Once again, in his speech Wednesday at the United Nations, President Obama revealed the reduced importance of the Israeli-Palestinian conflict on his agenda. He also revealed just how out of touch his entire country is with respect to reality.

The Israel-Palestine conflict was the last specific global issue mentioned by Obama in his address to the UN General Assembly, and his wording was straight out of the playbook. It was also only mentioned briefly and without any hint that the United States would be taking any action at all on the issue.

Here’s what he said:

Leadership will also be necessary to address the conflict between Palestinians and Israelis. As bleak as the landscape appears, America will never give up the pursuit of peace. The situation in Iraq, Syria and Libya should cure anyone of the illusion that this conflict is the main source of problems in the region; for far too long, it has been used in part as a way to distract people from problems at home. And the violence engulfing the region today has made too many Israelis ready to abandon the hard work of peace. But let’s be clear: the status quo in the West Bank and Gaza is not sustainable. We cannot afford to turn away from this effort – not when rockets are fired at innocent Israelis, or the lives of so many Palestinian children are taken from us in Gaza. So long as I am President, we will stand up for the principle that Israelis, Palestinians, the region, and the world will be more just with two states living side by side, in peace and security.

Could this have been any emptier? Just last month, Israel and Hamas were engaged in the biggest uptick in violence since the Second Intifada was in full swing.

The message from Obama comes through, though: We’re no longer interested in forcing the parties to the table. The subtext behind that is a US surrender to the stubbornness of the far-right wing government running Israel these days. The US will stop pressuring Israel for talks, and indeed, it already has. The question this raises, of course, is how the Obama administration will respond when and if the Palestinian Authority makes good on its repeated threats to bring this issue to the UN and the International Criminal Court.

In such a case, Obama will undoubtedly condemn the Palestinians’ “unilateral action”de facto US policy dictates that when the Palestinians take action, it is to be condemned, but when Israel does the same thing, it is, at worst, “unhelpful.” Yet the real question for the Palestinians is whether the United States will have any other response outside of some pro forma public statement. Obama’s hands-off approach seems to imply that it will not, though Palestinian President Mahmoud Abbas would be unwise to count on that.

But there’s another piece of this statement worth examining. Obama said, as he has many times, that the situation is unsustainable. He also notes that one myth that has long been held by many has been exposed as false by recent events: the notion that Palestine is the key source of instability in the region.

Obama is correct about the exposed old myth, but he merely spouts another in its place. Of course the occupation will not remain the same as it is today. It has changed some of its characteristics, almost always to the detriment of the Palestinians, many times since 1967. But the essence of the matter, the relationship between an occupying power and an occupied people locked in a conflict over land, rights, narratives, nationalism and competing claims of justice, has endured quite well over those years.

The Israeli right-wing was long aware, and often stated, that their subjugation of the Palestinians was not the main cause of instability in the region. Of course, there was a time when there was a much stronger argument for that myth. When the many Arab regimes, throughout most of the 20th century, were comfortably entrenched in power, things were pretty stable, as they often are under dictatorships that maintain their control. Under those circumstances, the cry of “Free Palestine” was heard much more loudly, as it was the only one the dictators would permit. Due to many factors (especially the US invasion of Iraq), that stability was shattered and, as one would expect, much of the Arab world, while not forgetting the Palestinians, demonstrated a focus on the miserable conditions they themselves were living in, and conflicts within their own countries. Thus, the myth was exposed.

But we need no shakeup like the Arab Awakening to see that the claim that the occupation is “unsustainable” is a myth. We really need only see that it has endured for more than 47 years, and when circumstances did threaten the status quo, Israel adapted its occupation to meet those circumstances. The most obvious example of that is the massive tightening of the occupation and even more massive expansion of settlements that constituted Israel’s response to the Oslo Accords.

Of course, it is a truism that any oppressive regime eventually meets its demise. That is clearly not what Obama means when he calls the occupation “unsustainable.” Rather, he means what so many others mean: Israel cannot continue to hold millions of Palestinians without rights. But, like so many other myths around Israel-Palestine, this one doesn’t bear scrutiny. Israel has done this for 47 years, and can do it for the foreseeable future. The demise of the occupation regime will come, as the demise of all regimes eventually come. But there is nothing particularly unsustainable about this one.

The Israeli right has become the Israeli mainstream, and they are busily coming up with ideas for how to sustain this occupation or, as Foreign Minister Avigdor Lieberman likes to put it, to “manage” the conflict. They recognize that the fear, ingrained in the thinking of many of the early Zionist philosophers of a Jewish Israel ruling over a majority of disenfranchised Muslim and Christian Arabs is unfounded. It turns out that contrary to the expectations of the early Zionist thinkers, Israelis can live with denying rights to Arabs, and the world is prepared to tolerate it, despite the clucking of tongues it evokes.

This issue can be traced back all the way to Theodor Herzl, and it was actively dealt with by Israel’s first Prime Minister David Ben-Gurion and, most notably, by the person in charge of land acquisition for the Jewish National Fund both before and after the State of Israel was established, Yoseph Weitz. In modern times, this notion has been expressed as a “demographic time bomb,” most notably by Netanyahu’s predecessor, Ehud Olmert.

