Lindsey Graham, who is not a stupid person, can be so embarrassing. Speaking at a press conference alongside Israeli Prime Minister Benjamin Netanyahu in Jerusalem Saturday, Graham said the following in response to Bibi’s call for “more sanctions, and stronger sanctions” against Iran.

But you, above all others, have said that sanctions are what got Iran to the table, and it will be the only thing that brings them to a deal that we can all live with.

I’m here to tell you, Mr. Prime Minister, that the Congress will follow your lead. [Emphasis added.]

What a remarkable thing to say to a foreign leader when he’s hosting you in his country, especially when the president of your own country is clearly not happy with that prime minister’s approach to this particular problem.

But that’s not all he said. He implied that people in the US intelligence community, which has insisted for more than seven years now that Iran has not made a decision to build a nuclear weapon, should have their driver’s licenses revoked whenever they return from overseas assignments, meetings or vacations.

To those who believe the Iranians have not been trying to develop a nuclear weapon, if you come to America, you should not be allowed to drive on our highways. Clearly, this regime for years has been deceiving the international community, has been trying to pursuit [sic], in my view, a nuclear weapon.

And then there’s this little gem offered to a leader who, as prime minister or the leader of the opposition, has steadfastly opposed the peace-making efforts of three US presidents, including George W. Bush, and who enthusiastically encouraged the United States to invade and occupy Iraq, among other incredibly stupid moves.

And what brings me here so many times, is common and shared values and common and shared enemies.

The fate of one country determines the fate of the other.

God bless the people of Israel, and you can count on the United States Congress, Republican and Democrat, to be there for you when you need us the most. [Emphasis added.]

Now, to be fair to Graham, he did not explicitly endorse Netanyahu’s call for “more sanctions, and stronger sanctions” despite his promise that Congress will follow Bibi’s “lead” in dealing with Iran. Instead, he promised that Congress will vote on the Kirk-Menendez bill, or what I originally called the “Wag the Dog Act of 2014,” next month, the approval of which, according to virtually all knowledgeable observers, will result in the collapse not only of the negotiations over Iran’s nuclear program, but also of the international sanctions regime. (For a more specific analysis, you can examine Ed Levine’s assessment of the bill after it was introduced last year.)

Graham, like Netanyahu himself, also insisted that he supports the administration’s efforts to negotiate a deal. “I would love nothing better than a diplomatic solution to the Iranian nuclear ambitions,” he said. “I support the Administration’s effort to try to bring this to a peaceful conclusion.” But then he went on to insist that any final agreement must include the abandonment by Tehran of its uranium enrichment capabilities—a demand that all of the P5+1 (US, UK, France, Russia, China plus Germany) consider totally unrealistic.

Now, Graham often has had a problem with getting a little carried away in his public rhetoric. Reacting to President Obama’s State of the Union Address last January, and particularly his remarks about imposing sanctions against Iran, the South Carolina senator warned that “the world is literally about to blow up.” At the 2010 Halifax International Security Forum, Graham reportedly stunned the audience—and apparently embarrassed his hosts—by calling for a full-scale attack on Iran beyond its nuclear facilities.

So my view of military force would be not to just neutralize their nuclear program, which are probably dispersed and hardened, but to sink their navy, destroy their air force and deliver a decisive blow to the Revolutionary Guard. In other words, neuter that regime.

But then last June, Graham, while on the rounds of the Sunday talk shows and apparently freaked out about Islamic State’s sweep in northern and western Iraq, called for Washington to work with Iran (and presumably with the hated Revolutionary Guard) to protect Baghdad. The US has to “have to have some dialogue with the Iranians that says, ‘let’s coordinate our efforts,’ but has some red lines,” he said on one show. “The Iranians can provide some assets to make sure Baghdad doesn’t fall,” he said on yet another. “We need to coordinate with the Iranians. To ignore Iran and not tell them, ‘Don’t take advantage of this situation,’ would be a mistake.”

More recently, Graham denounced the Republican-led House Intelligence Committee’s report on Benghazi as “full of crap.”

It’s pretty clear that Graham can sometimes get excitable, especially when the TV cameras are rolling.

Assuming that the Kirk-Menendez bill does come to the floor next month, however, the big question is whether it will attract enough Senate Democrats to render its passage veto-proof (because there’s no doubt whatsoever that Obama will veto it). That will take 33 Democrats and/or independents and/or Republicans. At this point, I think the president should not have too much trouble getting those votes, and the fact that Graham has now taken the lead on this while on foreign soil will likely make it easier for Obama to get the Democratic support he needs. But Graham’s assurance that a Republican-led Congress will “follow [Netanyahu’s] lead” (against a US president, if necessary) should prompt a few of his fellow-Republicans to reflect just a little on the implications of such deference by a powerful US senator to a foreign leader.

Graham also had a lot to say about Hamas and withholding funding for the United Nations if it becomes more involved in seeking an Israeli-Palestinian settlement. You can read the whole transcript of his appearance with Netanyahu here and judge for yourself.

The obsession in politics and diplomacy with decorum–largely a relic from the past–can easily distract people from the realities of the present. Case in point, the uproar over Jeffrey Goldberg’s latest article in the Atlantic, the headline of which, The Crisis in U.S.-Israel Relations Is Officially Here, would seem important enough to warrant more attention than it has gotten so far.

Instead, the whisper of an unnamed “senior Obama administration official,” who called Netanyahu a “chickenshit,” has occupied headlines. And instead of taking a strong, or even a weak stance on Netanyahu’s repeated declarations about expanding settlement activity everywhere in Jerusalem and the West Bank, the White House has only tried to distance itself from the remark, describing it as “unauthorized” and “inappropriate.”

As Goldberg himself pointed out, the fact that Bibi is a chickenshit is not entirely a bad thing. Whatever else it does, it also makes him quite afraid to back up his rhetoric with action. Even in Gaza this summer, the ongoing slaughter seemed, from Netanyahu’s point of view, to be something that spiraled much further out of control than he had intended. Indeed, his constant shifting of the mission’s goal posts indicated the lack of any sort of planning beforehand. Political pressures kept driving him on, as they do with most of his actions. But at least the “chickenshit” was never going to attack Iran despite his bellicosity, as the United States seems to finally understand.

Being less of a leader and more of a leaf blowing in the political wind is an apt description of Netanyahu, and it is strongly suggested in Goldberg’s piece. But it also applies to the Obama administration, which has repeatedly refused to use the tools it has at its disposal to create real pressure on Israel to, at the very least, desist from its actions that are obviously intended to destroy any possibility of a two-state solution. So, chickenshit cuts both ways.

Maybe Goldberg intended the chickenshit comment to overshadow the rest of his point, maybe he didn’t. But the assertion that we are in a period of crisis for US-Israel relations is a very important one. The question is: are we?

The simple answer is no, but Goldberg is not wrong in suggesting that such a crisis could occur in the near future. One can understand why Goldberg focuses so much on personal clashes. Never in the history of Israel has there been a government that so arrogantly insulted the United States so frequently. Whether it’s Netanyahu, Finance Minister Naftali Bennett, Defense Minister Moshe Ya’alon, or some other member of the Knesset, anti-American statements have risen to unprecedented levels.

For their part, US officials have been getting just the tiniest bit harsher in their criticism of Israel, while Israeli officials escalate their anti-US rhetoric. And then there’s the endless stories about how much Obama and Netanyahu dislike each other, with Goldberg’s in the lead. The problem, of course, as it is presented in this narrative of interpersonal conflict, is bad communication, or mismatched personalities.

In reality, none of this is really about Bibi and Barack disliking each other. They do, but that is beside the point. It is the direction that Israel has decided to go in that is the problem.

Let’s start off by noting that the degree of the “crisis” is being massively overblown. There is a much bigger problem in Europe for Bibi than there is in the United States. The Europeans are actually threatening to take some action, not just calling Bibi names in whispers to reporters. Sweden’s recognition of Palestine as a state is just a first step in a series of actions that might be on the horizon from Europe, where Israel conducts the biggest share of its trade. When the United States gets to that point, as it has on occasion in the ever more distant past, then we can start wondering if there is a crisis in relations that might cause some small shift in the status quo.

