Every few years, a call to boycott Israeli academic institutions gains enough momentum to make a brief wave in the media, before it enters the cycle of condemnation. After making the rounds, the boycott gets predictably denounced by major organizations, followed by widespread reiteration of support for the state of Israel. It diverts the public’s attention from the main issues of justice in Palestine, stands no chance of convincing a mainstream audience, and sets the stage for right-wing opponents. Still, a minority of academics dutifully roll their boycott stone up the endless hill of opposition again, only to see it rolled back down again. And roll down it should, because the current ASA-supported academic boycott of Israeli universities is, in my view, unprincipled, ineffective, and hypocritical.

The usual cycle of condemnation has been seen in the backlash to the recent American Studies Association (ASA) appeal, which called for a boycott of Israeli academic institutions. The relatively small list of individuals who signed the petition was overshadowed by official condemnations of the move by Harvard and Yale and the cancellation by four other universities of their membership in the group. A slew of other universities, including Yale, Princeton, Brown and NYU denounced the boycott, while the president of MIT, Rafael Reif, issued a statement that rejected it since it “fundamentally violates the principles of academic freedom” and contradicts the “longstanding practice of fostering active engagement with international academic institutions and open dialog among people from all nations.” Reif’s simple logic is correct: the boycott is entirely unprincipled if one is committed to academic freedom. Indeed, the academic boycott campaign has actually served to divert attention from the critical issue of Israeli violations of the human rights and international law to the otherwise unrelated question of academic freedom.

Moreover, the academic boycott ignores the fact that students and faculty within universities have historically served as key sources of resistance to arbitrary and abusive regimes. Although a small minority, there are Israelis within academia who organize opposition to the occupation and seek to advance justice for Palestinians. This voice of dissent should be harnessed to educate the population and influence policy, as in previous struggles, rather than boycotted and isolated.

To learn about the case for academic boycott this time, I turned to the website for the US Campaign for the Academic & Cultural Boycott of Israel (USCACBI). A graphic on its front page urges a halt to the Cornell-Technion Collaboration (“STOP the Cornell-Technion collaboration in NYC – NO to war crimes + NO to Israel”).

What could be so malicious about a scientific collaboration between two academic institutions offering a joint academic curriculum? The Cornell-Technion website states that the collaboration’s goal is to “create better health care information systems, mobile health care applications, and medical devices,” and that the joint venture “aims to increase the efficiency and sustainability of urban environments at all scales.” It will also provide a Masters of Science program for students. Could this be a misleading veil? Is this academic alliance secretly a destructive effort to further deny the rights of Palestinians? The hyperbolic languageon the campaign’s website is so far- fetched that it invites easy dismissal by its opponents. Extraordinary claims require real evidence, and the campaign fails to provide any substantiating the notion that this collaboration is anything but ordinary, similar to other collaborations between U.S. universities and universities throughout the Middle East and elsewhere. It’s transparent that the Cornell-Technion collaboration was not singled out for its substance, but rather for being a well-funded and visible collaboration. But that hardly justifies the hyperbole displayed on the site.

Meanwhile, important actual developments take place in the world. With the advent of peace talks, Netanyahu is planning to continue building settlements that further encroach on Palestinian territory and rights and are totally illegal under international law. The international community is overwhelmingly against the settlements, and Israel’s strongest ally, the United States (or a unified European coalition) has the power to end them with real economic pressure. It is straightforward to make a mainstream case for why settlements are illegal, why they infringe on the rights of Palestinians, and why they actively undermine hopes for any eventual peace settlement of the conflict. Critical matters like these are effectively sidetracked by the brouhaha over the academic boycott and by the long line of Israel advocates who are eager to take advantage of the opportunity to express their unconditional support for its government. In that respect, the academic boycott is not only ineffective, but also counter-productive.

Moreover, opponents of the academic boycott will rightly point out the hypocrisy of academics who sign it. A recent book by historian Craig Steven Wilder documented the ways in which major U.S. universities — including the Ivy League Harvard, Yale, Princeton, Brown universities — benefitted from the slave trade. More recently, institutions like MIT have contributed to weapons development and the planning of unjust wars, while benefitting handsomely from Pentagon and other government contracts. In one way or another, virtually all major American universities have contributed to or benefitted from injustices committed by their government. Thus, the appeal to punish one set of significantly younger, less influential institutions (like Israeli universities) can easily be depicted as hypocritical by its foes — especially when the call is made by those currently employed by major U.S. universities with richly tainted histories. These common-sense arguments against the academic boycott and its destructive effects have been made repeatedly by Noam Chomsky, among others.

Ultimately, it is economic pressure — justified by legal and human rights violations for which there is ample evidence and strong international opposition — that can help remedy the injustices in Palestine.

What will former Secretary of State Hillary Clinton say, if anything, about the Kirk-Menendez Iran sanctions bill?

The pressure on her to take a position must be considerable, if only because, as both the former secretary and presumed front-runner for the 2016 presidential nomination, she could exert a decisive influence on the bill’s fate in the Senate. If she takes a firm stance either pro or con, a dozen or more Democrats who are currently on the fence are likely to scurry in her direction, possibly enough to either persuade Majority Leader Harry Reid to block the bill from coming to the floor or to provide the hawks with enough votes to overcome an Obama veto.

The stakes for her are really quite high, particularly when you consider that her support for the Iraq war was probably the single most important reason for her defeat by Obama in 2008. If she comes out for the bill or declines to support the White House and John Kerry (and her protégé, Wendy Sherman), and the result is the bill’s enactment followed by the collapse of the P5+1 negotiations and a military strike by early 2016, she’ll once again lose the non-interventionist wing of Democratic Party to just about any challenger who now opposes the bill. This, after all, is almost certainly the biggest foreign policy issue of Obama’s second term.

On the other hand, if she opposes the bill and backs the administration of which she was a key part, she will almost certainly incur the wrath of AIPAC and its powerful donors, a situation that the Clintons have tried very hard to avoid since Bill Clinton became a rising star of the Liebermanesque Democratic Leadership Council.