But there’s no reason to believe this is really a problem. After all, according to the February 2014 report of Israel’s Central Bureau of Statistics, there are about 6,119,000 Jews in Israel and the West Bank. Between the West Bank, Gaza and Israel, there are some 5,894,631 Palestinians, according to the CIA World Factbook. Given the different population growth rates, Palestinians will be a majority very soon, but the day that happens, what is going to change? On the ground, in day to day life, what will be different than the day before?

The answer, of course, is that nothing will change and the Israeli right wing understands this. The United States, on the other hand, does not appear to. More to the point, the many activists who believe that Jews going from 51% of the population to 49% of it will suddenly mean that Israel is an apartheid state, as both Olmert and another former Prime Minister, Ehud Barak warned, also do not understand that when that line is crossed nothing will change. Nothing will change when that so-called demographic time bomb goes off.

So, while right wing leaders like Naftali Bennett consider ways to continue to “manage” the Palestinians indefinitely, Obama and a great any others, in the United States, Israel, Europe and even some among the Palestinians, continue to engage in myth-making and wishful thinking.

If this conflict is ever to be resolved, the only path to it entails full acknowledgment of the realities, on the ground, in the international diplomatic sphere and in politics. Anyone who truly believes that the demographic counter clicking down to under 50% Jewish will somehow shock the Israeli people and their government into recognizing the injustice of the occupation is engaging in fantasy. Such demographic changes are gradual, and this cushions the change so it is not a shock. In 1960, Whites, who were always an overwhelming minority, made up less than 20% of the population of South Africa, and Jews are unlikely to ever be anywhere near that small a minority in Israel-Palestine.

This is only one of many myths that need to be abandoned for any kind of resolution to be possible. It’s no less important to dispel these fanciful notions than it is to counter the stereotypes of Palestinians that are so widely held in the United States, Israel and elsewhere (like “they just want to kill the Jews” for instance). One way we will know people are serious about taking on this vexing conflict is when we see them abandon false notions and recognize that Israel-Palestine can contribute to a better world simply by ending the injustice and violence. When that’s the motivation, and it is applied to both sides, we’ll be getting somewhere.

Expressions of angst over Syria have entailed several themes, one of which concerns possible “spread” of the Syrian civil war into nearby states. Lebanon, for reasons of physical and ethnic geography, is most often mentioned as a locale of such spreading. But at least as useful as speculation about what the Syrian civil war may do to Lebanon is to reflect on how current events in Syria are echoing an earlier civil war in Lebanon. We have been through much of this before—thirty years ago, when Ronald Reagan was president.

By the early 1980s Lebanon had been suffering several years of combat among sectarian militias, reflecting disagreement over the fairness of old power-sharing agreements among the confessional communities. The biggest stirring of this already turbulent pot came in 1982 when Israel invaded Lebanon. The principal Israeli targets—declared targets, at least—were fighters of the Palestinian Liberation Organization who had been in Lebanon ever since being kicked out of Jordan a decade earlier, after losing the Black September confrontation with King Hussein. A small multinational force of U.S., French, and Italian troops entered Lebanon in August 1982 and supervised the extraction of the PLO to Tunisia before itself withdrawing to ships in the Mediterranean.

Israeli objectives were not limited just to booting the PLO out of Lebanon, however, and Israeli forces remained enmeshed in the sectarian fighting, besieging Beirut. Menachem Begin had ideas about trying to maintain a client to the north in the form of the pro-Israeli Christian government of Bachir Gemayel, who became president about when the PLO was leaving. Three weeks later Gemayel was assassinated, triggering the most horrid blood-letting of the Lebanese war. At least several hundred—and by some outside estimates perhaps something closer to 2,000—Palestinian civilians were slaughtered in the Sabra and Shatila refugee camps. The massacre was carried out by the Christian Phalangist militia, which was allied to and supplied by the Israelis. Israeli forces, whether wittingly or not, facilitated the massacre by maintaining a cordon around the area of the camps, and fired illuminating flares that enabled the Phalangists to continue their work by night.

The massacre stimulated the Reagan administration to organize a new multinational force that eventually included 1,800 U.S. marines as well as French and Italian troops. The force initially had some success in acting as a buffer between contending elements. But the intervention later became a textbook example of the near-inevitability of getting drawn into ever costlier commitments and endeavors in any situation as messy as Lebanon at that time. U.S. military engagement included not only the marines on the ground but also combat between carrier-based U.S. aircraft and Syrian forces (which had originally entered Lebanon as part of an Arab League peacekeeping force). At one point even the 16-inch guns of the battleship New Jersey were brought into action.

Those striking back at the increasingly resented foreign forces used methods against which jet fighters and battleships are of little use. In April 1983 a truck bomb was detonated at the U.S. embassy in Beirut, killing 63 persons. Six months later, another truck bomb was used against barracks housing U.S. troops (along with an identical and simultaneous attack against French troops). 241 U.S. servicemen were killed in that bombing—the deadliest terrorist attack against U.S. citizens until 9/11. Congressional pressure on the administration to withdraw from Lebanon increased. The last U.S. forces left in February 1984. The Lebanese civil war continued for several more years until sheer exhaustion, and a new political accord brokered by Saudi Arabia and Syria, brought it to an unsatisfying end.