The “chickenshit” epithet can apply to Obama just as much as it can to Netanyahu. He is a president with a non-confrontational style trying to govern with what is, arguably, the most defiant and combative Congress any president has ever had to deal with. And he is dealing with an Israeli government that is pursuing a very different strategy than its predecessors. The Israel of today no longer cares about the majority of the Jewish community in the United States. This Israel, correctly, determined that its ultimate desire to completely thwart a two-state solution and maintain an apartheid system over the Palestinians would never be acceptable to most American Jews. But most US Jews weren’t the ones providing the political power and, more importantly, the funding for congressional campaigns and for settlements in the West Bank.

The Jews that do provide these things, as well as the Christians, are right-wingers, either in their general politics or at least on Middle East policy (including policy toward the entire Arab world, Iran and Turkey). They are now the only ones Israel cares about. More liberal-minded devotees are not, at this stage, providing that much support for Israel, either economically or financially. Those of them who do provide this support will continue to check their otherwise liberal values at the Israeli door. The rest are not, in the estimate of the Netanyahu government, worth the compromises that must be made to garner their support.

In this circumstance, Israel has a freer hand in its actions. While Netanyahu announces more and more building plans in East Jerusalem and other sensitive parts of the Occupied Territories, Republicans, who stand a good chance of controlling both houses of Congress, are not criticizing Israeli actions in the slightest. Instead, as one would expect, they are attacking Obama for his insufficient support of Israel.

In this context, Israeli journalist Roi Ben-Yishai, one of Israel’s best, recently reported on Israel’s “new approach” to the Palestinians. It holds few surprises. Israel is not intending to return to talks, correctly believing they will be futile, and therefore would only make things worse. Israel’s assessment will remain correct until its own positions can be moderated by pressure like that of the Palestinians over the years.

The plan is then to have the quiescent Palestinian Authority (PA) assume control over Gaza and reinforce its control on the West Bank. In other words, marginalize Hamas throughout the Palestinian body politic. Under those circumstances, Israel would end the siege of Gaza and ease restrictions on movement in the West Bank as well. The idea is that the Palestinians can then build a functional economy, which Israel believes will cause the Palestinian people to oppose actions that could draw Israeli military reprisals. I rather doubt that would be the result, but right now, the delays in Palestinian international action imply that PA President Mahmoud Abbas is cooperating with Israel and Egypt on this effort, probably in the hope that this strategy would eliminate Hamas as a political rival.

This seems like another doomed plan, one that harkens back to old Israeli beliefs that Palestinian nationalism will eventually just go away. But we must recognize that this is happening with the silent approval of the United States. Egypt, in particular, would not work with Israel on such a plan if it believed that the United States would object. More to the point, the plan is also intended to provide the US with what it wants most: Palestinian silence. What American policy has always represented is the complete lack of importance placed on the welfare of the Palestinians, or anyone else (including ordinary Israelis) in the region, for that matter. The entire issue is only relevant insofar as it affects more “important” US concerns.

So, the Obama administration will likely allow Israel to proceed with its plans, even if it doesn’t believe those plans are likely to succeed. This is evident in the lack of material response to Israel’s direct challenge to the international consensus on a two-state solution.

The name-calling most recently highlighted by Goldberg merely reflects these disagreements and the fact that the increasingly populist and rightward tilt not only in the Israeli government but also in its population leads to verbose criticism of US officials, up to and including the president. Responses to such insults can be countered by Israel’s power in Congress in a way that more fundamental policy differences cannot. That frustrates some American officials, but it doesn’t provoke any material US response.

If Congress persists in pressuring the administration on its Iran policy, a pressure which most understand as directed by Jerusalem, Obama may well respond through the Palestinian issue. In that case, we might see a more direct counter to Israeli policies, such as a Security Council resolution condemning the settlements or even an “Obama Plan” basing a two-state solution on the 1967 borders and sharing Jerusalem. That would be a turn of events not seen in decades, but Israel has also never worked so hard to undermine US goals on foreign policy matters as it has on Iran.

But make no mistake, if the Palestinians get any respite from the Obama administration it will be because of Israel’s meddling through Congress on the Iran issue. It will not be due to any Palestinian action, much less on the insulting attitude of Israeli officials or the personal dislike between the current Israeli leader and the president of the United States. It is, ultimately, all about policy priorities, not personalities.

After Palestinian President Mahmoud Abbas stirred up some controversy by terming Israel’s recent bombardment of Gaza a “war of genocide” at the UN General Assembly last week, there was some speculation that the Israeli prime minister would come in breathing fire. But all Benjamin Netanyahu presented in his Monday address was the same old smoke.

Netanyahu was expected to rail against the Palestinian Authority leader, but he merely said he was “refuting” Abbas’ “lies” and instead focused on bringing his two favorite themes together: the Islamic State (IS) and Hamas are the same thing, and Iran is trying to fool the world with a moderate president while trying to acquiring a nuclear weapon.

Netanyahu addressed a largely empty hall, with mostly junior diplomats sitting through his speech, though billionaire casino magnate Sheldon Adelson and lawyer Alan Dershowitz, both staunch pro-Israel advocates, were also spotted in the hall. There was occasional applause but it mostly came from the Israeli delegation, a stark contrast to the kind of reception Bibi gets in the halls of Congress. Adelson apparently hosted Netanyahu for lunch following his speech.

Bibi has routinely made a fool of himself on the international stage. But what he says often plays fairly well in Israel, and it is always greeted with fawning adoration on Capitol Hill, though that means little—the response would be the same if he read from a phone book. Two years ago his Iranian cartoon bomb visual aid was ridiculed. This time he presented a blurry, unconvincing photo of children playing near what he claimed to be a rocket launcher. Few were impressed.

In fact, Bibi’s speech reeked of a desperation that has been a long time coming. True, the negotiations over Iran’s nuclear program are struggling along right now, but not for the reasons he had hoped for. Both sides are stuck on the details of Iran’s future capacity for nuclear enrichment, but both sides are also still committed to finding a resolution. That may or may not happen, but even if talks fail, that desire will remain and no one, absolutely no one, is interested in Bibi’s ludicrous and illegitimate standard of preventing Iran from maintaining any enrichment program at all.

On Gaza, Bibi knows full well that even the Obama administration was displeased by the obviously illegal Israeli actions in the strip this summer. Yes, the US can probably still be counted on to frustrate any UN moves for consequences directed at Israel, but that American view remains problematic as it will only fan the flames of much greater outrage in Europe. Netanyahu would be well-advised to stop talking about Gaza, but instead he peddles the ridiculous line that “Hamas is ISIS.” Again, no one is buying.

Between ham-handed references to retiring New York Yankees shortstop Derek Jeter and demonstrating his lack of geographic knowledge by claiming that Tel Aviv is as close to the Green Line (the internationally recognized border between Israel and the West Bank) as the UN building is to Times Square (Tel Aviv is actually about five times as far from the Green Line), Netanyahu gave the impression of a man with nothing new to say. And, indeed, there was nothing new.

Perhaps somewhat notable in its absence was any mention of a two-state solution. Netanyahu used his well-worn line about his willingness to make “historic compromises” but said it in the context of declaring his opposition, rather than his support for peace. Here’s the full quote:

I’m ready to make a historic compromise, not because Israel occupies a foreign land. The people of Israel are not occupiers in the land of Israel. History, archaeology and common sense all make clear that we have had a singular attachment to this land for over 3,000 years. I want peace because I want to create a better future for my people, but it must be a genuine peace–one that is anchored in mutual recognition and enduring security arrangements–rock solid security arrangements on the ground, because you see, Israeli withdrawals from Lebanon and Gaza created two militant Islamic enclaves on our borders for which tens of thousands of rockets have been fired at Israel, and these sobering experiences heightens Israel’s security concerns regarding potential territorial concessions in the future.

So, the lands is ours and maybe someday we’ll give the Palestinians a tiny bit if all of our conditions are met. That, in the Netanyahu dictionary, is “historical compromise.”