So far, she’s avoided saying anything on the bill. She reportedly told a private meeting just before Christmas that she thought that Israeli Prime Minister Netanyahu’s outspoken opposition to the bill and threats of unilateral military action had actually strengthened the administrations’ hand in negotiations. On the other hand, she was the first administration official to declare publicly (as early as 2010) that Iran could conceivably be permitted to enrich uranium on its own soil as part of a comprehensive solution to the nuclear issue — a position that stands in direct opposition to provisions of the Kirk-Menendez bill. Whether she was speaking for herself or was instructed to take that position is unclear. After all, it was Clinton who went beyond Obama’s early demands that Netanyahu suspend settlement activity by insisting that there must be “no exceptions,” including in “natural growth” of the settlements. And it’s clear that neither Bill nor Hillary is particularly fond of Bibi.

But both have consistently been very respectful of AIPAC, which is clearly going all out on this.

When it comes to the tedious dance between the United States, Israel and the Palestinian Authority, the more things change, the more they stay the same. As 2013 draws to a close, we have another proof of that cliché.

As 2013 dawned, President Barack Obama began his second term, and Benjamin Netanyahu — whose horse in the US race, Mitt Romney, had lost decisively — was winning re-election but embarking on a very difficult set of talks to cobble together a governing coalition in Israel. As there always is with a second-term US president, there was some speculation that Obama might decide to damn the torpedoes of domestic politics and put some moderate pressure on Israel to compromise. Despite some illusions, by the end of the year it became clear that this wasn’t happening.

A little less than a year ago, John Kerry was named Secretary of State and vowed not only to restart talks between Israel and the Palestinians but to bring them to a conclusion. Few believed he could get the two sides talking again, but Kerry managed it and thereby breathed a bit of life into Washington groups like J Street and Americans for Peace Now who have staked their existence to the fading hope of a two-state solution. But even fewer objective observers believed Kerry could actually fulfill the second part of his pledge, and as 2013 comes to an end, all the evidence points to the vindication of that pessimistic view.

The talks were restarted because Kerry asserted US authority, cajoled and convinced the two sides to talk again and was willing to exert some public pressure on the Israeli government as well as the Palestinian Authority to make it happen despite the political difficulties both sides faced in agreeing to them. But when it came to matters of substance, the sort of pressure that would be required — a good deal more than was needed just to restart the talks — was absent.

Recent events have demonstrated that the United States’ position on a final agreement still largely reflects Israeli concerns and de-prioritizes the more pressing concerns of the Palestinians. The key issue this time has been an ongoing Israeli presence in the Jordan Valley. For the Palestinians, this is a sine qua non. After all, it is very difficult to sell the idea that a military occupation has ended when the armed forces of the occupying country are still there.

The US’ idea of “compromise” on this point seems to be that Israel would maintain its hold on the Jordan Valley for some period of years, and then would gradually hand it over to the Palestinians if the Palestinians behaved themselves. It’s not hard to understand why the Palestinians see that paternalistic arrangement as the US taking Israel’s side, rather than as a compromise proposal.

Indeed, the US approach remains unchanged regarding Israel and Palestine, despite rather profound shifts in US policy across the region in the wake of regional changes and Obama’s re-election. The US has clearly moved to extricate itself from many of the region’s issues, has refused to take the interventionist steps its key ally, Saudi Arabia, was pushing hard for, and opened the door to diplomacy with Iran. But in Israel-Palestine, the approach remains the same: the issue is primarily viewed not through the lens of millions of innocent people living under a harsh military regime without civil or human rights, but through the lens of Israeli security.

This picture can sometimes be confusing because of the obvious dislike and mistrust that exists between President Obama and Prime Minister Netanyahu. There can be little doubt that there is real contention between the two, and this often plays out in public. But the reality is that this tension only lies between greater and lesser extremes of Israeli intransigence. The radical right-wing view, whose most prominent advocate in the Israeli government is Defense Minister Moshe Ya’alon, was laid out in Ha’aretz on Dec. 27: “Ya’alon demands that the army have freedom of movement in all West Bank cities. He also wants full Israeli control in the Jordan Valley and of all border crossings, as well as of the air space.” In other words, no significant end to the occupation, ever. The more moderate position thus becomes Netanyahu’s, which would allow for Palestinian control over areas outside the major settlement blocs (although the surrounding territory, which currently falls under the jurisdiction of the settlements’ “regional councils” would likely be included in the blocs that remain Israeli), and a reduction in Israel’s presence in the Jordan Valley along the lines that Kerry is proposing as well as some American and Palestinian participation in border crossings and air space.

Obviously, that puts a middle ground between more or slightly less occupation of the West Bank, and doesn’t allow for a real end to the Israeli occupation or anything approaching Palestinian sovereignty. So, as has happened many times over the past twenty years, the Palestinians correctly see the United States as joining a rejectionist Israeli position, even while the ever-increasing popular ranks of the Israeli right, and their supporters in the US, see the very same US positions as siding with the Palestinians.

But other things are changing. Israel, including the current government, has long seen participation in peace talks as an end unto itself because it served to ease international pressure. But this time around, the effect of merely holding talks has been considerably diminished. The European Union went ahead with conditions on an economic aid package that bar cooperation with settlements and businesses housed in them. The effect of this action is minimal; it won’t affect a great many programs, and Israel has avenues to attain most of the same cooperation. But along with explicit European warnings about further actions if peace talks fail, this is a clear message to Israel that Europe is losing patience with Israeli settlements and intransigence.

There is also the growing consciousness of the occupation in civil society movements advocating boycotts against and divestment from Israel, commonly referred to as the BDS (Boycott, Divestment and Sanctions) movement. Consider the recent decision by the American Studies Association in the US to approve an academic boycott against Israeli institutions. It, too, won’t have a dramatic effect on Israeli academics’ ability to pursue their work, but the message that was sent was profound. That was clear by the nearly hysterical reaction in Israel and among the well-connected supporters of Israel’s rejectionist policies in the United States. These popular forces coupled with the impatience in Europe, a potential rapprochement between the West and Iran and the concern over the changing terrain in the Arab world are creating pressure on Israel to change. Right now, Israel’s response is to dig its heels in even deeper, but that could change quickly if more Israelis start feeling the effects of international opprobrium.