Some parallels between that experience and the current situation regarding Syria are obvious. There is the overall complexity of the conflict and the presence of bad guys all around. There also is Israel taking advantage of a neighboring state’s civil war to pursue its own objectives, whether those are to smash a Palestinian force or to intercept long-established Hezbollah supply lines, regardless of how much its actions stoke and escalate the war. And if much of the discourse in Washington about Syria since the (presumed) Israeli attacks there over the past few days are any indication, there again is the pattern of Israeli actions increasing the chance of the United States getting sucked into the mess.Let us hope that those eager to get into the mess will reflect more than the statesmen of 1982 did about how this all will end. Moreover, those who talk about damage to U.S. prestige or credibility also ought to think about that aspect of the experience in Lebanon.

There is no way to sugar-coat that conclusion. It was just the sort of caving in to bad guys that we so often hear that we need to avoid. And it could have been avoided in Lebanon if the United States had not gotten involved in the mess in the first place, or at least if Israel had not—in its futile pursuit of absolute security for itself regardless of the insecurity it causes for everyone else—made the mess worse.

In recent weeks, a few incidents have begun to raise questions about the vaunted power of the so-called “Israel Lobby” and whether its influence might be waning. First there were the AIPAC-backed congressional bills that sought to level sanctions on the Palestinian Authority to punish it for having gone to the United Nations in seeking and winning an upgrade in their status to one that implied statehood and granted it a few more rights in the international system. Those bills both died before reaching the floors of the Senate and House of Representatives. More recently, there was the row over Chuck Hagel’s nomination as Secretary of Defense. That nomination went forward and it has since become evident that, despite some disparaging comments from a few Senators, Hagel is likely to be confirmed.

Those aren’t small failures for “the Lobby”, but the circumstances around them should be examined to put them in context. The two events do indicate the potential beginnings of a shift in the discourse around US policy in the Middle East, but it’s important not to make more out of this than there is.

On the matter of punishing the PA, the Jewish Telegraphic Agency mused on the significance of the fact that AIPAC found itself opposed by the Reform movement, the largest American Jewish denomination, led by the Union for Reform Judaism. This was unusual, not because more liberal Jewish organizations might disagree with AIPAC, but because they would actually advocate an opposing position in public. This supports the notion that the new “pro-Israel, pro-peace” lobbying group, J Street, has indeed opened up some space for discussion within the pivotal Jewish community about how the US might respond to events between Israel and the Palestinians.

This shouldn’t be exaggerated, however. J Street, for one thing, has also put itself into a position of redefining the boundaries of acceptable discourse, not necessarily opening it up. This was evidenced last year when J Street made clear its opposition to Christian groups taking any action that might put a small amount of pressure on the Netanyahu government to change its obstructionist stances. First there was J Street’s opposition to a Presbyterian initiative to divest from the occupation (carefully worded to avoid divestment from or boycott of Israel itself) and later its condemnation of a letter from church leaders calling for a review of whether US military aid to Israel was being used to support settlements and occupation and therefore violated US law.

This latest episode, while demonstrating that J Street has had impact in somewhat moving the boundaries of discourse, was not about policy, but about tactics. On one hand, AIPAC pushed for punitive measures to address what Israel saw as a grievance. On the other, the Reform movement took up the J Street line, which said that the proposed punishment would undermine Israeli interests. None of this challenges policy; it merely reflects a disagreement about how best to serve Israel’s interests.

On the Hagel nomination, AIPAC’s silence was deafening from the start. The opposition was led entirely by radical neoconservatives like Elliott Abrams, Bill Kristol and, organizationally by the demonstrably marginal Emergency Committee for Israel. Still, more mainstream Jewish leaders like Abraham Foxman of the Anti-Defamation League and David Harris of the American Jewish Committee, as well as leading Senate Republicans Mitch McConnell, John McCain and Lindsey Graham, expressed opposition to Hagel’s nomination.

But AIPAC understood that this was not a winning fight from the beginning and stayed out of it, at least in terms of the public arena. Leading Jewish Democrats also stayed silent or expressed support for Hagel. J Street supported Hagel, which was only natural since Hagel had spoken at one of their conferences, and the Israeli government, still reeling from backing the wrong horse in the presidential election, made it clear they were not going to oppose him.

AIPAC is really good at what it does. One of its chief skills has always been avoiding fights it won’t certainly win. It never intended to get into a fight over Hagel, so it left the fight to extremist groups like the ECI. But do these two incidents show that the Lobby is losing its grip?

I would emphasize the extent to which the Lobby operates on fear. I don’t mean to suggest that it doesn’t wield real power, it does. But that power is greatly magnified by two factors: the lack of an opposing force and an exaggerated belief in the extent of that power.

We are starting to see the waning of the Lobby’s power. Some of this is due to J Street in a small way, but in the end they will be replacing one problem with another if they succeed, as explained above. But the fact that there is a much greater light shining on the Lobby helps put their real power in perspective. It started with Stephen Walt’s and John Mearsheimer’s groundbreaking work, and has continued to the point where we now see columnists ranging from Glenn Greenwald and Andrew Sullivan to Thomas Friedman openly discussing the lobby’s power.

