putin’s unsettling actions also seemed to help keep the price of oil high, which Russia benefited from as a leading petroleum exporter. And while the West was highly critical of him, many governments elsewhere—most notably in Asia—seemed indifferent or even sympathetic toward Putin’s actions in Ukraine.

At present, though, things look very different for the Russian president. Western sanctions, which initially seemed quite weak, now appear to be having an increasingly negative effect on the Russian economy. More importantly, the dramatic decrease in the price of oil over the past few months has contributed to a sharp drop in Russia’s export income as well as to the value of the ruble. Eastern Ukraine has meanwhile become an increasingly costly venture for Moscow—not least because of the mounting deaths of Russian soldiers engaged in the fighting there. Absorbing Crimea is also proving costly for an increasingly cash-strapped Moscow. As Western disapproval and even fear of Russia have grown, the ranks of European political and economic leaders calling for accommodating Moscow and cooperating with Putin have thinned. Finally, those non-Western governments that earlier seemed indifferent or sympathetic to Putin’s policy toward Ukraine now seem either indifferent or eager to take advantage of Russia’s increasing economic difficulties.

Putin, in short, now seems to be facing something of a dilemma. Continuing his current policies toward eastern Ukraine will probably not bring about an end to what is becoming a quagmire there for Moscow, and will mean that Western economic sanctions on Russia remain in place or even worsen. Yet withdrawing from Ukraine could weaken Putin domestically since the Russian public has supported his forward policy on Ukraine and would not be happy to see it reversed.

So what will Putin do now? Many fear that he will lash out at the West by supporting Russian secessionists in the Baltics or elsewhere. Putin himself has contributed to this fear by talking about how a cornered rat will attack its pursuers. But despite the deteriorating situation that he now faces, the Russian president need not become that rat in the corner. Indeed, he can be expected to ensure that he does not.

 

This is because Putin is basically a pragmatist. While he can support Russian secessionists in the Baltics, Belarus, northern Kazakhstan, or elsewhere in Ukraine—as he did with those in Crimea and eastern Ukraine—Putin cannot now be certain that he can gain control over these territories quickly and easily like he did with Crimea. Instead, supporting such groups or intervening directly may only result in more drawn-out conflicts such as the one now taking place in eastern Ukraine. If it is increasingly costly for Russia to be involved in just one such conflict, it will be even costlier still for it to become involved in more of them. If he thought he could replicate what happened in Crimea, Putin might be tempted to do this. Indeed, his quick victory in Crimea may have persuaded him that he could also win in eastern Ukraine. But now that eastern Ukraine has proven to be so problematic, Putin must be aware that similar adventures elsewhere could prove similarly risky—and that Russian forces could only get more thinly spread if they become involved in more such conflicts.

Some fear that Putin might lash out in some other manner by, for example, ending Russian support for the ongoing negotiations with Iran over its nuclear program. But this also seems unlikely because: 1) Russia does not want Iran to acquire nuclear weapons, either and 2) the United States and its Western allies could still reach an agreement with Tehran on this matter without Russian help—which would only serve to demonstrate Russian impotence.

Russia stepping up its support for the Assad regime in Syria is another possibility. Doing so, though, would make Russia more of a target for Islamic State (ISIS or IS). Nor does it seem plausible that Putin would want Russia to become more involved in Syria when Moscow is far more concerned about what is happening in Ukraine and other former Soviet states.

Some fear, though, that reported Russian submarine deployments in Swedish waters, military overflights over several countries, and claims in the Arctic are all signs that Putin is preparing something even worse. However, while hardly reassuring, these moves seem aimed more at showing the Russian public how strong Putin is than as precursors to Russian initiation of conflict.

What all this suggests is that while Putin is aggressive, he is not reckless, and he demonstrated this during a Dec. 18 press conference. Indeed, while insisting that any Russian troops in eastern Ukraine are “volunteers,” he seemed also to hold open the door to cooperation with Kiev—and with Georgia, too (which Russia won a brief war against in 2008).

Returning to the rodentine analogy that Putin himself has used: if a cornered rat lashes out, one that is not cornered is more likely to find a safe place to run to instead. What this means for the West is that while it should assist Ukraine in resisting Russian incursions, it should reassure Putin that if he compromises on Ukraine, the West will not use this as an opportunity to rout him altogether. By continuing to cooperate with Russia on problems of common concern (such as Afghanistan, the Iranian nuclear issue, and terrorism) and by reiterating how Western sanctions would be lifted if Russia modifies its policy toward Ukraine, we can help Putin achieve his own goal of not ending up in a corner.

As a postscript to my previous post, I want to draw attention to two bits of news that I came across later that day, and to offer brief comments.