In the end, though, the biggest obstacle remains on the Palestinian side. The Palestinian Authority commands very little real sway these days among the Palestinian masses, and Hamas is not seen by many as a viable alternative. Exceedingly few Palestinians believe the PA’s reliance on the United States is a fruitful course toward their freedom, but Hamas, even beyond the obvious obstacles that were placed in front of it by the siege on Gaza, has offered no alternative strategy. Instead, the two sides vie for supremacy among an occupied and dispossessed people who largely prefer to see the two come together into an unified leadership.

There is some reason to hope for 2014 and beyond that Israel and the Palestinians arrive at a reasonable agreement. But for that to happen, the Palestinians themselves must become active participants, as was the hope after the Oslo Accords were signed in 1993. They need to be a party with their own agency and strategy, not a partner trying to prove itself to Israel’s closest ally with the dream that the US will suddenly turn to support them. The issue must be seen internationally as one of a monstrous occupation that must end for both moral and practical reasons, and that the occupation must end in a way that gives Israel a sense of security. But right now the main goal is to give Israel security while ending the occupation is viewed as a bonus. That dynamic must change, but the leadership in Washington continues to stand in the way.

On the eve of US Secretary of State John Kerry’s fifth trip of the year to Israel and the Palestinian Territories, little has changed. Despite Kerry’s entreaties not only to both parties but also to Jewish-Americans to come into his “Tent of the Peace Process,” every indication on the ground is, at best, more of the same. The only changes have made it more obvious than ever that the two-state solution, as previously conceived, is dead.

In advance of delaying this trip in order to consult with the rest of the administration’s leadership on increasing military aid to the Syrian rebels, Kerry spoke to the American Jewish Committee’s (AJC) annual meeting in early June. He entreated the audience to speak out in a voice that the Israeli leadership could hear in support of the moribund two-state solution.

Israeli Justice Minister Tzipi Livni, widely regarded as the government’s “fig leaf” whose role is to mask the rejectionism of Prime Minister Benjamin Netanyahu’s government, echoed Kerry’s call. And the AJC, along with other Jewish-American organizations, got an immediate chance to respond. Yet that very opportunity demonstrated the futility of Kerry’s and Livni’s efforts.

First, Netanyahu’s Deputy Defense Minister, Danny Danon, of Netanyahu’s own Likud Coalition, declared that “…if there will be a move to promote a two-state solution, you will see forces blocking it within the [Likud] party and the government.” Danon accurately pointed out that “…the majority of Likud ministers, along with the Jewish Home [party], will be against it.” Indeed, Jewish Home leader Naftali Bennett, an outspoken opponent of a Palestinian state who advocates Israeli annexation of more than 60% of the West Bank, followed up Danon’s remarks by saying that the two-state solution is dead and “We need to build, build, build.”

Netanyahu tried to distance himself from the comments, but most understood that Danon and Bennett were simply being straightforward about the Israeli government’s makeup and direction. Indeed, it was telling that, just a few days before Kerry was due to arrive for his latest visit, Netanyahu attended the dedication of a school named after his father in the West Bank settlement of Barkan. While his aides insisted that Netanyahu did not mean to make a political statement with his appearance, his words at the school say otherwise. “The most important thing is to deepen our roots, because all the rest grows from there,” Netanyahu said. “We are here today to deepen our roots.”

The Palestinian Authority has responded to all of this by pointing out that Israel is acting against the two-state solution. “Every time Kerry comes, [Netanyahu] does something to undermine the possibility of a Palestinian state,” said Palestinian lead negotiator, Saeb Erekat. “It’s more than provocative, it’s devastating. This government’s policies are disastrous for Palestinians, Israelis and the region. I don’t know what purpose it serves to undermine the two-state solution.”

Yet the Palestinians continue to be divided, and not just between Fatah in the West Bank and Hamas in Gaza. Rockets launched from Gaza Sunday night are believed to have been fired by the Palestinian Islamic Jihad in Gaza. The act was reported to have been undertaken to spite Hamas, which had killed an Islamic Jihad operative while ostensibly arresting him.

The continuing divisions, especially the constantly sputtering reunification process between Hamas and Fatah is yet another reason why the two-state solution as previously conceived is, in fact, inconceivable now, no matter how much wishful thinking Kerry engages in. While indications remain that both Israelis and Palestinians support the creation of a Palestinian state, the positive answers to that abstract question may not even reflect the scope of public opinion.

In December 2012, the Palestinian Center for Policy and Survey Research asked Palestinians about the two-state solution. The majority supporting the proposal was still there, though it was down to only 52%. But when asked about a demilitarized state, only 28% supported that idea, while a robust 71% opposed it. This can hardly be surprising. After all, a Palestinian state would not only be neighboring the country that has occupied it for 46 years, but there is also the flux in which the neighboring countries — Syria, Jordan, Egypt — find themselves today. If a threat did materialize against a fledgling Palestinian state, it is hard to imagine that Israel would put its soldiers in jeopardy to defend the neighbors they regard as untrustworthy and frankly, distasteful.

But such a state is a sine qua non for Israel, and not only for reluctant “peacemakers” like Netanyahu. A demilitarized Palestinian state was clearly the vision of Netanyahu’s predecessors, to the extent they would agree to a Palestinian state at all. And, in Israeli political discourse, the so-called peace camp — including such parties as Labor, Yesh Atid, Kadima and even the most left-wing Zionist party, Meretz — is unanimous in calling for a demilitarized state.

It is said that this is Kerry’s last-ditch effort. If the Israelis and Palestinians move no closer on this trip, Kerry is prepared to abandon his shuttle diplomacy to focus his efforts on issues that may prove more malleable. The Israelis would certainly like to see negotiations resume, as this takes pressure off of Israel in the international arena, especially with Europe. This explains why Naftali Bennett, who is so hostile to peace with the Palestinians, states that he would not “veto” talks.

But political realities dictate something very different. Bennett, and indeed Netanyahu, may want to see talks resume, but they do not want them concluded with a Palestinian state. The Palestinians themselves cannot present a united front; the Palestinian Authority does not represent all of the population nor do its positions align with any but a small minority of the Palestinian people. And the United States is not prepared to insist on results. That is why so many say the two-state solution is dead. Kerry should learn the obvious lesson and either re-think his policy approach or, as he is threatening, turn his attention elsewhere.

