Many analysts have stated that sanctions relief must be on the table if the goal is to entice Iran to make serious compromises. In July, former top CIA analyst Paul Pillar explained why the “Nothing-But-Pressure Fallacy” is doomed to fail:

 …And the story of stasis in the nuclear talks is also pretty simple. The Iranians have made it clear they are willing to make the key concession about no longer enriching uranium at the level that has raised fears about a “break-out” capability in return for sanctions relief. But the P5+1 have failed to identify what would bring such relief, instead offering only the tidbit of airplane parts and the vaguest of suggestions that they might consider some sort of relief in the future. The Iranians are thus left to believe that heavy pressure, including sanctions, will continue no matter what they do at the negotiating table, and that means no incentive to make more concessions.

This worrying development only adds to potential impediments already standing in the way of significant headway being made during the diplomatic process. Iran analyst Trita Parsi discusses “Three Worries about the Next Iran Talks” in Al-Monitor, such as grandstanding versus statemanship, which both the US and Iran are certainly prone to:

…Iran can’t expect that merely stopping enrichment at the 20% level will be sufficient to close the Iranian file and lift all sanctions. At the same time, lifting of both US and EU sanctions must be part of the solution. In previous rounds, Washington refused to put sanctions relief on the table, thinking — innocently perhaps — that pressure alone would bring the Iranians to compromise. Obama administration officials have told experts in Washington that it will likely go back to the table with the same package as in the summer; that is, with no sanctions relief. European diplomats, while admitting that no deal is possible without sanctions relief, tell me that they do not expect any sanctions to begin to be lifted until late 2013 at the earliest. Continued refusal to make sanctions relief part of the mix from the outset will prove to be a decisive mistake.

QUESTION: I want to ask you about Iran, and to speak with the same kind of candor you did about Syria. This morning, Dennis Ross said that he thought this year was going to be a decisive year. Apparently, one of the U.S. representatives in Vienna today said that we’re talking about a March deadline – if you could explain that a little bit further.

And tell us realistically what prospects you think there is for compromise with Iran, given the past year of efforts by the United States.

And also, if you believe that Israel is fully on board in letting the United States take the lead and not going off on its own path.

SECRETARY CLINTON: Well, as to the last question, I’m not going to speak to any country’s security decisions other than our own. Obviously, that’s up to Israel to decide. However, I will say that we continue to believe that there is still a window of opportunity to reach some kind of resolution over Iran’s nuclear program. Now, I’m not a wild-eyed optimist about it, but I think it’s imperative that we do everything we can – unilaterally, bilaterally, multilaterally – to test that proposition.

I think what was meant about the March reference was either about the IAEA and its continuing work or the fact that we finished our election and now would be a good time to test the proposition that there can be some good-faith serious negotiations before the Iranians get into their elections, which are going to heat up probably around the March period, heading toward a June election.

I think that it’s a difficult matter to predict, because it really depends upon how serious the Iranians are about making a decision that removes the possibility of their being able to acquire a nuclear weapon or the components of one that can be in effect on a shelf somewhere and still serve as a basis for intimidation.

We get differing reports, as I’m sure you have seen, as to how serious the Supreme Leader is about that, but we want to test the proposition. This President came into office saying he was prepared to engage with Iran, reached out to Iran, without much reciprocity. We put together this unprecedented coalition to impose these very tough sanctions on Iran. We know they’re having an effect internally. But I think that we’ll see in the next few months whether there’s a chance for any kind of a serious negotiation. And right now, I’m not sure that it can happen, but I certainly hope it does.

Mostafa Dolatyar, a career Iranian diplomat who heads the Iranian think tank, the Institute for Political and International Studies (IPIS), which has close ties to Iran’s foreign ministry, was tapped by Iran’s leadership to coordinate contacts with American outside-government policy experts, including those with former senior US officials involved unofficially in relaying ideas for shaping a possible nuclear compromise, the analysts told Al-Monitor in interviews this week. The IPIS channel is for coordinating non-official US contacts, which in the absence of formal diplomatic ties, have formed an important, if not unproblematic, part of Iran’s diplomatic scouting and Washington’s and Tehran’s imperfect efforts to understand and influence each others’ policy positions.

The appointment is the result of a desire “on the Iranian side for a more structured approach to dealing with America,” Mark Fitzpatrick, an Iran nuclear expert at the Institute for International and Strategic Studies (IISS) in London, told Al-Monitor in an interview Monday, adding that he now doubts that there are agreed plans for direct US-Iran talks after the elections.

