Two celebrations brought Lockheed Martin’s CEO, Marilyn A. Hewson, to Israel on April 9.

Hewson officially opened Lockheed Martin’s office in Beersheba, the closest major city to where IDF technical units are being consolidated at new bases in the Negev Desert, which will be supporting the defense contractor’s ”growing presence” in Israel. “By locating our new office in the capital of the Negev we are well positioned to work closely with our Israeli partners and stand ready to: accelerate project execution, reduce program risk and share our technical expertise by training and developing in-country talent,” Hewson said in her speech.

Then was the arrival of the first C-130J Super Hercules airlifter at Nevatim Air Base in Israel. The state of the art Super Hercules, fitted with “Israeli-specific, post-production modifications,” has been dubbed Shimshon (Samson) by the Israel Defense Forces, about which Hewson waxed rhapsodic:

This aircraft is worthy of its given name, Shimshon…[sic] a leader whose power was thought to be as mighty as the sun. Shimshon used his power to combat the enemies of Israel and perform heroic feats.In the same way, this aircraft will support the defense of Israel and the men and women who are the heroes of the Israeli Defense Force.

(Apparently Ms. Hewson is unaware that the biblical Samson/Shimshon (Judges 13:1-17:31), for all his strength, actually met a rather unenviable end — in Gaza — using his final surge strength to destroy himself along with the enemy. Yet the Philistines lived to fight another day and were still around a hundred years later.)

Much of the publicity heralding the Samson’s arrival emphasized the air transporter’s capabilities in carrying out humanitarian missions. According to Lockheed’s product description, “This rugged aircraft is regularly sent on missions in the harshest environments, and is often seen as the first aircraft ‘in,’ touching down on austere landing strips before any other transport to provide humanitarian relief after natural disasters.” Reuters notes that “In non-combat, but harsh, environments, C-130Js are often the first to carry out missions such as search and rescue, aerial firefighting in the United States and delivering relief supplies after earthquakes, hurricanes, typhoons and tsunamis around the world.” A Haaretz article anticipating the Samson’s arrival said that earlier versions of the Hercules aircraft had been used in 1976 to rescue hijacked Air France passengers being held hostage in Entebbe, Uganda and to transport Ethiopian Jews to Israel as part of Operation Solomon in 1991.

The Israeli Air Force website, however, describes the C-130J Hercules as “a tactical transport plane that is mostly used in joint missions with ground forces: supply missions, equipment transfer, airdropping combat forces and special missions.” The long version of the Super Hercules C-130J can carry 92 paratroopers and their equipment, which exceeds the 64 paratroopers the short version can accommodate. Comments by Israeli defense officials quoted in the Times of Israel suggest that Israel isn’t purchasing “Samson” for humanitarian intervention. The IDF Chief of Staff, Lt. Gen. Benny Gantz, who also attended the arrival ceremony, declared that the C-130J, which can fly close to the ground and land and take-off on primitive airstrips, was of “decisive importance” and would allow Israel to execute “more complex missions, under any conditions, deeper [within enemy territory], faster and more clandestinely.” IAF Commander Maj. Gen. Amir Eshel said that the “diversity of capabilities that the plane represents borders on the imaginary” [sic].

Israel orders its C-130Js, including the Super Hercules, through a Foreign Military Sale (FMS) contract with the US government. Israel’s annual Foreign Military Funding grant from the US signed in 2007 for a ten year period amounts to $3.1 billion to Israel annually (minus about $155 million due to the US government-mandated sequester). Considering that Israeli Prime Minister Benjamin Netanyahu budgeted $2.89 billion for an Israeli military strike on Iran’s nuclear facilities for 2013 and again for 2014, that doesn’t go very far, even when assuming that the Samson is being purchased with an eye toward war with Iran.

With Lockheed’s active involvement, Israel has been able to utilize a scheme called a deferred payment plan (DPP), in combination with a Pentagon process known as cash-flow financing, to make current purchases with deferred debt on favorable terms, to be paid with the FMS grants it is scheduled to receive in future years. Israel used this method to fund Pentagon-administered Foreign Military Sale purchases of Lockheed F-16I and F-35I fighters. Through this creative means of financing, Israel has already earmarked nearly all Foreign Military Funding through 2018 for F-35 fighter jets, heavy troop carriers, airlifters and other equipment.

Now Israel wants to buy — and the Pentagon wants to sell — half a dozen V-22 Ospreys, originally intended for the US Marine Corps serving in Afghanistan. What to do?

On March 20, during a visit to Israel, two members of the Senate Armed Services Committee, Kelly Ayotte (R-NH) and Joe Donnelly (D-IN), told Reuters that, in spite of belt-tightening in Washington, the US will  continue providing Israel with military assistance after its current Foreign Military Financing package of $3.1 billion a year expires in 2017. Ayotte said that talks concerning the 2018-2028 package were already underway. Lockheed Martin is rated a “heavy hitter” among campaign donors by the Center for Responsive Politics’ Open Secrets website. Thus far in the 2014 election cycle, Lockheed has contributed over $1.6 million to members of the Senate and the House of Representatives, about two thirds going to Republicans and the rest to Democrats.