I will use the dreaded word anti-Semitism here, because it has long been my view that, while outside observers gauge the Lobby’s power by the extent to which it has influenced US policy (an accurate measure), on the Hill, a lot of the belief in the Lobby’s power is a self-fulfilling prophecy that is based only in varying degrees on the Lobby’s actual successes and mostly on a long-held myth and belief that “the Jews” hold far more power than they do, as has been the case for centuries.

The Lobby possesses real power, but that power has taken on an almost mythical status. That’s partly because of a near absence of a counter to the Lobby. J Street and a few other groups are finally starting to create that, but it remains minimal for now. The lobby’s main focus is also foreign policy, which is rarely high on a Congress member’s list of priorities when he or she thinks about re-election. They would rather focus on domestic initiatives that actually matter to their voters than take on the Lobby. But it is also true that the Lobby’s past successes scare people more than they should. Few Jews, much less any other group of US citizens, cast their votes based on Israel, one way or the other.

The myth of exaggerated Jewish power, rooted in classical anti-Semitism, is also starting to be revealed for the sham it is. Yes, Jews make up a vastly disproportionate piece of the Democratic donor base, but consider this: in the 2012 election cycle, pro-Israel PACs contributed a total of just over $12 million. Of that money, a little more than $1 million came from J Street’s PAC. Mitt Romney and Barack Obama split about $1.43 million just about evenly. Between the two of them, they spent over $1.1 billion. Yes, individual Jewish donors give quite a bit, but poll after poll shows that Jews don’t vote based on Israel. A few major individual donors might give on this basis (Sheldon Adelson on the Republican side, Haim Saban for the Democrats), but this by itself cannot explain the slavish devotion shown in Washington to Israel. What can explain it is the prevailing myth that Jews and Jewish money are fully tied to Israel policy and are a pivotal pot of gold in election cycles. This anti-Semitic myth has been, ironically, perpetuated by virtually every major Jewish organization with AIPAC in the lead. Whether it’s true or not, the belief that it’s true has made it so.

But as this myth is revealed to be the smoke and mirrors that it is, so too are some of the effects of the Lobby’s history in elections blunted. And as more critical narratives across a broad spectrum of media arise, so too is the Lobby’s real power affected. We’re still missing an actual c4 lobby that can raise significant funds and advocate for Palestinian interests (as opposed to “peace,” two states or peace for Israel’s sake — that is, a lobby which, like the Israel Lobby, advocates for Palestinian interests alone). But existing factors are indeed changing the game. Too slowly, for sure, and these are all gains that can be wiped out and even reversed in a very short time. But it’s the first time since 1987 that I can recall seeing the Lobby’s influence taking a step back.

Slowly but surely, debate over US policy in the Middle East is starting to open up, and the machinations of AIPAC and the Lobby are being revealed, making it more difficult for it to operate. As a US Jew, I am also gratified to see that the exaggerated perception of Jewish power is beginning to wane. These are small steps and don’t indicate that things are going to change profoundly any time soon. But they are seeds for a more rational US policy and that gives me hope.

No less than three amendments were brought in the Senate, to be attached to the National Defense Authorization Act (NDAA) — a bill which has nothing to do with Israel and the Palestinians, but is a high-priority bill that the Senate must pass, and as such is a perfect target for frivolous amendments).

Two of the amendments are purely partisan and with a Republican minority in the Senate, they are unlikely to pass. The third, however, is bipartisan and the leading Democrat sponsoring it is Charles Schumer (D-NY) whose position as the Democrats’ lead fundraiser means he gets his senate colleagues’ attention. The partisan amendments are somewhat more draconian than the bipartisan one, which will make the bipartisan amendment look relatively moderate, thereby increasing the chances of its passage.

Along with Schumer, the amendment is sponsored by Lindsey Graham (R-SC), John Barrasso (R-WY) and Bob Menendez (D-NJ). It calls for the closure of the Palestine Liberation Organization’s (PLO) office in the US unless the Palestinians return to talks with Israel. No timeframe is given for the return to talks, nor is there any mention of anything Israel must do to make that return politically feasible for the Palestinians. This amounts to an attempt to force the Palestinians back into talks on Bibi Netanyahu’s terms, which, as I explain here, would be political suicide for the Palestinian Authority (PA).

The more important clause, however, would end all aid — with no provision for a presidential national security waiver — to the Palestinian Authority if it or any entity “that purports to represent the interests of the Palestinian people” should ever bring a case, or even support one brought by someone else, that the International Criminal Court (ICC) adjudicates. Access to the ICC is the biggest tangible gain the Palestinians got from their upgraded UN status, and this amendment is an attempt to ensure that it is useless. Significantly, according to the way the amendment is written, the aid cutoff would be automatically triggered even if the Palestinians support another case or if some other entity brings a case on the Palestinians’ behalf.

This may be only the beginning of legislative activism aimed at punishing the Palestinians for their UN move. The American-Israel Public Affairs Committee (AIPAC) also issued a memo that echoed the condemnation of the Palestinian action from US officials starting with President Obama; painted an extremely distorted picture of the circumstances around and meaning behind the PLO’s move; and made a list of “recommendations” for the US government to follow. These include pressuring Mahmoud Abbas to refrain from similar actions in the future, “…demonstrate to the PLO that unconstructive unilateral actions have consequences;” close the PLO office in DC; and threaten aid to the Palestinians.