But Bibi did present his ideas of peace. Well, not exactly his idea. He stole the idea from his foreign minister, the far-right leader of the proto-fascist party, Yisrael Beiteinu, Avigdor Lieberman. Lieberman has proposed, on several occasions, that Israel seek peace with the so-called “moderate Arab states” and then pursue an agreement with the Palestinians. It is, of course, a non-starter, as absurd as closing one’s eyes and believing the conflict will simply go away. But this is what passes for diplomacy in Bibi’s speech to the United Nations.

As with Abbas, Bibi was primarily speaking to his audience at home, both in Israel and in the United States. Abbas, however, won points at home, perhaps enough to compensate for the distaste his use of the term “genocide” evoked elsewhere. It’s hard to imagine that Netanyahu’s speech did much for anyone in Israel. It was a mere recycling of what have become clichés, and, while he did display his characteristic obstinacy, Bibi didn’t come across even as forceful as he has in other major speeches.

One point Netanyahu made has so far escaped notice, but in light of recent events bears scrutiny. He said that “…as prime minister of Israel, I’m entrusted with the awesome responsibility of ensuring the future of the Jewish people and the future of the Jewish state.”

Now, as protests became angrier over the summer, the inevitable, though generally isolated, incidents of anti-Semitism were often, and quite intentionally blended in analyses by defenders of Israel’s massive military campaign. The refrain, heard over and over, was that Jews should not be held accountable for Israel’s actions.

I agree completely. But the flip side of that is that Israel does not represent world Jewry. If a Jew in the US or France or Australia or Iran wants Israel to represent her, she should accept Israeli citizenship and move there. Netanyahu is quite correct that part of the job description of prime minister of any country is the security and well-being of that country’s citizens. But he is no more entrusted with my future, or the future of any other non-Israeli Jew, no matter how strong their Zionism may be, than David Cameron is responsible for Brits who have become citizens of other countries, or Angela Merkel is for German-Americans. They are all responsible for their citizens.

Indeed, the point is even stronger with Israel, which offers automatic citizenship to any Jew who emigrates there. Being of Jewish descent is sufficient to trigger that offer, something no other nation-state offers to descendants of its nation who are citizens of other states.

People can’t have it both ways. If they want to consider themselves Israelis and therefore have Netanyahu take responsibility for their well-being, then they are also responsible as any Israeli citizen is for their country’s actions. Most of us in the global, non-Israeli Jewish community do not want that responsibility, and so we are represented by the governments of our countries. Netanyahu should therefore worry about Israelis—and he’d do well to pay attention to ALL of his citizens and not just the Jewish ones—rather than trying to usurp responsibility for the Jews who didn’t elect him.

Obama met with Netanyahu two days after his UN address. At virtually the same time, the Israeli government was giving final approval to a new settlement in East Jerusalem that is widely understood to be the final nail in the coffin of the long-dead peace process. Between Obama’s barely a mention of Israel-Palestine, Abbas’ much more confrontational tone, and Netanyahu’s mantras, there was little hope left for the near future. If ever there was a time for powerful international intervention it is now. But with Abbas having announced a proposed Security Council resolution calling for Israel to end its occupation in 2016, and the United States having already signaled it would veto any such resolution, that doesn’t seem likely.

The White House has insisted that weapons transfers to Israel have not been suspended or halted, and that the administration is only “taking extra care to look at these shipments.” Yet some analysts understood the unusual decision as a warning message to Tel Aviv about the use of disproportionate force. Whether or not that’s true, it’s no secret that the United States is Israel’s biggest source of military assistance, even if the White House has not been completely aware of the extent of that support.

Two years ago, Congress passed the United States-Israel Enhanced Security Cooperation Act (P.L. 112-150), which reiterated, as a matter of policy, the US commitment “to help the Government of Israel preserve its qualitative military edge amid rapid and uncertain regional political transformation.” It expressed the non-binding “sense of Congress” favoring various possible avenues of cooperation: providing Excess Defense Articles to Israel; enhanced operational, intelligence, and political-military coordination; expediting the sale of specific weaponry including F-35 joint strike fighter aircraft, refueling tankers, and “bunker buster” bombs; as well as an US-Israel cooperative missile defense program and additional aid for Israel’s Iron Dome anti-rocket system.

Iron Dome: Approaching $1 billion—and Beyond

Iron Dome, a dual mission system built by Israeli defense contractor Rafael Advanced Defense Systems, which doubles as a very short range air defense system and an interceptor of incoming rockets, mortars and artillery, has received $720 million in American funding since the program’s inception in 2011. Israel currently has nine batteries, each costing about $100 million. The price tag for every Tamir missile fired by the Iron Dome system costs an estimated minimum of $50,000, with two missiles responding to every incoming rocket that is considered a threat to Israeli lives and property.

US support for Iron Dome will soon surpass $1 billion. In March, the Pentagon asked for $176 million for the program for Fiscal Year 2015, which begins Oct. 1, but the Senate Appropriations defense subcommittee raised the Iron Dome appropriation to $351 million on July 15—more than half the $621.6 million it had appropriated for Israeli missile defense for the upcoming year. A week later, Defense Secretary Chuck Hagel sent a letter to Senate leaders and key committee chairpersons relaying the Israeli government’s request for an immediate $285 million of emergency allocation for Iron Dome. On Aug. 1—a Friday afternoon—the House (398-8) and Senate both approved adding an additional $285 million to Iron Dome’s funding, which was followed by President Obama’s signature the following Monday morning.

As of last week, according to Y-Net, Iron Dome reportedly had a 90% success rate during the first month of  “Operation Protective Edge,” intercepting more than 600 rockets headed toward Israeli population centers from Gaza.

Autopilot Foreign Policy 

After Israel’s bombing of the UN school in Gaza, and the huge loss of Palestinian civilian lives due to the war, the Obama administration apparently became aware that it was unformed about, and had very little control over US military assistance to Israel. Indeed, the Wall Street Journal reported Aug. 14 that President Obama had just discovered that the US military was authorizing and providing weapons shipments to Israel without his knowledge.

Unknown to many policy makers, Israel was moving on a separate track to replenish supplies of lethal munitions being used in Gaza and to expedite the approval of the Iron Dome funds on Capitol Hill.

On July 20, Israel’s defense ministry asked the US military for a range of munitions, including 120-mm mortar shells and 40-mm illuminating rounds, which were already stored at a pre-positioned weapons stockpile in Israel.

The request was approved through military channels three days later but not made public. Under the terms of the deal, the Israelis used US financing to pay for $3 million in tank rounds. No presidential approval or signoff by the secretary of state was required or sought, according to officials.

The White House then instituted a review process over armaments being shipped to Israel, instructing the Pentagon and the US military to hold a transfer of Hellfire missiles. According to Haaretz:

Against the backdrop of American displeasure over IDF tactics used in the Gaza fighting and the high number of civilian casualties caused by Israel’s massive use of artillery fire rather than more precise weapons, officials in the White House and the State Department are now demanding to review every Israeli request for American arms individually, rather than let them move relatively unchecked through a direct military-to-military channel, a fact that slows down the process.

One senior US official said the decision to tighten oversight and require the pre-approval of higher-ranking officials for shipments was intended to make clear to Israel that there is no “blank check” from Washington in regards to the US-made weapons that the Israel Defense Forces (IDF) uses in Gaza.

For its part, the State Department has denied reports that it has been kept in the dark about US to Israel weapons transfers. Last week spokeswoman Marie Harf disagreed with the WSJ‘s assessment that the executive branch had been blindsided, and attributed any apparent delay to “inter-agency process.”

The Times of Israel has since reported that the holdup of the Hellfire missiles has been resolved; the weapons will soon be on their way. Although the anonymous Israeli official who operated as a source for the story didn’t specify when the weapons would be arriving, according to Israel’s Channel 10 news, “the incident is behind us.”