All was not as it seemed during President Barack Obama’s appearances in Jerusalem and Ramallah, where he addressed audiences of Israelis and Palestinians. On the surface, it looked like Obama was swearing fealty to Israel, and pledging unconditional US support for any and all Israeli actions. But a closer look at what was and was not said, as well as some of the surrounding circumstances, suggests that what Obama was really doing was paving a road toward a reduced US role in the Israel-Palestine conflict.

The contradictions in evidence abound, and could be seen from the very beginning. Obama kept calling Israeli Prime Minister Benjamin Netanyahu by his nickname, Bibi, at their joint press conference. “Oh, yes, we’re just the best of friends. Don’t worry, AIPAC,” Obama seemed to be saying. “Any friction between us is a thing of the past.” Yet, Obama had made a pointed decision to deliver the keynote speech of his trip not at the Knesset, but to an audience from Israel’s major universities. The many students invited excluded only those from Ariel University, the lone Israeli university located in the West Bank settlements.

The ham-handed excuse offered by the US embassy, that they only invited those universities with whom they partnered, was a convenient one. They don’t work with that university because of the political ramifications, and the exclusion here was for the same reason. And that sent a message to Obama’s “good friend,” Bibi.

Not speaking to the Knesset sent a message as well, and it was reflected in Obama’s speech. There is no reason for Obama to speak in a chamber where there is so much hostility toward him. Instead, he told his young Jerusalem audience: “let me say this as a politician — I can promise you this, political leaders will never take risks if the people do not push them to take some risks. You must create the change that you want to see.” Translation: “I can’t work on peace with your current government. You need to drive the change and open the door.” That, too, was a message to Bibi.

But more important than what was said was what was not said. For all the fawning that Obama did, he offered nothing new or of substance — not the slightest deviation from his well-established policies. There’s no new version of Dennis Ross, Anthony Zinni or George Mitchell being sent to the Middle East. There are no new incentives or confidence-building plans, however pointless. There was just a whole bunch of pronouncements about the unshakeable bond between the US and Israel.

Does that sound like a president who intends to maintain the US’ current level of involvement? It seems more like a President who is telling Israelis exactly what AIPAC is buying. The annual military aid will continue, as will money for Iron Dome, and never mind the many federal employees who were just sequestered out of a job or furloughed. The security and intelligence cooperation is likely to continue as well. Israel will, as Obama put it, remain “…the most powerful country in this region. Israel has the unshakeable support of the most powerful country in the world.”

While the US president sent a clear signal that he holds little hope that the current Israeli government is able or willing to pursue peace in any substantive way, he also cautioned Israelis about their growing peril. “Given the frustration in the international community about this conflict, Israel needs to reverse an undertow of isolation,” Obama said. “And given the march of technology, the only way to truly protect the Israeli people over the long term is through the absence of war. Because no wall is high enough and no Iron Dome is strong enough or perfect enough to stop every enemy that is intent on doing so from inflicting harm.”

Note that it’s Israel that needs to reverse this trend, and there’s no mention of any kind of US charm offensive or even advocacy on Israel’s behalf to assist the effort. The implication is clear: Israel’s policies and actions are to blame for its troubles and the US can’t change that, and, because of the political problems it would cause, this administration will not try. Could that also result in a somewhat diminished defense at the United Nations and other international arenas, on the part of the US? Time will tell.

Obama also let the Palestinian Authority know they should look elsewhere. By choosing to condemn Hamas for the rockets that hit Sderot earlier that day during his Ramallah speech rather than in Israel, he surely alienated many in the crowd he was addressing. By refusing to use even moderately stern language on settlements or promise even the mildest pressure on Israel, he seriously undermined Mahmoud Abbas, the man he was purportedly coming to support. Throughout his speech, despite his expressions of sympathy for the daily struggles of Palestinians, Obama never mentioned Israel’s responsibility to end the occupation, let alone to respect human rights or abide by international law.

That sent a very clear message: don’t look to the United States to deliver the goods. If Abbas was listening at all, he must know that internationalizing his cause, as he did last year at the UN, is the only option Obama has left for him. It was so clear, it had to be a deliberate message.

This might all be considered fanciful until one considers the changing position of Israel in the US view. As Aluf Benn, editor-in-chief of the Israeli daily, Ha’aretz points out, the entire Middle East region is of considerably less importance in the broader geo-political strategic view of the United States. “U.S. President Barack Obama said Wednesday his visit to Israel was meant to be a reassuring one,” Benn writes. “He is here to make it clear to Israelis that America stands behind them and will ensure their security, even though the neighborhood has become tougher… The visit comes at a time when the United States is withdrawing from its deep involvement in the Middle East, amid the growing fear of Israel and other regional allies that America will abandon them to radical Islamic forces.”

Benn’s alarmist language aside, he’s right. A big part of this is the oft-discussed “pivot to Asia,” that is the cornerstone of Obama’s foreign policy. Asia’s importance is growing as the Middle East’s is shrinking. The Middle East, particularly the Arabian Peninsula, was once called the “greatest material prize in history” by the US State Department because of its wealth of oil resources. But the US and Europe both see themselves on the road to “energy independence.” This sounds a little more grandiose than it really is. Local oil resources and increased reliance on alternative energy sources will significantly diminish the role of Middle Eastern oil both in terms of serving energy needs and in terms of its role in the global economy, but it won’t eliminate it. OPEC will still be a major force in determining the price and supply of oil, but it won’t have the near-monopoly it does today.

But that’s not the only factor. The so-called “Arab Spring” is not the simple romantic vision of emerging democracy that so many in the West thought it was, while they watched Egyptians oust Hosni Mubarak. It’s also not just the massive violence of Libya and Syria. Even in Tunisia and Egypt, transitions have been bumpy and marked with dissatisfaction and political jockeying as well as some very fundamental debates about the role of women, the military, religion and other key groups and institutions in their respective societies. Moves toward true independence and self-determination in these countries will be a long and unpredictable road. And no matter who ends up controlling the oil, they will have less leverage over the West than their predecessors with even more of a need to sell their oil there. So the strategic situation will be less favorable for the Arab governments that arise from this situation.