Ten days later, Defense News reported that Israel had agreed to take on more than $2 billion in commercial debt for near-term buys of V-22 tilt-rotor aircraft and other Pentagon-approved weaponry, trusting that the US will provide a 2018-2028 FMF package to foot the bill. Under a US-approved DPP, Israel would pay only interest and fees over the course of the current agreement set to expire in September 2018. The principal of the debt incurred to purchase the Ospreys would be covered by a new Obama-pledged package that would extend annual foreign military financing (FMF) aid through 2028. Lockheed loves the idea, even if the first purchase goes to a competitor. Why? Once the new means of proactive financing kicks in — Israel borrowing against an aid package it hasn’t even received yet, which, following approval, won’t go into effect for five years — Lockheed can expect benefits as well. According to Defense News, “Lockheed is expected to play a pivotal role in the new DPP scheme, which government and industry sources here say will facilitate follow-on procurement of Israel’s second squadron of F-35Is.”

First, it wanted the Senate to pass a binding bill (Kirk-Menendez, or S. 1881) that was certain to sabotage the nuclear negotiations between Iran and the P5+1 (the U.S., Britain, France, China, and Russia plus Germany). When that stalled in mid-January at only 59 co-sponsors, all but 16 of whom were Republicans, it initiated discussions about a non-binding resolution essentially endorsing Kirk-Menendez and laying out the conditions for a final “acceptable” agreement with Iran that was also certain to be rejected by Tehran.

It seems now that AIPAC, whose annual policy conference got underway Sunday and is scheduled to last through Tuesday despite ominous warnings of a new winter storm that may limit its 14,000 attendees’ lobbying capabilities, has been reduced to rounding up senators willing to sign a letter to Obama that softens or eliminates some of its previous language but suggests that some of its key demands — most notably, the abandonment by Iran of all uranium enrichment — may still be a sine qua non for Congressional acquiescence to lifting sanctions if and when a final agreement is reached. Gaining as many signatures on that letter as possible is now the top priority in AIPAC’s legislative agenda (although it will also continue pressing lawmakers to co-sponsor or otherwise support S. 1881).

The proposed letter is currently signed by six senators divided in equal parts between Republicans and Democrats. On the Republican side are Lindsey Graham, who’s been wanting to attack Iran for a really long time now; Mark Kirk; and Kelly Ayotte. On the Democratic side are Robert Menendez, Charles Schumer, and Christopher Coons. Of course, Kirk, Menendez, and Schumer were the three out-front and public co-sponsors of what became know as the Kirk-Menendez bill, while the three other letter signers also became co-sponsors. And, of course, Graham’s co-sponsorship, coupled with his long history of war-mongering, makes it difficult for the letter’s Democrats to indignantly insist, as they have in the past, that the letter is designed to reduce — rather than increase — the chances of war. One has to believe that if AIPAC could’ve gotten one of the Democrats who didn’t co-sponsor S. 1881, they would have preferred him or her to be among the original signatories of the letter. Their absence suggests that the group could run into similar resistance among Democrats even with a much toned-down letter. Indeed, a failure to get more than 59 senators to sign on to a mere letter — which, as I understand it, the administration still strongly opposes due to the baleful impact it could have on the P5+1 negotiations (both on Rouhani’s position and in light of the rapidly rising tensions with Russia over Ukraine ) — would constitute another very serious and highly embarrassing setback for AIPAC amid reports that some of its dissatisfied far-right backers are now mulling the possibility of creating a new lobby group.

But the letter appears to be part of a strategy to overcome that 59-senator threshold. By first asking recalcitrant Democrats to co-sponsor Kirk-Menendez, AIPAC knows it will likely be turned down, at least at this point. But then, by making a second “ask” — to sign a more innocuous-sounding letter — it no doubt believes that a number of Democrats who are uncomfortable about rebuffing AIPAC and/or not sounding “tough” on Iran and/or vesting complete confidence in Obama’s diplomacy strategy at a moment when it is under attack from the right over Ukraine, Syria, etc. etc., will go along in hopes that the Israel lobby will give them a gold star for campaign contribution purposes and not darken their doorway for at least a few months. It seems like a sound strategy, and, if successful, it would help demonstrate to AIPAC’s donors that its effectiveness has not diminished too much, in spite of its recent defeats.

Several points about the letter deserve highlighting:

First, AIPAC has dropped the “wag the dog” provision that called on Washington to provide all necessary help, including military support, to Israel in the event that its leaders felt compelled to attack Iran’s nuclear program. It also forgoes explicit military threats. And, of course, it is non-binding.