According to reports, Egypt has given both Israel and Hamas a take-it-or-leave-it plan for ending the current round of violence. It bears examination, not only for its intrinsic worth, but also for the implications it holds. As of this writing, Hamas has indicated it does not find the proposal “sufficient” in addressing their demands, and Israel has yet to respond directly. As reported:

  • Israel will halt all attacks on Gaza — by land, air or sea.
  • All Palestinian factions in Gaza will stop all attacks against Israel by land, air or sea, and will stop the construction of tunnels from Gaza into Israel.
  • The passage of people and goods will be allowed in order to rebuild Gaza. The transfer of goods between Gaza and the West Bank will be permitted, according to principles that will be determined between Israel and the Palestinian Authority (PA).
  • Israeli authorities will coordinate with the PA all issues of funds related to Gaza and its reconstruction. (This refers to paying government employees in Gaza, a major sticking point between Fatah and Hamas)
  • The buffer zones along the security fence in the northern and eastern Gaza Strip will be eliminated and PA forces in those areas will be deployed beginning January 1, 2015. This will be conducted in several steps: At first the buffer zone will be reduced to 300 meters from the border, then 100 meters and finally the removal of the buffer zone altogether with the deployment of PA troops.
  • The fishing zone off the Gaza coast will immediately be extended to 6 miles, and will be gradually extended to 12 miles, in coordination between Israel and the PA.
  • Israel will assist the PA in rebuilding infrastructure destroyed in Gaza, and will assist in providing basic necessities for those Gaza residents who were forced to flee their homes due to the fighting. Israel will provide medical aid to the wounded, and will expedite the transfer of humanitarian aid and food through the crossings.
  • The PA, in coordination with Israel and international aid groups, will provide the basic products needed to rebuild Gaza, according to a predetermined schedule that will allow those driven from their homes to return as soon as possible.
  • Egypt implores the international community to provide swift humanitarian and monetary assistance for Gaza’s reconstruction, according to a set schedule.
  • Upon the stabilization of the ceasefire and the return to normal life in Gaza, the sides will conclude their indirect negotiations in Cairo within a month after signing the deal. The exchange of prisoners and bodies will also be discussed at that time.
  • The possibility of constructing an airport and sea port in Gaza will be considered in accordance with the Oslo accords and other previous agreements.

At first glance, one might think that Israel would reject these terms. Almost none of Israel’s demands are included. Hamas, and the other Palestinian factions in Gaza, would not be disarmed, contrary to Netanyahu’s latest goal, which was not on the table when the fighting began (remember when Bibi was saying that all he wanted was “quiet for quiet”). And yet, while Israel certainly has shown no enthusiasm about this offer, it has not dismissed it either.

Israel is not, of course, going to accept the Egyptian terms, but its lack of outrage over what it certainly views as a one-sided deal speaks volumes. The fact that first Spain, then the United Kingdom and finally the United States all put temporary brakes on their usually consistent flows of arms to Israel was a serious message. And that message was heard loud and clear in the office of Prime Minister Benjamin Netanyahu.

Make no mistake: Spain, the UK, and most certainly the US will all resume the normal flow of weapons to Israel soon enough. The reviews and procedural changes that the countries made will not impede that flow and they certainly are not affecting Israel’s military capabilities either now or in the future. That wasn’t the point.

The point was to send Israel a message. That message was that the excesses of the current right-wing government in refusing peace, ignoring the boiling crises in the Occupied Territories, needlessly torturing Gaza and now finally killing far more civilians than could be explained away was more than the West was prepared to tolerate. That message coming from Spain meant little. Coming from London, it meant more. Coming from Washington, it set off alarm bells in Israel.

So, Israel will not reject the offer out of hand, but Netanyahu is counting on the belief that Washington will not press him to accept these terms. He may be right about that; the terms do not offer Israel anything Washington will see as balancing the relief it grants Gaza. But something similar to this arrangement could well be on the horizon.

This is the case because both the Obama administration and the Egyptian government recognize this proposal for what it is: a death sentence for Hamas as a resistance movement in control of territory. Although the wording above was edited for space in this piece, the absence of not only any mention but any implied role for Hamas in Gaza’s immediate future was just as stark in the reported wording. The deal is intended to bring the people of Gaza relief while handing over rule of the Gaza Strip to the Palestinian Authority.

Of course, if Netanyahu was really interested in the “quiet” he routinely insists on, he would accept this deal. To be fair, though, if he did so, his right-wing flank would revolt and so would much of the center and even the center-left that has been backing him throughout this misadventure. That fact, however, only strengthens the crucial point that the Israeli right-wing, which is in firm control of the country and will be even more so if Netanyahu’s current government falls, is much more afraid of a unified Palestinian body politic than it is of Hamas.

The Islamist resistance group is in a difficult position with this Egyptian offer. Obviously Egyptian dictator Abdel Fattah al-Sisi has a passionate hate for Hamas, and they are well aware of that. But here he has been very clever; the deal is virtually everything Hamas has been demanding: the opening of border crossings, the easing of offshore restrictions, the elimination of the so-called “buffer zones” inside Gaza, and reconstruction in the wake of the recent destruction. Even the more ambitious demands of a seaport and airport are at least acknowledged. But it all happens between Israel and the PA, not in any kind of coordination, much less partnership, with Hamas.

In effect, this means that Hamas will cede control of Gaza to the PA. This was, of course, the ostensible goal of forming a unity government with the PA in the spring. But things have changed since then. The PA’s cooperation with Israel during the Gaza fighting has shattered what little faith Palestinians had and whatever shred of trust Hamas might have had in Mahmoud Abbas’ “government.” Hamas cannot possibly be certain that if they do cede power they will not suffer a fate similar to that of the Muslim Brotherhood in al-Sisi’s Egypt.

Even if that scenario doesn’t materialize, there is no guarantee elections will be held any time soon, and so the technocratic PA, still under control of Mahmoud Abbas, will continue to run both the West Bank and Gaza. What Egypt has done is to include in that possible future the chance for Gazans to finally see the end of the siege, and to start rebuilding their infrastructure and growing their economy.

No doubt, the PA, as well as Egypt and the United States are very interested in that idea. You would think Israel would be as well, as this is the best path to obtaining the “quiet” Netanyahu claims this was all about. But his government loathes the idea of a PA with even the slightest shred of power.

If Abbas is able to convince Hamas to agree to something like this (a very big “if”), he should at once tell Israel that he will not pursue war crimes charges in the international legal system if the Israelis support the move. That could almost certainly buy Netanyahu off, despite his bluster that war crimes charges are meaningless. They aren’t, and he’s quite desperate to prevent them from being leveled at anyone inside Israel, especially himself.

The fly in the ointment for Abbas, al-Sisi, and the Obama administration is that, even if the terms of the proposal don’t spell it out, there is an assumption that a PA government in Gaza would move to disarm Hamas and the other factions. The goal would be to reduce them to the much less powerful position they hold in the West Bank. That was tried before, in 2007, and the Fatah forces were routed. There is no reason to believe they would not suffer a far worse defeat now, as many of their security people would be even more reluctant to take up arms against the force that just stood up to Israel. Abbas would have to come to some sort of understanding with Hamas in Gaza, which won’t sit well in Washington and Cairo.

Yet this sort of deal is exactly the kind that makes sense in terms of relief for the Palestinians. It also gives Israel a commitment to quiet and to Hamas’ refraining from building a new tunnel network. International monitors could certainly be put in place to ensure such things. It could work. But it’s not likely that Netanyahu will allow it, Hamas will just give up everything it has, or that Abbas has enough legitimacy in Gaza to take over there.

As so often happens, then, while nothing can be worked out by those with some power, the Palestinian people will continue to suffer the most — especially in Gaza.

When the history of pro-Israel lobbying in Washington is fully written, it may well be that the push for conflict with Iran will be seen as a major turning point. On Monday, a consistently hawkish, pro-Israel Democrat, Robert Menendez (D-NJ), withdrew the U.S.-Israel Strategic Partnership Act from the Senate Foreign Relations Committee’s docket. Menendez made the surprise move because a Republican member of the committee, Bob Corker (R-TN), was going to add an amendment intended to undermine the Obama administration’s efforts to reach an agreement with Iran on its nuclear program.

Judging from news reports in mainstream and far-right outlets, it seems the amendment was Corker’s idea. It would have required the U.S. president, upon reaching a deal with Iran, to submit a report to Congress within three days. Congress would then have a non-binding “vote of disapproval.” But AIPAC, the powerful pro-Israel lobbying group, stood by the amendment, and one has to think that Corker would not have introduced it if he knew AIPAC would oppose it. AIPAC eased up on its pressure against negotiations with Iran earlier this year, but it has remained steadfast in its distrust of the diplomatic process, as has, of course, the right-wing Israeli government of Benjamin Netanyahu. AIPAC’s decision to support the Corker amendment, coupled with a ratcheting up of the rhetoric coming from Netanyahu against the negotiations in recent days, suggests a renewed campaign to derail Obama’s efforts to resolve the dispute with Iran diplomatically.