It’s standard procedure for such bills that AIPAC be at least consulted on its contents and this certainly would have been the case for a response to the UN vote. The presence of AIPAC talking points in the bill leaves little doubt about its influence; the fact that AIPAC’s own statement is much broader implies this is not the end of such legislation. In announcing their memo, Ron Kampeas at the Jewish Telegraphic Agency reports that AIPAC in fact called for a “full review” of the U.S. relationship with the PLO.

AIPAC tries to push a point frequently made in the run-up to the UN vote — that Congress will cut off all aid to the PA if the PLO pursues gains at the UN. In fact, Congress has only mandated such cut-off if Palestine becomes a full member state of the UN, something the US can easily prevent because it requires Security Council certification. Still, it is clear that AIPAC is determined to punish the Palestinians in some way. Whether or not they are willing to risk the PA’s collapse — something the Obama Administration certainly wants to avoid, as does, quite likely, the Netanyahu government (at least currently) – remains to be seen.

Even granting that there was a good deal of lead time before the UN vote, it’s still worth noting how quickly Congress jumped to respond. It would be nice if they were so quick to respond to matters that are far more pertinent to US citizens, like, oh, the “fiscal cliff” for example. Maybe we can get AIPAC to push them on that.

The vote in the United Nations General Assembly on the Palestinian application for non-member status is a foregone conclusion. They’re going to win and it’s not really going to matter much, at least in the short term. Nonetheless, the decidedly warped world of diplomacy around the Israel-Palestine conflict has managed to give us a small degree of drama around the bid, which is also illustrative of why there seems to be so little hope for change.

I posted a draft of the resolution on my blog earlier this month. You can see the final version here (pdf). There is simply nothing there that anyone with even the mildest interest in resolving the conflict could have the slightest objection to. This says a lot about where Israel and the US stand. No, the drama lies outside, with the Israeli-US-UK efforts to scuttle the initiative.

It’s been clear for quite some time that the Palestinian Liberation Organization (PLO) was not going to back down from bringing this resolution to the UNGA. At this stage, any threatening actions by Israel or the US could cause the PLO’s collapse, which Israel very much wants to avoid. So they had no way to stop the initiative from going forward and instead tried to change the substance of the resolution.

That, too, failed, but the changes they tried to make are instructive. Israel wanted to change or insert three conditions, none of which made any sense for the Palestinians. The US took the three conditions whole cloth and tried to convince the Palestinians to insert them. When that failed, it was passed off to the UK, who could offer the Palestinians something the US could not — namely, a yes vote on the UNGA resolution if they agreed to these conditions. Based on various reports, it seems that the Palestinians simply wanted to end the debate and went ahead and submitted the proposed resolution to forestall further discussion of it.

So, all the attempts at change seem to have failed. But the truth is that there is very little here for Israel to be worried about, at least for the time being. And this is why their reaction, as well as those of the US and UK, are all very telling. Let’s look at the three conditions Israel wanted to insert:

  1. 1. Israel wanted the resolution to state that the Palestinians would not seek membership in the International Criminal Court (ICC). Had the Palestinian Authority (PA) agreed to this, it would have sacrificed the one tangible benefit it gets from the General Assembly’s recognition of its non-member status. The other benefits are a matter of prestige and hopefully some diplomatic weight. But this is something the Palestinians can actually use at some point. Israel does not want to answer to the ICC, a court in which it is not a member, but whose decisions can make Israel more uncomfortable and give weight to protest movements, especially in Europe, where there is much more regard for international law than in the United States.
  1. Indeed, had the PA agreed to something like this, the reaction in the West Bank might have been as bad as if they had agreed to withdraw the resolution altogether. That issue only gets magnified in the wake of Hamas emerging from the latest Israeli bombing campaign in Gaza not only alive, but strengthened politically and with a ceasefire whose terms are surprisingly favorable to the government of Gaza.
  1. I strongly suspect that while the possibility of Palestine going to the ICC is probably the single most vexing aspect of this move in Israel’s eyes, they also probably knew that this was a non-starter, and perhaps didn’t even really want the PA to agree, as it might have spelled doom for the quisling Authority. In any case, it was a foregone conclusion that Palestinian President Mahmoud Abbas would refuse Israel’s condition.
  1. 2. Israel wants a clause stressing that this is a symbolic decision that grants no sovereignty over the West Bank, Gaza Strip or East Jerusalem. This was just an attempt at bullying. The UNGA resolution is, by definition, symbolic. It does not carry the weight of law, but merely expresses the view of the GA, as far as such weighty matters as sovereignty are concerned. Yes, specific statuses in the GA can allow the Palestinians access to certain international bodies, but there is no recognition of sovereignty here, nor could there be.
  1. Israel wants this kind of statement to blunt the impact of the resolution in the diplomatic field, but really it wouldn’t do much of that either. It was just a way to diminish the Palestinians’ claim on paper, and more than anything else, it was a lead-in to the one thing Israeli Prime Minister Benjamin Netanyahu really hoped to get out of this.
  1. 3. Israel wants any decision to include a Palestinian commitment to renewing direct negotiations with Israel without preconditions. This has become Netanyahu’s Holy Grail. He would love nothing more than the continuing sham “peace process” to drag on while settlements expand. But he also knows too much had already been discussed in the Oslo process, and fears, perhaps with some reason, that US President Barack Obama might eventually press for an endgame along the lines of the Clinton Parameters. Even if he doesn’t, Bibi doesn’t want to maintain the framework of withdrawal from more than 90% of the West Bank and some sort of sharing of East Jerusalem.
  1. For Netanyahu, “no preconditions” is a mantra, but one which means something very different than what the term implies. “No preconditions” means starting from absolute zero from the Palestinian point of view. It means no presumption that the 1967 borders are the starting point for discussion, or that there is any legitimate Palestinian claim to East Jerusalem. It means forgetting the Oslo Accords, other than perhaps the lines that Netanyahu wants to hold talks with the starting point at the facts on the ground. Those facts involve the settlements, including those in East Jerusalem that cut the city off from the rest of the West Bank and hemmed Bethlehem in, among other Palestinian towns. They include separation between the West Bank and Gaza and no presumption that they must be rejoined.
  1. Within that framework, any land Israel surrenders, any settlement or outpost Israel evacuates, is a “concession” to the Palestinians and more than that, a gift and symbol of Israeli largesse. Given not only Netanyahu’s right-wing orientation, but the even more radical rightward tilt of his party and, even more, his coalition, this is the only way he could sit and talk with the Palestinians, even if it is just for show.
  1. In other words, no preconditions means no to any Palestinian conditions at all and yes to plenty from the Israelis. 