Second, it is ambiguous at best about whether its signers find acceptable any final agreement that permits Iran to engage in any uranium enrichment. Its ruling out any recognition of a “right to enrichment”; its demand that such an agreement preclude any “uranium pathway to a bomb;” and its insistence that any agreement cannot lead to any enrichment elsewhere in the region suggest that its authors have not given up on Israel’s “zero-enrichment” position, a stance that the administration and Tehran and Washington’s P5+1 partners all believe is completely unrealistic.

On the other hand, the assertion that there is “no reason for Iran to have an enrichment facility like Fordow” is more intriguing, depending on how you interpret its meaning. It may mean that the enrichment facility at Natanz is kosher, in which case it accepts future Iranian enrichment and demands only that an underground facility like Fordow, which is far more difficult to attack, be dismantled. Or it may mean that it objects to Fordow simply because it is an enrichment facility, thus making Natanz equally objectionable. Indeed, the ambiguity may be deliberate on AIPAC’s part, designed to appeal to those senators who choose to believe that the letter gives the administration the flexibility to accept a limited enrichment program, when, in fact, the letter’s intention is to reduce or eliminate that flexibility.

Third, the letter’s demand that any final agreement “must dismantle Iran’s nuclear weapons program” is tendentious  and provocative, not to mention factually inaccurate, simply because neither U.S. nor Israeli intelligence believes that Tehran has made a decision to build a weapon. What we know — and the Iranian authorities admit — is that it has a nuclear program with elements that could contribute to building a bomb, IF and only IF a decision is made to do so. So how do you dismantle a nuclear weapons program if your intelligence agencies believe there is no such thing?

You may see other problems with the language, the ambiguities of which, as noted above, may be intended to rope senators back into the AIPAC fold and get them to sign on to a letter that could be used against them in the future if they try to stick to the administration’s determination to exhaust diplomatic options. Much will now depend on the attitude taken by both the administration and the ten Democratic Senate chairs who came out early and strongly against a vote on Kirk-Menendez.

Dear Mr. President:

As representatives of the P5+1 and the Iranian government prepare to enter another round of negotiations to verifiably end Iran’s nuclear weapon program, we reiterate the four strategic elements articulated by 76 Senators to you on August 2, 2013 necessary to achieve resolution of the nuclear issue: (1) an explicit and continuing message that we will not allow Iran to acquire a nuclear weapons capability, (2) a sincere demonstration of openness to negotiations by Iran, (3) the maintenance and toughening of sanctions, and (4) a convincing threat of the use of force.

We support your efforts to explore a diplomatic opening, but we believe that the true test of Iranian sincerity is a willingness to match rhetoric with actions. The critical test will be Iran’s proposal to the P5+1 this week in Geneva. Iran’s first confidence-building action should be full cooperation with the International Atomic Energy Agency, fulfillment of its responsibilities under the Nuclear Nonproliferation Treaty, and implementation of all Resolutions passed by the United Nations Security Council regarding Iran’s nuclear weapons program, to include immediate suspension of all enrichment activity. If the Iranian government takes these steps in a verifiable and transparent manner, we are willing to match Iran’s good-faith actions by suspending the implementation of the next round of sanctions currently under consideration by the Congress. In short, the U.S. should consider, with the other members of the P5+1, a “suspension for suspension” initial agreement – in which Iran suspends enrichment and the U.S. suspends the implementation of new sanctions.

For the P5+1 states, such an agreement would ease concerns that Iran is using the talks as a subterfuge while its centrifuges spin and for Iran it would suspend critical additional sanctions on its key economic sectors.

The intent of sanctions is to force Iran to halt and dismantle its nuclear weapons program. Once this goal has been accomplished in a real, transparent, and verifiable way we will be prepared to remove existing sanctions in a measured, sequenced manner. However, at this time, we reaffirm that a credible military threat remains on the table and we underscore the imperative that the current sanctions be maintained aggressively, and call on you to increase pressure through sanctions already in place.

A nuclear weapons capable Iran threatens regional stability and international security and directly threatens U.S. national security interests. As we previously cautioned, Iran has historically used negotiations to affect progress on its nuclear weapons program. We must continue to realistically evaluate Iranian intentions, and we reiterate that the centrifuges cannot be allowed to continue spinning.

We reject Iranian statements that Iran should be able to continue enrichment in its own territory. Indeed, this is not a prerequisite for a peaceful nuclear energy program. Countries from Canada, to Mexico and South Africa benefit from peaceful nuclear energy programs, without indigenous enrichment programs. Iran does have a right to a peaceful nuclear energy program; it does not have a right to enrichment.

We remind you that the U.S. Department of State has characterized Iran as “the most active state sponsor of terrorism” and to be sure, verifiable dismantlement of the Iranian nuclear weapons program will not resolve the Iranian government’s deplorable abuse of basic human rights, denial of basic civil freedoms, or its ongoing activities that seek to destabilize the region.

We remain hopeful that talks next week in Geneva lead to concrete Iranian actions to prove to the world that Iran does not seek a nuclear weapons capability. However, if Iranian actions fail to match the rhetorical reassurances of the last two weeks, we are prepared to move forward with new sanctions to increase pressure on the government in Tehran.