Perhaps even more notably, this episode marks another step in the increasing polarization of Israel as a domestic U.S. political issue. The Republicans have been working hard ever since Barack Obama got elected to “own” the issue of Israel. In this case, however, they and AIPAC may have overplayed their hand, just as it did at the beginning of the year with S. 1881, when it lined up with Republicans to try to strangle the Joint Plan of Action (JPOA) between world powers and Iran in its crib.

The U.S.-Israel Strategic Partnership Act had already generated some controversy, especially over a provision that would have allowed Israel to participate in the U.S.’ visa waiver program, which would make it easier for Israeli citizens to obtain American visas. The House of Representatives ended up amending the bill to address the initial objections to admitting Israel into that program program. The objection centered on Israel’s unwillingness to reciprocate in granting visas to U.S. citizens, a standard expectation of the program. The bill now addresses this with language that requires Israel to treat U.S. citizens (including Arab Americans) as it wishes the U.S. to treat Israelis and satisfy all other requirements of the visa waiver program. Many believe that other objections, specifically revolving around Israel’s espionage activities in the U.S. (which Israel vehemently denies but are well known in the U.S. intelligence community), are the reason for a recent spate of leaks to Newsweek magazine on the subject.

But aside from that piece, the legislation is a pretty standard piece of pro-Israel fluff, which would provide only a modest, small boost to existing cooperation between the United States and Israel in military, security and scientific arenas. Yet it appears quite possible that AIPAC helped Corker kill it, however unintentionally. Why did that happen?

This seems to have been a miscalculation on AIPAC’s part. If this amendment originated with Corker and not AIPAC, as seems likely, then it was clearly an attempt by the Tennessee Republican to drive a wedge between the “pro-Israel community” and the president. AIPAC backs the idea, but they surely treasure bi-partisan support for their initiatives in Congress much more, as indicated by their decision to back down on S. 1881 in February, especially after it ran up against a solid wall of Democratic opposition. Yet AIPAC has been remarkably passive in the face of Republican efforts to make Israel a partisan issue. Of course, Republicans have gotten a lot of help from Netanyahu (and now his new ambassador, Ron Dermer) on that score in recent years. But the alienation of liberal Democrats from pro-Israel sentiment is growing as a result. This amendment and its result constitute one more step in that direction.

AIPAC, and probably Corker as well, did not expect Menendez to pull a popular pro-Israel bill from the Senate docket. But Menendez appears to have recognized the difficult position this amendment would put Senate Democrats in. They cannot credibly oppose Obama on negotiations with Iran because their constituents support the talks and are deeply opposed to military action against Iran. Once Obama, in his State of the Union Address no less, declared that he was standing firm on negotiating seriously with Iran and then prevailed in the fight over S. 1881, it was clear that most Congressional Democrats would not challenge the president so long as the talks continued. So, if the Corker amendment was brought, Senate Democrats would either have to vote against their president or against AIPAC. Neither prospect held any appeal to Menendez. So he pulled the bill.

In many ways, Menendez and other Senate Democrats who are particularly close to AIPAC just want to keep their heads down for the next two years. If Obama can work out a viable deal with Iran, that’s great. If not, they are probably hoping that a more hawkish leader, like Hillary Clinton, who will be more in line with AIPAC on Middle East policy, will win in 2016. Until then, they are going to have to walk a tightrope.

Republicans, meanwhile, are likely to continue their efforts to “own” the issue. Corker will probably back down on his amendment eventually so that the rest of the bill can go through. But that will mean that the Republicans can claim that Menendez, well-known as among the most pro-Israel Democrats in Congress, thwarted AIPAC’s plans.

If, as AIPAC surely hopes, the next president, from either party, is more in tune with the Netanyahu government than Obama, then a rightward move of the Israel issue serves it well in the long-term. Indeed, in such a case, AIPAC would probably prefer a Democrat again in the White House, reinforcing the group’s bipartisan image and influence, while Israel gets framed in Washington in a more comfortable way than it is now.

Still, this could backfire. Aggressive Republican efforts to make Israel a partisan issue — and AIPAC’s acquiescence in that strategy — are alienating a lot of Jews and a lot of Democrats. Most of those groups want a secure Israel, to be sure. But they also want to avoid war with Iran and an end to Israel’s occupation of Palestinian land. AIPAC is working against both of the latter goals.

AIPAC will have no problem keeping Republicans in their camp, unless more radical groups, such as Bill Kristol’s Emergency Committee for Israel (ECI), the Zionist Organization of America (ZOA), and, of course, the Republican Jewish Coalition, that criticized its capitulation on S. 1881 persuade its wealthiest donors to desert it. But Democrats might find it increasingly difficult to toe the AIPAC line, even with a more hawkish figure like Clinton in the White House. AIPAC has come a long way by justifiably touting its bipartisanship. Should “pro-Israel” become a Republican label, however, they stand to lose a great deal in the long run. And maybe that’s not a bad thing.

There’s more here, and the image is one of the United States as the party ultimately responsible for the failure of not only this round of peace talks, but also the previous rounds. I’ll resume here by completing the analysis of what was reported in YNet.

On the Israeli demand that the Palestinians recognize Israel as a “Jewish state,” the group of anonymous U.S. diplomats told Israeli reporter Nahum Barnea:

We couldn’t understand why it bothered him [Mahmoud Abbas] so much. For us, the Americans, the Jewish identity of Israel is obvious. …The more Israel hardened its demands, the more the Palestinian refusal deepened. Israel made this into a huge deal — a position that wouldn’t change under any circumstances. The Palestinians came to the conclusion that Israel was pulling a nasty trick on them. They suspected there was an effort to get from them approval of the Zionist narrative.

Seeing this in print truly shocked me. There were three objections to this idea from the Palestinians. Those where there all along, yet the U.S. speakers seem aware of only one of them: the validation of the Zionist narrative over the Palestinian narrative. The other two objections were that such recognition (unprecedented in international relations, one hastens to add, and something that Israel demands only from the Palestinians and no one else) would necessarily give a Palestinian stamp of approval to discrimination against non-Jews in Israel, most of whom are Palestinian; and that it would, by definition, preclude the question of the return of Palestinian refugees, a matter Abbas may be resigned to, but which he wants to deal with in negotiations in the hope that some redress for the refugees can be settled upon.

For these reasons, the recognition of Israel as a “Jewish state” is a major red line for Abbas. It was so when the issue was first mentioned by Ehud Olmert years ago, and has been true for all the time Israeli Prime Minister Benjamin Netanyahu has been talking about it. This is no secret, everyone on all sides knows what the issue is and why it is controversial. Everyone, that is, except the U.S. team assigned to mediating these talks.

The U.S. reveals a level of incompetence here that is staggering. It’s true that many cynics like myself have long claimed that U.S. diplomats cannot be helpful in Israel-Palestine because they are much more concerned about keeping Israel happy than pressing for the politically difficult choices that must be made for any agreement, and/or they just don’t understand what’s going on. But even for us, this interview adds a new dimension: the U.S. team is not only way out of their depth in dealing with Israel, they apparently have no idea that this is even the case. That combination of ignorance, enormous hubris and basic incompetence is the only explanation for the way these people are speaking about the collapse of the peace talks, which went exactly as most observers, across the spectrum, said they would go.

Ultimately, this picture forces the question: just what do we expect the Israeli government to do? Even if the Israeli leadership was more moderate, do we expect them to take huge political risks simply out of the goodness of their hearts, or because of threats that remain theoretical?

Why, I wonder, do we expect Israel to behave differently than any other government? There is a serious imbalance of power between Israel, a stable country with functioning political systems, a relatively well-to-do economy, and by far the strongest military in the Middle East, and the Palestinians, who have no infrastructure, no government, an economy barely sustained by international aid and no means of self-defense.