But last week former top CIA South Asia specialist Bruce Reidel warned that Iran is sending signals that it will respond forcefully to attacks:

Iran’s capabilities to inflict substantial damage on the Saudi and other gulf-state oil industries by cyberwarfare are difficult for outsiders to assess. Iran is a relative newcomer; until now, it has been mostly a victim. Iranian and Hizbullah abilities to penetrate Israel’s anti-missile defenses are also hard to estimate. Those defenses are among the best in the world, thanks to years of U.S. military assistance and Israeli ingenuity. So it is hard to know how hard Iran can really strike back if it is attacked. Bluffing and chest-thumping are a big part of the Iranian game plan. But the virus and the drone together sent a signal, don’t underestimate Iran.

Presuming the reports are true, it appears the Iranians are making a show of strength prior to the talks, just as the US has with its relentless sanctions regime. This may be because the Iranians want to put more pressure on their negotiating partners to offer a mutually acceptable settlement, or, as Iran hawks claim, because they are stalling for more time to develop a bomb to unleash against the world. While the latter scenario is certainly flashier, it doesn’t exactly square with the facts.

But progress in the next round of talks is still a possibility, according to the Arms Control Association’s Daryl Kimball. “Whatever happens after the election, the most important thing is that the P5+1 process resumes and that it be a much more dynamic negotiation that is not simply a reiteration of previous well-understood positions,” he said in an interview with the Council on Foreign Relations.

Iran expert and Lobe Log contributor Farideh Farhi meanwhile warns that inflexibility on both sides will impede a peaceful resolution to this decades-long dispute:

The reality is that the current sanctions regime does not constitute a stable situation. First, the instability (and instability is different from regime change as we are sadly learning in Syria) it might beget is a constant force for policy re-evaluation on all sides (other members of the P5+1 included). Second, maintaining sanctions require vigilance while egging on the sanctioned regime to become more risk-taking in trying to get around them. This is a formula for war and it will happen if a real effort at compromise is not made. Inflexibility will beget inflexibility.

Despite the failure of the Tehran Declaration, Turkey’s experience negotiating with Iran lends strength to [Mustafa] Kibaroglu’s argument for Turkey’s inclusion. Ankara demonstrated it can work with Tehran. Additionally, in June 2010 Turkey was one of two countries that voted against UN Security Council Resolution 1929, which imposed sanctions on Iran for failing to comply with early resolutions regarding its nuclear program. Given the animosity spurred on by the current sanctions, Iran may be more willing to work with Turkey than the members of the P5+1.

In addition, Kibaroglu reminds us that Israel is not the only Middle Eastern country that would be threatened by Iran obtaining nuclear weapons and that other regional perspectives on the security environment need to be considered. According to him, a nuclear armed Iran would be the “game changer” that affects the relationship between the two countries and tips the balance of power in Iran’s favor.

While Turkish inclusion in the P5+1 may not be the creative solution that revives the negotiations with Iran, Kibaroglu’s recommendations serve as an important reminder that there is no “one size fits all” formula for diplomatic negotiations. If the current P5+1 track does not achieve a breakthrough, it does not mean that negotiations have failed. Rather, that it is time for diplomats to get creative and consider alternative options, such as exploiting the good offices of new parties, to find a solution to the Iranian nuclear question.

The International Atomic Energy Agency (IAEA) report made public Thursday reveals that Iran has actually reduced the amount of 20-percent enriched uranium available for any possible “breakout” to weapons grade enrichment over the last three months rather than increasing it.

Contrary to the impression conveyed by most news media coverage, the report provides new evidence that Iran’s enrichment strategy is aimed at enhancing its bargaining position in negotiations with the United States rather than amassing such a breakout capability.

The reduction in the amount of 20-percent enriched uranium in the Iranian stockpile that could be used to enrich to weapons grade is the result of a major acceleration in the fabrication of fuel plates for the Tehran Research Reactor, which needs 20-percent enriched uranium to produce medical isotopes.

That higher level enriched uranium has been the main focus of U.S. diplomatic demands on Iran ever since 2009, on the ground that it represents the greatest threat of an Iranian move to obtain a nuclear weapon capability.

When 20-percent uranium is used to make fuel plates, however, it is very difficult to convert it back to a form that can enriched to weapons grade levels.

When data in the Aug. 30 IAEA report on the “inventory” of 20-percent enriched uranium is collated with comparable data in the May 25 IAEA report, it shows that Iran is further from having a breakout capability than it was three months earlier.