Not to mention the situation on the ground. Israel has elected a new government that has no interest in peace with the Palestinians. Settlement expansion continues while the Israeli bunker mentality is fortified. For their part, the Palestinians remain trapped between a Palestinian Authority which has lost virtually all legitimacy in the eyes of its people but is the only acceptable “partner” for the US and Israel, and a Hamas government that no one will talk to. Both sides of that divide seem as uninterested in reunification as Netanyahu is in a viable Palestinian state.

But then there’s the big mitigating factor, the US Israel Lobby. Obama has a lot of work to do in the next four years, and he needs Congress to do it. Much of that work focuses on domestic economic issues, but there are foreign policy questions as well. He simply cannot afford to spend the political capital of his second term fighting with AIPAC all the time. Nor do his colleagues in the Democratic Party wish to see him jeopardize their chances of making gains in the midterm elections by picking a fight with Israel.

But that domestic pressure is really all that is holding the US to Israel at this point. Powerful as AIPAC is, the President can still set broader policy priorities, as he seems to be. Asia will have its own difficulties, but the interests there are growing, while the US stake in Egypt, Syria, Lebanon, Tunisia, Yemen, and yes, even Israel and Palestine, are diminishing. To be sure, there is still a significant US stake in the Israel-Palestine conflict. And AIPAC will make sure we pay attention to it, as will the fact that Israel is a long-standing ally and while AIPAC may represent a small minority of US citizens, most do not want to see Israel as vulnerable to attack.

Ultimately though, Obama knows that the US has spent inordinate time and energy on this issue. He also knows that it’s becoming less and less vital for US concerns that really matter to him as time goes on. So, he goes to Israel, warms some hearts and minds and gives AIPAC the platitudes and assurances it wants. As Benn wrote, “With every passing day, Israel becomes less capable of taking out Iran’s nuclear facilities by itself, while its dependence on the United States for military superiority just keeps growing.” The US will continue to lead on Iran, which is something Obama wants.

As for the peace process? Obama would like to see Israel make peace possible, but absent that, he’s sent them a message: we’ll help if you want, but until you show some interest in changing the status quo, we have bigger fish to fry.

The optimism expressed by U.S. President Barack Obama and newly confirmed Secretary of State John Kerry about restarting the peace process between Israel and the Palestinians has been met with scepticism from many seasoned Middle East experts.

At his confirmation hearing, Kerry told the assembled Senate, “I pray that maybe this will be a moment that will allow us to renew the effort to bring the parties to the negotiating table and go down a different path than the one they were on in the last few years. I would like to try and do that.”

Since his re-election, there has been considerable debate in the U.S. media about whether Obama would re-engage in peace efforts between Israel and the Palestinians. It is often the case that second-term presidents engage more in foreign policy and have a freer hand, not having to be concerned about re-election at the end of their term.

Hagel faced much greater opposition on this score, and his confirmation is less certain than Kerry’s was, though it is expected that he too will be confirmed. Much of the opposition to Hagel stems from a 2006 interview where he said that “…the Jewish lobby intimidates a lot of people (on Capitol Hill)”, and “I’m not an Israeli senator. I’m a United States senator.”

But despite Obama’s choice for the key posts, and a White House statement saying that Obama had pledged “to work closely with Israel on our shared agenda for peace and security in the Middle East,” during his congratulatory call to Israeli Prime Minister Benjamin Netanyahu on the latter’s re-election last week, few see a strong possibility that the new administration will put much effort into the vexing conflict.

“I don’t think that Mr. Obama is lying about his intentions, it’s simply that he’s required to say he’ll reengage,” Mark Perry, former co-director of the Washington, D.C., London, and Beirut-based Conflicts Forum, told IPS.

“The only other possible answer would be: ‘I’m sick of the whole damn thing, and we’ll just have to wait for new Israeli leadership’ – which is something he dare not say. Mr. Obama is focused on domestic matters – which will command his every attention. He will need every vote he can get to pass his domestic programme, and irritating conservative Republicans and Democrats by making demands on Israel is something that he just won’t do.”

Yet speaking in Washington in a globally broadcast address on Tuesday, outgoing Secretary of State Hillary Clinton voiced optimism.

“I actually think that this election opens doors, not nails them shut,” Clinton said. “So I know that President Obama, my successor, soon-to-be Secretary of State John Kerry, will pursue this, will look for every possible opening… somehow, we have to look for ways to give the Palestinian people the pathway to peace, prosperity, and statehood that they deserve and give the Israeli people the security and stability that they seek.

“I think that still is possible, and I can assure you the United States under President Obama will continue to do everything we can to move the parties toward some resolution.”

Speaking at The Palestine Center in Washington, Yousef Munayyer, the executive director of The Jerusalem Fund, noted that Israel’s ongoing occupation and settlement expansion was a very minor issue in the Israeli election.

“The issue of peace is fading because the cost of occupation has become bearable for Israel and there is no motivation (to change) if the costs are low. The question that needs to be asked in Washington is how can we create incentives so an end to occupation becomes a reality. If we continue to support everything Israel does … we cannot expect it will happen.”

PJ Crowley, former spokesman for the U.S. State Department, told the same audience that the Israel-Palestine issue was no longer the same regional focal point it once was.

“In 2009, President Obama came in knowing that the Israel-Palestine issue is the key driver in the region. We believed that to be true in 2009, but it is not true in 2013,” Crowley said.

“There are new players in region, with (Egyptian President Hosni) Mubarak replaced by (Mohammed) Morsi, who was helpful in ending hostilities with Hamas, but has a much different view of the Palestine issue and has very different dynamics domestically. King Abdullah of Jordan has his hands full with 700,000 Syrian refugees. So Israel-Palestine has been pushed from the top of the list.”

Others have focused on the personal issues between Obama and Netanyahu. Martin Indyk, the former U.S. ambassador to Israel, said that the two leaders have “bad chemistry” between them. This was echoed by former U.S. ambassador to Saudi Arabia, Chas Freeman, who put the blame for the tension squarely on Netanyahu.