Iran’s Foreign Minister, Mohammad-Javad Zarif, addresses the Nuclear Diplomacy Seminar at Allameh University: “We have not had any roll-back, and the structure of the nuclear program has been preserved. The movement forward of the nuclear program towards industrialized [scale] is continuing, and Iran’s activities in Arak and Natanz will continue…We have gained respect for the state. They respect Iran’s behavior, and the calculations of the ill-wishers of the country are in disarray.” FDD Iran Press Review, 2 December 2014

Note the emphasis on avoiding roll-back, which suggests roll-back is an Iranian “red line,” and Zarif’s insistence that halving the number of operating centrifuges at Iran’s disposal would condemn the nuclear negotiation to failure. That may sound worrisome. But it need not be if, as is reportedly the case, Iran is ready to send its low enriched uranium stocks to Russia for use in making fuel for the Bushehr reactor. In those circumstances, avoiding roll-back can be reconciled with US break-out avoidance ambitions, provided these are moderated.

Note too the references to respect. This is a clue to why avoiding roll-back is a “red line.” The leaders of Iran see its nuclear achievements as a symbol of national dignity. For them, nuclear cut-backs would entail humiliation.

This talk of dignity and humiliation may strike some readers as over-sensitive. Britain and the US tend to take their dignity for granted. But remember General Charles de Gaulle, France’s president from 1944-46 and from 1958-69.

For him, the French defeat in 1940 was such a national humiliation that the restoration of French dignity was as much of an objective for him as helping Britain (and later the US) to win the war. Time and again, he tested the patience of his British war-time hosts and allies by making demands or refusing concessions in the interest of upholding French dignity and self-respect.

Now on to a Dec. 2 Reuters report, an excerpt of which I have provided below:

Iran said it has provided evidence to the United Nations atomic agency showing that documents on suspected nuclear bomb research by the country were forged and riddled with errors….

Iran has offered detailed explanations to the IAEA and there has never been “any authenticated documents for PMD claims”, said the Iranian note posted on the agency’s website…..

They “are full of mistakes and contain fake names with specific pronunciations, which only point toward a certain member of the IAEA as their forger”, it said.

Since Nov. 11, 2013, Iran and the International Atomic Energy Agency (IAEA) have been cooperating better on the so-called “possible military dimension” (PMD) of the Iranian case. Will this incline the IAEA secretariat to react more forensically than in the past to this latest Iranian dismissal of material allegedly found on a laptop a decade ago? Will they produce and circulate to members of the Board of Governors a reasoned critique of the Iranian “explanations” if, after studying Iran’s grounds for doubt, they continue to believe in the authenticity of the laptop material?

This material has been an obstacle to a peaceful resolution of the Iranian case ever since the IAEA elevated it to a primary concern in early 2008, when all other concerns had been resolved. From the outset people I respect, such as the former Director General of the IAEA, Mohamed ElBaradei, had doubts about its authenticity.

It would be as wrong to find Iran guilty of clandestine nuclear weapon research on the basis of dubious evidence as it would be to condemn a criminal suspect on the basis of dodgy state evidence submitted to secure a conviction.

The IAEA maintains that it has reasons other than the laptop material for suspecting a military dimension to the Iranian case. I am not suggesting that consigning the laptop material to the “too dubious to be useable” file would eliminate that dimension. But I am confident that putting it to one side would simplify the IAEA’s task of bringing this investigation to some kind of resolution.

The decision announced last Monday in Vienna to extend the talks aimed at a compressive agreement on Iran’s nuclear program for an additional seven months has resulted in Iran’s currency taking dive. In one week, the rial lost more than 5% of its value in the unofficial market. The devaluation has clear political and economic implications: it will revive inflation, slow or stop economic growth, and increase the pressure on Iranian President Hassan Rouhani as his government tries to make good on the election promises he made 18 months ago.

But will this soften Iran’s negotiating position? To answer this question, we need to look at the basis of this phase of the rial’s devaluation and what it means for ordinary Iranians.

The drop in the value of the rial after the extension was announced on Nov. 24 indicates that expectations in Iran for a final deal were high before the deal failed to materialize. This optimism had kept the rial’s value above what the economics of the situation warranted. In other words, rather than being in “free fall,” as several reports in the press have suggested, the rial is actually adjusting to a new equilibrium.

Two major factors have been putting pressure on the rial in the last few months, neither of which is related to the negotiations or the sanctions. The first is the decline of the price of oil, by more than 30% since this summer, which has reduced the already strained supply of foreign currency to the Iranian economy. As I noted in my previous post, prior to Nov. 24, the rial had remained surprisingly stable despite the falling price of oil.