That means that Israel, like any other powerful entity, yields nothing without a demand. And that demand cannot merely be spoken, nor can it be based on abstract notions of justice and peace. Those principles move people to create the pressure that leads to change, but values like peace and justice do not cause governments to change their policies in and of themselves.

The Netanyahu government is the most stable leadership Israel has had in decades. Netanyahu himself has spent more time in the prime minister’s office than any Israeli leader except for David Ben-Gurion. He’s not there because he is a peacenik. Do we expect him to act in direct violation of the wishes of his constituency, especially when most Israelis, while supportive of a two-state solution in the abstract, have repeatedly demonstrated, in polls and at the voting booth, that they are not willing to risk or sacrifice much for that peace?

Do we truly expect Netanyahu or any other Israeli leader to take steps that most Israelis believe, rightly or not, will put lives at risk, and that will, inevitably, create unprecedented political turmoil in the country? Do we expect Netanyahu, just out of a sense of morality, to take a step that will mean the loss of some significant water supplies for Israel and that, given the shifting nature of the Arab world today, may or may not really lead to regional peace? One can fathom Israel taking that risk, but only if there is a compelling reason. There isn’t one right now.

Israel does not fear that its ongoing occupation will brand it as an “apartheid state”; in many people’s eyes, it already is one. And international opprobrium may have manifested in the Boycott, Divestment and Sanctions (BDS) movement, but to date, that campaign has not done any harm to the Israeli economy. Maybe one day it will, but right now, BDS is not pressuring Israel to change. While international anger over Israel’s treatment of the Palestinians has caused a few financial institutions to pull away, capital is still flowing in on the whole. And most of Europe joins with the United States in maintaining strong business ties to Israel. All of these conditions might change, and when/if they do, that might constitute real incentive for Israel to change its approach. That is surely the hope of the BDS movemet. But right now, Israel is not feeling that pressure and does not expect to feel it in the near term. Its sometimes hysterical reaction to BDS is carried out on the level of a propaganda war, not as a strategic political issue.

However, Israel is concerned about the Palestinians dragging their leaders to the International Criminal Court (ICC). So they are preparing their defenses, and they will respond to the Palestinians with harsh measures if they try. Again, at this point, all this is potential, and not actual pressure. If the ICC actually attempts to try Israeli leaders for war crimes, this may change Israel’s thinking, but that is a long way off, and still depends on the Palestinians actually deciding to go that route, though recent developments do make it seem more likely that the Palestinians will do so.

What about this possibility, raised by one of Barnea’s contacts?

There’s great potential for deterioration here, which could end with the dismantling of the Palestinian Authority. Israeli soldiers will have to administer the lives of 2.5 million Palestinians, to their mothers’ chagrin. The donating countries will stop paying up, and the bill of $3 billion a year will have to be paid by your Finance Ministry.

That’s a possibility, but here’s another one: the PA collapses, Israel is forced to assume control and the cost, and Netanyahu, or his successor, appeals to Capitol Hill to help defray the costs by restarting the program of economic aid to Israel that was discontinued in 2008, and even expanding it significantly, as would be necessary, since economic aid to Israel was always much smaller than military. The argument will be couched in supporting our good friend, Israel, and also that paying Israel is the only way to maintain stability without having to put U.S. boots on the ground. There are various ways the U.S. could help defray these costs, and, again, Israel does not fear the Palestinians turning their cause into one for civil rights within Israel. They believe — again rightly or not – that there is enough support around the world for a Jewish state and that, when push comes to shove, this will supersede concern for Palestinian rights.

These factors come together to eliminate any perceived pressure on Israel to compromise. This, more than anything else, is what the United States fails to understand. Ultimately, the U.S. got almost everything wrong in this latest effort, to such an extent as it made their predecessors seem well-informed. But what is most important is this: if you’re not prepared to create the pressure that is required for Israel to make concessions and deal with the fights, in Jerusalem and in Washington, that this will involve, then don’t bother even starting such a process.

Obama seemed to understand this at the beginning of his first term. He tried to pressure Israel into a settlement freeze. But he underestimated the forces that would oppose him, and when he failed, he essentially pulled back. But then he let Secretary of State John Kerry convince him that his personal rapport with the Israelis would make a difference. He was as wrong as you could be. And the result is a politically emboldened Netanyahu and great despair in the Occupied Territories.

And if Israeli policy is so entrenched, U.S. policy seems all the more so in light of Kerry’s humble but dogged effort to make a change in the U.S. approach. The United States has been embarrassed here, and this was one of the most costly episodes, in terms of U.S. credibility, in this conflict where U.S. support for Israel while pretending to be an “honest broker” has been draining U.S. credibility for decades.

Yet despite that, no one expects anything to change in Washington. One last quote from Barnea’s interlocutors: “The boycott and the Palestinian application to international organizations are medium-range problems. America will help, but there’s no guarantee its support will be enough.”

So, if we had any doubt about what comes next, that little tidbit dispels them. Yes, Obama is fed up with Israel, and Kerry is frustrated. Both men are well aware that Netanyahu has repeatedly made the U.S. looked foolish. Kerry has been personally and directly insulted by several Israeli officials just in recent months. But the U.S. will still shield Israel as much as it possibly can.

So when Obama says he’s taking a time out, many have read that as him throwing up his hands and saying “Fine, Israel and the Palestinians can just fight this out themselves.” But that’s not what will happen. Diplomacy may stop, but the $3 billion a year of military aid will continue. So will diplomatic support at the United Nations, where the U.S. will continue to veto every significant UN Security Council resolution that tries to promote an end to occupation. And the U.S. will continue to act as Israel’s advocate in the UN General Assembly, with the Europeans, with Arab states…with the world. In the end, stepping back from this shuttle diplomacy is just another way for the U.S. to make matters worse.

Maybe out of the ashes of this embarrassment something better will rise. But that will only happen if the United States and every other outside player finally learns the lesson of why all these efforts keep failing. The initial indication, as Barnea kindly informs us, is not promising.

I’ve been slowly reading Robert Gates’ Duty over the last week or so and some of it is quite pertinent in light of the recent recommendation by JINSA’s Michael Makovsky and Lt. Gen. David Deptula (ret.) in the Wall Street Journal that the Obama administration provide Israel with Massive Ordinance Penetrator (MOP) bombs and B-52 bombers to deliver them against Iran’s nuclear facilities. Here’s what they wrote in their article entitled, “Sending a Bunker-Buster Message to Iran”:

By transferring to Israel MOPs and B-52Hs the administration would send a signal that its ally, which already has the will, now has the ability to prevent a nuclear Iran [a very dubious assertion, according to most experts]. Once they are delivered — ideally as the current six-month interim deal is set to expire in July — Iran will be put on notice that its nuclear program will come to an end, one way or another.

While Gates in his book (pp. 190-191] doesn’t say whether Israel requested the same weaponry in 2007, his description of the arguments presented, both pro and con, would certainly apply to Makovksy’s and Deptula’s arguments today. The passage is worth quoting in full, although the main point is summarized at the end when Gates quotes directly from what he told Bush in private. Here’s the passage as a whole:

Debate [about Iran's nuclear program] heated up considerably in May [2007], prompted by several Israeli military requests that, if satisfied, would greatly enhance their ability to strike the Iranian nuclear sites. In a meeting with the Joint Chiefs and me in the Tank on May 10, in the middle of a conversation on Afghanistan, the president suddenly asked if anybody was thinking about military action against Iran. He quickly added that the goal was of course to prevent Iran from getting a nuclear weapons and that he “just wanted you to be thinking about it — not a call to arms.”

Two days later the national security team met with the president in his private dining room adjacent to the Oval Office. The participants included Cheney, Rice, Mullen, Bolten, Hadley, Hadley’s deputy Jim Jeffrey, and me. We addressed two questions: How do we answer the Israelis and what should we do about the Iranian nuclear program? In many respects, it was a reprise of the debate over the Syrian nuclear reactor the year before. Hadley asked me to lead off. When making my case to the president on a significant issue like this one, I always wrote out in advance the points I wanted to make, because I did not want to omit something important. Given Bush 43′s green light to Olmert on the Syrian reactor, I was very apprehensive as the meeting began.