Ultimately, Israel knew it would have to tolerate this Palestinian move. It really couldn’t even respond to it without risking its West Bank subcontractor whose demise would mean that Israel would have to foot much more of the bill for its occupation. So, they tried to get the one thing they thought they had at least an outside shot at: talks without preconditions.

Israel’s failure to achieve that goal is not surprising. But the buy-in Netanyahu got from both the US and UK is something we should all be looking at. Abbas didn’t break off talks with Netanyahu on principle, or even because of settlement expansion itself. He broke them off because he knew that, after 17 years of negotiations in the shadow of expanding settlements, the clock had expired and the Palestinian people would no longer tolerate such a state of affairs. The peace process had been exposed as a sham to cover an entrenching occupation, and only a complete halt to settlement construction would allow Abbas to come back to the table without seriously risking the existence of the PA.

Maybe the US and UK knew that Abbas would not accept the “no preconditions” condition and that’s why they felt comfortable pressing for it. But I doubt it. Both countries simply want to see talks resume, fearing the stalemate and vacuum diplomatic silence produces while Hamas continues to establish itself as the more credible Palestinian leadership body.

And what choice do the US and UK have? The same choice they’ve always had, the same one that was always the only way this was ever going to be resolved: pressure both sides — but especially the powerful and comfortable one, Israel — to make the deal. (Pressure on Israel has been totally absent, while both the US and UK are quite practiced in pressuring the Palestinians). Remind them that the exports they both depend on, the cooperation they both need, will no longer be so forthcoming if they don’t achieve a lasting peace.

And, of course, that is an option that neither country is willing to take for no good reason other than domestic politics. This isn’t about forcing anything on anyone. Israel and the Palestinians are perfectly free to choose their own course, but if they choose one that is contrary to US or UK interests, those countries can also choose not to do business with them. This wouldn’t exactly cripple either nation, but domestic politics continue to rule the day, and the craven leaderships in both countries cannot even conceive of such actions.

Let’s keep this short. Hamas-run Gaza in the midst of conflict with Israel has just played host to the Secretary General of the Arab League, the Prime Minister of Egypt and the Foreign Ministers of Turkey, Iraq, Jordan, Lebanon, the Palestinian Authority, Qatar, Tunisia, Saudi Arabia and Sudan. Prior to this escalation, regional developments had obviously shifted in Hamas’s favor, including a visit to Gaza by the Emir of Qatar and the commitment to provide some $400 million. Hamas has again proven that it can create a degree of mutual deterrence with Israel, that it is taken seriously by Israel, and can bargain effectively with Israel, from securing prisoner releases to securing commitments barring IDF incursions into Palestinian territory, right back to claiming success in having driven Israel from Gaza. Just to rub it in, on the same day that the IDF was committing not to enter Gaza, its troops were busy conducting raids and arrests throughout the West Bank.

What’s more, Gaza is likely to witness more rapid economic growth than the West Bank in the next period, not only because there is a lower base to start from, but also given the likelihood of delivery of assistance commitments from Turkey, Qatar and elsewhere (initially for reconstruction—think of the rebuilding in southern Lebanon and Beirut neighbourhoods after 2006). The Palestinian balance has shifted, full stop.

Fatah and the PLO cannot be dismissed in Palestinian politics, but their longstanding approach of currying American favor, in the hope of delivering Israel absent the creation of Palestinian leverage and assets, has run its course. They appear to have missed the boat in leading a popular campaign of unarmed struggle and the PA’s security cooperation with Israel looks distinctly unseemly in the eyes of many Palestinians. Palestinian unity remains an obvious need but that is far from easy to secure.