The data in the two reports indicate that Iran increased the total production of 20-percent enriched uranium from 143 kg in May 2012 to 189.4 kg in mid-August. But the total stockpile of 20-percent enriched uranium that could be more easily enriched to weapons grade – and which has been the focus of U.S. diplomatic demands on Iran ever since 2009 – fell from 101 kg to 91.4 kg during the quarter.

The reduction in the stockpile available for weapons grade enrichment was the result of the conversion of 53.3 kg of 20-percent enriched uranium into fuel plates – compared with only 43 kg in the previous five months.

Iran was thus creating fuel plates for its medical reactor faster than it was enriching uranium to a 20-percent level.

But although that reduction of the stockpile of enriched uranium of greatest concern to the United States was the real significance of the new report, it was not conveyed by the headlines and leads in news media coverage. Those stories focused instead on the fact that production of 20-percent enriched uranium had increased, and that the number of centrifuges at the underground facility at Fordow had doubled.

“Nobody has put out the story that their stockpile is shrinking,” said Joe Cirincione, president of the Ploughshares Fund and a leading independent specialist on nuclear weapons policy, in an interview with IPS.

David Sanger and William Broad of the New York Times asserted in an Aug. 30 story that Iran had “doubled the number of centrifuges installed” at Fordow and had “cleansed” the site where the IAEA believed there had been nuclear weapons development work. The story made no reference to fuel plates or the effective stockpile of 20-percent enriched uranium.

A second story by Sanger and Jodi Rudoren on the same day, datelined Jerusalem, was even more alarmist and inaccurate. It declared that the nuclear programme was “speeding up” and that Iran was “close to crossing what Israel has said is its red line: the capacity to produce nuclear weapons in a location invulnerable to Israeli attack.”

Reuters and AP stories also focused on the doubling of centrifuges as the main message in the IAEA report, and Reuters also said Iran “seems to be struggling to develop more efficient nuclear technology that would shorten the time it would need for any atom bomb bid”.

The Washington Post headline said that Iran was “speeding up” uranium enrichment, and the lead said Iran had “substantially increased the production of a more enriched form of uranium in recent months”. But in the second paragraph, it added, somewhat cryptically, that Iran “appeared to take steps that would make it harder to use its uranium stockpile to make nuclear bombs”.

Only a few paragraphs later was it made clear that the lead was misleading, because the IAEA had found that Iran had “converted much of the new material to metal form for use in a nuclear research reactor.” It even quoted an unnamed Barack Obama administration officials said it could not be “further enriched to weapons-grade material….”

In fact the IAEA data showed that it had converted all of the uranium enriched to 20 percent during the quarter to fuel plates, and had converted some of the production from previous quarters as well.

The media reports of a doubling of the number of centrifuges at the underground facility at Fordow were also misleading. When the information is examined more carefully, it actually provides further evidence that Iran is not striving to amass the higher level uranium needed for a breakout capability but is maneuvering to prepare for a later negotiated settlement.

Although the IAEA report shows that the number of centrifuges in place in Fordow has increased from 696 to 2,140 over the past six months, it also makes it clear that the number of centrifuges actually operating has not changed during that period.

The reason for that striking anomaly in the deployment at Fordow does not appear to be technical problems with the centrifuges. The 1,444 centrifuges that are not operating were never even connected by pipes, as the Institute for Science and International Security (ISIS) observed in its Aug. 30 commentary on the report.

The noncommittal character of the deployment of centrifuges at Fordow suggests that Iran has not decided whether those 1,444 centrifuges are to be committed to 3.5-percent enrichment or to 20-percent enrichment.

The Obama administration appears to understand that this uncertainty about the purpose of the centrifuges is aimed at strengthening Iran’s diplomatic hand in future negotiations. “They have been very strategic about it,” a senior U.S. official told the New York Times just before the report was made public. “They are creating tremendous capacity, but they are not using it.”

The official added, “That gives them leverage, but they think it also stops short of creating the pretext for an attack.”

Cirincione agrees with that senior official’s analysis. “The Iranians are excellent chess players. They are moving their pieces very carefully,” he said. “They are continuing to enhance the value of their bargaining chips.”

The implication of the IAEA report, Cirincione believes, is that Iran is still maneuvering to position itself for a more advantageous agreement in future negotiations. “If you were the Iranians, why would you negotiate right now?” asked Cirincione. “You would want to wait for a better deal.”

In previous rounds of negotiations with Iran in 2012, the United States demanded an end to all 20-percent enrichment and even the closure of the Fordow facility but offered no alleviation of the harsh financial sanctions now being imposed on Iran.