“Frankly, I doubt that Obama…is likely to invest much effort in either supporting or opposing Netanyahu’s Israel now,” Freeman told IPS. “Netanyahu has not only beaten the warmth out of his government’s relationship with its American counterpart, he has left Obama with no basis for engagement with him other than posturing for domestic political effect.”

John Mearsheimer, professor of International Relations at the University of Chicago summed up the pessimism, telling IPS, “Obama will surely go through the motions to make it look like he is serious about pushing the peace process forward.”

“I would be very surprised, however, if he makes a serious effort to get a two-state solution, simply because the Israelis taught him in his first term that they are in the driver’s seat and they are not interested in allowing the Palestinians to have their own state. Nothing happened with the recent Israeli election to change that dynamic.”

The Israeli elections ushered in a record number of new Knesset members, yet the prospects for resolving Israel’s 45-year old occupation of Palestinian land are as dim as ever, maybe even more so. Here in the United States, some noises are being made about trying to renew the moribund “peace process,” but there is little enthusiasm about it. Indeed, most observers do not believe there is any real possibility for progress.

This sort of atmosphere tends to engender two responses. One was presented to me directly by Professor Stephen Walt, co-author of The Israel Lobby, who said:

What the United States, Israel, and the Palestinians need is a peace settlement, not more ‘peace process.’ If Obama is serious, he should lay out a detailed U.S. plan for establishing a viable Palestinian state with appropriate security guarantees for Israel, and he should make U.S. diplomatic, economic, and military support for both sides conditional on their willingness to conform to it. If either one balks, the United States should distance itself and cut off aid.

I didn’t ask, but I feel safe in assuming that, despite the merits of this proposed course of action, Steve is well aware that the chances of this happening are roughly the same as Sheldon Adelson saluting a Barack Obama parade. Still, he is far from alone in advocating for pressure on both sides. Jewish Voice for Peace leads that call from the Jewish community, which is far more divided on this question than one is often led to believe. The global Boycott, Divestment and Sanctions (BDS) movement is growing and having an impact as well, including in the United States. A coalition of mainstream Christian leaders recently called for a review of US aid to Israel. And, of course, Palestinian-American and Arab-American activists continue their own dogged efforts, despite the particular obstacles they face in the US.

The other response, favored in Washington, is to simply say that the time is not ripe and the United States must manage the situation until conditions, particularly  the leadership of Israel and the Palestinian Authority, are more suitable. This view is rooted not only in Israel’s intransigence, but also in the ongoing split between the PA and Hamas, as well as a certain conservatism about any action while the region is in such a state of flux. In fact, it appears that, until something comes about to change the dynamics, this is exactly the course that the Obama Administration is likely to follow.

But there are, in fact, other options, and here’s a modest one I’d like to put forward: Obama could spend the time until other action is politically viable, either domestically or in the region, by working to correct some of the United States’ most grievous missteps. And I suggest he start by walking back George W. Bush’s 2004 letter to Ariel Sharon.

That letter, part of an exchange of such letters between Bush and Sharon, fundamentally altered the nature of negotiations and was instrumental in poisoning the atmosphere around talks between Israel and the Palestinians. However flawed the Oslo process might have been from the beginning, the promises Bush made to Sharon in his letter magnified those flaws immensely.

The significance of Bush’s letter was huge. It didn’t introduce much that was new, but it essentially gave Israel gifts in the form of matters that were supposed to be negotiated. The letter also went further in Israel’s favor with some matters than the Clinton Parameters. Those Parameters were and are the essential basis for Israel-Palestinian negotiations.

The biggest departure Bush made from the Clinton Parameters was on Palestinian refugees. Clinton included at least some acknowledgment of the importance that the Right of Return has for Palestinians and listed five possible destinations for their relocation, one of which was within Israel proper. Bush summarily executed that idea. The relevant text from his letter:

It seems clear that an agreed, just, fair and realistic framework for a solution to the Palestinian refugee issue as part of any final status agreement will need to be found through the establishment of a Palestinian state, and the settling of Palestinian refugees there, rather than in Israel.

To date, this framing has ruled. It has been considered an established fact that refugees would return somewhere other than Israel and that even any token return, as was occasionally discussed by Prime Minister Ehud Olmert, would happen on an insignificant level.

It was not unfair for an analyst, in 2004, to expect that such would be the outcome. But that would have been an expected result of negotiations, not an established fact preceding them. With an American president’s imprimatur, the entire framework of negotiations was changed, and the idea of refugees returning to Israel — something that is anathema to most Israelis and sacrosanct to most Palestinians — was simply decided by fiat in favor of Israel and removed from the negotiating arena.

Another passage has had even more impact: Bush’s assurance that Israel would not go back to the 1967 lines. The Clinton Parameters proposed that Israel keep the “major settlement blocs” as well. But it was Bush’s statement, again, which removed the issue from the negotiating table. In essence, he handed Israel an assurance that it would keep the “major population centers” that had grown up in the West Bank and, ever since then, Israel’s excuse for building in those settlements has been based on the argument that “everyone knows” they are going to remain in Israeli hands anyway. Again, the text of Bush’s letter:

In light of new realities on the ground, including already existing major Israeli populations centers, it is unrealistic to expect that the outcome of final status negotiations will be a full and complete return to the armistice lines of 1949, and all previous efforts to negotiate a two-state solution have reached the same conclusion. It is realistic to expect that any final status agreement will only be achieved on the basis of mutually agreed changes that reflect these realities.

Whereas the Clinton Parameters tied the retention of the settlements to a specific (if unbalanced) swap of land, no direct mention of the Palestinians receiving anything in exchange is made here. That has enabled Israel not only to use the US position as a cover for settlement expansion, it has also allowed them to essentially pocket these settlement blocs and negotiate over what else or how big a swath around them would be kept.

There are other points in the letter which are unworkable or inconsistent with international law, existing US policy or both. But those two points fundamentally altered the negotiating framework.