I recommended saying no to all the Israelis’ requests. Giving them any of the items on their new list would signal U.S. support for them to attack Iran unilaterally: “At that point, we lose our ability to control our fate in the entire region.” I said we would be handing over the initiative regarding U.S. vital national interests to a foreign power, a government that, when we asked them not to attack Syria, did so anyway. We should offer to collaborate more closely with Israel, I continued, doing more on missile defense and other capabilities, “but Olmert should be told in the strongest possible terms not to act unilaterally.” The United States was not reconciled to Iran having nuclear weapons, but we needed a long-term solution, not just a one-to-three-year delay. I went on to say that a strike by the United States or Israel would end divisions in the Iranian government, strengthen the most radical elements, unify the country behind the government in their hatred of us, and demonstrate to all Iranians the need to develop nuclear weapons. I warned that Iran was not Syria — it would retaliate, putting at risk Iraq, Lebanon, oil supplies from the Gulf (which would lead to skyrocketing oil prices), and the end of the peace process, as well as increasing the likelihood of a Hizballah war against Israel. Addressing what I knew to be Cheney’s desire to deal with the Iranian nuclear program before Bush left office, I observed that our current efforts to isolate Iran, significantly increase their economic problems, and delay their nuclear program might not be successful in bringing about a change of policy in Tehran during the Bush presidency, but they would leave his successor a robust array of tools with which to apply pressure. Finally, I pointed out that the president’s own conditions for preemptive war had not been met, our own intelligence estimate would be used against us, and we would be the ones isolated, not Iran.

Cheney spoke next, and I knew what was coming. Matter-of-factly, he said he disagreed with everything I had said. The United States should give Israel everything it wanted. We could not allow Iran to get nuclear weapons. If we weren’t going to act, he said, then we should enable the Israelis. Twenty years on, he argued, if there was a nuclear-armed Iran, people would say the Bush administration could have stopped it. I interjected that twenty years on, people might also say that we not only didn’t stop them from getting nuclear weapons but made it inevitable. I was pretty sure Condi did not favor accommodating Israeli’s requests, but the way she expressed her concerns about not leaving our ally in the lurch or feeling isolated led Mullen and me after the meeting to worry that she might be changing her mind. Mullen talked about the difficulty of carrying out a successful attack. Hadley remained silent. At the end, the president was non-commital, clearly frustrated by the lack of good options for dealing with Iran. He had a lot of company in the room on that score.

That afternoon I flew to Colorado Springs to celebrate the fiftieth anniversary of the North American Aerospace Defense Command. Aboard the plane, I became increasingly worried that the president might be persuaded by Cheney and Olmert to act or to enable the Israelis to act, especially if Condi’s position was softening. I decided to communicate once again with Bush privately. I said,

“We must not make our vital interests in the entire Middle East, the Persian Gulf, and Southwest Asia hostage to another nation’s decisions — no matter how close an ally. Above all, we ought not risk what we have gained in Iraq or the lives of our soldiers there on an Israeli military gamble in Iran. Olmert has his own agenda, and he will pursue it irrespective of our interests. …We will be bystanders to actions that affect us directly and dramatically. …Most evidence suggests we have some time. …The military option probably remains available for several years.  …A military attack by either Israel or the United States will, I believe — having watched these guys since 1979 — guarantee that the Iranians will develop nuclear weapons, and seek revenge. …A surprise attack on Iran risks a further conflict in the Gulf and all its potential consequences, with no consultation with the Congress or foreknowledge on the part of the American people. That strikes me as very dangerous, and not just for sustaining our efforts in the Gulf.”

Most of that should act as a rebuttal to Makovsky’s and Deptula’s dangerous recommendations.

Two celebrations brought Lockheed Martin’s CEO, Marilyn A. Hewson, to Israel on April 9.

Hewson officially opened Lockheed Martin’s office in Beersheba, the closest major city to where IDF technical units are being consolidated at new bases in the Negev Desert, which will be supporting the defense contractor’s ”growing presence” in Israel. “By locating our new office in the capital of the Negev we are well positioned to work closely with our Israeli partners and stand ready to: accelerate project execution, reduce program risk and share our technical expertise by training and developing in-country talent,” Hewson said in her speech.

Then was the arrival of the first C-130J Super Hercules airlifter at Nevatim Air Base in Israel. The state of the art Super Hercules, fitted with “Israeli-specific, post-production modifications,” has been dubbed Shimshon (Samson) by the Israel Defense Forces, about which Hewson waxed rhapsodic:

This aircraft is worthy of its given name, Shimshon…[sic] a leader whose power was thought to be as mighty as the sun. Shimshon used his power to combat the enemies of Israel and perform heroic feats.In the same way, this aircraft will support the defense of Israel and the men and women who are the heroes of the Israeli Defense Force.

(Apparently Ms. Hewson is unaware that the biblical Samson/Shimshon (Judges 13:1-17:31), for all his strength, actually met a rather unenviable end — in Gaza — using his final surge strength to destroy himself along with the enemy. Yet the Philistines lived to fight another day and were still around a hundred years later.)

Much of the publicity heralding the Samson’s arrival emphasized the air transporter’s capabilities in carrying out humanitarian missions. According to Lockheed’s product description, “This rugged aircraft is regularly sent on missions in the harshest environments, and is often seen as the first aircraft ‘in,’ touching down on austere landing strips before any other transport to provide humanitarian relief after natural disasters.” Reuters notes that “In non-combat, but harsh, environments, C-130Js are often the first to carry out missions such as search and rescue, aerial firefighting in the United States and delivering relief supplies after earthquakes, hurricanes, typhoons and tsunamis around the world.” A Haaretz article anticipating the Samson’s arrival said that earlier versions of the Hercules aircraft had been used in 1976 to rescue hijacked Air France passengers being held hostage in Entebbe, Uganda and to transport Ethiopian Jews to Israel as part of Operation Solomon in 1991.

The Israeli Air Force website, however, describes the C-130J Hercules as “a tactical transport plane that is mostly used in joint missions with ground forces: supply missions, equipment transfer, airdropping combat forces and special missions.” The long version of the Super Hercules C-130J can carry 92 paratroopers and their equipment, which exceeds the 64 paratroopers the short version can accommodate. Comments by Israeli defense officials quoted in the Times of Israel suggest that Israel isn’t purchasing “Samson” for humanitarian intervention. The IDF Chief of Staff, Lt. Gen. Benny Gantz, who also attended the arrival ceremony, declared that the C-130J, which can fly close to the ground and land and take-off on primitive airstrips, was of “decisive importance” and would allow Israel to execute “more complex missions, under any conditions, deeper [within enemy territory], faster and more clandestinely.” IAF Commander Maj. Gen. Amir Eshel said that the “diversity of capabilities that the plane represents borders on the imaginary” [sic].

Israel orders its C-130Js, including the Super Hercules, through a Foreign Military Sale (FMS) contract with the US government. Israel’s annual Foreign Military Funding grant from the US signed in 2007 for a ten year period amounts to $3.1 billion to Israel annually (minus about $155 million due to the US government-mandated sequester). Considering that Israeli Prime Minister Benjamin Netanyahu budgeted $2.89 billion for an Israeli military strike on Iran’s nuclear facilities for 2013 and again for 2014, that doesn’t go very far, even when assuming that the Samson is being purchased with an eye toward war with Iran.

With Lockheed’s active involvement, Israel has been able to utilize a scheme called a deferred payment plan (DPP), in combination with a Pentagon process known as cash-flow financing, to make current purchases with deferred debt on favorable terms, to be paid with the FMS grants it is scheduled to receive in future years. Israel used this method to fund Pentagon-administered Foreign Military Sale purchases of Lockheed F-16I and F-35I fighters. Through this creative means of financing, Israel has already earmarked nearly all Foreign Military Funding through 2018 for F-35 fighter jets, heavy troop carriers, airlifters and other equipment.

Now Israel wants to buy — and the Pentagon wants to sell — half a dozen V-22 Ospreys, originally intended for the US Marine Corps serving in Afghanistan. What to do?