Whenever Middle East tensions rise, observers wonder whether the Camp David accords between Israel and Egypt will weather the storm. It is no different this time. Asked at last Friday’s daily briefing if the peace treaty was “in jeopardy”, State Department spokesperson Victoria Nuland, assured correspondents that the U.S. had no indications from Egypt there was “any difficulty on that question” and believed it “very important for Egypt to live up to its international obligations.”

The newly invigorated Egyptian street would beg to differ with Ms. Nuland. True, the last thing Egyptian president Mohammed Morsi needs is a definitive break with Israel or – more importantly – its U.S. patron. But he may find it hard to sustain even a cold peace in the face of the already great devastation and bloodshed Israel has visited upon the besieged Gaza Strip, whose deliberately impoverished Palestinian population has nowhere to run from the bombing and was only just beginning to recover from Israel’s 2008-9 assault.

Israel’s decision to launch a full-scale military operation that risked spiraling out of control will have fallout not just on the battlefield but also in the political arena, putting at risk its two greatest geopolitical gains of the past 30 years – the Camp David Accords with Egypt and the Oslo Accords signed with the Palestinians.

The value of these accords to Israel has been immeasurable. With Egypt definitively out of the Arab-Israeli military equation, Israel has been able to dominate the Middle East without fearing all-out war on multiple fronts.

And with the Palestine Liberation Organization (PLO) and Palestinian Authority (PA) domesticated, Israel has been able to aggressively colonize the occupied territory with minimal obstruction, while the PA security forces – financed by the United States and European Union – play a lead role in ensuring the security of Israel’s occupation. Israel was also able to nurture new relationships in the Arab world, particularly in the Gulf.

Israel presumably factored the risks of undermining these accords into its calculations. It excels at scanning the political environment, and recalibrating its strategies accordingly, even if its policies often backfire over the longer term. Yet in the changing regional context of 2012, Israel would be foolish to presume that it alone is in a position to capitalize on opportunities produced by such dynamics.

Palestinian and Egyptian activists have for months been demanding a break with Camp David and Oslo, and similar voices are heard in Jordan regarding the Wadi Araba agreement. The Israeli offensive against Gaza gives them an opening to push further, while making it harder for the rulers of these three nations to resist calls for a clean break.

That is not to say that such activists necessarily want war with Israel. They simply want to terminate agreements that have brought neither peace nor justice, and that have tied their nations’ hands politically as well as economically. Think, for example, of the deal that obliged Egypt to sell gas at cut-rate prices to Israel. Or the Paris Protocol that gave Israel the right to collect Palestinian tax revenues and then hand them over, or not, at will. Or the Jordanian market compelled to open its doors to Israeli produce while Jordanian farmers’ products spoil.

The Egyptian response has been quick and visible. Morsi recalled his ambassador to Israel and sent his prime minister to visit Gaza. He was spared having to expel Israel’s ambassador by the fact that the latter quietly fled before Israel’s commenced its assault. Egypt worked intensely to secure a ceasefire, even though Israel assassinated its main Hamas interlocutor, Ahmad Ja’abari, after a two-day Egyptian-mediated truce that was respected – in part due to Ja’abari’s efforts – by all Palestinian factions. The inevitable Hamas response provided the pretext for Israel’s Operation Pillar of Defense.

The PA/PLO response has been less visible than that of Egypt, but perhaps more dramatic when compared to its stance during Israel’s Operation Cast Lead in December 2008 – January 2009. At that time, the PA/PLO resisted attempts to bring about an immediate ceasefire largely to please the U.S. It still had hopes that the U.S. support would give Palestinians a fair two-state solution. It also hoped that Israel might terminally defeat Hamas and that Fatah could regain control of the Gaza Strip – lost to Hamas in June 2007.

The PA/PLO’s foot-dragging during Operation Cast Lead was so pronounced that the then-president of the UN General Assembly, the Nicaraguan priest Father Miguel d’Escoto Brockmann, effectively accused it of complicity in damning words: “I wanted to help Palestine, but those who should supposedly have been most interested denied their support for reasons of ‘caution’ that I was incapable of understanding. I hope that they were right and that I was wrong. Otherwise, we face an ugly situation of constant complicity with the aggression against the rights of the noble and long-suffering Palestinian people.”

By contrast, during the latest assault PA/PLO head Mahmoud Abbas loudly urged Arab and international action to bring about an end to the fighting and spoke of reconciliation between Fatah and Hamas. True to form, the PA/PLO security forces began by brutally cracking down on some of the West Bank demonstrations protesting Israel’s assault on Gaza, particularly those that looked as though they might reach nearby Israeli forces. But they were forced to change their tactics as the conflict escalated and demonstrators repeatedly clashed with Israeli soldiers.

Moreover, as the conflict raged the PA/PLO had to live with a major demonstration in Ramallah largely made up of Hamas forces, whose green flags dominated the event. And neither Palestinian nor Israeli forces were able to stop determined Palestinian activists from getting into the illegal Israeli West Bank settlement of Beit El despite beatings and arrests by both Israeli and Palestinian forces. Eight Palestinian women even managed to scale the settlement wall.