What Obama can do during his second term is walk these points back and return them to the Clinton Parameters. He can cite the Parameters’ five options for the refugees (return to the new state of Palestine or to the areas Israel swaps to that new state, settlement in the states they currently reside in, resettlement in other states or return to Israel) and reaffirm UNGA Resolution 194 as the basis for a resolution, as stated in the Parameters and in the now 10-year old Saudi peace proposal. This would be framed as a basis for negotiation, not as a finished proposal.

On the land issue, Obama could reaffirm the ’67 borders as the basis for talks, with agreed upon modifications that would amount to equivalent value when quality and quantity are accounted for. This does not amount to a map, and allows plenty of room for negotiation, including over the use of the West Bank aquifer, which is fully on Palestinian land but crucial for Israel’s needs.

If, in this context, Obama also reaffirms support for full Palestinian sovereignty and international guarantees of security for both Israel and Palestine, he could also address the condition of a Palestinian state being de-militarized, which is an impingement on Palestinian sovereignty and is a much more bitter pill for Palestinians to swallow than it was in 2000.

Of course, Congress will go ballistic, as will Israel, as the point of all of this is to take Palestinian demands just a little more seriously. But as much as Congress, AIPAC and Israel would like to deny it, that is a sine qua non for any substantive progress at this point and such a proposal would likely play very well in the EU, the UN and even with Russia and China. The Arab League will likely support it enthusiastically.

Obama would have to approach the process gradually and take the time to lay the groundwork for it. But it certainly appears right now that he has that time; he doesn’t seem to have many other cards to play in the Israel-Palestine milieu right now either. This is something that can actually be done and can have lasting effect, well after Obama is out of office. It also opens up a chance to rethink the whole outline of a two-state solution, which is the only thing that can possibly save that idea from the failure of Oslo. Obama would be well advised to try it.

WASHINGTON, Dec 6 2012 (IPS) - Increasingly distressed over the possible consequences of Israel’s recent steps to punish the Palestinian Authority (PA) and consolidate its hold on the West Bank, a number of prominent voices here are urging President Barack Obama to exert real pressure on Israeli Prime Minister Benjamin Netanyahu to reverse course.

His government’s announcement that it will build 3,000 new housing units in East Jerusalem and the West Bank and expedite planning for the development of the area known as E-1, the last undeveloped area that links the northern and southern parts of the West Bank, is seen here as a particularly damaging provocation both for Palestinians and the administration itself.

“Construction in E-1 would make it almost impossible to provide a future Palestinian state the contiguity it needs to be viable and cut it off from East Jerusalem,” warned Debra DeLee, president of Americans for Peace Now (APN), a Jewish peace group.

“Without a viable Palestinian state in the West Bank and the Gaza Strip, Israel is doomed to become a bi-national state, which means an end to the Zionist vision of an Israel that is both Jewish and democratic,” she added in an appeal to Obama to “personally intervene with …Netanyahu and demand that his government reverse its decision.”

Hers was one of a number of voices urging the president to take much stronger action against the Israeli leader, who is also withholding from the PA more than 100 million dollars in desperately needed tax receipts in retaliation for its successful bid at the U.N. General Assembly late last month to gain “non-observer state status”.

Unlike several European countries, notably Britain, France, Spain, Denmark, and Sweden, the U.S., one of only nine countries – out of 188 – that voted against the PA’s diplomatic upgrade, has not yet formally protested Israel’s actions.

Indeed, its initial reaction to Israel’s announcements was relatively muted. Calling the moves “counter-productive” to the goal of resuming peace talks, the White House simply “urge(d) Israeli leaders to reconsider these unilateral decisions…” After three days, the State Department released a statement noting that construction in the E-1 area would be “especially damaging to efforts to achieve a two-state solution.” Obama himself has been mum on the issue.

The relative mildness of the U.S. response to date has suggested to many here that the president has no intention of taking on the Israeli leader in a renewed effort to get a peace accord, a goal he pursued with considerable earnestness in the first 18 months of his administration before essentially giving up pending the outcome of this year’s election.

Given the Israel lobby’s strength with both sides of the aisle in Congress, Obama may want to avoid more bruising battles in his second term with Netanyahu, whose right-wing coalition is considered likely to win next month’s parliamentary elections, and his powerful supporters here.

He may wish instead to focus on domestic priorities, further reducing the U.S. “footprint” in the Greater Middle East, and consolidating his “pivot” to the Asia-Pacific.

Nonetheless, there is little love lost between Obama and the Israeli leader, who all but publicly endorsed Obama’s Republican challenger, Mitt Romney, during the election campaign.

An hint of that bad blood surfaced this week amidst reports that, in a high-powered, off-the-record meeting with prominent Israelis and their U.S. supporters at the Brookings Institution’s Saban Center last weekend, former White House Chief of Staff Rahm Emanuel, who remains close to Obama, accused Netanyahu of having “repeatedly betrayed” the president.

Emanuel, currently the mayor of Chicago, singled out Israel’s latest moves against the PA, which he reportedly described as particularly galling, given Washington’s support for Israel during its brief war last month against Hamas in Gaza and its lonely opposition to the PA’s diplomatic upgrade at the U.N.

Some believe the president may be waiting to take action until he resolves more-urgent business, notably averting the so-called “fiscal cliff” at the end of this month, then negotiating a bigger deficit deal early next year, and getting a new foreign-team up and running.

Others, including former President George W. Bush’s top Middle East aide and a staunch defender of Netanyahu, Elliott Abrams, believe Obama may be playing a double game by, on the one hand, muting U.S. displeasure with Israel while, on the other, encouraging Washington’s European allies to distance themselves from Israel – as they did during last week’s U.N. vote.

The decision by Germany, which has long defended the Jewish state’s actions in world forums, to abstain on the Palestinian vote, reportedly came as a particular shock. Indeed, the only European nation joining the U.S. in the lonely “no” column was the Czech Republic.

“The sense that the Netanyahu coalition can’t get along with Europe or the United States may hurt Netanyahu with Israeli voters – which is perhaps the precise objective of this entire effort,” Abrams wrote in National Review Online.

While such a strategy may indeed bear fruit, others insist that the stakes for the U.S. are too high to forgo more-assertive tactics toward Israel’s leadership, particularly as it has itself moved increasingly rightward. This is particularly true in light of the Arab Awakening and the rise of political Islam throughout the Middle East.