On March 20, during a visit to Israel, two members of the Senate Armed Services Committee, Kelly Ayotte (R-NH) and Joe Donnelly (D-IN), told Reuters that, in spite of belt-tightening in Washington, the US will  continue providing Israel with military assistance after its current Foreign Military Financing package of $3.1 billion a year expires in 2017. Ayotte said that talks concerning the 2018-2028 package were already underway. Lockheed Martin is rated a “heavy hitter” among campaign donors by the Center for Responsive Politics’ Open Secrets website. Thus far in the 2014 election cycle, Lockheed has contributed over $1.6 million to members of the Senate and the House of Representatives, about two thirds going to Republicans and the rest to Democrats.

Ten days later, Defense News reported that Israel had agreed to take on more than $2 billion in commercial debt for near-term buys of V-22 tilt-rotor aircraft and other Pentagon-approved weaponry, trusting that the US will provide a 2018-2028 FMF package to foot the bill. Under a US-approved DPP, Israel would pay only interest and fees over the course of the current agreement set to expire in September 2018. The principal of the debt incurred to purchase the Ospreys would be covered by a new Obama-pledged package that would extend annual foreign military financing (FMF) aid through 2028. Lockheed loves the idea, even if the first purchase goes to a competitor. Why? Once the new means of proactive financing kicks in — Israel borrowing against an aid package it hasn’t even received yet, which, following approval, won’t go into effect for five years — Lockheed can expect benefits as well. According to Defense News, “Lockheed is expected to play a pivotal role in the new DPP scheme, which government and industry sources here say will facilitate follow-on procurement of Israel’s second squadron of F-35Is.”

John Kerry’s words at a report-back to the Senate Foreign Relations Committee sent shock waves all the way to Jerusalem. “Unfortunately, prisoners were not released on the Saturday they were supposed to be released,” he said. “And so day one went by, day two went by, day three went by. And then in the afternoon, when they were about to maybe get there, 700 settlement units were announced in Jerusalem and, poof, that was sort of the moment. We find ourselves where we are.”

That was well outside the usual boundaries of discourse for top US officials, and it certainly got noticed. Kerry’s own State Department subordinates quickly rushed to reaffirm that “…today, Secretary Kerry was again crystal clear that both sides have taken unhelpful steps and at no point has he engaged in a blame game.”

But the message was clear and Kerry himself has taken no steps to truly back off from it. He technically didn’t “blame” Israel. Rather, as he put it, “I only described the unfolding of events and the natural difficulties involved in managing such a complex and sensitive negotiation.”

The message, in a nutshell, is that the Obama administration is fed up with Bibi Netanyahu and his antics. That’s been welcomed by the vast majority of thinking analysts and observers who understood long ago that Israel has acted as the major obstacle to talks and that US pandering to Netanyahu was only going to harden the Israelis’ positions. But that welcome needs to be cooled a bit.

However frustrated Kerry may be by Netanyahu and Palestinian President Mahmoud Abbas declining to accept a US-brokered deal that was absurdly lopsided in Israel’s favor, the peace process must, apparently, go on. The United States continues intense efforts to bring the two sides back to the table despite the fact that months of talks have only been counter-productive and that the current goal of the talks is to find a framework for talks. At this point, the entire Oslo process is little more than a joke. If anything, it resembles a zombie from the television show, The Walking Dead — it’s really dead but it just keeps walking around and making noise.

Despite Kerry’s testimony, he’s staying in the business of bringing Israelis and Palestinians back to the table, and there’s one reason: the only goal remaining on the Obama administration’s agenda is to prevent the talks from completely breaking down on their watch. Yet it seems even that modest goal is beyond Kerry’s grasp. According to Israeli officials, the method for bringing the talks back to zombie-life is to re-issue the offer Abbas pre-empted with his application to fifteen international treaties and institutions. The only changes apparently on the table are compensation to Israel for Abbas’ heinous crime.

Despite Abbas’ unusually bold action in those applications, his track record of submission suggests he will cave-in again. Still, it’s hard to see how he can justify such a turnaround under these circumstances. So, it’s slightly more likely that he will not agree to this. But the most likely outcome is that the Israelis and Palestinians will continue to squabble, and that the deadline of April 29 will be upon us before Kerry can put the sham talks back together.

Given the beating the US is taking around the world over other issues, especially Ukraine; and the always-tenuous balance of maintaining the Iran nuclear talks, Kerry may have no choice but to finally give up on this poorly planned and even more poorly executed attempt to secure a resolution of the Oslo process. It’s now too late, but given the enormous amount of energy Kerry has devoted to this quixotic task, he may not be able to admit it. In any case, the US now must choose between looking foolish by giving up or looking even more foolish by pressing on in this effort when it’s clearly not prepared to do what it would take to get something done.

Abbas has pretty much mapped his post-talks course, and it certainly seems like most Palestinians are anxious to see it happen. That is, increased activism at the United Nations, including applying for accession to the Rome Statute, which would allow the Palestinians to bring Israeli leaders to the International Criminal Court on war crimes charges. Israel is very concerned about that, and that’s why despite the total harmlessness to Israel of the Palestinians’ fifteen international applications, Israel is reacting with increased threats, including an announced intention to steal the tax revenues Israel, by agreement, collects for the Palestinians.

In fact, it is in Israel where we have seen the most activity in response to the breakdown in talks, and none of it is encouraging. The Israeli opposition took days to comment. Zehava Gal-On, head of the left-wing Zionist Meretz Party had, as one would expect, the clearest criticism, saying Israel had given the United States “the finger.” The ostensible leader of the opposition, Isaac Herzog, was less harsh, but called for new elections. That would, however, be foolish as recent polls clearly indicate a strengthening of the right-wing majority. The two parties within Netanyahu’s coalition — HaTnuah and Yesh Atid — which are supposed to be holding Bibi’s feet to the peace talks fire, scrambled desperately to find credible ways to support Netanyahu instead.

Netanyahu’s critics have come from his right flank, in two different ways. First, Trade and Labor Minister, Naftali Bennett of the religious HaBayit Hayehudi (Jewish Home) party called for Israel to annex large chunks of the West Bank to punish the Palestinians for their fifteen applications. While there is no chance Israel will do that in the near future, Bennett has been pushing annexation since he rose to the top of his party and has vowed to intensify the public campaign in this direction. Given the ongoing rightward trend among Israeli citizens, this is a cause that could gain considerable momentum going forward.

Then, Netanyahu’s Foreign Minister, Avigdor Lieberman continued his efforts to position himself as the next Prime Minister by meeting with Kerry and publicly stating that Kerry didn’t blame Israel for the breakdown. Lieberman thus gave the impression of himself as a true diplomat, an image the radically right-wing and historically undiplomatic leader of the largely Russian Yisrael Beiteinu (Israel Our Home) party, has been trying to cultivate ever since he came back to his post after being suspended while under investigation for corruption charges. Lieberman still invites great skepticism among Israelis, but his image is definitely improving.

Bennett, having gotten wind of the attempt by Kerry to revive the talks, then publicly declared that he would pull HaBayit HaYehudi out of the government if the previously arranged deal, or anything similar, went through. Bennett is known for bombast, and the fact is that this stance of his is not supported by his own party. Even HaBayit HaYehudi Housing Minister Uri Ariel, who played a central role in derailing the talks by announcing new settlement construction just as Kerry was trying to put a crutch underneath the discussions, disagrees with Bennett.

Still, these challenges from his right flank are serious for Netanyahu in the long-term, although right now, his popularity is rising among Israelis. That is probably more dismaying than anything else. Israel has, at last, killed the Oslo process and Abbas’ apparent willingness to continue working with the United States to keep them going for no discernible purpose is not winning him any points among his own public.

In the end, the situation is merely a more concentrated form of the one which has held for most of the Oslo era. The United States insists on both managing the process and keeping it going. It calls on the Israelis and Palestinians to make “hard choices” and take “bold steps,” yet administration after administration is unwilling to make its own choices and take its own steps in the face of expected political backlash to bring about a deal. Israel keeps its own goal front and center; that being to make sure that it minimizes, or even eliminates, the possibility of any significant Israeli concession. And the Palestinian people wait for a leadership that will defend their interests and recognize that cooperation with the United States will never get them to their goals of independence and self-determination.