There is no question that Pillar of Defense has further weakened the Fatah-led PA/PLO. It has nothing to show for its participation in the U.S.-led Oslo-framed peace process that, as revealed by Al Jazeera’s Palestine Papers, reached almost slavish subservience. The aid-dependent economy that was booming in the West Bank at the time of Cast Lead is now practically on life support.

Abbas and Fatah still have control of the PLO, which is internationally recognized as the sole legitimate representative of the Palestinian people – and, of course, they still have those well-armed security forces. Abbas’ bid for non-member observer state at the United Nations on November 29 will help keep him and his allies in the picture, but the weaker they get, the harder it will be for them to hold the line in defense of the Oslo Accords, which Hamas refuses to recognize, at least explicitly.

Moreover, the PLO will soon be placed in the position of having to show the value-added of its upgraded UN status by seeking membership in the International Criminal Court so as to hold Israel accountable for its violations of international law, including in Gaza. This would be a major departure. Abbas’ team made no use of an important legal victory, the Advisory Opinion of the International Court of Justice, which could have been used to stop other states from dealing with Israel’s settlements and put a brake on its colonization, among other things. And they deliberately undermined the Goldstone Report – the UN Human Rights Council fact-finding mission findings on Cast Lead.

Meanwhile, no matter how great Palestinian losses in life, limb, and infrastructure in the Gaza Strip, Hamas will emerge strengthened simply by surviving, as Hizballah did after Israel’s 2006 attack on Lebanon, when Israel developed its Dahiya Doctrine of using disproportionate force to crush its enemies without heed to civilian casualties. Hamas has in addition won important shows of support from Arab states, some of whose envoys joined Egypt in visiting Gaza during Israel’s offensive. And, of course, it still has its own powerful security forces.

Hamas can taint its “victory” by transforming it into a partisan show of strength with Fatah, as its supporters were quick to do in the recent Ramallah demonstration. Such an attitude flies in the face of the resurgent movement to redefine the Palestinian national struggle as one that transcends factionalism in the quest for self-determination, freedom, justice and equality.

Hamas may use its stronger position vis-à-vis Fatah to push for full PLO membership, breaking Fatah’s longstanding stranglehold on the umbrella movement. Indeed, Fatah may find that the only way it can stay relevant is by bringing Hamas into the PLO fold while Fatah can still negotiate a significant share of seats in the Palestinian National Council and on the PLO Executive Committee. If Hamas joins the PLO while maintaining its refusal to recognize the Oslo Accords, that will be a further nail in Oslo’s all-but-sealed coffin.

Thus, Israel may find that it emerged from Operation Pillar of Defense with its military reputation relatively unscathed – only relatively because rockets that can hit Tel Aviv will never completely disappear and Iron Dome is not 100% secure – but with its ability to manage its neighborhood seriously weakened. Without a PA/PLO to mediate its West Bank occupation, Israel will have to manage it directly. Israel may also find its hitherto unfettered colonization of the Occupied Palestinian Territory (OPT) severely constrained by determined Palestinian activism – an own goal for Benjamin Netanyahu who made settlement building a priority of his current premiership.

This is how, by pursuing military victory at any cost in the short term, Israel sets itself up for political failure in the longer-term. Its options are bleak: to maintain the present apartheid system of rule over the OPT and within Israel itself, while “thinning out” the Palestinian population to the extent possible.

In so doing, Israel faces growing world opprobrium and isolation in the Arab and Middle East regions – an Arab League meetingon Gaza called for “a moratorium” on normalization with Israel. It also faces possible PLO-led legal action against its occupation policies, continuing demonstrations and instability in the OPT and Israel, an increasingly effective campaign for boycott, divestment and sanctions that is exacting a moral and economic price, and, potentially, a movement for full civil and political rights in the part of Palestine that became Israel in 1948 as well as the Palestinian territory occupied in 1967. These are the openings Palestinians will be using to scale up the fight for their rights.

So why am I worried? First and foremost, because our leadership still has no viable strategy for dealing with Hamas in Gaza. Even the objectives of this offensive as outlined by Defense Minister Barak Wednesday evening—strengthening deterrence, destroying rockets, hurting the terrorist organizations, defending the Israeli civilian rear—are tactical and temporary, not strategic. Having tried and failed to choke Hamas economically, having invaded the Strip four years ago at a heavy price in international condemnation without achieving more than a few months’ peace and quiet, and having undertaken, along with the Quartet, not to talk to Hamas (which in any case won’t talk to Israel), the Olmert and Netanyahu governments have for five years (since Hamas’s takeover of Gaza) sufficed with tactics, not strategy.

The most this operation can do is achieve a few more months of quiet that will get Netanyahu and Barak through the coming elections. By demonstrating that the PLO does not control Gaza, it might also slightly damage that organization’s credibility as it seeks U.N. recognition for a state that comprises Gaza. That’s the best case. It assumes that Hamas will not seriously escalate and cause heavy loss of life in Israel. It also assumes that an errant bomb won’t accidentally kill a bunch of kids in Khan Yunis or Rafah, thereby bringing down upon us the wrath of the world.