The rial was also under pressure because Iran’s inflation exceeded that of its major trading partners, making Iranian producers less competitive. Prices in Iran have increased by 23% since Rouhani’s election in June 2013 when the rial traded around 31,000 per dollar. All else the same, the rial would have to fall by 23% to keep Iranian production competitive. That would mean an exchange rate of over 38,000 rials per dollar in the unofficial market and 32,500 in the official market. Presently, these rates are at 34,000 and 26,500.

Of course, all else is not the same. The price of oil is lower, Iran has started receiving around $700 million a month of its unfrozen assets, and there have been changes in economic policy. Some of these changes, like the lower price of oil, would require the rial to devalue further, while others would have the opposite effect.

At the same time, although the rial could continue to decline, currently it’s certainly not in free fall.

An overlooked fact in Western press reports on this issue is that the Rouhani government, populated in part by economists focused on the competitiveness of Iranian producers, had signaled its intention to officially devalue the rial before the Nov. 24 extension was announced. Indeed, officials spoke publicly last month about a (modest) 7.5% increase in the official exchange rate to be used in the 1394 (2015/2016) budget to 28,500 rials to the dollar.

Now on to that burning question: How long will this crisis last?

The pace of devaluation in the free market has quickly slowed down—the rial even rose against the dollar on Dec. 1—but as I mentioned earlier, further drops in the value of the rial are still possible as the reality of the lower price of oil sinks in.

Devaluation is a sign of an underlying imbalance in the economy, so when it happens, people are naturally alarmed. But it is also part of the solution to the same imbalances that need correcting. Consider, for example, that a cheaper rial is good for production and employment, even in a poor business environment hampered by international sanctions and domestic impediments to production, which business people refer to as “internal sanctions.”

Devaluations also redistribute income. In the short-run, inflation, which dropped last year below 20%, will rise as prices for goods bought and sold at the unofficial rate increase. The burden of the higher inflation will fall primarily on people living on fixed incomes, on the public payroll, and those who travel abroad or send money to their children abroad—all of whom compose the better part of the middle class.

Unlike former President Mahmoud Ahmadinejad, Rouhani does not believe in directly paying the poor, so what happens to this segment—about 10-20%— of the Iranian population is less certain. Wages of unskilled workers usually increase with inflation, though not always in tandem. They also rise with demand for labor, which could get a boost from devaluation. However, the 30% increase in the price of bread that was quietly implemented earlier this week, on Dec. 1, will hurt the poor disproportionately, as it was put through without any compensatory mechanism.

Of course, if the Rouhani government is forced to reduce the country’s much larger energy subsidies to balance its budget in the face of falling oil revenues, it may ultimately have to swallow its pride and take up the Ahmadinejad cash transfer mechanism, which Rouhani strongly criticized during his presidential campaign.

Ultimately, the drop in the price of oil will result in lower economic growth and loss of income across the country. But there is no policy that can fully compensate for a large decline in the terms of trade, which the recent decline in the price of oil represents—there are only good and bad policy responses. Allowing the rial to devalue is a good start, but not enough. The government should also be planning policies to help domestic producers rise to the occasion and measures required to protect the poor as prices for basic goods such as bread and energy rise.

So much has been written and said about the uranium enrichment aspect of the 14-month nuclear negotiation with Iran that it is hard to look at it with fresh eyes, and starting from first principles. Nonetheless what follows is an attempt to do so. It suggests that the US and Iran are closer on enrichment than once seemed possible, but are still at risk of failing to find common ground in the course of the extension agreed a week ago.

From an international legal perspective the text that matters is the Nuclear Non-Proliferation Treaty (NPT), to which Iran deposited its last instrument of ratification on 5 March 1970, the same day as the deposit of the US instruments. Under the NPT the US is a “Nuclear Weapon State,” Iran a “Non-Nuclear Weapon State” (NNWS).

The NPT does not prohibit the acquisition of enrichment technology by NNWS. Nor does it impose any limit on the size or number of NNWS enrichment facilities. It merely requires NNWS to use that technology exclusively for peaceful purposes, and to place all the nuclear material fed into and produced by such facilities under International Atomic Energy Agency (IAEA) safeguards.

In the current negotiation, Iran has assured the US that it takes its NPT obligations very seriously. It has also reaffirmed its intention to use enrichment technology exclusively for peaceful purposes, and to continue to implement the NPT safeguards agreement that it concluded in 1975.

Some people assume that such assurances are worthless. They point to the breaches of the NPT safeguards agreement that occurred between approximately1991 and 2003. However, none of those breaches amounted to evidence of an intention to use enrichment for non-peaceful purposes. And US intelligence has yet to come across any such evidence; suspicion of Iranian nuclear weapon intent has rested on inference, not evidence. States, like people, can make mistakes and then resolve not to repeat them.