“The clear trend is toward both greater religiosity and greater identification with the Palestinian cause,” noted Amb. Chas Freeman (ret.), a top U.S. Middle East specialist, in a recent lecture in which he also argued that Israel’s “mid-November assault on Gaza has simply re-inforced the regional view that Israel is an enemy with which it is impossible to peacefully co-exist” and that Israel’s land grabs were making a two-state solution increasingly improbable.

Zbigniew Brzezinski, who served as national security adviser to former President Jimmy Carter, argued that Obama should seize back the initiative from the influence of the Israel lobby in Congress, stressing that he can overcome opposition there “if he stands firm for ‘the national interest’.”

Last week’s U.N. vote, he noted, “marks the nadir of the dramatically declined global respect for U.S. capability to cope with an issue that is morally troubling today and, in the long run, explosive.” The greatest opportunity for taking action, he added, would be in the first year of his second term.

Similarly, Paul Pillar, a career CIA analyst who also served as National Intelligence Officer for the Near East from 2000 to 2005, called this week on his nationalinterest.org blog for Obama to treat Netanyahu much the same way as he is dealing with Republicans in Congress over the budget: “by taking his message campaign-style to the country.”

“His appeal over the heads of members of Congress is a recognition that the opposition party understands only the language of political force. But Mr. Obama also has had enough bitter and frustrating experience with Netanyahu to warrant reaching similar conclusions regarding dealing with Israel,” he wrote, noting that policy toward Israel has become “just as much a domestic issue as the budget,” particularly in light of the Israeli prime minister’s own interference in the U.S. elections.

Moreover, he noted, a very recent survey conducted by the Saban Center’s Shibley Telhami found that 62 percent of the Israeli Jewish electorate hold favourable opinions of Obama, suggesting that a “charm offensive” there by the U.S. president could yield dividends.

In only the past few weeks, Fox has done at least two interviews promoting the settler propaganda movie “Iranium,” which, according to the host of a New York premiere, is aimed at promoting an attack on the Islamic Republic.

Now the conservative-leaning channel is zooming in on Iran at State Department briefings and reporting on an Israeli account of two Iranian warships about to pass through the Suez Canal. (I’m planning on addressing Fox‘s report on the apparently developing Suez incident in a piece for the wire, and I’ll post that when it’s up.)

At State, Fox‘s James Rosen honed in on the U.S.’s role in Iran during a briefing. Rosen quizzed a state adviser, Tomicah Tillemann, about how Iran fit into a meeting about the launch of an initiative to reach out to global civil society:

QUESTION: James Rosen, Fox News. Can you expound on how this effort is or isn’t affecting our ability to influence events in Iran?

MR. TILLEMANN: Again, I think that’s a question that we may want to leave to the briefing that will follow this immediately. But it’s a good question.

QUESTION: Is Iran not part of the efforts that you’re involved with?

MR. TILLEMANN: There was an Iranian activist who was present at the table with the Secretary this morning, and Iran is very much part of the discussion on civil society, and it’s a country with a rich history of civil society. As the Secretary spoke about in Krakow, Iran historically has had some of the strongest civil society in the Middle East, and we are eager to do what we can to strengthen that civil society. We think it’s very unfortunate the regime has turned its back on that rich tradition of civil society.

QUESTION: And how do you plan to advance it?

MR. TILLEMANN: We have a number of mechanisms, and we can talk specifics later if you’re interested.

QUESTION: Why is that not a fit subject for discussion with you? You’re the one in charge of the program.

MR. TILLEMANN: I’m – some of those programs are conducted, actually, through other bureaus, and we can talk with some colleagues in NEA and other partners within the Department who will be better equipped to give you specifics on those issues.

Moments later, responding to a reporter from Voice of America, Tillemann added that the Iranian was author Azar Nafisi, who holds some anti-regime views and has spoken before about the need for the West to understand (or at least know about) Iranian civil society.

May, the president of the Foundation for Defense of Democracies (FDD), which has five other experts who appear in the film, called Iran “radical.” But May refuses to answer whether he knew that the movie he starred in was written and produced by Alex Traiman, a member of another ideological religious movement: the Israeli settlers in the West Bank. (More below.)

With a history of hawkish pro-Israel advocacy and a past career as the spokesman for the Republican National Committee, we do know that May fits well into the film, which waffles between the usual Clarion Fund calls to action against the Muslim menace and a partisan flair of attacks on Barack Obama and the Democratic Party.

May offered hints of hawkishness in his Fox interview, delivering a thinly-veiled call for escalated actions to halt Iran’s nuclear program.

“The Western community needs to make up its mind that this regime must not get nuclear weapons,” May said, “and they must decide to take accelerated steps to achieve that goal.”

When I asked May when he knew — if at all — that Traiman was an ideological Israeli settler, he responded by e-mail, writing:

I hope that people will see the film and decide for themselves what conclusions to draw. I know there are those who would prefer people not see the film – that’s why there were threats against those screening it in Canada – and that’s why there are those who will engage in character assassination against the film-makers.

I explained to May that pointing out Trainman’s status as a West Bank settler only counts as character assassination if you make the value judgement that settlements are bad, and repeated that I was curious about his and FDD’s stance on the illegal Israeli civilan outposts in occupied territory.

Moreover, I made clear to May that my primary question was a factual one about when he knew Traiman lived in a settlement: “Did you know — when solicited to do an interview for, when you did the interview for, and when you promoted “Iranium” — that the film was written and directed by Alex Traiman, an Israeli West Bank settler?”

May replied: “I’ve given you my answer,” and repeated a claim he’d made at FDD’s Iran conference in December that what I do “bears little resemblance to legitimate journalism.” (I hasten to note that, other than that one outburst, May has never been anything but polite. He even answered my questions that same night after the conference for the Foreign Policy piece I wrote about the proceedings.)

I wrote back to May again:

Anytime you want to talk about FDD’s or your personal stance on settlements, I’m happy to do so. Ditto with my specific factual question about the timeframe in which you knew Alex Traiman, Iranium’s writer and director, was an ideological West Bank settler.

My offer, of course, still stands.