There are also several resolutions adopted by the UN Security Council (UNSC) between 2006 and 2010 that make legal demands of Iran. But none of them imposes limits on the size and number of Iranian enrichment facilities. Still less do any of them outlaw Iranian possession of enrichment technology for peaceful purposes. One of them requires Iran to cooperate with the IAEA to resolve concern that Iran has engaged in research into nuclear weapon-related technologies. Iran has been doing that since November 2013, albeit with increasing hesitancy.

In the Iranian case another perspective is as important as the legal perspective; it is the confidence-building perspective. This was crucial to an attempt to resolve the problem peacefully in the wake of the IAEA Director General reporting the safeguards breaches to which reference is made above, because these breaches had undermined confidence in Iran’s peaceful intentions.

In the autumn of 2003, Iran volunteered, in the interest of confidence-building, to go beyond the requirements of its NPT safeguards agreement and make available to the IAEA the information and access required by the Additional Protocol (AP). Tehran also undertook to suspend activity at its only enrichment facility while it negotiated longer-term confidence-building measures with the UK, France and Germany (E3). The Iranians implemented these short-term measures scrupulously and ceased doing so only after they had grasped that nothing less than renunciation of the enrichment option would satisfy the E3.

In the current negotiation, various reports suggest that Iran has so far volunteered to renew application of the AP, de facto initially and later de jure; to accept limits on the size and number of its enrichment facilities during a confidence-building period; to refrain from producing uranium enriched to more than 5% U235; to convert some of its under 5% U235 uranium (LEU) into forms in which it would not be readily available as feed material; and to send the rest of its LEU stock to Russia for use in the fuel that the Rosatom corporation is supplying to the power reactor at Bushehr. Iran’s negotiators also have reportedly suggested that they are ready to extend the Bushehr fuel supply contract well beyond 2021.

In parallel, Iran has negotiated that Rosatom will help build two further power reactors and will supply them with fuel throughout their operating lives.

In confidence-building terms, this amounts to an impressive package. With only 10,000 IR-1 centrifuges in operation in only one facility, and its LEU stock unavailable to serve as feed material, Iran would need at least six months to produce enough highly enriched uranium (HEU) for one nuclear device. With only 8000 IR-1s and no LEU feed, Iran would need at least eight months.

And if the Bushehr supply contract were extended to 2031, Iran would only need to consider increasing the available quantity of separative work units (a measure of centrifuge output) in the late 2020s.

In other words, Iran is offering a package that exceeds its NPT obligations by a wide margin. IAEA inspectors would be able to acquire confidence that there are no undeclared nuclear activities or material in Iran. The international community would know that it had six to eight months at least to react to any sign of Iranian misuse of its enrichment capacity for non-peaceful purposes.

So why in Vienna did it seem that this package is not enough for the US? That is for representatives of the US administration to explain. Past statements suggest that they will say that they need certainty that Iran will be incapable of producing (“cannot”) even one nuclear weapon.

That may sound reasonable but is in fact an unrealistic goal. It would require Iran not only to destroy all its centrifuges but also to wipe the minds of its engineers clean of all their knowledge and experience of enrichment technology. It also puts the negotiation at risk of the same fate as the 2003-5 E3 negotiation, because Iran is unready to build confidence by closing down its enrichment program. And it runs counter to the spirit of the NPT, since the NPT bases nuclear non-proliferation on self-restraint, political will, and deterrence through verification, not on nuclear technology surrender.

If instead the administration admits that it cannot literally “close all pathways” to a weapon but claims that it needs at least 12 months to react to any break-out attempt, then they should be asked why six to eight months would not be enough.

It is self-evident that 12 months of additional sanctions would not cause Iran to abandon a break-out attempt. Eight years of sanctions have failed to persuade Iran to re-suspend enrichment. Post-1918 history is littered with failed sanctions policies.

On the other hand, 12 months are more than are needed to get UN Security Council approval for the use of force to prevent break-out and to act on it—or for a coalition of the willing to form in the unlikely event of Russia or China threatening to veto a UNSC resolution. In 1990, only six months were needed for the US to gain approval for and prepare a massive operation to drive Saddam Hussein out of Kuwait. As recently as last April, Secretary John Kerry was formulating the goal as “six to 12 months.”

This analysis will be misconstrued by some as an apologia for Iran. Others will realize, I hope, that it is an attempt to clarify the progress that has been made on enrichment over the last 12 months; to explain why the current Iranian offer is reasonable from a legal and from a confidence-building perspective; and to counter the pernicious influence on US negotiating goals of people who want the bar set so high that Iran will refuse the jump.
